Split Decision: Supreme Court Upholds Injunction Against Biden's OSHA Vaccine Mandate;
Fake "Conservative" Justices Uphold Mandate for Health Care Workers Mandate

Breaking, via @Techo_Fog.

The Court is deciding whether to uphold or strike down -- "stay" -- a temporary injunction. The injunction is currently suspending enforcement of the OSHA mandate.

A bit confusing there -- the government wants to "stay," or suspend, the injunction. The injunction itself is staying, or suspending, enforcement of the law. So the government wants to enjoin the injunction.

The Supreme Court says "Nah, we'll leave the injunction in place." Meaning, the mandate cannot be enforced. The courts will have a full trial on the lawfulness of the mandates later, but for now, they're assuming it will be found to be unlawful and are suspending its enforcement.

An injunction is a remedy sought before an actual trial when there is claimed to be irreparable harm that will be suffered before the trial can be held. Injunctions are decided on quick-and-dirty hearings, with lower evidentiary standards and expedited procedures.

To win on a motion for an injunction, you have to show, most importantly, that you'll suffer an irreversible harm that cannot be later remedied at a full trial unless you are granted the injunction (for a contrary example: losing money isn't an irreparable harm, as you can always be compensated at any point in time, but being forced to take a vaccine you don't want would be a bell that can't be unrung), and that you're likely to succeed on the merits when the full trial is held and concluded.

The lower courts found that the plaintiffs would in fact prevail on the merits.

The Supreme Court now agrees.

likeltosucceed.png

Specifically, they're likely to prevail on their argument that the mandate is "unlawful."

likelyunlawful.png

They find that the Brandon Administration's contention that Congress silently authorized OSHA to have the power to enforce a national vaccine policy is stupid. The Supreme Court will allow the argument that Congress perhaps intended, without explicitly stating, some minor provisions or limitations in the stated law.

But for major parts of the law, they expect that Congress will speak clearly. And audibly. And not "silently" and through implication and emanations and penumbras.

congressspeakclearly.png

This isn't a guarantee the Court (or the lower courts, first) will rule the mandate unconstitutional when they get around to ruling on the merits -- they could all be dazzled by new arguments later -- but that's the way to bet.

Still no word on the mandate on health care workers.

ididthat.jpg

Update: Even though it is now a well-known fact that hospitals are calling in covid-infected doctors and nurses into work, and therefore there can be no rational basis for depriving anyone of their right to refuse a vaccine, the "conservative" justices picked for us by the neoliberal Federalist Society did what they always do and sided with the liberals.

Because they are liberals.

Kurt Schlichter
@KurtSchlichter

No more Federalist Society judges. I want conservatives who will vote conservative every single time.

Update: Ron Klain retweeted Stephanie Ruhle commenting on the fact that Biden's OSHA mandate was a "work-around," meaning, a way to get around the pesky little fact that Biden was doing something that Congress had not authorized and therefore was without legitimacy and was an illegal presidential action.

in their reasoning for upholding the injunction against the OSHA mandate.

Heckuva job, Acting President Klain.

52 Reading through the opinions quickly, its not clear at all to me that Congress granted CMS the authority to require workers to be vaccinated. The majority points to, as the dissent says, a "hodgepodge" of regulations, but no clear statutory mandate.

At a guess, SCOTUS blinked here because it generally agrees that healthcare workers should be vaccinated, and worked backwards. Roberts wants to split the baby, and he dragged Kavanaugh along with him (the latter being the most disappointing).

One other thing I've noticed is that there's less meat available. The store is renovating which could explain that a bit but whereas they used to stock prime beef, even wagyu, now we get select.

In addition to these programs, CMS has other responsibilities, including the administrative simplification standards from the Health Insurance Portability and Accountability Act of 1996 (HIPAA), quality standards in long-term care facilities (more commonly referred to as nursing homes) through its survey and certification process, clinical laboratory quality standards under the Clinical Laboratory Improvement Amendments, and oversight of HealthCare.gov. None of this is about sense. This is about breaking the system so that they can impose their preferred substitution.

The left wants single-payer. To get that they require (at would, at least, prefer) popular demand. The young, and stupid, already clamor for single-payer. Having the system collapse because you fire a significant fraction of the workers would increase the call for more government intervention. Because people are stupid.

So healthcare workers -- American citizens like everybody else -- are now forced to take a jab that we're now fully aware is not effective and with greater potential to do harm than any vaccine in history? Brilliant.

So the ruling has nothing to do with science or bodily sovereignty but only with the limited authority of OSHA?

Posted by: Meade Lux Lewis, Domestic Terrorist at January 13, 2022 03:30 PM (sWM8x)

369 They argued that CMS can mandate handwashing and flu vaccines, so why not covid.
__________

Well, handwashing and flu shots don't require you to take dangerous experimental drugs into your body, for one thing.

The covid vaccines are experimental drugs that have never been subjected to any long-term testing, have significant side effects (over a million adverse reactions, including tens of thousands of deaths and permanent disabilities have been reported to VAERS) and the long-term effects, which could be horrendous according to many experts, are still unknown.

These mRNA vaccines could do significant long-term damage to vaccinated peoples' immune systems, damage which could cause their bodies to be much more vulnerable to diseases like cancer and other serious conditions.

And to add insult to injury, as we now know, the vaccines don't actually protect anybody from getting covid. So there is even less justification for forcing people to submit to these experimental drugs.

I wonder if it would be cheaper/better for a hospital to offer a fee for service cost to those on medicare or medicaid, and not accept any government money, then to lose a bunch of nurses and doctors who don't want to get the shot.

1-hand out free tests like candy, wait for all of the lunatics with zero symptoms to stampede
2-take out the majority of hospital beds to comply with 6 ft or whatever
3-mandate, so less nurses and doctors and hospital/clinic administrators
4-put so much fear into people and hide the truth

Justice Kavanaugh doesn't address these because...har har! That would never happen - thus his ruling is his feelz.

I think that would only apply to patients arriving through the ER under EMTALA.

The problem is that in normal times, most hospitals are half empty. And even though Medicare and Medicaid pay shitty rates compared to most private carriers, it's still enough to cover the marginal cost of filling those empty beds. Most hospitals could not go without that reimbursement.

In any case, they outlawed therapeutics which also reduced symptoms and saved lives. That was the murderous part ... and as omicron is "10 times milder" (or whatever) ... there is no reason to force the risky jab jab jab forever nonsense.

Finding a good doc who accepts Medicare in Big City is not a problem. Big Medical facilities are in bed with the govt which means they take Medicare; therefore, the docs associated with that facility also take Medicare.

The end result is one can easily obtain a good primary who is associated with a good medical facility.

Posted by: steevy at January 13, 2022 03:57 PM (CYnTg)

557 I really don't understand the split decision as a Constitutional matter.

Constitutionality has nothing to do with the decision.

The court's decision turns on the narrow question of whether OSHA, whose remit is employment safety, has the power to impose a vaccine mandate on employers.

The money quote is this:

COVID-19 can and does spread at home, in schools, during sporting events, and everywhere else that people gather. That kind of universal risk is no different from the day-to-day dangers that all face from crime, air pollution, or any number of communicable diseases. Permitting OSHA to regulate the hazards of daily life -- simply because most Americans have jobs and face those same risks while on the clock -- would significantly expand OSHA's regulatory authority without clear congressional authorization."

This says nothing about whether some other federal agency could impose a vaxx requirement, or whether Congress (or a state government) could impose a universal vaxx requirement on the entire populace. That question wasn't even presented.

576 Small practices in general don't like any kind of health plan (they are NOT insurance. Insurance is a bet. A Health care plan is shared risk) because of the time it takes to get paid.

And the hassles the Ins. cos put them thru to get paid. And much of the time they don't get what they think they should get for their time/trouble. It's particularly aggravating for Medicaid/medicare. As they pay way less than most drs can afford which is why they all have banded together to share the costs.

Since it began medicare has been forcing how the health care system operates.

586 If you think ID should be required to vote, you are a racist white supremacist terrorist.

You have a gross misunderstanding how elections work today.

Everyone and anyone can vote. Unless specified in the Constitution, that vote can be challenged. If no one challenges a vote of a 15 year old illegal alien, then the vote is permitted.

Voting is completely independent of Elections. Its not the vote that counts, but the ballots that are counted. Ballots need not reflect a corresponding vote. Anyone can jam ballots into a box. While it may be illegal to add or modify ballots, if there are no penalties and the fictious ballots are counted it doesn't matter.

Ballots, not votes are certified. Votes are not required to have any correlation to certified ballots.

it is the certification of ballots that decides elections.

604 559 I suspect, if we had someone that bothered to analyze the data, that any hospitalizations we are seeing are from Delta. There's a huge drop off in them as Omnicrom takes over. I don't see how people wind up in the hospital from it. It doesn't go into your lungs.

My Dad is being discharged today out of the hospital with Covid and double pneumonia. They called it covid pneumonia. Of course, they can't tell you if its delta or omicron, but I am beginning to be increasingly suspicious that these new variants are being purposefully released in the atmosphere. There is no logical reason for the exponential uptick in cases.

Have you noticed the amount of shorting against Beyond Meat?

Big Meat is real though. Through cheap/free money, there has been a massive amount of consolidation in the meat industry where a few players control the entire market sort of like OPEC. They even have Mob rules where if a supermarket finds an additional supplier, the Big Meat cartel will punish the store by withdrawing supply.

We are run by drug cartels and those who operate like drug cartels.

650 Health Insurance is not insurance.

What we have are health care plans. Negotiated by the coordinating company/group. They are shared risk.

At any one time only x number of members are making claims and only so many will make claims. They can figure this close enough to optimize their premiums so that they can make money. They operate in a group so that they can share any large out of the ordinary payouts in anyone place/time. Such as a tornado or tsunami hits one town that has a lot of members.

Health insurance is a bet. The actuaries figure the odds someone will get this or that disease and base their premiums on that. They only payout on a specific disease or diseases. Usually catastrophic one such as cancer or major accident and such. They do not cover trips to the er or other procedural stuff. They payoff for specific illness.
