Media Observers: Court Appears Poised to Strike Down Brandon's Vaccine Mandates on Large Employers, But Might Uphold His Mandate on Health Care Workers

Two different mandates were the subject of lawsuits that were heard in oral arguments before the Supreme Court today.

Hopefully both will be struck down, but one seems more likely than the other.

The Supreme Court's conservative majority on Friday appeared ready to reject one of President Joe Biden's most aggressive attempts so far to combat the spread of Covid-19 -- a vaccine or testing requirement aimed at large businesses.

But in a separate challenge, some justices seemed more open to a vaccine mandate aimed at certain health care workers.

The court heard arguments for almost four hours as the number of infections is soaring, and 40 million adults in the US are still declining to get vaccinated.

The three liberal justices on the court expressed clear approval for the administration's rules in both areas.

You don't say. The three liberals in lockstep for every single liberal political position? You don't say. You don't say. You don't say.

Wow they must really be reading "the law" to come to the exact same political position on every single different legal issue every single time, huh?

Two sets of rules, issued in November, were the subject of Friday's cases. The first would impact some 80 million individuals and requires large employers to mandate that their employees either get vaccinated or submit to weekly testing. Conservative Justices Samuel Alito, Clarence Thomas and Amy Coney Barrett, suggested that the Biden administration's rule, issued under an agency's emergency powers, was too broad.

Barrett asked whether a "more targeted" regulation aimed at industries with a higher risk of transmission, would be more likely to pass legal muster.

Along the same lines, Thomas suggested that younger, unvaccinated workers might have fewer health risks and should not be subject to the same rules as older workers. He also said that states could be better suited than the federal government to require vaccines or testing under their police powers.

Those are some very small-bore objections. Gorsuch, Kavanaugh, and, shockingly, Roberts had more robust objections.

Two of President Donald Trump's nominees, Gorsuch and Brett Kavanaugh, questioned whether a federal agency could issue a regulation with such vast economic and political significance without the clear authorization of Congress. Chief Justice John Roberts seemed to agree on that point by wondering if the government had responded on an "agency by agency" basis, in order to get around the fact that Congress and some states had failed to act.

The arguments for imposing the mandate on health care workers weren't legal, they were simply Karen: People gonna die 'less you do this.

The arguments against: You have no legal power to do this.

Lawyers for two different sets of states counter that CMS acted outside the scope of its authority when issuing the mandate because Congress never specifically authorized the agency to issue such a broad rule. They also charge the agency with bypassing normal procedures which would have allowed stake holders to weigh in on the mandate.

...

Separately, Elizabeth Murrill, Louisiana's solicitor general, representing a different set of states, said that the mandate is also unconstitutional. She argued that under the Spending Clause of the Constitution Congress' power to legislate "rests on whether the State voluntarily and knowingly accepts the terms" of a contract.

In the case at hand, she said, the facilities that accept the federal funds had no advance notice of the mandate. She also argued that Congress can't simply delegate the authority to a federal agency to require vaccines for over 10 million health care workers without a clear statement of intent.

Jordan Boyd at The Federalist said at least four Justices seemed "skeptical" of the president's unilateral power to order this without Congress's authority:

Justices Clarence Thomas, Samuel Alito, Amy Coney Barrett, and Neil Gorsuch all seemed skeptical of the vaccine mandate on the grounds that the federal government was extending its reach into state issues. In his questioning, Gorsuch emphasized that the mandate seems less effective as a health and safety protocol and is more of an issue of control.

"Could CMS also implement regulations about exercise regimes?" Gorsuch asked, wondering if "substances that must be ingested by hospital employees" could be implemented "in the name of health and safety?"

The leftwing partisans invented their own facts:

During the arguments, Justice Elena Kagan, Justice Stephen Breyer, and the counsel arguing in favor of the mandate continued to spew misinformation about COVID-19 and the effectiveness of COVID-19 vaccines. Kagan repeatedly lied that vaccinated workers couldn't transmit the virus despite numerous admissions from the Centers for Disease Control and Prevention that the jab doesn't stop viral spread and data showing a significant number of breakthrough COVID cases.

She was the shepherd of Obamacare.

The "Wise Latina" proved her worthiness to be on the court, by making up nonsense stupidlies that only a Wise Latina could make up.

@kerpen

This is just absolutely astonishing. "100,000 children in serious condition," per Sotomayor. Where do these people obtain their misinformation? The current national pediatric COVID census per HHS is 3,342. Many/most incidental.

According to my top-of-the-head and pulled out-of-my-ass math that number of 40 million adults is easily the number who either contracted it and hardly noticed, or people who didn't even notice.

You can't have the numbers of infected without some percentage who laugh it off. This is now an 'infection of the vaccinated'.

83 One thing was abundantly clear after listening to the hearing today, Trump did real and lasting damage to the left with his SC appointments.

I'm not saying all Trump's picks are superstar conservatives and obviously Roberts is a squish but we at least have a chance now when big issues like this make it to SC. The 3 liberals not only had their minds made up before the hearing even began they were making up obvious lies and and making arguments based on emotions and feelings because the Constitution and the law is not on their side.

Had Hillary won and filled those seats the mandates and likely much worse would already be law. That's how the left rolls.

86 By similar arguments, such as Healthcare workers are more exposed, when we have the reins of government (snicker) let's mandate that in those cities that have defunded the police, or even merely shackled their response, all the citizens/residents must be armed at all times with firearms, children included, to ward off attacks by criminals. We will allow legitimate religious objections.

87 Here's the technocratic, preferred scenario.

Government is going to allow businesses to manufacture hastily-produced health products and force ALL citizens (non-citizens remain exempt) to inject that product. Simultaneously, those businesses (and the government that mandates this) will be exempt from any repercussions should that product fail in any manner.

Yep, that's the sign of sound design and leadership. I'm certain nothing bad can happen.

How can the government justify forcing people to submit to an experimental drug therapy, that carries a risk of death or permanent disability, to combat a virus that has a better than 99% survival rate (in the alpha and delta variations) and a 100% survival rate (in the omicron variation)?

As a matter of public policy, this crap is insane.

Even the CDC hacks admit that the "vaccines" don't stop transmission of the virus between people, so there is no justification for any of this.

Jewells45,
Laws are presumed constitutional so that challengers have the burden of proof to show that it is not so. Furthermore, there is the practice that constitutional questions are to be avoided if the mandate would fail based on ordinary law. So, strictly speaking, the constitutional question only comes into play if the Biden junta promulgated the regulations according to statutes like the Administrative Procedures Act requiring notice and comment, etc.

Difficult to claim emergency when both the Administration and Congress had months before issuing the 'emergency' rule to actually pass legislation granting the CMS and OSHA the power to do what they did.

The truth is most of them were political hacks in the past and today are mainly proteges in the judiciary of a few important senators.

Standout justices are rare and there has never been a full court composed of legal genius ever. Precedent, though, constrains even the legal geniuses in that certain decisions were considered wrong in hindsight but would require a massive effort to correct over decades which upsets the principle of legal stability.

Posted by: Marcus T

Depends on what questions that the court accepted, remember this is whether or not the court finds that OSHA has the legislative authority in the first place (because this is essentially interlocutory appeal regarding a preliminary injunction). Ditto for the CMS, so the justices consider the facts most favorable to the government's position that these agencies do have that power.

If the Court finds that the agencies lack the ability to issue such a rule under the most favorable conditions, then a permanent injunction is warranted for this route of rulemaking.

Jewells, the normal procedure is for a court to rule after hearing arguments and evidence from both sides. However, these cases came to the Supreme Court as preliminary injunctions from district courts and thence appealed to the 5th and 6th circuits from even going into effect. To win a preliminary injunction against a rule, you have to demonstrate irreparable harm that outweighs any benefits from the action plus that the challengers are likely to prevail at trial. The challengers have the burden of proof for these elements.

So let's make everybody get the vaccines, even though they don't actually prevent transmission of the virus, because it'll be doing something, and something's better than nothing, even if it doesn't work, right?

It's totally worth risking death or permanent disability to guard against getting a virus that has almost no chance of killing you, and that you're probably going to get anyway, no matter how many vaccinations you get, right?

On both issues, the question is whether OSHA (or CMS in the other case) have the legitimate delegated authority to issue regulations. OSHA issued them as an emergency, dunno about CMS justification. On state police power to issue such regulations, most states have statutory and administrative power to do so under Jacobson v. Mass and even the later lamented Buck v. Bell std.
But federal police power has to be tied to specific legislative authorization to the agencies granted via Congress within its delegated constitutional powers to legislate.

Medicare and CMS's police power rests on the welfare clause power and OSHA's police power under the commerce clause. Dunno if that is broad enough to grant Congressional power absent the specific delegation of those powers to the agencies in the first place.

328 As long as we keep pretending the Leftists are going to play by the rules we will continue to suffer at their hands. Leftists only play by the rules long enough and far enough to get into positions of power so they can enact their agenda through "living documents" and such horse shit. These three liberal justices are living proof of this.

It's time to take the gloves off. We cannot allow them to erode our freedoms any farther.
