Pennsylvania Court Voids School Mask Mandate

Finally people are rising against the madness.

Corrected: This is not an ruling by the Pennsylvania Supreme Court, Alec Lemeas and DMan correct me, but by an appeals court. The Karen Governor is appealing to a higher court.

An order by Pennsylvania's acting health secretary that requires masks inside K-12 schools and child care facilities was thrown out Wednesday by a state court that said she lacked the authority. The Wolf administration said lawyers were directed to file an immediate appeal.
Commonwealth Court sided 4-1 with the ranking Republican in the state Senate and others who sued to challenge the masking order that took effect in early September as a result of the coronavirus pandemic.

The judges said acting Health Secretary Alison Beam's mandate did not comply with the state's laws about reviewing and approving regulations and was adopted without an existing disaster emergency declared by the governor.
The state's disease control law does not give health secretaries "the blanket authority to create new rules and regulations out of whole cloth, provided they are related in some way to the control of disease or can otherwise be characterized as disease control measures," wrote Judge Christine Fizzano Cannon, a Republican, for the majority.

I'm in favor of no emergency powers period. If there is a true emergency that requires the government, the people will allow it whether it is declared an emergency or not. These emergency powers are to used far too often.

not being from Pennsylvania, I had to look that up. Looks like the Commonwealth Court is the top Pa Court for Government disputes, but it can be overruled the Pa Supreme Court if they choose to take the case.

107 I was reviewing my local school board agenda recently. This includes the Superintendent's report. In it the supt. mentioned all the adjustments elementary school kids have had to go through - between being schooled at home, masks, etc. Social interactions suffering is the highlight.

Yet - he is still mandating face masks. Even worse, we just had an election for school board members. most of the wards had anti-mask mandate candidates running. Not wanting to eliminate masks - just give parents the right to choose. Every single one of them lost.

There is a big variation in the g-force limits for different directions relative to the body.

"Negative gs", whether "up" along the vertical axis, or "eyeballs out" along the horizontal are not tolerated well.

That was what I did earlier this year at an auto parts store where I'd gone to pick up a UPS dropoff. The manager actually implied I was lying when I said I had a medical exemption from the mask. He wanted me to stand outside and wait for my package. I said, "I'm not a second class citizen, to be segregated. Give me my package and I'll leave."

Eventually he gave in and handed me the damn package, and said, "Don't come back."

I hope he enjoyed the extensive 5-hour re-training in how to treat customers required by his regional manager when I complained to the head office.

Heard someone make a really interesting observation, although I'm no vaccinologist so I don't know the ins and outs.

The push for kids to get the Pfizer shot as a regularly-scheduled thing same as all the other school-required shots is because that puts Comirnity (or whatever the name is) permanently under a different level of legal protection where the maximum payout is something like $300K.

That's why kids are going to be required to get it.
