Pennsylvania Court Voids School Mask Mandate

Finally people are rising against the madness.

Corrected: This is not an ruling by the Pennsylvania Supreme Court, Alec Lemeas and DMan correct me, but by an appeals court. The Karen Governor is appealing to a higher court.

An order by Pennsylvania's acting health secretary that requires masks inside K-12 schools and child care facilities was thrown out Wednesday by a state court that said she lacked the authority. The Wolf administration said lawyers were directed to file an immediate appeal.

Commonwealth Court sided 4-1 with the ranking Republican in the state Senate and others who sued to challenge the masking order that took effect in early September as a result of the coronavirus pandemic.

...

The judges said acting Health Secretary Alison Beam's mandate did not comply with the state's laws about reviewing and approving regulations and was adopted without an existing disaster emergency declared by the governor.

The state's disease control law does not give health secretaries "the blanket authority to create new rules and regulations out of whole cloth, provided they are related in some way to the control of disease or can otherwise be characterized as disease control measures," wrote Judge Christine Fizzano Cannon, a Republican, for the majority.

Compare and contrast:

When a generation of kids begin exhibiting an induced autism-like syndrome of stunted social development caused by not seeing human faces through several of their key formative years, we can all say, "Well, at least we protected the 50 year old Karen teachers. And bitter broken shut-ins like AllahPundit. They're our Real Most Precious Resources, after all."

One thing that communism got right is that it does go to a part of human psychology, not for the regular people who have to live under it, but for the people in charge of it. They get to be lords and masters with the full cloak of the state surrounding them, doing unto their neighbors what they have always wanted to do: take them down a peg, take what they have, or ultimately kill them.

That is why Communism should be fought everywhere.

99 65 Ace, why do you call a commonwealth court (presumably what is elsewhere known as a superior or circuit court, aka, trial court) the PA "Supreme Court"? PA ain't NY (NY is the only state that calls its trial courts "supreme court" - like MD, NY's top court is not called "Supreme Court").
Posted by: SFGoth at November 11, 2021 03:03 PM (KAi1n)

not being from Pennsylvania, I had to look that up. Looks like the Commonwealth Court is the top Pa Court for Government disputes, but it can be overruled the Pa Supreme Court if they choose to take the case.

https://www.pacourts.us/learn/

so you're correct, it's not a Supreme Court, it's one step down. (and only Pa has such a thing)

Yet - he is still mandating face masks. Even worse, we just had an election for school board members. most of the wards had anti-mask mandate candidates running. Not wanting to eliminate masks - just give parents the right to choose. Every single one of them lost.

He wanted me to stand outside and wait for my package. I said, "I'm not a second class citizen, to be segregated. Give me my package and I'll leave."

Eventually he gave in and handed me the damn package, and said, "Don't come back."

But in the end, I don't trust the legislature that much either. It just means that the process is better, not the result. But good process typically leads to better results.

And Taiwan has just halted 2nd jabs of Pfizer for teenagers due to the myocarditis risk, and aren't even going to consider vaccinating children under 12.

Also, in Germany, the Krau Fauci, name Drosten or something is making a big change in the narrative. The "pandemic of the unvaccinated" is no longer useful, because it undermines the push for boosters. If only the unvaxxed are getting sick, who needs boosters?

So the Krauts are pivoting on that. Fauci and the CDC will soon make such a change here, I imagine.

The state called back the video expert and they got into meaningless minutia about brightness/contrast enhancement in a video file. It was pointless. Heard someone make a really interesting observation, although I'm no vaccinologist so I don't know the ins and outs.

The push for kids to get the Pfizer shot as a regularly-scheduled thing same as all the other school-required shots is because that puts Comirnity (or whatever the name is) permanently under a different level of legal protection where the maximum payout is something like $300K.

That's why kids are going to be required to get it.
