Fifth Circuit Court of Appeal Issues Emergency Injunction Blocking Biden's Vaccine Mandate

"Grave statutory and constitutional" issues.

A U.S. federal appeals court issued a stay Saturday freezing the Biden administration's efforts to require workers at U.S. companies with at least 100 employees be vaccinated against COVID-19 or be tested weekly, citing "grave statutory and constitutional" issues with the rule.

The order demands the government respond to the petitioner's demand for a permanent injunction by 5pm on Monday.

If I am informed of mandatory vaccination at my employer I will ignore it. No way am I getting injected with that stuff.

The Ninth Circuit has a terrible decision, called the "Boise" decision, which says that you can't prohibit homeless camping, unless you can show that you have "adequate" shelter space suitable for the needs of the homeless.

That decision only applies in the Ninth Circuit's jurisdiction.

osha came up with an emergency rule that biden has now delayed until January 4th 2022 after he held a press conference on September 9th 2021 announcing the mandate. Good luck going to court defending the mandate when the lawsuits will argue that osha does not have the authority to issue an "emergency" rule that was delayed for 4 months. Let's go brandon!

He was furious that people weren't coming together and that there was an issue about getting vaccinated at all. I was listening and watching the call and it was disgusting (this is a huge well known company) He at this point he has until Jan. 4th to get the shot or lose his job. They do have wide power to search open fields without a warrant or probable cause and stop vehicles, boats, businesses such as restaurants and cold storage facilities etc. to search for illegally obtained game or to enforce the Lacey Amendment.

Under probable cause, they have to either make application for a warrant or they have to have probable cause that a person has committed a crime using articulable objective facts derived from their investigation. Hot pursuit and other exceptions do apply to game wardens as they do to other leos.
