Southwest CEO Disputes His Own Company's Directive, Now Claiming That People Won't Be Fired for Refusing the Vaccine

I don't know if he's spinning for the public -- lying about not firing people -- or if this represents an actual shift in the company's position.

Because, as "Nice Deb" Heine reports, the company previously announced that anyone who was not vaccinated by late November would be fired.

During an interview with ABC News Tuesday, Gary Kelly, the CEO of Southwest Airlines, stated that no employees will be fired over the company's vaccine mandate. However, the airline announced on October 4 that all 56,000 U.S. Southwest employees needed to get vaccinated against COVID-19 by November 24, or face termination.

He did acknowledge that the vaccine mandate is "very controversial," and not something he wanted for his company.

"This is a government mandate, it's a presidential order, and we're doing our best to comply with that according to the deadlines that have been set," Kelly said.

...

"We're not going to fire any employees over this. We're urging all of our employees to get vaccinated. If they can't get vaccinated, we're urging them to seek an accommodation, so we'll do everything we can to support our people here," he said.

A company-wide guidance, obtained by American Greatness, specifically stated that failure to comply with the new vaccine policy would result in termination.

He had previously said that, as a federal contractor, the company had "no choice" but to impose the mandate.

Um, except for turning down future government contract work.

Let the US government work with its partner and model -- the Chinese government.

Is this really something you need evidence for?

Yes, for many reasons. First, it would require acknowledgment that mandate policies are blowing back on them. Second, it would implicate the union in an illegal labor action and trigger a war.

Given the change in policy, I agree that it looks like tacit acknowledgement that the policy is harming operations. If it is harming operations, it implies that it is because people are slowing down or taking time off in response to the mandate. That response would, however, be a violation.

No one - not management (politics) or the employees and union (labor agreements) - wants to acknowledge that it might be an employee action. They'll just change the policy.

It would make sense that flying would exacerbate the problem. Clots and deep vein thrombosis are problems for people susceptible to them when flying. This is why a lot of people who are at elevated risk for those wear compression stockings while flying.

If the shots cause clotting issues (and that seems to be at least a semi-common side effect), flying could definitely make it worse.

The information is getting out there about cardiac events and clotting issues were noted even when the vaxx flavors were rolled out. Just recently, the Swedes noted the failing protection from these vaxxs and the risk to young and healthy from side effects of being vaxxed probably outweighs any fleeting benefits.

I knew about thrombosis from several surgeries and asking docs about travel issues.

Airline pilot unions are very strong, but for airline pilots to strike is a very complicated process. In short, the company and union have to go through a protracted routine with the Nat'l. Labor Relations Board to get permission to go on strike. Any action take by the union before that -- like a sickout or a vax-out -- has federal legal penalties. Some pilots' unions have carried out sickouts, but they will never, never admit to doing such a thing.

I've been looking into this because it affects several close family members. EOs have been signed for both federal employees and federal contractors. There have been no EOs signed for private companies yet. Of course, some private companies have declared their own vaccine mandate.

Exactly! I only learned about aspirin being a treatment for covid (at the outset, not when it gets bad) a few weeks back when Tucker had Dr. Siegel on to discuss the available covide treatments. Then found a Fox News site article from March 2021 about a study in Israel confirming that baby aspirin tab per day significantly reduces chances you end up in hospital on a ventillator (~50%).

This is why it's so evil the usual crowd suddenly started telling people taking aspirin is dangerous. It's cheap and accessible, and could help w/clot shot and also w/covid should you get it.

The court's jurisprudence gives police powers for health, safety, and welfare to state, but has refused to give that power to the federal government. The strongest means then for the feds has been the commerce clause.

Right now, all we have is an executive order to federal contractors which might or might not be valid. There is no administrative rule by OSHA or even a proposed one for notice and comment the last time that I checked. There is also not a statute passed by Congress that gives the feds the power to issue vaccination mandates except perhaps to travelers regulated by the commerce clause or crossing national boundaries.

183 The saving grace for me is that my company as big as it is has two main hubs, Texas and Florida so largely reflects those states in temperament.

They aren't requiring us to get vax, but some of the clients we have are requiring it.

We also have a mission critical environments division that is all government contracting so all that personnel has to be vaxed no questions asked.

Josh Blackman has been writing about this. In Jacobsen, the actual consequence of not getting vaccinated was to pay a nominal fine. Plus the big mega-carriers - United, Delta and American - probably know that this ends only one way: with contraction consolidation and nationalization into a flagship carrier like most other countries have. They're likely jockeying for position on that now, to become the new national flag carrier as it all implodes.

The large carriers like SWA and Frontier will become national/regional carriers on a different playing field. The rest will die.

Doesn't mean aspirin is dangerous, and moving against aspirin because of that is irrational and clearly not the real reason.

True. My daughter was forced out her job for refusing to get vaccinated. Many nurses did and were let go. The hospital then hired contract staff to backfill. The medical company I work for is "strongly recommending" everyone get the Kung Flu shot, but no word whether it's going to be mandatory. I've already told them I'm leaving on 12/31, so if it's mandatory before then, I'll just leave sooner.

My supervisor has also said she won't be getting the shot, and they are going to have a very hard time replacing her.

OSHA/DOL are trying to use an emergency rule procedure to avoid the normal Administrative Practices Act. This is seldom used and often overturned by courts since 1983 regarding an asbestos rule.

Courts tend to take a dim view that an emergency suddenly appears after 18 months or so that allows sidestepping normal APA practices. My guess is that it will be enjoined by judges somewhere as the penalty of 14000 per violation is more than enough to give any employer of 100 or more the power to challenge any implementation of it via standing.

Really, this is just parenting advice applied to lawyering: telling people they can't do something versus saying if they do, "x" might or will follow and suggesting that "y" course of action is an alternative. At the end of the day, lawyers are advisors and have to accept that. By the same token, clients want to have it both ways: if you tell them "x" is a really stupid plan, they cry; if you don't tell them "x" is a really stupid plan, they blame you when they find out for themselves how stupid plan "x" is.

OSHA/DOL are trying to use an emergency rule procedure to avoid the normal Administrative Practices Act. This is seldom used and often overturned by courts since 1983 regarding an asbestos rule.

Courts tend to take a dim view that an emergency suddenly appears after 18 months or so that allows sidestepping normal APA practices. My guess is that it will be enjoined by judges somewhere as the penalty of 14000 per violation is more than enough to give any employer of 100 or more the power to challenge any implementation of it via standing.

400 Was just reading the injunction granted in the Northern District of New York for the NY State healthcare workers. It is pretty clear that these mandates are a federal violation of Title VII.

There was even a question he didn't bother to address because the plantiffs are so likely to succeed on the merits of the Title VII claim.

At this point, any company that does not offer easily granted religious/medical alternatives of masks and testing, is in serious legal jeopardy. These mandates are losing in federal and state courts.

2nd and 3rd Courts of Appeals have issued similar rulings in other cases.

OSHA indicated formal intent back in June of issuing emergency regulations and then Biden's Sept 9 EO, delegated covid management regulation to an interagency task force. OSHA and Dept of Labor Office of Federal Contract Compliance are involved to my understanding with assignees from other agencies involved in the Task Force.

Apparently, the task force is going to recommend OSHA issue a temporary order requiring compliance with vaxx or other means without going through the normal notice and comment rulemaking. This makes it more vulnerable to court challenge. Some of the leaked details apparently include stiff fines for employers for violations.

Buddy that went to the ER after waiting too long once sick (with SARS) was told that this whole thing is reasonably silly. It's like the flu. There's nothing you can really do about it. OSHA/DOL are trying to use an emergency rule procedure to avoid the normal Administrative Practices Act. This is seldom used and often overturned by courts since 1983 regarding an asbestos rule.

Courts tend to take a dim view that an emergency suddenly appears after 18 months or so that allows sidestepping normal APA practices. My guess is that it will be enjoined by judges somewhere as the penalty of 14000 per violation is more than enough to give any employer of 100 or more the power to challenge any implementation of it via standing.

OSHA is looking for anyway to not issue a regulation because they have no legal ground to stand on regardless of the methodology they use to create the rule. And with Biden having burned his bridges with SCOTUS, OSHA will not get any help.

In addition, OSHA does not directly administer the act in every state. I don't know what the situation is in Texas, but I imagine they T-OSHA, a state based and directed agency that applies safety rules. Pretty plain where Texas is at. So OSHA isn't coming to SWA's rescue.

What is going to tangle things up is if the fed govt can mandate businesses force individuals to take something, then it is potentially an unlimited power. Even Jacobson ruling had the Supreme Court suggesting that states do not have that power. Since then, the whole jurisprudence of right of privacy, right to die, abortion, etc. have been erected on the basis of my body, my choice and then there are religious arguments as well including RFRA which binds OSHA. Note that an interagency taskforce was specially created for this rule that circumvents any agency from taking all the blame for the rule. My personal guess is that some district court judge somewhere will issue an injunction and it might well be nationwide as the Obama judges have established that precedent via Hawaiian judges.

482 Just heard a duo of talking heads on the radio explaining for their listeners that the problems at Southwest over the weekend were really about scheduling and personnel and weather and a couple other things, and that -- tangentially -- there was also some concern from a few pilots about covid vaccines but they really had nothing to do with the slowdown. (Basically, they reframed the bullshit that came out of Psaki's piehole the other day.)

To that end, I think that if airlines and the White House are going to play this off as a weather glitch and "little hub-but," the pilots ought to create an unmistakably huge "hub-but" to clarify who's got who by the balls here.

487 Someone needs to ask a simple question from a SW spox. I spent a lot of time explaining why gov officials could not fly SW even though they were cheaper. They can not compete for most Gov contracts because they do not meet basic contract reqs. If SW has gov contracts it is outside what gov officials are allowed to book.
