Kim Gardner -- the Soros DA Who Hounded the McCloskeys and Used Them for Soliciting Donations -- Repeatedly Fails to Show Up in Court to Prosecute an Accused Murderer, Resulting In Him Being Set Loose Back on the Streets

Dereliction of duty?

Or adherence to a plan?

St. Louis Circuit Attorney Kim Gardner is under fire after a judge drops murder charges against an accused killer.

The unusual move came after the prosecutor from Gardner's office, who was assigned the case, didn’t show up to court. Now the chairman of the St. Louis Aldermanic Public Safety committee wants to call Gardner in front of his committee to explain the incident.

Judge Jason Sengheiser wrote a scathing order dropping the murder charges. The accused killer, Brandon Campbell, was released from jail and is still at large.

The judge noted in his order that the prosecutor who was assigned to the case was on maternity leave for three months and said the office hadn't replaced her.

The judge sharply criticized Gardner's office for the mix up saying, "The Circuit Attorney's Office has essentially abandoned its duty to prosecute those it charges with crimes."

IIRC the prosecution failed to appear THREE TIMES ... supposedly leaving the judge no choice. The ass hat should have immediately ordered the arrest prosecution of the D.A. instead.

If we had a real U.S. Attorney General, they would immediately prosecute the D.A.for violating the civil rights of the victim and victim's family.

99 And this is the tip of the iceberg - and the less outrageous one at that - of what goes on with illegal aliens, and with JailBreak "reform", and with incarceration policies generally, in many many jurisdictions. Among the many predictable outrages at DHS is they discontinued tracking serious crimes by illegals (surprise!).

There is nothing resembling a press in the US of course, hasn't been for years, so one can only glean the "highlights" from outrageous cases that make local "news". Some online types follow this - Daniel Horowitz is one.

Even when some of this reality leaks through the local "news", there's barely any response. Public, I mean.

It's dead, Jim.

The prosecutor has to turn over any witness statements, exculpatory evidence, autopsy report, lab test results, etc. Defendant needs that to make an informed plea or go to trial. 116 St. Louis is a strange city. Unlike Chicago, New York, etc., or pretty much any major metro in the country, St. Louis didn't annex surrounding municipalities as the city grew over time.

Nowadays, the city itself is pretty small, in terms of population and land area, and tax base was hollowed out after deindustrialization of downtown in the '60s, and most commercial companies settled in the suburbs.

St. Louis County is a whole different political beast encompassing the city and suburbs.

Statutory interpretation of the speedy trial requirement. Supreme Court has held that lengthy delays in arraignment without a general emergency like Katrina can trigger due process problems for the state. As a result, most states have codified this to give 48-72 hour time limit on arraignments.

It's not the judge that was the problem. There are rules that have to be followed (don't laugh).

It was at least three times that no prosecutor showed up, plus no response to various orders. The judge didn't dismiss "with prejudice" so they state could refile. However the state re-filed the charges after the defendant had been release. This is 100% on the soros da.

205 Why Soros? Remember the plan by the globalists is to create chaos so the globalists will have something to point to that they will say a world gov't can stop.

It's all part of the plan. Those at the top or just even close have nothing to fear as they have the money to go where it's safer, buy security, live where it's safer and purchase what they need that will be delivered to them wherever they want.

Riots, burnings, disease, chaos doesn't affect them.

It does affect the middle to below as they have no protection other than the gov't. The gov't has now been bought off to be part of the ruling class when the global gov't comes to be.

We will be rounded up and put in multiple story enclaves where you cannot leave and if you misbehave they just cancel your account and you will not be able to eat or have a place to sleep and all your possession will be sold or given away or will be stolen by the random gangs that will roam the halls and forums within the enclave. No one will help you because that could get them in trouble with the Authority and put them out of their house and forced to live like you.

206 The case was up on a motion by the defendant for discovery. The prosecutor has to turn over any witness statements, exculpatory evidence, autopsy report, lab test results, etc. Defendant needs that to make an informed plea or go to trial. It was already continued thrice. Sanction for not tendering discovery after 3 court dates was dismissal of the indictment. Double jeopardy did not attach so he will be charged again. Judge did nothing wrong.

If he is recalled, it will be a rare example of how the Gleichschaltung and Total Misinformation Environment occasionally do not prevent a sensible thing from happening.

This guy was narrowly elected, immediately alienated local LE and other prosecutors, and had very little cover from the "press", which is the key. Thus, he's vulnerable. Even SoCal voters can, in some circumstances, *apparently*, do the sensible thing when confronted with facts about basic things. We'll see.

343 I don't think society is well served allowing a murderer to walk

Is society well served by honoring defendants' constitutional rights and requiring prosecutors to comply with the law and procedural rules?

Is this guy guilty? Statistically, that's likely. But we have the trial process to ensure that. How we get from (a) to (b) matters here. It's how we have some assurance that the guy charged with murder is actually guilty as charged.

Its the same argument the Left used when letting people go because they weren't read their Miranda rights after being arrested.

I'm skeptical of law enforcement and government in general, just think there has to be a better way to handle a scheduling fuck up like this when murder is in the backdrop. Seems more about the judge feeling his time was wasted and wanting to make a point than feeling the constitution was in jeopardy.

I wouldn't chalk this up a win for justice if it was my kid that was murdered by him.

371 This sort of thing of procedural injustice happened in America before where the gangs ran cities such as Kansas City (Pendergast), NYC (Tammany Hall), Chicago (Capone etc.), Minnesota (Purple Gang and others), etc. etc. and mobbed up lawyers controlled the DA's offices.

It took a combination of local citizens voting bums out, the states going after the crooked officeholders, and the federal government to get the rest. The issue is how to live in those cities until that happens.

Yep. The state has the burden of proof. If the state fails to meet that, for whatever reason, at the time and place set for trial (and it looks here like the state didn't even request a continuance), the defense counsel move to dismiss and the judge wouldn't have a choice but to grant it.

One of the reason the FBI was formed is because criminals could easily commit crimes across multiple state lines and then depend on corrupt DA's or LE (sometime actual family members) to protect them from investigation and arrest - a basic mob technique that needed to be broken.

Too bad that is organization has seemingly lost its way on why it was formed and its over all mission.
