Supreme Court Upholds Arizona Law to Insure the Integrity of the Vote and Outlaw "Ballot Harvesting"

Some good news. Wow, Trump's "conservative" justices actually voted conservatively for once.

Thank God for small favors.

"Ballot harvesting" is a I-can't-believe-this-was-ever-legal practice of paying hard partisans to "harvest" the ballots of third parties, supposedly to "help" them vote.

Most people strongly suspect that the "ballot harvesters" are simply collecting the ballots of dead people and out-of-state people and simply casting votes themselves.

Numerous races have gone from Republican leads to Democrat "victories" when the Democrat-paid "ballot harvesters" suddenly turn in thousands of ballots in the closing moments of vote counting.

The Arizona law also requires votes cast by voters who vote in the wrong precinct to not be counted.

This is, again, an area rife with fraud. The only chance a criminal impersonator has to be caught casting a false vote in someone else's name is to be recognized at the precinct by the poll worker -- or recognized not to be the voter in question.

Permitting fraudsters to cast votes in other precincts where the person they're supposed to be is not known to anyone seems intentionally designed to permit Democrat fraud.

The 6-3 decision was written by Justice Samuel Alito. Justices John Roberts, Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett joined in the majority with Justices Kagan, Sotomayor, and Breyer in the dissent, which was written by Kagan.

What it boils down to is the Court upheld the state's ability to prohibit third-party collection of mail-in ballots, otherwise known as "ballot harvesting" and said that the state can also disallow votes cast in the wrong precinct.

Thatís a huge blow against the Democrats because of how they have utilized ballot harvesting. Many believe that they are able to use it, perhaps questionably, to change the nature of elections. Republicans have been fighting against it for some time to make elections more secure.

Democrats had tried to argue that the restrictions disallowing votes in the wrong precinct were somehow racially discriminatory. The court rejected that argument and it's a good thing. The very argument is itself racist -- to suggest that somehow people of color don't know what precinct to vote in.

Responding to the Democrats' (and the 9th circuit's) claims that these "restrictions" disproportionately hurt minorities, the Court found that everyone had an equal opportunity to vote either in person or by early voting, and, in any event, the state's strong interest in insuring that only legal votes be cast and counted would trump the very minor "disparate impact" the laws may (or may not) have on minorities.

The Court notes as a starting matter that Arizona "makes it quite easy to vote."

That is true. And it seems to me that if your state "makes it quite easy to vote" and yet you insist on creating ways for people to vote without identifying themselves, you're only trying to make it "quite easy" to cast fraudulent ballots.

The full decision is here.

14 The big thing here (aside from the result) is the Court's utter rejection of disparate-impact style analysis with respect to Sec. 2 of the VRA. The Dem's attempt to shoehorn employment discrimination law and attach it to Sec. 2 was extremely pernicious -- SCOTUS express rejection of such an approach will help in future cases around the country, and may actually scuttle the DOJ's effort to bring Sec. 2 VRA claims against the new Georgia law.

17 Even if it doesn't directly facilitate fraud, allowing voting in other precincts removes one of the ways in which the legislature can encourage local governments to clean up their voter rolls, and voter rolls which are hopelessly out of date create confusion and give judges an incentive to simply throw up their hands and say, "count it all!" so it enables other types of fraud as well as bureaucratic incompetence.

The wrong place will be further away. You'll have to do *more* work to cast your ballot in the wrong place! And it isn't like voting locations are a secret, or that your official election mail doesn't tell you where your polling place is. How was wrong-precinct voting even a thing that needed to be addressed?

Wrong-precinct voting must be a weird kind of con where they do it in order to stuff provisional ballots into the system that get magically sanitized and made real, first-class ballots.

77 Another problem with mail-in voting (not that this was specifically addressed here, it just occurred to me) is around the handling of duplicates. If you get a duplicate (which would have been possible for me in the last election, since the DMV troll and the elections troll entered my address slightly differently and so I got two ballots), there are four ways to handle it:
You can reject all, you can accept all, you can accept the newest and reject the oldest, or you can accept the oldest and reject anything subsequent.

Most systems choose door #3 and accept the latest and reject any prior. This makes sense from a systems standpoint - if you foul up a ballot and need a new one, it should cancel out the old one. It's fairly safe. But it is also ripe for insider fraud. I can just run off duplicates, fill them out however I like, and send them through the system. Wham-bam, the legitimate vote got canceled by the illegitimate vote.

And remote voting makes that *way* easier.

The problem is that this becomes a reason for me not to trust him, even though he's a pleasant dude. If DeSantis can't say "Trump was the best president since Coolidge and he was fucking robbed," then sorry bud- thanks for playing.

87 Ballot harvesting is appalling, but laws against it are meaningless if they are not enforced. Take as an example Colorado. In CO, ballot harvesting is illegal. Ballots must be dropped off by you or a member of your immediate family. Strangers aren't allowed.

Yet it still happens all the time, almost laughably. The guy in front of me when I dropped my ballot in '20 must've pushed 15 of the damn things through the slot. This would be easy to catch - the drop-boxes are monitored and so they had him on camera. It's just that no one cares.

So saying, "sure, you can make harvesting illegal" is all well and good, but unless someone actually wants to enforce that, it doesn't matter. It's yet another reason why mail-in voting is such a terribly stupid idea.

92 The cross-precinct thing is weird to me. Precincts are hyper-local. Except for very odd conditions where you're *right* on the line, it's pretty damned hard to go to the wrong place.

Posted by: Joe Mannix (Not a cop!) at July 01, 2021 01:32 PM (Jsjd7)

I would assume it's more a problem in big cities with smaller precincts, where theoretically someone could move to a new apartment and suddenly find themselves in a new precinct even though the same school district, etc., or where precincts get redrawn and suddenly a whole bunch of people are in a new precinct instead of the one they voted in for the past twenty years.

This one has pissed me off since I first saw it. I was on campus during some elections - both main and by - and there are these giant voter registration pushes. It struck me as dishonest at the first moment, since virtually no one at a major college actually has residency in the district. Most college kids go home for major breaks and summers and don't really live in the place. Yet, they're registered and vote there. I assume a lot of them get absentee ballots to vote at home, too. But the local vote is almost always fraudulent.

Voting out every single incumbent Republican federally, even if it means losing the seat for a cycle, would be worth it until they change their behavior. There's barely a dime's worth of difference between a federal Republican and a Democrat. The party needs to be eviscerated and purged of its rot before it can be effective. Incorrect.

The individual would be in prison for 50 years while Democrats would use the event to show that Republicans are the real cheaters after detailing in exact detail the method of cheating done by the Republicans in this instance. The media would parrot the idea that only Republicans do this, and that election integrity is actually such a huge issue that we need to make ballot harvesting legal across the land, but only done by trusted federal officials appointed by Joe Biden.

Where we disagree, I think, is whether the outcome you describe - and about which you are correct - is in question if Republicans are returned to national office. I don't think it is. The Republicans, by and large, *do* rest on their laurels whenever they're not actively enabling the opposition. Acknowledging that the Left wants me dead and to install a permanent tyranny - and they do - is not the same as asserting that Republicans are interested in trying to do anything at all to stop them. The Dems are fast and the Reps are slow, but they're on the same road to the same destination in all cases - at least nationally.

When that ballot initiative passed, Wolf's emergency powers were stripped. Your election law reverted to what it was prior to COVID.

This means you no longer have "no-excuse" absentee ballots. That was the big thing that Wolf vetoed. PA now reverts to majority of voting must be done on election day.

Now it is up to PA to put a Republican in the governors office who will sign the new election law in 2023.

If you read the ruling they were very precise with their language and citations. To the point where it would be hard to question federal involvement in any state elections, and that the authority for electoral processes lies with the legislature. While that may become more explicit with some of the other cases out there, they were very clear about the interests of the state in preventing fraud and maintaining electoral integrity. That's of course not because they care about us, but they care about their own vanity and the fact most people flamed their cowardly behavior after the last election, err, steal...

A country that actively rejected leftist rule isn't going to just become compliant. We still have the hope of doing things through voting and representative governance. Once that hope goes away...things get sporty.

Ah, so, 15th Amendment. And the GOPe played along with the slow-rolling coup the entire Trump administration, the will of their putative constituency. They nullified the 2016 election, then they rolled over (at best, were complicit, at worst) for the theft of a century. Bad GOPe. No money. No votes.
And to someone's point, Trump opened people's eyes to the enemy: Apparently not enough.

Of course they tried, like they do every year. But they didn't pull out all the stops. This whole "oh they'd never do it here" thing is without the slightest merit: THEY DID IT EVERYWHERE LAST TIME. This doesn't seem to have sunk into people's heads. President Trump won by a landslide and they rigged it so he lost.

They'll do it again and again everywhere until they control it all. Who'll stop them? What's the down side to their doing so, from their perspective? They think they are fighting a Holy War against Nazis. It would be evil to NOT cheat, in their minds.

Article 2 spells it out very clearly, that the authority rests with each state's legislature to select electors.

Why is that? because legislatures have to hammer out laws when no one knows ahead of time whose ox is being gored, so the laws are presumed to be fair.

The last thing you want is a Governor or state SC changing election laws while the votes are being counted, as in Florida 2000.

Embarrassing but true: My phone was on vibrate. I couldn't find it. I'd call it and (because cell coverage is iffy at my house) sometimes I'd hear a faint buzz and other times the call never made it. But I'd hear it in one room and start tearing it apart - no luck. Then I heard it in another room - again, no luck. I even heard it faintly while searching the basement.

Long story short - it was in my wallet pocket. I *never* put my phone in that pocket! And my wallet dampened the vibration enough that it took me more than an hour to find it.

So check all of your pockets first!

Plain old citizens getting their private boats in the water to rescue people from flooding, providing food, water, and shelter to hurricane refugees, helping build sandbag barriers to prevent flooding, and lots more.

Except in places where the local government pretty much prevents cooperation, by letting rioters and looters run wild, making it hazardous for good samaritans, especially white good samaritans.

271 " individual states decide how to run elections within their borders."

I'm a little paranoid and gun shy maybe, but it seemed odd Roberts had the "within their borders" language, instead of just "states decide how to run elections". I guess it means, run their own elections and not make decisions for other states, but that seems obvious without the language. What I wondered is if it opened some door to question whether they can only decide for state elections, but not federal office elections.

(I didn't read the whole decision, and maybe it refers to language in the constitution or that specific amendment)

Yes, thanks, as always, for the effervescent and uplifting view from China. This actually goes a long way in ensuring the new voters laws being put in place by the states, stand. Which is what we wanted after the last election. It helps to shrink the opportunities for fraud, and allows fraud that slips through to be discounted. It also created de facto standards whereby blue states can be sued if they are not in accordance with electoral fraud protections and processes which have been ruled as unconstitutional. It is also only the beginning and something we can build on.

290 OK, now do voter ID.

As I said earlier this morning, while the ruling is correct here, the stipulation of so much idiotic baseless nonsense continues to render the judiciary pretty farcical.

There is no "burden" whatsoever on the voter. The eligible voter has the ability to have their vote counted, it is the voter's responsibility to vote. Traditional secured absentee ballots completely - completely - cover all conceivable meritorious claims about voting inconvenience or impracticality.

The "court" should have obliterated the concept of "burden" for voters, as a start. "Early voting" and "harvesting" are absurd on their face, indefensible, even more obviously so than opposition to a rigorous/constant culling of voter registration rolls.

Almost everyone here is convinced a presidential election was stolen, but don't think that's fightworthy. So the temperature needs to get turned up until people are willing to fight. It's sad and all, but this country needs a whole lot more misery. That would be tricky, as most places only have one WiFi access point and even if you have more, endpoints don't typically connect to multiples except when negotiating handoff if your system supports that.

What you *could* do, though, would be to calibrate the device to the WiFi to determine signal strength as a function of distance from the access point. Then you can log in, see it connected at 30% strength, and infer a circle of x feet from the AP. That might work, and would be pretty easy to implement.

327 SCOTUS set up a few tests today which are positive for affirming voter ID. The state has a prevailing interest in ensuring who you are, and therefore electoral integrity. If they provide ample opportunity for people, all people, to gain and possess ID used in voting processes there is no harm. They made it clear the voters has some responsibility, and must make some effort. Under those conditions there are not any racial or economic disparities. None.

Paper ballots, at most, electro-mechanical tabulation. No electronics at any stage. One day for voting. Voter ID. Complete transparency at all stages (now something that can be taken to an extreme degree, via web video streaming). Culling of voter registration rolls.

That's it. That's all that's needed. Concept of "burden" on voters, for decades now, is ridiculous on its face, and should be excluded from the discussion. Many countries use exactly/mostly the formula above, and they have never have a hint of election integrity trouble. The US would never, never recognize elections the way they are run in many key US states today (have pointed this out a thousand times).

I believe Roberts ducked making decisions on highly contentious topics in order to let public opinion and politics eventually resolve those issues (ObamaCare - it's legal 'cause it's a tax!). Maybe he finally noticed that politics as he wants it to work is not working in this country. A namby-pamby or no SCOTUS decision simply makes one or both sides do more name-calling and gear-up for more battles in the Federal courts, instead of working to get compromise on new or revised laws.

337 To my knowledge not many. I think he would have to open a lawsuit using VRA as a basis, ala Georgia. Which is hard since AZ was not involved in the original VRA.

AZ on the other hand has the legal right to imprison any fed that touches ballots.

How would the VRA actually apply? The election is over, and checking the results cannot possibly disenfranchise anyone or have a disparate effect along racial lines. What are the mental gymnastics they're going through there to justify it?

347 The contention, or implication, that obtaining photo ID - necessary to modern life for all but the invalid and those under others' care - is *any* sort of factor to be considered is absurd on its face.

That "conservative" judges (stupid term) don't instantly, and vituperatively, make this point, and exclude the entire subject, is of course to be expected, as mediocre elements of a farcical "judiciary" that is 1,000 times more influential than it should be, across the board.

Heh. I once had a meeting with my boss and she was talking about some new things she wanted me to work on. She said that it was important that "thought leaders like you" get involved in X, Y and Z.

I said, "I am happy to do all that, but I have one condition. Please do not ever call me a 'thought leader' again."

She laughed. I did the work.

Damned if I know, I agree it is a huge stretch. But Garland started that argument with AZ spouting off about disenfranchising voters, which is VRA language.

I think all of these things are distractions and tactical. They know they can't win in the courts, but they are hoping to get an injunction that interferes with 2022.

I notice they made threats in AZ, but didn't bring a suit. They brought a suit in GA though.

359 Is this the first major case where literally anything justified by "disparate impact" on minorities has been successfully banned? I mean, I think that's why the Democrats have latched on to all this white supremacy/CRT crap. It's been an absolute silver bullet. The ultimate trump card that wins every single time. Until now?

Bear, I agree with the premise that things still have to get worse, but not the conclusion I think you're implying. Back in the Burning Times days, I used to opine that when things get bad for Average Joe, they get really, really bad in the inner cities. The result isn't a big bad civil war, because before it gets to that point, the cities will be worse than last summer. The complete breakdown, to the extent that it happens, will result in gangs and militias controlling turf in our major cities like Beirut or Belfast. There will be some states (let's call them red) that will get it together, and there are other states (call them blue) that will not get it together. People and businesses will migrate from blue to red. This takes decades, but at the end we have a stronger federal system with a smaller central government.

366 'Who and where? You'll need to be more specific, because unfortunately fake Republicans and RINOs are becoming more and more common across the state.'

I believe it was the district that Will Hurd abandoned. Mr. Hurd is a black former FBI/CIA (? one or the other) who won a traditionally hispanic seat somewhere around or south of San Antonio. I know he had the largest gop held seat along the Texas border. He almost always sided with the dems.

With his seat open the fake republican was actually a dem hispanic that was counting on his name to get elected.
