Bill Cosby to Be Released from Prison After Judge Overturns Conviction for Sexual Assault

Corrected: I am reading the decision now and now understand how Cosby got his immunity.

Cosby was forced to testify in a civil case for sexual assault. The prosecutor gave him immunity from criminal prosecution in order to compel him to testify in civil court.


Otherwise Cosby could plead the fifth in civil court, saying any answer he gave could be used against him in criminal court. Giving Cosby immunity takes away his fifth amendment right to not testify.

That prosecutor claimed he believed it would be too difficult to convict Cosby without forensic evidence, so it was better that he be compelled to testify in civil court rather than keeping open a phantom possibility of charging him criminally.

A later prosecutor ignored this deal and charged him for the crime.

Now a judge rules, correctly I guess, that Cosby had immunity, whether a later prosecutor likes it or not.

So as it stands, Cosby is unconvicted and free.


Pennsylvania's highest court overturned Bill Cosby's sex assault conviction Wednesday after finding an agreement with a previous prosecutor prevented him from being charged in the case.

Cosby has served more than two years of a three-to-10-year sentence at a state prison near Philadelphia. He had vowed to serve all 10 years rather than acknowledge any remorse over the 2004 encounter with accuser Andrea Constand.

If I understand it correctly, the previous prosecutor knew that a criminal trial was unlikely to succeed, but a civil case had a better chance. The previous prosecutor gave him immunity in exchange for his testimony in the civil suit. The new prosecutor then used that testimony in a subsequent criminal trial.

That said, I have some pretty significant issues with using civil testimony which is compelled as there can be no Fifth Amendment claims since immunity was granted to then turn around and charge using that testimony. Yeah, I'm not about to trust, say, the FBI and DOJ with that power.

That throat cleared, hell, yes, this is corrupt on all of the levels.

Yes. And this is why I oppose the death penalty. Not because it is immoral or unjustifiable or an invalid punishment, but because there is no way I trust any element of our state or legal systems enough. I don't trust any of them enough to be comfortable lending them a credit card, let alone giving any of the rotten shits authority over death-as-punishment.

IIRC, the agreement with the prosecutor was that Cosby would settle with the accuser (the lesbian basketball woman from Temple) in her civil suit (which he did, for around $3 million, according to reports), and then he wouldn't be prosecuted criminally for what she claims he did.

It was a bullshit case. The basketball woman was deliberately shining Cosby on, because she knew he was attracted to her, and she was trying to use him to get money and/or a better position at Temple, where Cosby had a lot of juice.

She waited over a year after the alleged "assault" before reporting it, then couldn't remember the exact date it happened, then suddenly was able to recall that it happened earlier than she originally said it did (because that original date put it outside the statute of limitations). She was and is a liar and a fraud and a shake-down artist, and she has already been well paid for her part in this scam. I have no sympathy for her.

My folks went to Temple. I toured the campus when I was in college selection mode. They - like virtually all campuses - had pillars set up with bright blue lights and big red buttons that will call the police if you hit the button. What stood out to me, though, was that Temple had so *many* of them as compared to other campuses.

I asked the tour guide about that. She lit up and said - every excitedly - "Great question! We have so many because it enables really impressive mapping technology at the police headquarters. If you're being pursued, you can hit the buttons as you go, and the system will predict multiple likely routes and automatically dispatch police to intercept you at multiple locations. It has really improved safety."

It was a beautiful piece of spin, but there's no way to spin away the level of casual, everyday danger than would make such a system relevant...

SJU is my Alma mater. If you stay near campus, you're fine. A few blocks east and it gets dicey. LsSalle is in my division. We had a high school girl catch a stray bullet last year. Very violent area, but again, if you stay near campus, it's much safer.

At Cosby's criminal trial, they used his deposition as evidence against him (which also violates the 5th Amendment protection against self-incrimination). Yes, having more money means a greater share of justice in that not all of us could buy off an accuser with $3.4 million, but that Cosby was prosecuted in violation of this agreement almost 12 years later when the statute of limitations was set to expire is also because he was a high-profile defendant. He has served more than 2 years in his 80s when he is clearly no longer a threat to society, the woman agreed years ago she had been made whole, but the main point is a deal is a deal: Imagine a system in which a prosecutor can grant immunity for your testimony and then another prosecutor arbitrarily set that aside.

That was the thing about putting all those women on the stand to tell their tales. Cosby wasn't being tried for assaulting any of them. He couldn't be tried, because all of their alleged assaults were barred by the statute of limitations. The stuff they were claiming happened 20 or 30 or 40 years ago, if it happened at all. There was no way for Cosby to defend himself against their accusations. People (except maybe Brett Kavanaugh) don't usually keep records of where they were and what they were doing and who else was around them on a specific date 3 or 4 decades ago. We have statutes of limitations for this very reason. After so much time has passed, it becomes impossible to prove or disprove these kinds of allegations, so it's just not fair to let people get on the stand and testify. But this trial court did it anyway.

This reminds me of doing a tour with my Nephew at St. Xavier in Cincinnati, it was surrounded by the hood, they had the same system and they said response time was less than minute, and one of the Moms goes really and presses the button and times the response.

If he had paid her off at the beginning (I have no idea if there was even an opportunity to do that), it's likely no one would have even heard of it. It wasn't charm. Cosby had something the women wanted. He had money, and he had influence and connections in Hollywood (and at Temple University, where the main accuser worked) that he could use to benefit the women's careers.

Cosby had something the women wanted, and the women had something Cosby wanted. They were all trying to use each other. None of them were innocent, including Cosby. He appears to have criminally assaulted some women, but none of them came forward and pressed charges at the time, because they were afraid that it would harm their careers. They made a calculation, based on their financial interests. You could argue that it was unfair that they were put in that position, and you would probably be right in some respects, but that's the way the world worked back then. The fact that some women were treated unfairly in the past didn't give the prosecutors the right to bring a clearly bullshit prosecution against Cosby in the present, using a woman who was not a real victim, but a conniving con.

The first prosecutor, Bruce Castor, did not believe at the time that he had the evidence to win at trial. He consulted with the victim, and they offered Cosby a non-prosecution agreement if he would waive his 5th Amendment rights and agreed to testify in a civil case brought by the victim. Cosby then testified in the civil case that he had given drugs to women and fondled them in a deposition which was sealed by the Court (IIRC, it was the Federal Court in the Eastern District of Pennsylvania). The civil case settled for an undisclosed sum, and the victim/plaintiff went on her merry way.

The PA D.A. had initially declined to file any criminal charges against Cosby after Constand (the lesbian accuser from Temple U) came forward (a year after the alleged assault) with her claim. The D.A. said there was insufficient evidence. Then Constand filed the civil lawsuit, and named a bunch of other potential "victims" and the case became a cause celebre. Then the prosecutor's office started working together with the plaintiff's lawyers to take Cosby down, because the prosecutor had an election to win.

Had a pastor friend do the same thing with his daughter's date. Had another pastor friend always talk to his daughter's dates about the boy's car. The young men would gladly talk about their cars and the good shape they are in. He would then say that car trouble is no excuse for not having her back by the agreed time.

Thank God I have sons. Could not handle a teenage girl and all female boarding schools with razor wire fences are expensive.

390 It's less immunity than the way the chain of events happened. Essentially, the DA was investigating Cosby for sexual assault and was considering filing criminal charges at the same time Cosby was the subject of a civil lawsuit for sexual assaults. If Cosby had been deposed in the civil lawsuit, then he could have asserted his fifth amendment right not testify (because he was facing potential criminal charges). So the DA basically told Cosby that he would not prosecute Cosby in the criminal case and then the DA sent out a press release announcing he had ended the criminal investigation into Crosby. At that point, Cosby could no longer assert his fifth amendment right not to testify, because he wasn't facing criminal charges anymore. Cosby testified and then, years later, the new DA came in and used the recently unsealed deposition transcripts to charge Cosby with the same crime that the prior DA had announced he would not prosecute Cosby for.
