NSA Issues Carefully-Worded, Lawyerly Non-Denial About Reading Tucker Carlson's Emails

nsastatement.jpg

They deny that Carlson is a "target" of the NSA.

But Carlson never alleged he was a "target of the NSA."

He alleged they were reading his communications.

And they don't deny that.

And this whole "target" business tells you this is a lie. The FBI and DOJ claimed that Trump was not a "target" when he accused them of spying.

But of course he was a target. They avoided saying he was the target, but they were reading all his communications, and they intended to.

What they did was fake up a case that Trump's one-day "advisor" Carter Page was communicating with Russians. (While overlooking the fact that the reason he was communicating with Russians was that he was a CIA source who reported to them what Russian contacts told him.)

Now that Carter Page was a target, the "two-hop" rule allowed them to spy on anyone who communicated with Carter Page, and then anyone who communicated with anyone who communicated with Carter Page.

So the NSA says they're assigned to spy on foreign targets.

Well... let's think about this. Tucker Carlson obviously communicates with Glenn Greenwald, a frequent show gues.

Greenwald is an expatriate living in Brazil.

Now, I don't know if they're allowed to spy on expatriate, but I do know 1, they've already got an open case on Greenwald due to the Edward Snowden business and 2, Greenwald's partner is Brazillian.

Make Greenwald's partner a target, or any of his foreign contacts are -- and then you get two hops -- one hop to Greewald, and then a second hop to Tucker Carlson.

And you can read all of his emails.

I mean, he wasn't the target. His emails were just "gathered incidentally to an investigation of the named target."

Except, as in the case with Trump, Tucker Carlson is the real target and all the bullshit about this just being "incidental" is a criminal lie.

And what did the NSA say there? That they will spy on Americans "WITH LIMITED EXCEPTIONS," like in an emergency.

And "emergency," such as the threat from WHITE SUPREMACIST INSURRECTIONISTS Q-ANON SUPPORTERS who are currently planning to invade DC?

This is what the media and the government they serve tells me every day.

Should I not believe them that we're in an "emergency" situation requiring "limited exceptions" to the Bill of Rights?

The left, including AllahPundit, are very, very impressed by the fact that the leftwing Fox News Division is once again showing its leftwing stripes:

Oh, Chris Wallace doesn't want to investigate the claims of Tucker Carlson? What great proof.

Chris Wallace told me, while "moderating" a debate, that Critical Race Theory was "just about teaching people to be polite." And he more recently insisted that it was really the Republicans who are "defunding the police."

And I know both of those things are totally true so, yeah, this all checks out.

I Believe Chris Wallace.

Isn't it strange that AllahPundit, who works at a "conservative" website, always echoes the claims of the extreme left?

And isn't it strange that since 2016 AllahPundit, who claims to be a libertarian (I think he's dropped the "conservatarian" fiction) has been a steadfast defender of government rights to spy on whoever it wants, whenever it wants?

Anyway.

Glenn Greenwald also pointed out this somewhat interesting, purely coincidental news: A pro-Trump official just got suspended by the Pentagon for releasing confidential information from the NSA.

Confidential information, like the NSA spying on Tucker Carlson?

Let's read that again:

Top Pentagon Cyber official's security clearance suspended, over suspected disclosure of classified info.

Hm!

Well I'm sure the Chris Wallace's Leftwing Opinions Network will get right on that.

Now, Harmeet K. Dillon was on Tucker Carlson, and made a lot of these points.

But she also pointed out that among the bad actors of the US government and "intelligence" permanent shadow government, the NSA are relative good guys. The NSA sometimes refuses to share information with the FBI because they fear the FBI will use it for illegal or unethical purposes. Such as, you know, spying on the enemies of the Democrat Party.

Just something to think about. Maybe the NSA did collect "incidental" information about Tucker Carlson -- but then the FBI demanded to see his emails, and a partisan official at the NSA complied.

Or, maybe it's just Biden's socialists now weaponizing the NSA, as they previously weaponized the FBI, CIA, and Pentagon.

Their non-denial certainly suggests that they're dirty here. Or, at least: They know their "incidentally" collected information is being used by bad actors in the FBI or DOJ.

And, by the way: Is it really true that Fox isn't reporting on this at all?

Microsoft exec details 'frightening' DOJ 'abuse' of secret requests for Americans' data in hearing

Tom Burt's comments were made during a hearing on DOJ abuse

A Microsoft executive on Wednesday detailed the "frightening" abuse by the Department of Justice of "secrecy orders" that allow the government to take Americans' data from tech companies without ever letting them know.

Tom Burt, Microsoft's corporate vice president for customer security and trust, made the comments in a House Judiciary Committee hearing about Department of Justice abuse of such orders in prosecutions and leak investigations.

Burt lamented that "secrecy orders," which prevent Microsoft or other companies from letting customers know that the government is seeking their personal data, make it much easier for the government to skirt due process when pursuing an investigation. Therefore, Burt said, they've become shockingly "routine."

"It's no surprise then that through the Obama, Trump and Biden administrations, up to a third of all legal demands we received from federal law enforcement include secrecy orders, up to 3,500 in just one year," Burt said. "And these are just the demands on Microsoft. Add the demands likely served on Facebook, Apple, Twitter and others and you get a frightening sense of the mountain of secrecy orders used by federal law enforcement in recent years."

Via Deb Heine, who also suggests that we view this Congressional hearing on the Justice Department's frequent spying on "journalists."

Friends of mine who have connections to people in the spy state do not know any facts about this matter -- they're guessing -- but do say that based on their general understanding of how this works and who the really bad actors are: This is probably the FBI and DOJ.

Related, from Jane D'oh:

BTW, notice, once again, AllahPundit grabs the grabbiest story so that he can cover it with his disgusting leftwing spin.

Does no one at Hot Air realize that maybe a "conservative" site should sometimes have a conservative voice covering the grabbiest stories of the day?

Why is it always this alcoholic shut-in leftwing Literal C*ck?

Update: Harmeet K. Dhillon redlines the "denial."

dhillonredline.jpg

BTW, Tucker Carlson noted that, if it seems GOP "representatives" in DC are a little too deferential to the Deep State Spies -- remember, the Deep State Spies have all the emails GOP representatives are sending.

There might be a reason why the GOP is so eager to please the Deep State Spies they supposedly provide oversight for.

22 Spot on and very well put together, Ace. I have but one niggling disagreement with what you wrote:
They deny that Carlson is a "target" of American intelligence.

They didn't even do that. They denied that Carlson is a target of the NSA. As you point out, thanks to everyone's favorite dance move - the FISA Two Hop - this is irrelevant. But even so, they didn't say that Carlson wasn't *anyone's* target, only that he wasn't *their* target. This could even be true. It could be from the FBI or the DIA or any number of other intelligence outfits.

Not that it matters, as you point out. And then there's the other side of the problem: even if Carlson *is* a target, they'd just lie about it. Do you trust some statement from the NSA? I sure don't. If anything, it makes me sure of the opposite - that whole "don't trust a rumor until it is confirmed by an official denial" thing...

Tucker alleges:
NSA is monitoring his electronic communications &&

Is doing so with the intent to take his show off the air.

This allegation is untrue.

Logically speaking, even if two of those statements is true, because you've "and-ed" them all together like that, if any part of that statement is false, the entire statement resolves to false. So, to a non-logician/mathematician it APPEARS as if they're denying every part, but in fact, it's a huge obfuscation.

Now why or what do you suppose the reason is they decided to speak about this one particular claim?

77 I'm sorry that Trump's nominees to the Court haven't singlehandedly turned America around in a few years' time. Be sure and write Trump to let him know how disappointed you are.
Willowed, Bear ASB,

Bear, I have several decades of analyzing Scotus and my grandparents both worked in the federal court system. I am capable of boring people to tears with discussions about what Rule 10 means, the differences between appeals and writs of certiorari, etc.
In essence, the problem with Republican nominated judges is of such long standing that you could write a book about why Republican appointees usually prove to be such a disappointment on the court and as lower court judges. It is primarily because they identify with their leftist colleagues in law, universities, and the media culturally and socially. In other words, just as GOPe leaders do in Congress by and large.
The rare exceptions such as Thomas, Alioto, Scalia, Rehnquist, are notable because they care more for getting the result and law correct than what society thinks. Most GOPe judges do not have the courage to do so. So you get justices like Souter, Roberts, Kennedy, Powell, etc. that want societal approval.

99 IIRC, Adm. Rogers, while head of the NSA in fall 2016, discovered that the FBI as well as two FBI contractors were querying the heck out of the NSA databases under Section 702 (FISA). He shut it down and the head of the DoJ National Security group, John Carlin, was then obligated to report this abuse to the FISA court. He did, and then resigned. . . this is how the NSA's data can be abused by the FBI (i.e. how the NSA is not the bad guy in this scenario).

Here's the details: https://tinyurl.com/sjmwkjut

Posted by: SkylerKat

The only completely secure encryption method is using a "one time pad".
The technique is to gather a random stream of bits (universe background noise is good). Then exchange this data with the desired recipient (make sure no one else gathers this data stream!), then you can use that data to encrypt your message.

The exchange of the random stream is non-trivial and can only be used once.

112 81, there is a basic misunderstanding about FISA warrants and the NSA. Essentially, the NSA collects EVERYTHING--think of it as a giant vacuum cleaner grabbing everything of interest. Then the idea is that a FISA warrant is needed if the person is a US citizen or legal resident to actually identify that individual and use the information via a law enforcement agency.

However, the NSA had something like a google type about search (prior to the NSA director shutting it down in 2016) where authorized individuals including law enforcement and its contractors can query the data and it will pull up comms/texts/pictures/data but not identify the American citizen or legal resident. That has to be made with specific authorization by national security appointees in the admin and is called unmasking. That did not involve the FISA warrant process at all because theoretically the intercepts of the American citizen etc. was incidental to the collection of the information and places like FusionGPS were where the information collected by contractors was leaked by essentially Dem operatives in govt.

126 Heres more from the link describing NSA data that was queried by the FBI in 2016, which may also be how someone at the NSA discovered Tucker was being spied on:

Downstream collection involves the government acquiring data from the companies providing service to the user - like Google or Facebook. However, some Section 702 collection is obtained via upstream collection.

In simple parlance, upstream collection means the NSA accesses the high capacity fiber optic cables that carry Internet traffic and copies all the data flowing through those cables. The agency is then supposed to filter out any "wholly domestic" communications that are between Americans located in the U.S.

Data collected incidentally on U.S. Citizens is generally not destroyed. It is minimized. As we will see later, this became a problem. Intelligence Agencies can then search the data using "To", "From" or "About" queries on a target of Section 702 collection.

"About" queries are particularly worrisome. They occur when the target is neither the sender nor the recipient of the collected communication - but the target's selector, such as an email address, is being passed between two other communicants.

What's absolutely infuriating about that claim is that it can be technically true, and yet completely misleading (spooks are good at lying without lying? who knew?).

Sure, it doesn't specifically say, "This email was sent by John Q Rando", but if you look at a little bit of data and have a brain in your head, you can figure out very quickly exactly who you're dealing with.

Maybe every day they drive to WalMart and every night they drive to 555 Love St. Well, you do a little bit of open source data search and discover that John Q Rando lives at 555 Love St and his LinkedIn says he works at WalMart as a manager. You've now "unmasked" that person.

It is a long held policy of the FBI to NOT allow or tape investigation interviews. Particularly the initial approach and any conversation.

This is done on purpose so that they can then modify their report at a later time if they need to show "Probable Cause".

They do do taped interviews just not the first one. And they have always done this. Even tho it is proven to be beneficial for both law enforcement and the preservation of the interviewees rights.

And that says all you need to know about the FBI.

147 The rare exceptions such as Thomas, Alioto, Scalia, Rehnquist, are notable because they care more for getting the result and law correct than what society thinks. Most GOPe judges do not have the courage to do so. So you get justices like Souter, Roberts, Kennedy, Powell, etc. that want societal approval.
Posted by: whig

I agree with this completely, but at the same time I think there are two points missing.

1. Most people underestimate the actual intelligence of justices, politicians, lawyers,.... and a weak mind is easy to fool.
2. It is not as simple as societal approval in a direct sense, but that they are immersed in a propaganda machine that deludes their weak mind into thinking their path is correct. Not just for society, but for the law. Weak minds are very powerful at convincing themselves of just about anything.

Technofog also wrote about it on occasion.

BTW, any reader of spy novels or even WWII intercepts using Enigma, or the radio game in France, can figure out secure ways to communicate even now. Part of it requires going old school to analog which is harder for computers to deal with and part of it requires anonymous cell based organizations which is much harder to pull off. BTW, traffic analysis includes facts such as the suspect going dark aka encryption or changing methods of comms as well as communication patterns. Thus abrupt changes in actions is often like waving a red flag that you have something to hide which can actually bring more scrutiny to your comms. It is suspected that both computer chips and encryption methods also have backdoors to circumvent privacy as well.

So Have Fun Storming the Castle.

162 105 The only completely secure encryption method is using a "one time pad".

The technique is to gather a random stream of bits (universe
background noise is good). Then exchange this data with the desired
recipient (make sure no one else gathers this data stream!), then you
can use that data to encrypt your message.

The exchange of the random stream is non-trivial and can only be used once.

that sounds complicated. howzabout we build a little box that generates stuff that looks random. half a dozen or so code wheels that advance unpredictably and xor their output with the plaintext. nobody'll figure it out.

177 147 Gentleman, for a project, I actually went to DC and the Library of Congress to pull and read the day to day correspondence and files of several Sup. Ct. justices including Earl Warren.

Most of them have pretty good information sources even without the internet and their exposure to the law clerks present and past who are generally at the top of their profession help broaden it. The harsh fact is most people want to be thought well of and as Tocqueville mentions, it is more difficult in a republic than a monarchy to oppose public and elite opinion. It is also difficult for some to oppose authority aka the Chief or their colleagues at times.

There is also the influence of spouses and children that become important when you are a justice for some people. Blackmun's Roe decision was influenced by his wife and children as well as Blackmun's prior work as legal counsel for the Mayo Clinic. Difficult to unpack all of that so generally approval from others aka society covers the gamut.

Unless you count Clinesmith's temporary inconvenience. Durham? Obviously expectations have to be rock-bottom.

And isn't there a money-laundering "investigation" of Hunter et al supposed to be under way, based on the laptop revelations?

Though I don't suppose anyone at DOJ would think to look into the repeated, specific, unimpeachably authentic statements from the laptop about Joe receiving from 10 to 50% of the family grift proceeds. There is also another one. Tho with the computing ability that's out there and the recording of all text in databases that may not be true.

That's the code that uses a particular edition of a particular book. You then use a substitution code that indicates the page, the paragraph and the word each particular code represents.

It's best not to use the most popular or first edition as your base but find a book or topic that has been replicated by others and the more reprints and re editing for that book done the better.

Unless you become an international target because you're a mass murderer or something it will probably be usable as they won't go to the extent of searching for your book. It does take time.

Run out of electricity? Where did it all go???

There used to be coal-fired power plants about every 20 or 30 miles on the Ohio River that were supplying power to Ohio and elsewhere. Now, after California, Ohio is the largest electricity "importing" state in the country. A lot of that "excess" electrical generation used to be shot up to New York State during peak power demand periods. Well, guess what? It's all been demolished.

231 182 rhomboid, I think that is correct, I learned the vernacular when it mattered and promptly forgot it due to the press of life plus used to read espionage and spy histories. One of the more amusing anthologies had Allen Dulles commenting on fictional spy short stories. Bodyguard of Lies is an exceptional overall study of informational warfare during WWII in the West including spying, Enigma, disinformation, etc. The Puzzle Palace is a bit old but useful for background information and some of the programs that the NSA runs were disclosed during the Snowden leaks. One of the projects that I dealt with in the past was how organizations process information.

Also, thanks Lizzy for the headsup on the sourcing of CTH coverage. I do know Sundance at the CTH was a central clearing house for a lot of information but did not remember who the original source was for some of it.

Souter was put there because GHWB did not want Roe overturned and and a weird solitary dude from New England with a scant paper trail was ideal to prevent questions. Ginsburg was a known quantity for Clinton as she and Hillary knew each other and Ginsburg was a long time counsel for the ACLU and feminist groups. Sotomayor was a known solid left candidate on the circuit court that was nominated for district court by GHWB.

Justices on the left, other than retiring decisions, are largely immune from the approval racket because they have institutional support from anyone that they care about. Linda Greenhouse, NYT reporter for the court, was a close friend of Ginsburg for example. Anthony Lewis was also close buddies with a Warren era justice whose name escapes me--maybe Fortas? Only Whizzer White, appointed by Kennedy was a somewhat conservative justice appointed by a Dem. but when he was appointed, the Dems were more concerned with federal economic power than social issues.

304 275 I just had the idea to turn my chest freezer into mostly a solid block of ice. 20 cube feet of solid ice should keep a lot of stuff cold for uh... 3 weeks?

Yeah, I know. Details etc.
Posted by: klaftern at June 30, 2021 04:54 PM (r4sI4)

Fill the spare space with frozen water bottles, and ICE.

Seriously.

Air doesn't hold the cold. Ice does, and it takes a lot of heat to change ice back into water.

The points you make are not reiterated enough...Supreme Court Justices needed backing from certain appointed mass media court watchers and certain "qualified" legal organizations that can give cover to politicians in order for them to be confirmed...period. Dems and lefties and moderately liberal "Rockefeller styled" legal organizations universally run these gatekeeper posts, thus no real constitutional conservative justice like Bork is ever going to sit on the supreme court unless this gatekeeper process is broken up.

Also every other nation's intelligence services do it. Also private actors. Even if you abolished NSA, your comms are still insecure. All you would accomplish by killing NSA is blinding US intelligence to the stuff that everybody else intercepts without hindrance.

About *koff koff* years ago when I was on an Army base in Egypt, they'd cycle the power every afternoon so that it would shut down the A/C in each barracks room (the power switch would stay off when the power came back on). I was often on night shift so I was trying to sleep when that happened. And it doesn't take long for a barracks room to turn into an oven when the outside temp is 130+.

So I 100MPH-taped a rock to the power switch to hold it down after the power came back on. Worked perfectly, and best part is, I never got caught. Heh.

You put them in their barracks, disarm them, feed them 3 squares a day, give them a couple hours a day of Close order drill, KP, and Clean up duty. Then you identify and remove the Saddamites and the Islamic Fanatics. Put them out in the community cleaning up the trash, shit, and garbage (that is a never ending job!!!).
Then give them new officers and start retraining them.
Then in a year to 18 months you can LEAVE!!!

338 323 Durable, it is more likely that the NSA would farm it out to the other members of the Five Eyes group.

The easiest way to quell this crap is to remove any criminal law protections explicitly by law from those that misuse it and make any such actions a justification defense requiring affirmative actions by the NSA or IC defendants in court.

You know, just like we do for self defense shootings--it is still murder but the person doing the self defense shooting has to justify their actions by a preponderance of the proof to a jury. Incentives matter.

339 Thanks Mark, maybe a q for the lads & lasses at PM.

I think I see the path now. An in the clear message that then gets encrypted to place in your inbox would (I think?) offer a way for a third party with a copy of the in the clear message and your encrypted storage to break the encryption.

And point taken, the easiest solution is to compartmentalize.

The issue with 'brown outs' is that the grid of a lot of liberal states like NY and CA rely on, well, serially unreliable renewable power to back fill the grid during available power short falls...instead of, you know, back stopping the grid with reliable coal or nuclear power. There are peak load and non-peak load times during the summer and these times have been known since electrical grids were built...but for NY and its idiotic governor? Everyday is a new day, I guess....

349 Haha. Yep. Remember Trump was never a "target of any investigation" in fact McCabe and Comey both said that under oath. It was just Flynn, Page, etc.

IOW, they were just targeting someone else - which allowed them to read all Trump's emails and eavesdrop on all his conversations with them.

Posted by: rcocean at June 30, 2021 07:50 PM (evE25)

350 So, of course the NSA isn't "targeting" Tucker. They're just reading all his emails. And if some of those emails get looked at by other people, like someone at CNN or MSNBC or even Joe Biden. Well gosh, heads will roll!

We can get John Dunham to prosecute. Promise.

Posted by: rcocean at June 30, 2021 07:52 PM (evE25)

351 BTW, the reaction to Tucker's charges by the RINO's and Cucks is interesting. For example, the Washington Examiner says we have to wait for more "proof". Its not like Tucker is the FBI, Nancy Pelosi, or the NYT. His word isn't good enough for the Examiner.

Maybe Tucker could get some anonymous Source that talks to the WaPo or Jack Tapper, they would believe it.

Posted by: rcocean at June 30, 2021 07:57 PM (evE25)
