The Supreme Court Ducks Another Foundational Issue By Claiming Obamacare Litigants Have No Standing to Sue

The Supreme Court has permitted Obamacare to stand, not by ruling on it by the merits, but by disqualifying a lawsuit filed against it by claiming the litigants had no standing to sue as they incurred no concrete harm.

The suit argued -- correctly -- that the only rationale that Bush-appointed liberal Chief Justice Roberts had given to claim that Obamacare was Constitutional was that the entire bill was a "tax," owing to the presence of the individual mandate, and that the power of the federal government to lay taxes as it pleases was nigh-plenary.

But then later, the individual mandate was repealed. Leaving Obamacare naked of the one provision that was risibly claimed to render it constitutional instead of plainly unconstitutional.

Makes sense.

But the bravehearts of the Supreme Court chose to duck the issue by saying that they could not reach the merits of the suit, as the litigants themselves suffered no harm by the repeal of the individual mandate, and thus could not file a lawsuit challenging Obamacare.

One actual conservative -- Justice Thomas -- endorsed this perverse logic, agreeing that the states suffered no concrete harm, and so were litigants without a basis upon which to sue.

Though he did blast Obamacare -- and the Court, for doing all in its power to "the court has gone to great lengths to rescue the Act from its own text."

Alito, joined by Gorsuch, dissented, finding that Obamacare is indeed unconstitutional, writing this "third installment in our epic Affordable Care Act trilogy" uses the pretext of a repealed "tax that does not tax to stand and support one of the biggest Government programs in our Nation's history."

Alito also found that the litigants -- here, the states -- did indeed suffer a concrete enough harm to permit them standing to appear in court.


The U.S. Supreme Court on Thursday upheld the Affordable Care Act on the basis that Texas and several other states lacked standing to file a 2018 lawsuit challenging the individual mandate as unenforceable and therefore necessitating the wholesale destruction of Obamacare on the basis of an unforgiving severability analysis.


In a lengthy dissent exactly twice as many pages long as the comparatively brief and tidy majority opinion, conservative Justice Samuel Alito -- joined by Justice Neil Gorsuch -- said that his peers have essentially ignored decades of precedent to issue a "remarkable" and "contrary" holding that is "based on a fundamental distortion of our standing jurisprudence."

"The States have clearly shown that they suffer concrete and particularized financial injuries that are traceable to conduct of the Federal Government," the dissent argues, endorsing a liberal interpretation of standing. "The ACA saddles them with expensive and burdensome obligations, and those obligations are enforced by the Federal Government. That is sufficient to establish standing."

Not so, says the majority.

"Unsurprisingly, the States have not demonstrated that an unenforceable mandate will cause their residents to enroll in valuable benefits programs that they would otherwise forgo," liberal Justice Stephen Breyer writes. "It would require far stronger evidence than the States have offered here to support their counterintuitive theory of standing, which rests on a 'highly attenuated chain of possibilities.'"

If you see the sleight-of-hand that Breyer is pulling there: He says the states suffer no harm due to the non-enforceability of the mandate itself, and therefore the states have no standing to sue.

Gorusch and Alito say that the relevant question is if the Act itself causes harm to the states, which it inarguably does -- in a legal sense, at any rate.

And so then of course, they should have the right to sue.

The majority says the mandate, which is now effectively dead letter, inflicts no harm.

The dissent notes that the real question is whether the Act inflicts harm-- which it does. So the question should be reached, and Obamacare should be overturned.

But the majority -- alas, including Kavanaugh and Barrett, as well as Thomas -- focus just on the mandate, when the suit itself is whether Obamacare is still constitutional given that the figleaf "tax" which propped it up as constitutional is no longer in operation.


Just vote harder, guys.

It's 9-0 with six justices joining Roberts opinion, which is a pure attempt to avoid having to address Free Speech and the Smith decision, and Alito issuing a 70 odd page concurrence just annihilating Roberts and Gorsuch also issuing a concurrence where he point blank calls out Roberts because the case was supposed to address Smith and Free Speech.

Roberts is doing absolutely everything possible to prevent there from being a direct ruling on Smith. Thomas and now Gorsuch have pointed out that such a ruling is inevitable.

It's cowardice, plain and simple, by Roberts.

Courts do not make what are known as advisory decisions/opinions. The person suing must have a specific, individualized harm. I hate to say it because I loathe the use of standing to avoid decisions, but the individual plaintiffs had no standing. The mandate was repealed and thus the individuals would not have any harm to them.

I disagree utterly on standing by the states. The states are still being forced to comply with provisions of the ACA and that does cause specific harm.

The public policy reason for must have specific, personalized harm is to keep the courts from being clogged up by everyone suing because they don't like a political action.

It's cowardice. His decisions are always tailored to avoid any big, controversial issues and instead focus on technicalities. In essence he keeps trying to throw this stuff back to the executive and legislative branches. Hence "it's a tax" or finding that Trump could add the citizenship question to the census, but he didn't do it in quite the correct way, etc. Roberts is trying to avoid another Roe v. Wade, but in doing so he's making a hash of the law. The irony is that he may very well bring about the chaos and violence which he wants to avoid.

The legislature could simply strip SCOTUS of much of its appellate jurisdiction if they wanted to. They've done it in the past regarding specific laws. They don't because that would push the responsibility onto them for when the courts are clogged up with contradictory rulings and uncertainties.

Basically politics has become a game of hot potato, where everyone keeps trying to shift responsibility for decisions to someone else.

Smith, which is a Scalia opinion, is that free expression of religion is not impacted by laws of general applicability.

This is the peyote case. Native American drug counsellors were fired because they used peyote during a religious ceremony. They filed for unemployment and were denied because drug use was a grounds for denial of benefits.

The ruling was that, in most circumstances, laws of general applicability that impact religious practices are not subject to the compelling interest test. The rational basis test should be used. That's a very low level test that is highly favorable to government actions.

It brought back the beliefs/actions distinction. The government cannot tell you what to believe but religiously based actions are not protected unless the law singles out religion.

I hate to say it about a Scalia opinion but this is nonsense on stilts. Beliefs are shown by actions. Bluntly (pun intended), the decision came out the way it did because it involved drugs and Scalia had a HUGE blind spot about drugs. Drugs bad, laws against them good.

I use Liberty HealthShare. I can’t vouch for them, as I’ve never had to use them. But it is much less expensive than insurance, although rising due to general rising health care costs.

And they do make having a Direct Primary Care provider much less expensive.

Not quite. The decision was that Philadelphia had no right to deny CSS from being a contractor for foster children placement based on CSS refusing to accept same sex couples as potential foster parents.

Look, it's a win, yes, but it was based on Roberts saying oh hey since the Commissioner had purely discretionary powers to grant exemptions that means it wasn't generally applicable and HAND WAVE HAND WAVE Smith doesn't apply and, no, we aren't going to address Smith even though that's why we took up the case in the first place.

Yes, we used Samaritan for years, and if I start my own business again like I hope too, I'll use them again.

We didn't have to test it much so my experience doesn't speak to "do people actually send you their money". But it appeared to be run very well and my impression is that it's very reliable.

This case going the other way would have been an activist move by the court to correct a prior poor decision. If you use the definition of harm needed to have standing here, literally anything the Federal government does can be challenged.

276 The "suffered no harm" caveat is one I'd the stupidest things in law when it comes to trying to stop the government. So if the government okays mass arrest of say, the Japanese, you can't stop the clearly illegal and unconstitutional act, until those citizens have already been harmed, knowing full well that it's 100% unconstitutional. Or they won't stop it if you're a concerned 3rd party. So people are okay with watching fellow citizens get hurt or worse, because the Supreme Court has decided that the government can explicitly say they are going to break the law, but we can't take them at their word.

This wouldn't be held up for you or I, as if we made a threat we'd be arrested before we can go through with it, even if a 3rd party heard the threat and made the complaint to police. The government threatens us all with its unconstitutional laws, but it's not until they put its citizens through hell that they can be stopped (unless the SCotUS decides that it's fully onboard edith all the government's unconstitutional laws, like they often do)
