What I had read a few days back was the firing pin spring was installed in front of the firing pin. Not knowing the model of pistol makes any kind of info like that useless.
This is the first claim I have heard that the firing pin was absent. It would be nice to know the model of the pistol.

My guess is that she wrote up the charges with the phrase "readily capable of lethal use" peppered throughout, and one of her underlings who actually knows Missouri law caught her mistake and made sure the guns could fire.
Now that this tampering was caught, I will wager that their next line of attack will be that the McCluskeys had the time and wherewithal (being lawyers themselves) to remove and hide all their bullets and move the firing pin to make the gun inoperable, all so they wouldn't be charged with a crime. After all, if they were truly frightened and weren't trying to intimidate, why would they leave the safety of their house with a prop gun and an unloaded rifle?

The law specifically says that the gun has to be capable of firing at the time of the action to be illegal. What it looks like is that Gardner got her grubby hands on the handgun when it was not in fireable condition. So she had her lab people figure out how it was disabled, how hard it was to do that, and how hard it would be to be put back in working order.
The couple seems to be laying down grounds for a defense of "those guns weren't really dangerous" (at least as part of their defense), and that is backed up by 1) the pistol being turned over disabled, and 2) no ammunition for the rifle found on the premises. So that leaves Scrunt Gardner to prove that they disabled the pistol AND removed all the ammo between the incident and the warrant being executed, which adds a bit of a complication to her bullshit case. She now has to overcome the "presumption of innocence" angle and show that the couple deliberately tampered with evidence by fixing the pistol and dumping the ammo. Her job just got a bit harder.
Now, if it turns out that Gardner tried to keep the testing on the pistol secret and it somehow got out, THEN start going for the lamp posts. But at this point I wanna get all them ducks in a row before taking her down.

Happily, the whole exchange is captured in communications back and forth from the Crime Lab to the Prosecutors office. And the renewal of the weapon is on tape. No way the crime lab techs wanted to be blamed for this; in fact, it wouldn't surprise me if they were the original source of the story.

It's funny, but I remember that the Left went nuts when the Right came up with ALEC, which is an organization that tried to have business sit down with the legislature in meetings that would determine the best business-friendly policies that could pass muster - at least that is how NPR tried to paint it. When they did it, it was nefarious, of course.
Well, they succeeded in scaring many businesses, including WalMart, off ALEC.
In the meantime, the Left took that prototype, weaponized it, and perfected it. Hence, the Soros-backed AGs, etc.
It seems like the Right innovates in the political arena (direct mail, PACs), and the Left first demonizes, then perfects. See Citizens United for more examples of how the Left ends up doing much worse than the Right ever has the thought to do.

It is a frame-up, of course. I suspect that some non-trivial portion of prosecutions - maybe 10% if not more - are frame-ups (just a wild-ass guess). I strongly suspect that there is no such thing as an honest prosecutor. They just usually have the sense to not put down in writing what they're doing to railroad defendants.

The lab techs are supposed to follow lab protocol, which basically requires them to document everything they do to evidence (which they seem to have done here). It's not their job to know the elements of each crime the prosecutor is charging, and the prosecutor's office has an affirmative duty under the law to behave ethically, which means not instructing lab techs do alter evidence so the prosecutor's office can frame somebody for a crime they didn't commit.

There has been a huge turnover in the office. Reputable prosecutors don't want to work there, for obvious reasons. Plus the office under Gardner only has something like a 20% conviction rate, which is a joke as most even semi-competent prosecutors win over 90% of cases.

I disagree. There were a lot of people there, none of them wanted a bullet wound. They had no idea that the guns were useless. And if they were useless, it's no 9 dimensional chess game to assume that the couple were hoping to scare the rioters. It's what they had.
