Charged or not, this does need to be Megaphoned on every available media (notice I said "available", which rules out the MSM, of course).

I stand by my position that this is a very stupid move on Gardner's part, she has exposed herself to charges if the state's AG wants to do so, plus having the McCloskey case dismissed due to evidence tampering. Thanks Jukin. Yep firing pin spring, or pin itself, usually easiest to remove from such designs - usually they're not "captured" springs, they're just placed in there. Switching position, one in front of other, is indeed the simplest approach, though not all designs have room for that.

I seriously doubt Gardner knew anything about the law stating that the gun needs to be able to fire.
My guess is that she wrote up the charges with the phrase "readily capable of lethal use" peppered throughout, and one of her underlings who actually knows Missouri law caught her mistake and made sure the guns could fire. Now that this tampering was caught, I will wager that their next line of attack will be that the McCluskeys had the time and wherewithal (being lawyers themselves) to remove and hide all their bullets and move the firing pin to make the gun inoperable, all so they wouldn't be charged with a crime. The law specifically says that the gun has to be capable of firing at the time of the action to be illegal. What it looks like is that Gardner got her grubby hands on the handgun when it was not in fireable condition. So that leaves Scrunt Gardner to prove that they disabled the pistol AND removed all the ammo between the incident and the warrant being executed, which adds a bit of a complication to her bullshit case. She now has to overcome the "presumption of innocence" angle and show that the couple deliberately tampered with evidence by fixing the pistol and dumping the ammo. Her job just got a bit harder. Now, if it turns out that Gardner tried to keep the testing on the pistol secret and it somehow got out, THEN start going for the lamp posts. The crux of the matter is these two saw the mob tear down their gates and were probably both pissed off and scared. They called 911 and were told to pound sand. That probably tipped the scales of their emotions over to "pissed off" rather than scared, and based on that mindset, that is why they decided to go outside with guns that weren't loaded, in order to posture and blow off steam.
Was that stupid? Probably, not only because you had to assume the mob would film them and flood the internet with their pictures, but because they actually put themselves in a lot more danger than they would have been if they stayed inside. All the more this should go to court did Gardner can be seen as the incompetent DA she is, and the McCloskys can counter sue, which they are experts at. Hopefully afterwards there's significant jail time for her (which won't happen unless Trump can pull off a win in Nov) but if he does he needs to start using the DoJ like Dems do, getting these criminal politicians rounded up for every little crime they commit
