AP Headline: "Ex-judge says push to dismiss Flynn case is 'abuse of power'"
Don't Worry: It's Fake News. AP Is Misleading You, As It Does Every Day.
A former federal judge appointed to review the Justice Department's motion to dismiss criminal charges against former national security adviser Michael Flynn has found that the government's request should be denied because there is "clear evidence of a gross abuse of prosecutorial power." Former U.S. District Judge John Gleeson said in a filing Wednesday that the government "has engaged in highly irregular conduct to benefit a political ally of the President."So that's the official word, huh? AP's headline sure wants you to take that as authoritative. Here's what AP's headline fails to mention, and which the article itself waits to tell you, and then downplays: The "ex-judge" in question is John Gleeson, the judge who wrote the Washington Post editorial demanding that Flynn be jailed, and the same person that Noted Low-IQ Charity Hire Emmet Sullivan appointed as his own personal prosecutor. So it seems as if we already knew John Gleeson's unhinged, partisan opinion, right? This isn't new news. This isn't some independent judge asked by the circuit court to make some initial findings. This is the Personal Prosecutor that Sullivan has sought to hire to prosecute Flynn, using taxpayer funds for the purpose of private vengeance. Another point: Robert Barnes (of @BarnesLaw) pointed something out on Viva Frei (a Canadian law-vlogger who either leans right or leans fair, but who, being Canadian, often has to guess or surmise as regards the exact details of American legal practice). Barnes said the reason Emmet Sullivan hired a lawyer to represent him in front of the DC Court of Appeals isn't just because he's an idiot who relies entirely on the advice of his four young, inexperienced clerks, and feared being exposed as an incompetent fool in the declining years of his already-low mental acuity. Oh, that was certainly one reason, Barnes said. But there was another: Judges can't leak to the press, he said. I assume he means that judges face serious penalties for leaking to the press about a case in progress, because I'm pretty sure judges do leak. So I guess he meant: Judges can't safely leak to the press. But their personal lawyers can. Indeed, that's half the function of a lawyer in a high profile case. Barnes says that Sullivan made sure he (improperly) used taxpayer funds to rent his own mouthpiece because he wanted her to be able to leak his claims to the press. Now, John Gleeson is not the lawyer that Sullivan hired to defend him in front of the DC Circuit; John Gleeson is the partisan WaPo screed writer that Sullivan attempted to hire as his persona prosecutor for private vengeance. But I imagine the idea is the same: Sullivan can't leak his deranged view of his limitless Red Queen powers to the press, so his buddy and would-be personal vigilante does so for him. The oral arguments in this case will take place Friday. I don't know if these oral arguments will be recorded or aired live. I kind of doubt it. It took decades for the Supreme Court to allow that. it's all a farce, but there's an interesting bit - Gleeson was supposed to take months, clearly he rushed this out because he's scared of what the Appeals Court is about to do. If he had waited much longer, his approval to write anything at all on this was probably going to be taken away.

the opponents of Judge Sullivan's orders are going to be given twice as much time to argue against him as he is going to be given to defend his actions. That looks significant.
And why order oral arguments at all, which was somewhat unusual in this case? Because that's the only way that the Appeals Court Judges could directly ask Sullivan some questions of their own, questions he did not address in his brief, and clearly they want to go on record as having done that.
I think Gleeson pushed this out fast because he knows which way this is going to go.

Without checking the citations, I'm certain the cases he cited in support of the judge reviewing the basis for the dismissal are all from cases where the defendant opposed the dismissal.
Because there's direct case law contradicting him and he didn't cite to it with "but cf."
In short, he's lying to the appellate court.

Exactly. Think a slip opinion with very little meat added to it. The Appellate Courts want to maintain an illusion the judicial system is still semi-functional. Sullivan is a moronic partisan, but he's not an outlier and it is best the rubes don't realize that.

yes, and think about this - they have accepted the paradigm THREE parties in this case now; the Defense, the Prosecution, and the Judge. And the way they have scheduled these arguments now emphasizes the fact that the Defense and the Prosecution are on the same side, and the Judge is against them both!!!
even on that basis alone, once any Judge becomes an adversarial party in a case, Judicial Ethics mandates his immediate removal from that case.
Also, I think it is huge that they're going to be allowing oral arguments to be live streamed. Listeners are going to hear 15 minutes of hemming and hawing by Sullivan trying to explain why he ignored the standing precedents in this type of case (he never addressed that in his brief), and then they're going to hear 30 minutes of Sidney Powell and the Jeffrey Wall explaining why Judge Sullivan is a partisan hack who needs to be immediately removed from this case for his unethical behavior.

As I understand it...
Yes...the executive has the power to bring charges and drop them.
The judicial has the power to judge/adjudicate the cases that come before it.
But...as I see it...right or wrong...in broad strokes...
This judge is basically saying that *since Flynn has already pled guilty and I accepted his guilt...the whole thing is in my hands to simply say what his sentence is.*
Is that it in a nut-shell?
I'm not trying to litigate or understand all of the minutae of this case, or federal case law and processes and constitutional stuff.
I know that is important.
But...is the high lighted portion *generally* correct in terms of *his* position?
Right or wrong, is this a fair assessment of *his* position/view?
