New Jersey's Fascist Liberal Governor Phil Murphy: I Wasn't Thinking About the Bill of Rights When I Ordered Churchgoers to Be Arrested En Masse

Full video here. As Tucker presses him on what legal authority he has to overrule the Bill of Rights, Phil Murphy keeps saying "science."

But then, it turns out he's also unable to answer very, very basic questions about the "science" he's citing as his authority to repeal the Constitution.

He also can't explain what "science" says that it's safe for people to be in close contact in a liquor store, but not in a synogogue.

Liberal Democrats always want to appear "tough," especially because they are notoriously weak on crime and foreign policy. Given that they never crack down on crime or foreign enemies, that leaves one group left to target for "tough" handling: law-abiding American citizens and, increasingly, churchgoers.

There is no provision in the Constitution for the suspension of basic rights in an epidemic.

The police power (passing laws to secure health safety and welfare) is nigh unlimited in states and local jurisdictions. That is why we still have blue laws in some places. Under the police power, individuals can be quarantined if they pose a threat to the safety of others as evidenced through the traditional English powers exercised in events like the plague of 1665 and earlier outbreaks. They can quarantine a family who is sick. They can shut down marketplaces. They can do lots of things PROVIDED they bear a reasonable relationship to the stated goal.

There is no rational basis for half of these absurd rules going on right now. Even quarantining sick individuals power theoretically should be accompanied by notice and an opportunity for hearing under our constitutional concept of due process, but a statute can certainly convey the basic authority to quarantine.

Witless Whitmer and this asshole mayor think that they can make any rule at all and say "COVID" and make it OK.

All I can say in response is: "That's real retarded, sir."

Well see the very 1st A says we have the right to freely exercise our religion. Most sane reasonable people would conclude that means we have the right to go to a church. Now Obama seemed to think that is all it meant. Now we know the left doesn't want to allow that. So per the left, you don't have the right to practice your faith outside of church, nor do you have the right to go to church. So some of us believe this is a restriction on our God-given right that our enshrined in the BOR. Now I know it says Congress , but the 14th A said all people have the privileges and immunities of being Americans ... this means the 14th A incorporates the 1st Amendment.

All being said, it is not the BOR that gives us this protection.

Removing the 16A doesn't do anything with income taxes except make it required to have any income from property (rental income, etc) be apportioned. In other words, either drastically complicate the tax code OR remove tax from property-derived income entirely and increase the tax burden on everything else.

It is curious. Lived here since 1988 at the end of a very quiet dead end road in a very quiet town. In all those years I've seen the state police down here a combined total of 3 times, once was when they were looking for a lost child. 155 Obesity does not mean that you have diabetes. My late husband weighed 350 and was not diabetic. We would have to explain that to the doctors every damn time we went in. He had afib but did not need meds for it. He had limited mobility due to the second hip replacement, so yeah, his weight affected his hips. And they were so busy focusing on the stuff he didn't have that they missed the liver disease.

We would do a lot better if we stopped believing some of this nonsense that doctors tell us. Every time we change insurance, we have to do this fitness assessment. They always tell you to do a low salt, low fat, high carb diet. We know that's wrong and have known it for over ten years now. Yet that is still their advice. There are some areas that the medical profession does good work in and other areas where they are terrible. And this blind spot about obesity is one of the areas they are bad at. Look at the real underlying risks and stop looking at what they weigh on the scale.

The 17th's legacy is horrendous, effectively cutting off the vertical checks and balances of the federal system by depriving the states of their direct say in the federal government.

You always can ignore his orders, and that always carries the risk of being arrested, etc. This doesn't relate to oaths but to his real powers. If the fed or whatever government follows his decides you were in the right, you might get out of the klink scot-free.

I'm not super-interested in those odds myself, but I don't really participate in this ridiculous political system either.

Notable that the original Bill of Rights didn't apply to the states so originalists might be in trouble in that circumstance, if their state decided it can suspend religious gatherings for any reason at all.

Troll or not, that is a correct statement of pre-14th amendment constitutional law. States had established churches prior to the Civil War, and would not have thought twice about imposing any sort of ridiculous law on their citizens (and did so!). States were thought to be mini-national entities, and the vaunted "Bill of Rights" was considered by many anti-Federalists (nowadays extremely limited govt conservatives) to be an unnecessary spelling out and limitation of our God-given rights.

I've read so many stories of Senators receiving instructions to vote a certain way and disagreeing. It would play out one of a few ways. Either the senator would comply and keep quiet, or the senator would resign, or the senator would do what they wanted and the state legislature would recall them and replace them.

Since absolutely none of the latter two happens now, I attribute that largely to the 17th Amendment.

First, that's 3% of those known to have the virus, and we know at least as many get it and are never symptomatic enough to show up. So halve that number, and that's your absolute ceiling.

Also, that's assuming everyone is going to get the virus, which they're not. So cut that number way down again.

And then factor in that the mortality rate can be mitigated even further with Vitamin C and D to boost the immune system, and then if you still get it, take HCQ and other drugs which will usually knock it out.

All of which is to say, shut up.

I don't know when NJ will stop electing rich Goldman Sachs alumni.

Murphy was essentially a back-slapping sales guy who became significantly rich and then carpet-bombed the state with ads for over a year before the Dem primary.

He's not very bright. A lot of the bigger decisions and deals seem to be made by Senate President Sweeney and I don't really know what Murphy does all day besides really cling to lefty goals like $15 an hour. (My teenage daughter's friends with jobs ALL work under the table - nice lesson to learn.)

So of course he will probably be re-elected if he doesn't stand down due to his kidney cancer.

The sad thing is NJ has a lot of blue believers. My neighbors on both sides are huuuuge leftists. We left our church after the umpteenth sermon espousing gun control. (True story - our pastor was on the side of the Baltimore rioters). To me, keeping people out of there is not a disservice.

I am so done and with Murphy's move to vote by mail (once you go absentee you are vote by mail for life unless you go through a process with your county clerk, which I did because it pissed me off so much) Dems will rule until the state is a bloated carcass in front of Pennsylvania.

Exactly. 3% of those sick enough to get tested and show as positive die. Not everyone is tested, and extrapolating from incomplete datasets is not a sound basis for public policy.

Potential problem I see with masks is it might give false sense of protection to the people the high risk factors who really should continue to self isolate. But, I still agree that the benefit as a "crutch" to get back to normal is worth it.

60,000 deaths = 164 per day / 5,000 per month
20 million infections = ~55,000 per day / 1.6 milllion per month
800,000 hospitalizations = 2,200 per day / 66k per month

Imagine if the media were reporting that data of infections and hospitalizations and deaths due to seasonal flu as breathlessly and hysterically as they are doing with COVID-19. Would it be any different than what they are doing now?

Nope.

But what about the drastic measures being taken by China with their people? Well, they have a protest to put down, right? So they use the excuse of the virus and take all the extreme actions they want. Just like our totalitarian Governors are doing here with banning anything and everything they feel like. Only with China, they go to extremes and just kill people who aren't following the rules.

Then you had Event 201 that war-gamed a pandemic. And within a month, a virus is released to start a pandemic.

And we have social media being used to either ban or correct "false information"... just as suggested in the Event 201 war-gaming.

And then there's Bill Gates who is against herd immunity and wants massive testing and vaccinations... who just happens to be in the business of tests and vaccinations.

And then there's Birx and Fauci connected to the Deep State.

And China and Gates control the WHO.

And Birx's relative who is involved with the Gates Foundation.

Yeah, maybe the last 5 weeks of working from home and dealing with Half-Whitmer and her army of Karens is heating me up and afixing the tinfoil a bit tighter to my head --- (I can see you all looking at me like Mel Gibson looking at his kids in Signs when they were wearing the tinfoil looking at the aliens book) --- but...

Science is the application of the scientific method to acquire new knowledge, the testing of hypotheses by recourse to experimental observations as opposed to received truth or tortured "reasoning."

Farting around with retorts to transmute metals was not science. Alchemy etc. produced precious little new knowledge apart from strictly serendipitous discoveries.

I spent my life at hospitals and there are way more people around 9-5 than the rest of the day. Attendings go home, and the floors are crawling with administrators, social workers and misc clerical people (billing, supply, laundy)

There is no law that says attendings must blow outta there by 5 ish and social workers and billing people could enter data at any time of day. One of the best surgeons I know used to book ORs exclusively after 6p. There was no pressure on space and the evening and night staffs were less stressed by the numbers of people arriving post-op to the units. And who would not rather have an attending or two around at 10p rather than a resident?

A lot of the nursing and assistants work 12h days and only three days a week. While you always need an adequate number of these, you could "distance" better if the other shifts (even if this was in ad administrative building) were utilized by non healthcare regulars. Computers still work after 5p

Trying to explain this to my buddy in CT who is a Trump hater and a democrat.

He either refuses to think anything bad is going to happen to the small business people or his Trump hatred blinds him to what is happening, I am not sure which it is.


Gave him the example of the tire store owned by one guy who has 2 other guys working for him.

Nobody is buying tires right now the only thing his shop is doing is flat repairs. He doesn't make enough to keep three people working with that so he let's his two guys go and is going it alone.

He still is not making enough money to pay his bills. Mortgage, Insurance and utilities still have to be paid and now he is dipping into his savings to pay them. Eventually he will go bankrupt if this lasts much longer than the next few weeks.


My buddy says he will be OK because the government will loan him money to stay afloat. I say fine, but he has to repay that money on top of his current bills and he was just getting by and able to put a little away every month, he really can't afford a loan payment, plus it's going to take a long time for his business to get back to where it was.

OK, Galileo remains the outlier, always. The "scientific method" would probably be a better parameter for debate than "science", since observational theories (as opposed to experimental attempts), since we had Archimedes and Pythagoras in ancient times, too.

Since we are just fucking around here, it's not like there's any real clear line but certainly the late 1700s saw a change in quality as to what constituted "science." Even so, there remained serious resistance to the new methods until the late 19th century.

Our notion of what constitutes valid science has always puzzled me, especially now with the widespread adoption of "modeling" as a substitute for hard, reproduceable experimentation.
