To be fair, that's not exactly what she said. The quote was "well if a Judge said that, that Judge would have to recuse himself".
Yes, because in a Criminal Trial, the law is supposed to be impartial. but this is NOT a Criminal Trial, this is a Political Trial - even the Dems themselves have said that. And it is being held in a Political Court - so by this standard *Every* Senator would have to recuse themselves.
And also - the Senate sets its *own* rules for Impeachment, not even the SCOTUS can dictate what those rules will be. That includes recusal.

The Rules are whatever McConnell and his majority say they are. The Senate passes specific rules for each impeachment, there are no standing rules. McConnell has suggested that the 1998 rules be re-adopted, and he has a very good case.
"Recusal" is a made up thing that never applies to any Senator.

I mean, the trial they *want* is likely to go disastrously wrong for them, assuming Trump and Mitch play hardball.
Their best outcome is to refer it to the senate for a quick dismissal, which is exactly what Mitch is offering.

Jake Tapper last night was going on about how Trump will be forever stained by this, he is now part of history as one of the few impeached presidents, how years from now it is likely the only thing people will remember about him blah blah blah.

There hasn't been a trial to declare about. There was simply an indictment: a process to determine whether or not a trial ought to take place. As the old saying goes, you can indict a ham sandwich, the standards are pretty low for the process.
The Senate holds the trials. It doesn't really even matter what the House does at this point, because they're out of the system now. They did their thing and are done now. In the past, the two bodies have worked together to set things up, but that is merely courtesy and tradition.
The US Constitution says very little about the mechanics of the trial and impeachment system other than the basics. The two legislative bodies create rules to handle the nitty gritty of it all. Those rules can be changed at will.
Once an indictment has been handed down, its up to the court whether or not a trial even takes place, they aren't compelled to take the recommendation. If they say they aren't going to try anything, its perfectly constitutional.
This is literally all the US Constitution says on the subject:
Article I, Section 2, Clause 5 provides:
The House of Representatives ... shall have the sole Power of Impeachment.
Article I, Section 3, Clauses 6 and 7 provide:
The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two-thirds of the Members present.
Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States; but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.
Article II, Section 2 provides:
[The President] ... shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.
Article II, Section 4 provides:
The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

My issue is even if the ham sandwich gets indicted, there is an actual criminal statute that was violated contained within the indictment. In this case no crime is contained in the articles of impeachment which is unprecedented.
In all other impeachment proceedings there was an actual criminal code violation. Even the one they were working on for Nixon had laws that they said he violated.

Whensoever the Senate shall receive notice from the House of Representatives that managers are appointed on their part to conduct an impeachment against any person and are directed to carry articles of impeachment to the Senate, the Secretary of the Senate shall immediately inform the House of Representatives that the Senate is ready to receive the managers for the purpose of exhibiting such articles of impeachment, agreeably to such notice.
It is under this rule of the Senate that Tribe and Lawfareblog and then Pelosi got the idea that they could delay transmission - because these Senate rules say that it doesn't start until they receive notice from the House.
But this rule can and likely will be changed. Likely the rest of the rules (which were updated for the Clinton impeachment) will stand as is.

Only for judges. For the president it has to be specific illegal acts. Breaking actual written laws. Judges are given a tenure that only extends as long as they engage in "good behavior" which means that they can be removed for lacking that. The president can only be impeached for specific illegal acts.
This is probably because people can vote a president out of office in 4 years at most, and federal judges are completely out of the hands of the voters save through representatives.

The original is so sweet and earnest - trailer park community with super nice guy who helps all the other residents, has the sweet as apple pie girlfriend, no one is cynical or sassy (OK, the little brother is age-appropriate in his sass), classic good vs bad, higher calling vs. insecurity, etc.. No way they would not tweak it so that the kid is a victim of some sort of oppression (he's a DREAMER, his mom is broke because big business cut her job), the girlfriend would be just as talented, maybe even smarter than him, and on and on.

First - investigate how? After this, there's no need for any witnesses to show up. What will Congress do - impeach on the same thing again?
Second - once the first one is dismissed, it will be quite easy to dismiss any others by a simple voice vote, in a day.

Nixon sued during his impeachment and it went all the way to the SC. They ruled that the Senate is the sole authority over the trial and the SC would stay out of all impeachment and not interfere unless the articles being considered were simply "the President is a bad man".

That's it.
And even by that definition, in no remotest sense does this mean "good behavior" or "was a bad orange man."

You can't have a criminal trial without a violation of an actual criminal statute. That is the argument that mcconnel is trying to make I think.
If this does go to a trial, Trump will have all of the rights a normal defendant enjoys in any criminal proceedings. He can call witnesses, demand to face his accusers (whoever they might be) and his number one right is to be told what actual criminal statute he violated. In this case, the House articulated no actual defined in Federal law crime.
That's why I don't think this will go to trial. I could be wrong, heck I was wrong on the dems voting for impeachment. I thought for sure pelosi would walk back from that cliff but she pulled a swan dive off of it.

It is a LAW. Its been litigated a bunch of times.
So they impeached him for acts which WOULD fall under an actual statute, but created a non defined 'crime'.

According to a Supreme Court decision and opinion written for the Nixon impeachment, yes. The SC indicated they might step in if the Senate rubber-stamped Articles that just said the President is "a bad guy". That quote is in the opinion.

Well, if the charge is serious enough...
The seriousness of the charge, not any evidence, means you must be investigated.
A serious investigation is required so you can prove your innocence.
If you decline to admit your guilt then in order to preserve the Constitution, it is worth millions of taxpayer dollars to conduct a thorough investigation paying high priced lawyers on an hourly basis.
For the greater good of the country, evidence presented against you may be falsified or simply made up.
Exculpatory information need not be disclosed as it is irrelevant due to the seriousness of the charges.

Obstruction of Congress.
Yet, the remedy for such is not Impeachment, but an Congressional Over-ride of the Veto, by the vote of a 2/3 majority by each Chamber of Congress.
Now, Pelosi's "Article of Impeachment" is that Trump "Obstructed Congress" by refusing to allow Executive Employees to testify before her dog & pony circus show(s).
She had two avenues to seek leverage to force those testimonies.
a. Author Legislation requiring the President to cooperate, and have it pass both the House and Senate. Trump would of course veto it, and then she has the option of securing an Override of said veto, forcing the Legislation into law.
b. Sue the President before the Supreme Court, in an effort to force the President to cooperate with her sham-show. Which suit, would be EXACTLY the reciprocal of what she filed Impeachment for, in that Trump went to the Supreme Court to thwart HER efforts, in the first damn place.
Thus, this Impeachment is specifically UN-Constitutional, and should be declared as such the instant it is delivered to the Senate.
