Yes, because in a Criminal Trial, the law is supposed to be impartial. but this is NOT a Criminal Trial, this is a Political Trial - even the Dems themselves have said that. And it is being held in a Political Court - so by this standard *Every* Senator would have to recuse themselves. And also - the Senate sets its *own* rules for Impeachment, not even the SCOTUS can dictate what those rules will be. That includes recusal. There hasn't been a trial to declare about. There was simply an indictment: a process to determine whether or not a trial ought to take place. As the old saying goes, you can indict a ham sandwich, the standards are pretty low for the process. The Senate holds the trials. It doesn't really even matter what the House does at this point, because they're out of the system now. They did their thing and are done now. In the past, the two bodies have worked together to set things up, but that is merely courtesy and tradition. The US Constitution says very little about the mechanics of the trial and impeachment system other than the basics. The two legislative bodies create rules to handle the nitty gritty of it all. Those rules can be changed at will. Once an indictment has been handed down, its up to the court whether or not a trial even takes place, they aren't compelled to take the recommendation. If they say they aren't going to try anything, its perfectly constitutional. This is literally all the US Constitution says on the subject: Article I, Section 2, Clause 5 provides: The House of Representatives ... shall have the sole Power of Impeachment. Article I, Section 3, Clauses 6 and 7 provide: The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two-thirds of the Members present. Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States; but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law. Article II, Section 2 provides: [The President] ... shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment. Article II, Section 4 provides: The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors. The Senate rules on impeachment AS CURRENTLY WRITTEN are pretty detailed and the first paragraph says:
Whensoever the Senate shall receive notice from the House of Representatives that managers are appointed on their part to conduct an impeachment against any person and are directed to carry articles of impeachment to the Senate, the Secretary of the Senate shall immediately inform the House of Representatives that the Senate is ready to receive the managers for the purpose of exhibiting such articles of impeachment, agreeably to such notice. It is under this rule of the Senate that Tribe and Lawfareblog and then Pelosi got the idea that they could delay transmission - because these Senate rules say that it doesn't start until they receive notice from the House. Only for judges. For the president it has to be specific illegal acts. Breaking actual written laws. Judges are given a tenure that only extends as long as they engage in "good behavior" which means that they can be removed for lacking that. The president can only be impeached for specific illegal acts. This is probably because people can vote a president out of office in 4 years at most, and federal judges are completely out of the hands of the voters save through representatives. Anyway, Nancy holds onto the bill of impeachment and claims that she isn't satisfied with the Senate's preparations for trial. She holds onto it until Election Day, in fact, and hopes for a Democrat takeover of the Senate. Failing that, she can claim that the Senate is essentially locked down because the President is illegitimate. So nothing moves through the House and goes up to the Senate, and Trump is frozen out of legislative accomplishments until 2022, when she can hope again for a Dem takeover of the Senate. It's basically a way of holding the legislative process hostage. If this does go to a trial, Trump will have all of the rights a normal defendant enjoys in any criminal proceedings. A Presidential Veto of a particular piece of Legislation, is by any sense of logic:
Obstruction of Congress. Yet, the remedy for such is not Impeachment, but an Congressional Over-ride of the Veto, by the vote of a 2/3 majority by each Chamber of Congress. Now, Pelosi's "Article of Impeachment" is that Trump "Obstructed Congress" by refusing to allow Executive Employees to testify before her dog & pony circus show(s). She had two avenues to seek leverage to force those testimonies. a. Author Legislation requiring the President to cooperate, and have it pass both the House and Senate. Trump would of course veto it, and then she has the option of securing an Override of said veto, forcing the Legislation into law. b. Sue the President before the Supreme Court, in an effort to force the President to cooperate with her sham-show. Which suit, would be EXACTLY the reciprocal of what she filed Impeachment for, in that Trump went to the Supreme Court to thwart HER efforts, in the first damn place. Thus, this Impeachment is specifically UN-Constitutional, and should be declared as such the instant it is delivered to the Senate.
