Hostess Bakers Union: We Reject Your Latest Offer. Hostess Final Offer: Then We're Closing Up And You'll Get Nothing. Bakers Union: Good! Wait, What?

18,500 people are going to lose their jobs because one union decided that they thought it was possible to get blood from a stone.

"We deeply regret the necessity of today's decision, but we do not have the financial resources to weather an extended nationwide strike," said CEO Gregory Rayburn in a statement.

Hostess will move to sell its assets to the highest bidder. That could mean new life for some of its most popular products, which could be scooped up at auction and attached to products from other companies.

A letter that Hostess sent to its network of stores that carry its product said it expects "there will be great interest in our brands." But it said it could not give a time frame for when the sales would take place and its products would be available again.

But even if those brands are bought and restarted, the Hostess workers will not get their jobs back.

"The industry has overcapacity. We're overcapacity. Our rivals are overcapacity," said Rayburn in an interview on CNBC. Asked if the shutdown decision could be reversed if the Bakers' union agreed to immediately return to work, he responded, "Too late."

If feel bad for the workers who weren't part of the idiotic bakers union but have zero sympathy for the idiots who were. Hostess was already in bankruptcy, they were out of money, broke, finished. They had a plan to try and claw their way back and the bakers said, "no".

What was Hostess offering?

The concessions, which affect both the bakery union and Teamsters, call for cuts in wages and benefits of 27 percent to 32 percent over the five-year contract, with an immediate wage cut of 8 percent, the bakery union said. The company stopped contributing to workers' pensions last year.

The bakery union represents about 5,680 Hostess workers, about 30 percent of Hostess' total work force.

Pretty steep cuts but still 68% to 73% > 0%.

Union idiots are free to choose this course of action but they are also going to have to live with the consequences of that choice. The important thing is that these people get no public assistance benefits whatsoever. In this economy there is no reason that people struggling to get by should subsidize people who throw away jobs.

People voted for irresponsibility, now they must get it. No soft landings, no pity. It's time for harsh lessons to be learned.

It will all depend on how both sides present their cases and and how pro-union the hearing judge is.

There's a cumulative effect fromthis type of massive 'layoff' and/or bankruptcy, too. Many of the workers in related companies and jobs around nation the will be out of work or have their hours cut, as a result, Plus, if those workers in related businesses aren't employed, they won't be buying stuff from *other* companies and businesses, who will then be forced to cut their own workforce in order to stay competitive, and so on...
Add situations like this to the massive layoffs which are already beginning as a result of Obamacare...

43 Whenever management votes themselves pay raises or bonuses in times of dire economic circumstances, I can see how such moves raise eyebrows. I remember a while back that Delta's board voted to give themselves bonuses whilst having to lay off several thousand employees to stave off bankruptcy.

And this is sort of the gray area of the free market. If management does this, then yes it is irresponsible considering the impact on the company and the employees. BUT... ultimately, it's the management (as represented by the people who own majority of stock in the company, i.e. the board) that actually OWNS the company and are beholden to no one but themselves on a purely legal level.

They are free to do with the company as they will - run it effectively to make a profit or make mistakes and run it into the ground. What is debatable is the morality/ethics of the issue. Something that liberals seek to regulate and control.

I do not know enough about Hostess and it's management/operations to comment on the actions of the directors. But for a union to decide to kill the company as opposed to taking pay cuts - drastic as they might have been - is completely irresponsible and IMMORAL.

FUCK LIBERALISM. IT KILLS EVERYTHING IT TOUCHES.

Not going to happen. The problem in a nutshell is this: when the delta between working and not working get's small enough, a lot more people choose not working, and some people, like these idiot baker's union members, probably don't have much to lose. Take unemployment, take food stamps, fake up some disability, and voila! You can trade jobs for funemployment.

98 Copied and pasted

I am sure this has already been brought up, but I didn't feel like scrolling the entire thread.

I am so sick and tired of people bashing Romney and bashing the GOP message. And sick of the GOP grasping for straws at how they are losing voters. And Susana Martinez whom I like very much, talks about sitting down with voters and asking them "what they want" and how can we earn their vote. Susana, they want free abortions, free birth control, food stamps, $60k jobs straight out of college. We KNOW what they want. Here's the ish. There is nothing we can do about it.

This was just reiterated to me this morning, while reading about Hostess going under. This company is struggling to get by, but is still able to employ 18,000 people. But, the unions have to be greedy and selfish, and it destroys the company. Is this economy, is now, really the time to be making demands and being unreasonable? These unions are more worried about squeezing every last dime out of the Man, than they are about saving jobs and saving an American company. Pathetic.

Let it burn.

176 Seriously, though, did the workers not bother to think that all the way through?

They didn't just ruin 13000 other lives, they did far worse than that.

Full liquidation means also discharging any current and future obligations. So all those retirees who were drawing pensions? Yeah, they don't get pensions anymore. Retiree health benefits? Gone. COBRA insurance? Doesn't apply to companies that liquidate through bankruptcy. Unemployment? Likewise.

Full liquidation SUCKS for all current and prior employees.

And that doesn't even get into the ancillary losses- how many tons of flour and sugar does Hostess use in a day? How many gallons of gasoline did their trucks use on their deliveries?

186 By the way surfer, I don't care if Romney was Republican, a RINO, dull, a Democrat, a DINO, or Barney the Purple Dinosaur. He could have been the biggest yawner to hit the campaign trail in history. Don't care.

He was uniquely qualified (amongst those who ran and especially between the top two) to help our country economically and financially.

If we have to run the Homecoming King with a C+average over the nerd with an A average to win an election, welp, our country is down the toilet already.

Turns the company around, thousands of people gets jobs, the company is booming again.

Then in 2 and a half years, Romney is publicly acknowledged as the turnaround genius who saved Hostess. Romney stands in front of some podium somewhere, flips America the double bird, with a big EFF YOU.

>>The important thing is that these people get no public assistance

struggling to get by should subsidize people who throw away jobs.

In principle, this would be nice, but in practice, no.

You can debate whether or not there should be such a thing as public assistance at all, or what form it should take, but if it does exist, I don't think it should be predicated on (debatable) good intentions by collective bargainers.

The point of this sort of assistance is to protect those who can't really look out for themselves (eg families of unemployed workers, etc). The fact that a substantial proportion of those who get public assistance don't truly deserve it (or in some cases even need it) is secondary.

Slightly off topic, but I want to start the "Give 'em what they voted for good and Hard" movement. I see alot of folks on this board screaming for the R's to not allow a tax raise, any raise as it will hurt the economy. Well, we are headed for recession-depression regardless. So, let it burn. The R's should set the line at $500,000 to protect the middle class and small business and let Obama tax the shit out of da rich. Da rich voted for him, just web search "8 of 10 wealthiest counties in America vote for Obama", so give em what they want, raise their taxes and eliminate all their deductions. Then, when the economy tanks anyway, stand up loud and proud and scream "We gave Obama what he wanted!". Let the media try and spin that.

1) The company offered a 25% stake + 2 spots on the board of directors as concessions for the pay/pension/health cuts.

2) The teamsters union accepted the offer, so even they saw the writing on the wall.

Different skill sets are needed during different times over the course of our nation's history. During the 60s, we needed a visionary; In 1980, we needed a powerful, magnanimous leader; in this period, we don't need an inspirational leader, we NEED a tactician. You can have the most inspiring leader and eloquent speaker in the world, and unless he can help the country get out of its fiscal hole, he's worthless.

As I said before, if you are content running a candidate who is mediocre with the financial skills that are needed right now, so that we can appeal to the American Idol mindset, well you are too far gone to reason with.

Bad night, just woke up, but I do have something to add.

This has been going on for a couple of years. Hostess had its first problem a few years ago when it revamped its snack foods to be healthier. It bought a whole new production line to make the healthier snacks but they apparently tasted like shit because they didn't sell. Plus, there were the usual problems with getting a brand new line up and running efficiently. That put Hostess behind the eight ball about two years ago.

Management tried to work out the production problems and return to its core products in response. An article I read about six months ago said production was up and their core products were selling well. Hostess had a chance at making a comeback after their triage.

Then the unions decided they wanted what they wanted more than their jobs. And the rest, as they say, is history.

285 Why are they griping about management? Of course management is selfish. That is why they join a union and pay good money to union officials to negotiate on their behalf.

Lesson: If you are going to hire someone to negotiate for you, 1) Ensure they are somewhat competent 2) Ensure they have YOUR best interests in mind 3) Have a backup plan, because you are probably wrong about 1) and 2)

I am relatively pro-union -- at least in relation to most posters here. I think they have a place, and sometimes it is a good idea to join (Skilled, licensed Worker unions like electricians, pipefitters, and so on). That said, I have structured my career so that a) I do not have to work in a union b) My job depends as little on union coworkers as possible.

I have found no one who negotiates on behalf of my labor better than I do myself.

General rule of thumb: If your negotiator is negotiating on the behalf of a group that is larger than you, it is unlikely that they are negotiating in YOUR best interests. Unless you are a hot chick.

TEAMSTERS: BAKERY WORKERS SHOULD HOLD SECRET BALLOT VOTE AT HOSTESS

As is our longstanding tradition, Teamster members by and large are honoring Bakery Worker picket lines when encountered and complying with their contractual obligations when not encountering picket lines. The BCTGM leaders are putting Teamster members in a horrible position – asking them to support a strike that will put them out of a job when they haven’t even asked all their members to go on strike.

That strike is now on the verge of forcing the company to liquidate – it is difficult for Teamster members to believe that is what the BCTGM Hostess members ultimately wanted to accomplish when they went out on strike.

We may never know unless the BCTGM members, based on the facts they know today, get to determine their fate in a secret ballot vote. Teamster members would understand that the will of the BCTGM Hostess membership was truly heard if that was the case.

But it only cut them down to the level that non-union members were at. The unions have inflated their compensation packages above and beyond "THE MARKET", when "THE MARKET" dictates that they come back into line, it is decried as a cut.

did the union think they were going to get better wages from a Mexican or Chinese owner? Because thats the only buyers, the truly ironic facet of these types of fights is that everyone wants to throw the patriot card of Keep American jobs, American made, you cant hurt American workers blah blah blah, and it all boils down to bankruptcy and selling the defunct assets for pennies on the dollar to Mexican or Chinese buyers.

The pay cuts sound drastic, but I'm guessing the bakers were dramatically overpaid given the excess capacity and lack of demand in the marketplace now for bakers.

It's hard to accept that your occupation just isn't worth as much as it used to be, but that appears to be the case here. Unions cannot repeal the law of supply and demand, and if they insist on above-market wages they will end up losing everything.

338 333, The teamsters did not honor the bakers' strike, they kept delivering the product. That is very rare for the teamsters and indicates the bakers were over reaching.

If Hostess fired them and hired scabs, the teamsters would not have delivered the product.

There is more going on here to boot, this is a showdown, but I dont have enough info to make an accurate analysis. Hostess is privately owned, the bakers thought they had a buyer but the deal required a better union agreement, so they thought hostess was bluffing, Hostess will sell the brands, the shelf space alone that they own is worth a fortune, but keeping that shelf space requires product be on the shelf, for them to shut down operations means they have several months product in stock to ship to stores, or they are well and truly going nuclear on the union in a mutually assured destruction move.

Hostess/International Bakeries has gone through bankruptcy reorganizaton twice in the last dozen years. The company grew in the 70's and 80's through buying up a bunch of regional bakery companies--each of which had its own labyrinth of union contracts and work rules. I think that at the peak Hostess had more than 300 different union contracts with four or five hundred sets of work rules. The company would go into bankruptcy and be bought out of bankruptcy by some investing group.

But they never could shed all their union contracts and work rules. And now the industry is faced with overcapacity. Hostess is a high cost producer. Maybe Hostess could have staggered on a little longer with the union labor concessions they sought--maybe not. And of course Queen Moochelle was on a rampage against junk food--and what's more of a junk food than a Twinkie?
This time Hostess will go for straight liquidation. Shut the plants, sell off the pieces, void the labor contracts--and the pension obligations. Every job will be lost--union and white collar management.
Somebody will buy the brands--Wonder Bread, Twinkies, Hostess cupcakes and all that. The product will be produced in other plants--by other workers. The Hostess labor unions have diddled themselves to an extent--maybe some of their members will get jobs back in a former Hostess bakery plant--but they sure as hell won't get the same pay, and they won't be part of a union.

354 This whole thing is not rocket science, it is basic accounting or algebra. Profit = Sales - Costs, when Costs get too high, there are no Unicorn Farts in that equation to somehow make the Union part of Labor Costs work out. I always find it interesting to hear some high schooler whine about algebra and how they will never ever need it or use it once their class is done. When you try to explain to them that certain algebraic equations rule life as we know it, they just can't see it. Sadly, people who do not understand that there are no Unicorn Farts or Pixie Sprinkles in any of life's equations vote.

356 Idea for a small business: Make high-quality twinkie-like cakes.

In Austin, there is already a trailer-based outlet that sells high-end cupcakes (called "Hey Cupcake!")

With the attention being focused on Hostess, it would be a good time for a business to sell filled cupcakes in the oblong twinkie shape.

Also high-quality analogues of the other hostess products.

Start local, then expand.

359 So if the median baker's salary is about $11/hour and your asking them to issue a cut of 30%+, essentially driving down a low wage below a living wage ($7), how is this sustainable for any working individual with a family and mortgage today, or even a apartment and family?

Also, how is the mismanagement of a brand essentially to placed entirely on the fault of the workers? Marketing planning, distribution contracts and other top down activities should have been incorporated by management, especially if you are paying a group of six figured salaries to MBA educated professionals who are tasked with running a business to profit by means of management and strategy for growth not simply reducing operational expense and basically padding your margins.

In the area of pension, why can't the Union simply forgo this and seek out 401k packages for their workforce like the rest of us? Why is it one way or the other and we couldn't have put together a more creative package?

Lastly, I feel for the families in this unfortunate result and yes no one at the top will be suffering nearly as bad, regardless of which party or economic philosophy you support, as the lower economic bracket here. The truth is a majority will suffer from the incompetence of BOTH management/ownership and the Bakers Union.

Someone else will buy this brand and you'll see this repeated all over again unfortunately.

Posted by: Charles at November 16, 2012 01:13 PM (CWmEB)

360 I don't know, seems like a pretty smart move on the union's part. If you're making $12/hour (the low end of the scale that gets quoted for Hostess' bakers), a 27% cut means $8.76/hour - and you know you're stuck there for at least 5 years. At the higher end ($15/hour), you're looking at $10.95/hour. Extended to yearly gross, assuming 40 hr workweeks 50 weeks out of the year, we're talking what used to be $24,000 - $30,000 becoming $17,500 - $21,900. Minimum wage already gives you $14,500, and a quick check of job ads online suggests the going rate for an experience baker, nationally, is somewhere around $13.50/hr. Also, shift managers at McDonald's average $9.70/hr, and stock clerks at Target average $9.88/hr, so just being familiar with the concept of work and able to pass a drug test would gross a better income than many of Hostess' bakers were looking at. I know I, at least, would seriously protest losing over $6,000/year, -especially- if I knew the worst they could do was fire me, and that I could make at least $2,000 more at the first unskilled job I came across.

How many of you would want to, knowing your job was probably going away anyway? Congratulations to those who judge without putting yourselves in those shoes for at least a minute. It's okay to force workers to take lower wages, but not for workers to refuse. Extortion works both ways. When workers are extorted, every working person loses, as it drives down the prevailing wage. Ultimately, that will be your wages. You all need to stop listening to Fox and take up arms against the real enemy - globalization. It's ruining every industrialized nation. Workers in China make about 10% of what we do. In Vietnam, they make 3%. Who here is willing to compete with that? Morons. Absolute ignorant morons.
