Clinton-Appointed Judge in Flynn Sentencing Hearing Accuses Him of Treason, Suggests He'll Sentence Him Beyond What the Plea Deal Calls for

#TheResistance has a new hero.

The Clinton-appointed judge, Emmett Sullivan, claimed that Flynn's suggestion that the FBI misled him (which it, you know, did) cast doubt on Flynn's acceptance of culpability. The not-so-veiled threat from the judge is that if Flynn wouldn't repudiate his previous complaints about the FBI, he'd toss out the plea deal and sentence Flynn more harshly than the plea called for.

He also badgered both Flynn and the prosecutor about whether Flynn had committed "treason."

Though then, after he returned from a break, this Clinton appointee said he wanted to "clarify" that his own previous claim that Flynn was working in the White House when his contacts with foreigners occurred. I guess he bothered to read the actual facts and corrected himself -- well, "clarified" -- that Flynn wasn't in the White House and that he was now not "suggesting" treason.

Which is actually exactly what he did before.

Basically the judge seems to be threatening Flynn with jail time unless he offers more to the Mueller investigation. Flynn has gotten that message, and now says he wants to delay sentencing because he might cooperate more with Mueller.

The court has delayed sentencing to permit this. So, no sentencing today. After threatening Flynn for an hour, Flynn got the message and said he would cooperate more.

It's an odd trial, but when half the evidence is under seal, it's really impossible to know what the deal is.

16 In defense of this judge, he was practically begging Flynn to withdraw the plea, and I think based on that he might have even thrown the whole thing out. Flynn is either hiding something else or was just laying down like a tired, wounded dog until the judge insinuated he would do hard time if he didn't at least agree to delay sentencing.

What I don't understand, and would fault the judge on (unless his hands are tied) is ... why does he have to play along with this fucking charade? Why not vacate the plea irrespective of whether Flynn agrees to or not given that he all but stated he knew there was serious proprietorial misconduct? Throw the damn plea and indictment out, with prejudice, hold the prosecution in contempt, and let them know that if they go after Flynn again further contempt charges will follow.

I think the treason comment was aimed squarely at the prosecution. And by retracting it, as Jackal claimed, he got the prosecution to back off too. So if it wasn't treason, was it really that bad.

Sullivan gave Flynn every opportunity to retract his plea. And he still has time. Flynn has agency.

But if Flynn stays the course, Sullivan will throw the book at him. How cooperative he will be following that will remain to be seen. That could be a wild card Mueuller wants to avoid.

But that's the thing. Why does a judge need to get -more- evidence than the prosecution freely offers? Particularly if the prosecution has a plea deal and is recommending a light sentence?

You can call it a good cop/ bad judge, but if that was true Sullivan wouldn't be bringing up things that tend to damage the prosecution. It's at least as likely that Sullivan is fed up to the gills, and will punish Flynn for his role in this kabuki.

Judges told him there was not enough for treason. Sullivan will hold them to that now. So he backed off, because he didn't want that sting to linger.

85 I used to work for a judge as a clerk and pleas were taken according to form. The defendant had to admit to each element of the crime under oath and the prosecution had to provide the facts for each element that the defendant was pleading guilty to.

If the judge is not certain what crime the defendant is pleading to that is on the prosecution for not making that perfectly clear in the presentencing report. If the defendant is pleading yet proclaiming innocence regarding one of the elements, then again everything gets stopped to be sorted out. Ultimately, if it turned into a Charlie Foxtrot it was the fault of the prosecution for not getting everything lined up before hand.

That's the thing. I don't think the judge is any more pleased with Flynn than with the prosecution. He sees a defense case that implies the government set Flynn up, but is pleading guilty in the face of exculpatory evidence. Then severely criticizes Flynn, only to walk it back after a meeting with the prosecutors.

Is it just opposite day around here? Forget Sullivan's political leanings, I'm wondering if he's as confused as I am.

Flynn was pleading guilty to all kinds of serious shit (to make Trump look bad ), but, in cooperation with the Mueller, the prosecution agreed to let him off easy.

Flynn has been counseled by his lawyers for months to accept the deal the FBI offered that had zero prison time with it and potentially the opportunity of having the charges dismissed and he walked into the Twilight Zone today in front of a federal judge who is threatening jail and mentioning treason.

I think he did the right thing and ask for delay and regroup. The ground shifted under everyone right in the middle of the sentencing phase and I would want to take some time and think things over myself if I was him.

I would agree if the judge hadn't been so adamant in his goading Flynn to drop the plea, particularly after the pre-sentencing memo that Flynn's team submitted. The underlying message of that was "I was set up and they committed serious misconduct in prosecuting me." Why submit that if you are just going to roll over.

I think the judge was pointing out the absurdity of the circumstances; that according to the special counsel he lied to FBI agents, lied about being misled, worked as a foreign agent, and may have committed treason and Logan Act violations...

...but because he plead guilty to lying and the Special Counsel recommended no time, he should serve no time while he testifies against others for crimes he's theoretically implicated in.

The judge is saying that he can't get off easy (specifically references Petraeus) by cooperating, either he's a criminal who deserves jail time or he's been railroaded.

It won't be going in earnest by any means, but the players will be starting to emerge. Whatever happens then (and G-d forbid another delay), it will be during a time with implications to some degree for 2020.

If this judge is indeed on the deep state side of the house, this might be a factor. I see this (not a lawyer, not even a good amateur legal mind) as more ambiguous than "the judge is a bad guy" but the timing is potentially a cause for nervousness.

From what I recall at the time Flynn was first fired, he was fired because he 'lied' to Pence. At the time I recall things were rather 'fluid' in the WH and other executive agencies: how far to push any narrative either for or against PDJT's election. And I don't understand why it was so egregious that Flynn's lawyers pointed out the malfeasance in the initial interviews. If the judge think thats irrelevant, he could ignore it. It almost sounds like he was trying to punish Flynn for his lawyers raising those facts.

Exactly. Flynn had the grenade that would have blown the whole "muh Russia" investigation to kingdom come. The judge indicated he was quite willing to pull the pin. And Flynn refused to hand him the grenade.

I no longer feel any sympathy for him being on Mueller's leash. When you have the judge on your side and begging you to drop the plea because he knows you were set up, you take it. You don't fucking insult the judge by insisting on continuing the charade, especially after you submit a sentencing memo that laid out why it was a setup in the first place. This isn't really new. The decision is recent, but the doctrine espoused isn't. It's based off of a US Supreme Court decision from several years back that ruled that the police are not required to keep innocent civilians alive and/or unharmed.

While I don't like the implications of this, I suspect that the reason for it is pretty straightforward. Otherwise the cops could be sued for all sorts of stuff that happened that was arguably not under their control, such as a hostage negotiation that went bad.

The big problem with this isn't the LEOs, it's the school. Public education is largely mandatory, and the schools are serving in loco parentis. They very emphatically have a duty to protect their students; to argue otherwise is batshit crazy.
With this decision they're telling anyone that can't afford home or private schools that they're required to hand their kids over to the state during the school week, but that the state only has a watered down, half-assed obligation to keep them safe.

I just don't think Flynn is going to shatter his bonds and yell "I'm innocent! Free me!".

So we've watched Romeo drink the poison, now we're just waiting for Juliet to wake up and stab herself. Flynn isn't going to change his plea and the Judge isn't going to throw the case out, if he were, he'd have already done it.
Realistically if we assume Sullivan thinks this can be played against Mueller and in favor of Flynn, what does he think is going to happen now?


All I see is Mueller cackling and telling his men to press Flynn to make up some shit that implicates Trump and all of this goes away for him.

321 After reading the post at Legal Insurrection I'm of the opinion that this judge is setting the prosecution up for misconduct charges.

The judge asked Flynn if, after seeing the 302s that were withheld (exculpatory evidence prosection withheld) if he wanted to change his plea and Flynn declined the offer. The judge tried several more times to get him to withdraw his plea since it was blatantly obvious Mueller withheld information and the original 302s and notes are gone.

Now the judge saying he could sentence Flynn to lengthy jail time comes through harshly when READ but we dont know his tone when SPOKEN. The judge was giving him a chance to reconsider a guilty plea in light of this new evidence. Flynn again declined.

Finally the judge asked for both parties to get together amd come up with a plan when they reconveve in March.

The takeaway?

Flynn has been mentally broken by the Mueller prosecution. He is no longer a use to them but he does not want his family to suffer any longer. The judge gave him every oppprtunity to fight this injustice but Flynn is broken.

This judge saw straight through Muellers BS in witholding exculpatory evidence. I think this judge is also pissed at the delays in providing the information and the fact that the original 302s and notes have been destroyed. I thimk that when this reconvenes in March there are gonna be fireworks and they will be directed at Mueller.

Thats my reading of the situation as posted at Legal Imsurrection and elsewhere.

It feels to me like the judge knows this entire charge is bullshit, and he's signaling to Flynn that the judge doesn't CARE what 'deal' has been made with the prosecutor, if he pleads guilty he's getting jail time.

The judge is sending a signal to Flynn - fight the laughable charge, or go to jail, but he's not going to allow Flynn to plead guilty and walk away.

It goes beyond abstract stuff like school board representation. They are straight up claiming a blanket immunity from the predictable results of their negligence as long as it's someone else who pulls the trigger.
This is about culpability, not administrative priorities; the latter results in hurt feelings. People are dead because multiple organizations and dozens of individuals employed by them consistently failed to do their job.

He literally was bankrupted, asked for a little of the love the actual criminal Andrew McCabe received, and money wasn't raised. I don't know whether it is true or not about his son but if so that only increases how I feel.

Flynn served a nation honorably that turned around and spat on him and used him a political prop. He deserved better.

345 When I read the interpretation in this thread that this judge was somehow speaking to Mueller's team, et al. I was genuinely amazed.
Everything the judge said was to Flynn and about Flynn. The context is crystal clear.

I am old enough to remember the days when even liberal judges would throw just about any case out if there was even "accidental" misconduct in a prosecutor's procedure. The underlying value was to protect liberty and the presumption of actual innocence, even if it means a guilty individual walks free.

Those days are long past. I suppose it became most obvious to me when the signature of a judge was no longer required for a U.S. citizen's phone conversations to listened to by governing authorities.

I am thinking a Judge can refuse to accept a plea, but in this case the plea was already accepted by Contreras, Strozk's dinner buddy, so Sullivan can't refuse to accept it because under law it has already been accepted.

354 Rush was talking about the Ted Stevens case and was talking about the corruption of the prosecutors that was so obvious, but yet took so long to be addressed, in context of Judge Emmet Sullivan bringing the hammer down on the prosecutors.

That stood out for me. To me, it seemed like the judge was backed into a corner and HAD to say something about the prosecutors because they made it untenable for the jugde not to, vs Sullivan recognizing this "obvious" prosecutorial misconduct and dealing with it right from the start.

I felt that did not bode well for Flynn. I was worried that Sullivan is some kind of leftist shill, and it looks like this is exactly the case.

I'm about to posit some rank speculation, here. But I swear, if I could, I would bet $1,000 even money on this speculation, I damn well would.

Judge Sullivan sent signals (through back channels or surrogates) that he was very sympathetic to General Flynn and even that Mueller's team may have behaved unethically in pressuring him into the guilty plea.
"But, you know, you guys (the defense) are going to have to make some kind of argument at sentencing to give the judge a predicate for lashing out at the government's case. He can't just step out there on his own. You have plead guilty after all. You have to at least vaguely suggest that you plea deal may not have been entirely legitimate. Give him something to work."

Unfortunately the defense took the bait, and instead this gave that hypocritical judge _THE_ perfect excuse to: lash out at the defense; falsely insinuate that the General may have committed treason; and postpone sentencing for MONTHS.

This allows Democrats and the media to continue the bullshit charade that what General Flynn has given - or is going to give - Mueller will devastate Trump.

I believe that General Flynn was setup... again.

360 It's simple - they are trying to goad Flynn into COMPOSING testimony. He has already answered honestly (and I'm assuming that they have ruthlessly combed through his testimony to make sure that there isn't a smidge of mis-statement that they can hang further charges on).

But, he didn't finger Trump. He's going along with the plea deal, as it has promised to keep his son from going through the same hell as he has. They tried to goad him into rejecting this deal, in order to have an excuse for going after his son - at which point, what father would not say, "I'll say anything, just leave him alone!"

Flynn is treading a narrow path, and - so far - he has beaten them. They are delaying, trying to wear him down by attrition.

PS - not that it's a secret, but the Judge is in on this. His "mis-statemtents" about treason didn't have the effect of goading him into an open, public protest. So, he walked it back.

Either that, or the Judge studied at the Hopelessly Over the Top Dramatic School, and just got carried away with his lines.
