  • OpenAI has disputed the claims in a class action suit brought by various authors such as Richard Kadrey, and "authors" such as Sarah Silverman, responding with your momma is a derivative work. (Ars Technica)
    Authors claim generative AI is just a "grift" that repackages original works.
    The first half of this is self-evident.

    The second half is like saying steak is just repackaged carbon dioxide. Yes. Grass absorbs carbon dioxide from the atmosphere to grow. Cows eat grass. People eat cows.

    But the carbon dioxide is free, so it's irrelevant.

    In just the same way, authors - and "authors" - repackage the work of previous authors. We accept this if they're sufficiently subtle about it, and the flavour comes out different, just like cows and grass.

    We don't expect grass to pay for the right to absorb carbon dioxide from the air, nor do we require authors to pay commercial licenses for the books they read as they learn to write.

    But if we are served a plate of alleged steak, and it is green and leafy, we tend to riot and burn the restaurant down. Metaphorically.

    Much as I loathe OpenAI as a bunch of useless grifters, what they are doing is clearly fair use under US law. Which doesn't mean they will win in court, and certainly doesn't mean that the law won't end up changing.

    It just means that they are right.

17 The summer of hellacious heat is ending here in Las Cruces just in time for the Hatch Green Chile Festival to crank it right back up this weekend. The festival hasn't run out of control yet which makes going a lot of fun. There is the usual vendor row, a lineup of bands, and carnival rides but the real purpose is the selling, buying, and roasting of green chiles from the local Hatch Valley growers. The smell of the roasting green chiles fills the air and signals the coming fall as much as the turning of the leaves do up north. I will be one of those buying a fall supply which I freeze and use over the coming months in everything it seems. One pleasure is to take the freshly roasted green chilies home and whip up a batch of Green Chile Chicken Stew. Living in a rich farming area, that still comes right inside the city limits, is a sublime pleasure.

Aveeno soap and a hot shower followed by a generous dose of calamine lotion seems to tame it for a while though. It's been about 10 days now. FML!

There was an ad that I saw last night while watching "The Last Alaskans" for a food product -- whose name and makeup I cannot presently remember -- that had received "EPA certification" for some reason. My immediate thoughts were, of course, (1) "What was the EPA doing messing around with certifying anything to do with our food supply?" and, (2) "What 'gubmint is good' toady would think that mentioning having received such certification was a noteworthy selling point for my food product?"

68 There is an invasive around the midwest at least, called Cow Parsnip that can really F you up. It grows tall and thick along streams. To the untrained eye the flower might look like a species of Dill. It is not. Deep scarring can result. Bad stuff.

I remember being surprised to find Poison Oak/Ivy grows quite well in the high desert out in Utah, at least places there is water. It wasn’t on my radar as something to look out for.

And then large rattlesnakes. Big as your bicep, and 5 feet long. Yeesh. I didn’t consciously see it, but my mind did. Very very good camouflage. It never moved, but I did.

There must be something deep in our brain, some evolutionary protection mechanism that is passed on in our genes. “Snakes Bad” lol

151 NTSB has released a preliminary report on the crash of the MiG-23UB Flogger.

Plane apparently developed a fault in the afterburner so not enough thrust was being generated so the command pilot extended the wings to maximize lift while troubleshooting, he also started setting up for a return to the runway.

The back seat pilot said they needed to eject now. Command pilot continued to fly the aircraft while troubleshooting when he suddenly found himself strapped to a rocket ejecting from the jet.

After the accident the command pilot said he did not engage the ejection sequence. The backseater said they were pressed for time and couldn't say if he did initiate ejection.

My personal opinion from reading this is the Retard in Back panicked and pulled the handle thus preventing a possible safe recovery of the airplane and endangering the lives of people in an apartment complex that the wreckage narrowly missed.

But we will know more when the full NTSB report is released.

3.01 inches of total rain for the storm, and a peak wind gust of less than 12mph.

Of course we did have that car get flipped over in the middle of the road by a very brief tornado over in Goose Creek.

That tornado seemed to exist just long enough to snag that car, and then...Poof...it was gone.

Without dashcam footage, I don't think anyone would have believed it.

Thankful for the good things in life.
There's the prettiest full moon this year about 15 degrees over the horizon over the neighbor's house.
It was actually cool outside, about 70 or so.
We got the date wrong for a dinner at church, so we went out for Mexican food instead and there are leftovers for lunch. Plus, we got the best homemade pralines ever.
I used three dice from the Yahtze game and probability to work out a scheme for a scrap quilt and it worked well.

Hope everyone has a few things in your life, too.

Will say a prayer for you, Fen, that they recognize your excellent qualities!
