Michael Byrd, Who Shot and Killed Ashley Babbit, Was "Exonerated" Without Cooperating With Investigation or Giving an Interview to Investigators

The man who shot and killed an unarmed woman without warning was cleared of any wrongdoing... without even being interviewed.



When U.S. Capitol Police Lt. Michael Byrd went on "NBC Nightly News" to tell his side of shooting and killing unarmed Jan. 6 rioter Ashli Babbitt, he made a point to note he'd been investigated by several agencies and exonerated for his actions that day.

"There's an investigative process [and] I was cleared by the DOJ [Department of Justice], and FBI and [the D.C.] Metropolitan Police," he told NBC News anchor Lester Holt in August, adding that the Capitol Police also cleared him of wrongdoing and decided not to discipline or demote him for the shooting.

Byrd then answered a series of questions by Holt about the shooting, but what he told the friendly journalist, he likely never told investigators. That's because he refused to answer their questions, according to several sources and documents reviewed by RealClearInvestigations.

In fact, investigators cleared Byrd of wrongdoing in the shooting without actually interviewing him about the shooting or threatening him with punishment if he did not cooperate with their criminal investigation.

"He didn't provide any statement to [criminal] investigators and they didn't push him to make a statement," Babbitt family attorney Terry Roberts said in an RCI interview. "It's astonishing how skimpy his investigative file is."

Roberts, who has spoken with the D.C. MPD detective assigned to the case, said the kid-glove treatment of Byrd raises suspicions the investigation was a "whitewash."

The lawyer's account appears to be backed up by a January 2021 internal affairs report, which notes Byrd "declined to provide a statement," D.C. MPD documents show.

Asked about it, a D.C. MPD spokeswoman confirmed that Byrd did not cooperate with internal affairs agents or FBI agents, who jointly investigated what was one of the most high-profile officer-involved shooting cases in U.S. history.

"MPD did not formally interview Lt. Byrd," deputy D.C. MPD communications director Kristen Metzger said. And, "He didn't give a statement while under the U.S. Attorney's Office investigation.


He might have said something incriminating in an interview, so best not to have one!

There is a very specific UOF doctrine with precedent setting cases that applies here. This shooting (really murder) fails all of those tests. If this saw the inside of most courtrooms there would be no way to hide that fact. That's why they made sure it didn't.

Saw a segment on Jan 6th last night on Newsmax and they interviewed Ashli's mother and husband. They showed various clips of Byrd in different locations inside the Capitol. He had his pistol out and pointed an awful lot and he wasn't the only one.

Yup, their last ditch effort to prompt the crowd into a proper riot. John Sullivan had final orders to bring a handful of the more rebellious ones upstairs, sheep for the slaughter. In return, he'd get footage of what sparked the riots and burning of the Capitol and checks waiting for him from CNN/MSNBC. Instead, all he got was footage of somebody being executed and nothing else. But, he still got $35k from each outlet.

It is also possible that he is not connected, but was just "overlooked" though incompetence or connections, and they decided to turn him into a snark hunt - they do that a lot, where the Left refuses to cooperate on things to get the Right worked up over the wrong issue.

It is a deception tactic, like putting out false information which is easily disproved. It makes the other side look foolish, and takes the attention away from the real lies.

Epps gets a lot of focus but he was not the only one. Revolver did a good piece a month or so ago that featured 4 or 5 others who were very involved in doing things like removing security fencing and exhorting people to move into the Capitol who were clearly captured on video and in some cases were in police custody and nothing has happened to any of them.

There was one guy they referred to as Black Ski Mask Guy who was arrested the night before on a bus that was carrying guns. The bus was taken down by at least a dozen cops and everyone onboard was booked and then released. The arrest took place right in front of DC police station.

Black Ski Mask Guy was one of them and the next day he was seen on video helping tear down security fence to allow people onto the Capitol grounds. He's never been arrested or identified yet the cops know exactly who he is.

Yes, there's been a few like that guy that some have managed to even link to other events. The orange hat guys are another - they were supposed to be proud boys, and they all glowed brighter than their caps. Even have footage from a couple of sources of what appears to be a guy and gal handing weapons out a Capitol window, bats and 2x4's. They really, really wanted to get people violent, and totally projected the general reaction of the crowd. It is a Spanish word that in continental jargon refers to a wine cellar or shop but in Latino areas of the US, specifically the northeast, is a convenience store small grocery.

I do not have a problem with it as I would not have a problem with my Italian friends having a "salumeria," "trattoria," or "pizzeria."

Back in the 80s, two LAPD officers pulled over a marked LA Sheriff's vehicle with uniformed officers inside. The LAPD then put the deputies on the ground and held them at gunpoint as they called out a Sgt who also couldn't determine if the officers were genuine or not for several minutes.

LASD put out a very sarcastic training video for LAPD officers to help them identify uniformed LASD vehicles and uniforms.

I think the most salient point of the Dorner affair was the breakdown in law and order. Because he targeted police and their families, the LAPD ground to a halt in search of him. They plunged the city into chaos for over a week during the hunt. They completely lost their equilibrium, shooting three innocent people during their headlong freakout (and then the City whitewashed all of that).

He found a critical weak point, largely by accident, because of his personal anger at the other cops.

In NY a bodega was a small supermarket - not a convenience store at all, since they focused on fresh veggies. Often they sold meat too, and stuff like rice in 5 lb. sacks.

I agree. I saw somebody on some forum say that Cruz cracked a sly smile during the Tucker interview, and their backformation was that Cruz was going to grill the DOJ stooge and he couldn't disclose to Tucker that he was, yet.

That's possible, I guess.

Trump had a way of directing press coverage through outrage, the press would shine their light in opprobrium and the real details that they had been trying to ignore would slip out and filter through.

I'm not saying that's what Cruz was doing, I'm just open to the possibility. Maybe our side is getting smart and this was a setup between Tucker and Cruz.

Now that wouldn't be moral, but it might be effective. To get Kinginzer to start talking about his "old buddy Ray".
