Alec Baldwin Shows Infamous Hot Temper, Chases Questioner Even As DA Is Considering Charging Him In Shooting Death of Cinematographer
Plus: Alec Baldwin -- Murderer?

This is a man full of range and impulse.

After that video, a video of Viva Frei discussing why he thinks that Alec Baldwin probably deliberately fired the gun in a rage.

No, he didn't know there was a bullet in it (we assume). But this is a man we have repeatedly seen provoked into rage over trifles. And here he was, being ordered about by a female cinematographer, rather than a male director (and it's always directors who give orders to actors, not cinematographers).

To make his point, Viva Frei takes us through a quick recap of Baldwin's well-known rage and impulse control issues, from "selfish rotten little pig" to molesting papparazzi.

His logic makes sense: Baldwin was, as usual, in a mad rage over nothing, and forgot himself, and forgot all of his gun safety training, and angrily pointed the gun at the cinematographer and angrily pulled the trigger.

This accords with the first reports from the set which said that Baldwin did exactly that: That he said, angrily, "You want it like that?!" as he pulled the trigger.

Note this wouldn't make it murder, as he wouldn't have intended to shoot and kill the woman, as he wouldn't have known the gun was loaded with a bullet. (Although see below.)

It would start to put him on the hook for something like criminally negligent homicide.

Andrew "Law of Self Defense" Branca was impressed by Viva Frei's argument and carried it further, wondering if, were it true that Baldwin had angrily pulled the trigger of a gun while aiming it at a human being, he could/would be charged with actual murder.

Or felony murder, to be precise. Branca wonders if Baldwin's hypothetical angry, deliberate snapping of the gun at Helenya Hutchins could be construed as a battery, which is a felony. A predicate felony for applying the felony murder rule, which says that if a death then occurs in the commission of any predicate felony (such as battery), the person committing that felony may be charged with murder, whether he intended to commit murder or not.

Under New Mexico law, an unlawful intentional touching or application of force done in an angry manner qualifies as a simple battery (s. 30-3-4. Battery). Of course, we're presuming that Baldwin never intended to actually apply force to Hutchins.

Nevertheless, merely putting someone in fear of an imminent battery is itself a crime. Under New Mexico law, menacing conduct which causes another person to reasonably believe that he is in danger of receiving an immediate battery qualifies as misdemeanor simple assault (. 30-3-1. Assault).

Further, a gun, a deadly weapon, was used here, and unlawfully assaulting someone with a deadly weapon meaning putting them in fear of imminent harm from the gun, escalates the criminal offense to felony aggravated assault (s. 30-3-2. Aggravated assault).

And, finally, under New Mexico law the killing of one human being by another without lawful justification in the commission of any felony qualifies as felony murder, a murder in the first degree (s. 30-2-1 Murder).


I don't buy any of that because, if Hutchins' assumption was that the gun was unloaded, she could not fear an imminent unlawful application of force.

Still -- fun to think about!

There's another way to skin that cat, though I don't imagine it would apply, the so-called "depraved heart" murder rule, which is mentioned in the third clause here:

A. Murder in the first degree is the killing of one human being by another without lawful justification or excuse, by any of the means with which death may be caused:

(1) by any kind of willful, deliberate and premeditated killing;

(2) in the commission of or attempt to commit any felony; or

(3) by any act greatly dangerous to the lives of others, indicating a depraved mind regardless of human life.

The idea is that you act in a way that is so willfully in disregard to whether someone lives or dies it counts as intentional murder. It's called "depraved heart" in other states that employ the rule.

The trouble with that is: Well, you wouldn't want all accidental shootings to fall under this rule, so what would bring Baldwin's shooting into the "depraved mind" category? You could argue that he had prior knowledge that there were all sorts of problems with the guns and live ammo on the set, with people quitting over safety concerns. (He claimed he didn't hear about that but I'm sure he claimed that to avoid legal liability, and I'm sure this could be proven a lie.)

So he had a duty to act with even greater care, not the much reduced care he actually acted with.

Still, another big s-t-r-e-t-c-h.

But the idea of Alec Baldwin cooling his heels in jail for the rest of his life amuses me sufficiently to spend a few minutes trying to dream up ways in which it could possibly happen.

If you're emotional child who goes around being a rage monster at arbitrary annoyances and you brandish a gun at someone - let alone fire it - you're a a defective person. 35 You could probably use a couple types of legal legerdemain to squeeze a murder charge out of this... but I wouldn't. DAs pull that kind of shit all the time, but on regular no-name people they can scare into pleading out on a lesser charge, or successfully demonize in front of a jury.

Baldwin isn't going to lay down and be railroaded into plea deal for a manslaughter charge, and if they put him in front of a jury, there will be at least couple people on it who will say "This seems rough to go for a murder charge, I'm acquitting." He's known to the public, and it'll be hard to make him out as a psychotic gangster, which is what it would take.

Don't overcharge this. Hit him with the manslaughter charge. You can win on that one. Still a tough row to hoe, not matter what, though. Strong likelihood of a juror saying "duuuuhhh, he can't be guilty, buuuh derrrp, he's in duh moviezzz and i lurv muh celebritiezzz.

54 It's not a "depraved heart" murder because those almost always require the person to be directing his actions at multiple persons. The guy in Las Vegas, for example, didn't intend to kill a specific person in that crowd, which would normally be a first degree murder charge (intent, premeditation) but he fired into the crowd with a depraved heart/indifference, knowing he was likely going to kill someone. The Minnesota Supreme Court just ruled against the government that charged Noor with Murder 3 (depraved heart) in the Justine Damond killing, saying his actions were only directed at one person, so no murder 3. They've got the same overcharging problem with Chauvin and George Floyd. They charged him with depraved heart murder but his actions were clearly directed only at Floyd, so that charge is probably going to be reversed as well.
This is a case of manslaughter, and pretty clear cut.

With Smollett, it was clear early on that all that the Chicago PD wanted was an admission of fault and an apology - they were ready to drop the whole thing, no trial, if Jussie would have just hung his head and sweet talked them a little bit. But Jussie couldn't - he kept saying things like the Rayciss Cops wouldn't investigate, and he's been so ignorantly insulting of everyone that he might actually end up with a jail sentence, which basically will be for Criminally Running his Mouth and Wasting Everyone's Time with Bullshit.

Alec Baldwin's tweets and interviews may be having the same effect - indications are that the investigators are starting to get really pissed, and feel personally insulted at some of the crap Baldwin has been spewing in public.

It's never a good move to give someone who's investigating you a personal interest in taking you down a few pegs.

YD, using a murder charge along with lesser and included charges are often used so that the jurors can make a compromise verdict as well as for plea negotiations. A lot depends on NM law but Baldwin would not look so good if he is demonstrated to have a pattern of anger and abuse issues including a propensity for violence. Having a line up of witnesses that had been attacked verbally as well as physically by Baldwin would also make it difficult for the Hollywood machine to support him as well as star struck jurors.

In the end, I don't think he will face criminal charges but will lose in a civil trial perhaps even facing personal liability.

If he really did say the "reshoots" line and point the gun at someone to pull a trigger, then he's absolutely guilty of some homicide variant. If he was practicing for a scene, the cinematographer was in front of him getting a feel for the shot and the gun went off by a malfunction, then he's just negligent.

I doubt it, unless the cardinals are taking the traditional path for dealing with the consequences when they make a catastrophically bad choice for the papacy. The downside to a lifetime appointment is when they decide that you need to go. It wouldn't be unprecedented them to ice a pope and try again.

Yes, that is definitely harmful in a civil suit. What might happen though is that Baldwin's act may not be covered by insurance as a volitional bad act, not negligence. A lot depends on the actual facts of what was taking place at the time of the shooting, the alteration/damage of the firearm if any, if any video evidence exists, and so on.

Good points - Branca had a post up a few days ago where he talked about the legal differences between a pure accident with no liability, a negligent accident where civil liability will apply, and a criminally negligent accident where criminal charges may apply. It was long and I can't repeat all that, but a key factor is that to reach the level of criminal negligence, the defendant must have done something that *any* reasonable person would have known was wrong and dangerous to do in those circumstances. (Driving drunk is the most obvious example)

They can. Apparently, at least some blanks are handloaded in the movie industry so that the signature of the discharge fits with what the cinematographer wants. A wadcutter can resemble a std. revolver blank except replacing a wad over the charge with a lead bullet. Semi or rifle blanks are usually pretty obvious with a crimp which is designed to feed better than revolver blank types. A firearm that is semi or full auto often has to be altered so that the blank pressure will operate the mechanism.

So OH, KY and TN have *two* injunctions - the "nationwide injunction" that just dropped and last week's (likely more legitimate) district injunction.

Do the two contractor mandate injunctions share reasoning, or do the judges made different arguments? The OH/KY/TN injunction's reasoning is that it is an overstep of executive authority and a violation of restrictions on administrative procedures.

In Saving Private Ryan, if you look carefully at the scene where Tom Hanks is popping rounds at the tank with his .45, you can see that his weapon is having feed issues. It jams multiple times. I believe this was caused by underpowered blanks.

Very possible. Semi autos are tough because you have to have enough recoil to operate the action and that can vary by firearm (due to the laws of physics). The recoil from blanks comes from the expulsion of gas only while both the bullet and gas contribute to recoil from a regular cartridge. Back in the service, we used blank adaptors for the AR in part to provide enough gas pressure to operate the system.

The military (and many law enforcement agencies) regularly point their actual weapons at each other for training. With and without blanks. Accidents are very rare, but do occasionally happen. I remember, as a cadet, having someone shoot an M60 at me (with blanks). The blank adapter wasn't on correctly, so it popped off and flew about a foot from my head.

I believe all of these cases remain to be tried in Fed District Court. These injunctions are stopping implementation now because the judges believe the plaintiffs have a good chance of winning their case when it's tried.

It is very common in movies, Snatch for example, for actors to point guns at other actors. Can't remember the scene - but do know when I first got my new Springfield 1911, I had serious feeding problems. Turned out that it just didn't like the hollowpoints I had (only .45 ACP I could find a year ago). Once I used regular RN FMJ's and they "polished up" everything a bit, it was working fine with everything. Wonder if it was just a combination of a newly built gun and shape of blanks? A few morons (and rangemaster) confirmed my issues on the gun thread.

I hated cleaning ARs after firing blanks. Adding mud to the equation would just make it worse. Blank powder is nasty and gets everything twice as dirty than regular rounds of ammo. Disposing of old blanks is even worse as you cannot effectively decommission them unlike old regular ammo for any salvageable parts.

Remember - with these mandates, Time is of the Essence. But when it gets set for trial, the Courts can easily make sure that it doesn't even come up for argument for at least 6 months, maybe a year.

349 I hated cleaning ARs after firing blanks. Adding mud to the equation would just make it worse. Blank powder is nasty and gets everything twice as dirty than regular rounds of ammo. Disposing of old blanks is even worse as you cannot effectively decommission them unlike old regular ammo for any salvageable parts.

371 A lot of semi-auto (and full auto) weapons need a lot of modification to run blanks reliably. Being a movie armorer is a real full time job, requiring a lot of know how.

Revolvers are much easier, and don't normally require modifications. Most revolvers can fire blanks and normal ammo without modification.

Word is, the dumb ass armorer chick on Rust was shooting the guns used in scenes with live ammo earlier in the week before Baldwin's homicide.

Cities and States derive their police power (the power to regulate) from the respective State Constitutions, so those questions will have to be decided by the State Courts on a case by case basis.

The cases in Federal Court are saying that the Federal Government has no power under the Constitution to make these kinds of orders.

376 Mike M, you are certainly entitled to your opinion. But as a matter of law, lethal and other harmful accidents involving firearms are what are called foreseeable. So, if your movie requires such to be done like pointing at the camera, pointing at another person, etc. then like using most dangerous and lethal equipment, the level of care required to do that without liability (both criminal and civil) must be extraordinary.

This was not followed by the people involved nor the practices that they followed. E.g. cameras are usually operated remotely or the personnel not involved in the scene are either removed or protected by bullet proof screens. Live ammo is to be strictly segregated from blank ammunition and under lock and key of the armorer, and so on.
Even if all the previous problems occurred, live ammo, damaged firearm, etc. If Mr. Baldwin had personally checked the firearm for being loaded and did not point it at the cinematographer/director without any apparent protection as well as cocking it, one person will still be alive and another unwounded. The fault is Mr. Baldwin's and it is for the justice system of NM to decide how fault should be allocated and punished
