The people who want to restrict or prohibit your access to food, water, employment, medical care, and other necessities of life are never the good guys.

The people who justify any and all excesses in the name of 'public health' or 'public safety' are never the good guys.

The people who impose restrictive rules on others they have no intention of keeping themselves are never the good guys.

And those who support, encourage, defend, and cheer on the people who would do these things are never the good guys, either.

AoSHQ Weekly Prayer List


Prayer Requests:

9/18 – Homer’s Donuts needs prayers for hope, healing, health, support, and strength as his wife has chosen to divorce him. They have a young son. Clinical depression and panic attacks, a constant in his life, are hitting him hard. He says he has such low energy that Jeb Bush looks down on him. The divorce is making things worse, and he feels completely obsolete and alone, without anyone on his side.
10/28 Update – Homer’s Donuts says he is undergoing more frequent panic attacks and fears that the frequency and severity will ultimately lead him to be declared “unfit” to have custody of his son. He has an exit plan in place and will move out soon, but life with the ex-wife is simply unbearable.

10/17 – Pollywog the ‘Ette passes along a prayer request for Brother Tim, who was admitted to the hospital Sunday for kidney stones and UTI. He needs both full healing, since this isn’t the first time he’s had these problems, and financial blessings. Prayer that he be able to have rest and peace, not something hospitals are known for, would be helpful as well.
11/16 Update – Brother Tim is healing, but still needs prayers for his job situation.

10/20 – Dr_No sends an update on his daughter, Megan, who we have prayed for while she was going through Stage III[c] cancer of the sigmoid colon. She has been done with chemo for a while and has received her ‘N.E.D’ diagnosis: ‘No Evidence of Disease’. Her doctors and caregivers were outstanding, and it means everything to see her able to live a normal life again. Yes, there’s always the unspoken fear that she may in future get a diagnosis of cancer’s return, but for now we enjoy that she’s healthy again and no longer in pain. After reading the prayer list, and understanding what others are faced with Do_No says he can only wish for them the joy and relief that he and the rest of the family have at Megan’s successful treatment, and sends his thanks to all for their words up.

10/22 - Pookysgirl asks for prayers for Pooky, as he is going in for extensive neuropsychological testing for 4-8 hours on Oct 27, so he could really use prayers today. He’s had issues with similar testing in the past, so prayers for calming and peace would be appreciated.
11/29 update – The results were not what they were hoping for. Pooky did not get any specific diagnoses but got put into 4 different “unspecified” categories. He sees his therapist and his med manager within the next month, and hopefully they can help them understand the diagnoses and any medication changes. This news has been very difficult to handle.

10/27 – R asks for prayers for himself and the woman he loves. He broke her heart with foolish decisions and now they are both brokenhearted. He is facing a future that will be filled with problems that might break him. He is trying not to fall into despair and could use a boost from everyone.

11/5 – Eeyore mood has an update:
I wrote you a couple of times about my friend's 4 year old grandson who was killed by the child's mother's boyfriend. He got out on bail because he was only charged with Negligence Resulting in Death. The autopsy report has not been formally released. The results could bring an increase in charges. The man is due back in court for a preliminary hearing on Nov. 15th. I would ask for prayer that the man who killed my friend's grandson be charged for the crimes he committed and justice be done. Also that God's peace be for the child's father, siblings and grandmother so they know He cares for them. Understandably, they are still devastated by this tragedy. Compounding this is that the child's mother is still defending her son's killer, saying it was an accident. 11/18 Update – The mother’s boyfriend is still out on bond. No new charges were added. The tentative trial date is June 22.

11/8 – 496 requests prayers for strength and wisdom for him and his entire family.

11/9 – Weak Geek asks for prayers for his father, who is recovering from surgery. He is out of intensive care but drops into bouts of defeatism. Also prayers for WG’s sister, who is on site and therefore shoulders the brunt of this burden.

11/9 – Krebs v Carnot has 2 requests: First, that his father-in-law William, find peace and blessings in the presence of the Lord, having passed away Saturday after a brief illness, and hat members of his family be comforted and strengthened with the knowledge that their beloved Bill has found eternal and joyous peace at last. And second, that his mother, 3 siblings, and he be granted patience, strength, and wisdom, as they work through getting Mom to a state where she is able to continue to live her life as independently as possible in the place of her choosing, and that all those in the elder care community working with her continue to help Mom see and do what she much through their kind and loving teachings and that Mom’s eyes be opened so as to understand that they, too, will rejoice as she progresses toward her goal.

11/16 – Inspector’s best friend Tom was diagnosed with Covid last week. It’s been like a nasty flu, but he is recovering. Prayers for his continued recovery, that it not affect his job.

11/16 – Inspector’s co-worker Marie was diagnosed last week with uterine cancer. It was caught early, so they’re hopeful for the prognosis, but prayer for healing, and strength for her and her family would be very appreciated.

For Healing:

10/20 – Nancy at 7000 ft is asking for prayers for her friend Timothy, who just had a quadruple bypass yesterday. Tim owns and runs a small business repairing industrial machines, and has recently purchased an old church with his wife Gabrielle, and was in the process of moving when he experienced a minor heart attack. Further investigation revealed he had an aneurismic section of his aorta, a genetic condition, and required multiple bypasses. Pray for an easing of his post-surgical pain and a full recovery.

10/27 – J asks for prayers for his nephew, Tim, who has throat and tongue cancer. Tim is in his mid-30s, married, and has 5 kids.

11/3 – MammaB is asking for prayers for her father who is 84 and having kidney failure.

11/4 – Tonypete asks for prayers for his dear friend Beth’s daughter Dominique who is 36 years old and has been diagnosed with Stage IV colon cancer. It has already spread to her liver and appears to be very aggressive. Please pray for a remission and for her doctors’ skill. Failing that, prayers for a Holy Death.

11/24 – commissar of Plenty and Lysenko gender fluid requests prayers for healing and no surgery required (20% odds) for a medical problem he is experiencing.

11/28 - Ladyl asks for complete healing for Hattie, a 3 year old who is undergoing multiple complex surgeries for a congenital skin condition. Brad, a middle-aged man diagnosed with colon cancer who may end up with a colostomy bag needs prayers as well, that his physicians find the best possible solution and cure his condition. And DR, a 65 year old man who also requested prayers for an undisclosed situation.

Monday Who Dis: Patricia Medina enjoyed an extensive career, finally retiring in 1978 after working in movies and television since the 1930s. She made a number of films with South African-born actor Louis Hayward: Fortunes of Captain Blood (1950), Captain Pirate (1952), Lady in the Iron Mask (1952), The Lady and the Bandit (1951). Hayward saw service in WWII. He was a United States Marine combat photographer, and his work during the invasion of the Japanese-held island of Tarawa earned him a Bronze Star for courage under fire.

14 Prayer request for the people of Oxford, Michigan, our adopted home town. Lived there for 12 years, moved away in Jan 2019. Our neighbor's high schoolers all made it out ok. Small-ish and very quiet town. We loved it there. It was the commute to Detroit that drained the life out of me.

Not always. Sometimes they're pulling down statues of Lenin and Stalin. Totalitarian dictators having their monuments removed when their systems fail is a slightly different category, I think.

Removing monuments to the *current* culture and system is what we're seeing now, like we saw in places like Afghanistan when the Taliban destroyed all non-Muslim symbols. Those are acts of a conquering horde of barbarians destroying non-compliant history rather than the removal of dead and defunct personality cultists.

Patriots in New York City pulled down a statue of George III in 1776. They were the good guys.

Pulling down a statue shouldn't be done lightly, however, and it is an act of revolution. So it is a good statement of intent of what these people want.

I disagree - Breyer is squawking publicly (which he never does) because he knows he's on the losing side of this one. Now I don't think they'll overturn Roe (good discussion of this last thread) They'll say Roe is upheld, but in same way or other say that States, under Roe, have the authority to set the date of Viabity. This would uphold the Mississippi law. The Texas law did something completely different, a nice end run around the system - but if that falls, Texas would be glad to replace it with a version of the Mississippi law.

The two laws represent two very different approaches to attacking Roe and Casey. Only one of them needs to work.

True, but for the cost/benefit problem. Putting aside corrupt or incompetent prosecution condemning an innocent man (which is why I oppose the death penalty), there is still a cost/benefit problem.

The death penalty is permanent and can be applied only once. If you're prepared to gamble with that outcome, then any other crime you commit in support of the capital crime is free. A fairly and swiftly applied death penalty for violent crime would be a deterrent to any thinking being. But DP is a deterrent to rational individuals. A deterrent doesn't have to deter 100% in order to be effective.

For instance, I think we like to say the war on drugs or prohibition were failures. But were they? During prohibition, alcohol related deaths and illness were reduced. The reason we consider them failures is through an actuarial lens. In other words, the costs of liberty and enforcement exceeded the benefit.

But the measures did actually reduce certain negative societal factors associated with alcohol. And based on the ever increasing overdose numbers, we see the end of the war on drugs is likely to result in a rise in drug abuse and lives most.

As a 1L I read an article about a poll that was taken of law professors (overwhelmingly a lefty bunch) as to which were the top 10 worst SCOTUS decisions in history. Number 1 was Roe. They all agreed it had no mooring whatsoever in the Constitution, but immediately followed that up by saying that it should never be overturned because abortion was soooo relied upon in our society and such an important pillar of our culture. This is where Justice Douglas explained the penumbras and emanations of the various amendments 'created' the right to privacy for married adults to use contraceptives in CT. The case was a setup from the get go and failed to get standing the first two times because no one in CT had been charged with violating it. The third time, they found a constable willing to charge the couple (Planned Parenthood director and wife if I remember correctly) the 50 buck fine which set up the case.

Even future Justice Ginsberg criticized the mediocre reasoning of Justice Blackmun in the case as she proposed the equal protection argument was a stronger one as abortion laws and punishment have effects greater on women than men.

I generally agree with what you're saying. I think the importance of stare decisis originally was so courts wouldn't waste their time on arguments that had already been rejected. But also for non-lawyers, having a definitive guideline they could depend on was important. If the Supreme Court had decided a water rights case between 2 states, everyone could rely on that decision, and plan accordingly.

The problem is, once the court moved past their original jurisdiction and decided they were going to weigh in on everything political, you had them locking the country in to the whims of 9 people on one particular day

The concept of stare decisis comes from common law and before that Roman law as well as Judaic law. To some extent Islamic law gives a nod to it as well.

The reason is pragmatic, a law that changes all the time due to proclivities of individual judges is not a generally applicable law so it would be essentially unknowable. Contracts right now between people and companies rest on the idea that law is knowable by individuals which means the terms of art used in those contracts has to be understood by all involved to have one definition that can be authoritatively applied if needed.

Criminal law has even greater need for stability which is why the state legislatures more or less got rid of common law crimes by first writing statutes and then later complete codes of criminal law replacing them which often enacted in legislative language previous court decisions in common law criminal cases. If you are going to punish people, then the law has to be knowable.

The problem is that Congress abdicated all responsibility for these issues. The Constitution gives Congress the power to limit SCOTUS' appellate jurisdiction, but it's rarely used because doing so would mean that it would be up to Congress to settle conflicting decisions.

I'm starting to think that the death of RBG was one of the best, and most overdue, events to happen to us in the last 4 years or so.

She played a role on the court none of the current liberals can fill; she was a diehard liberal, but also very intelligent and scholarly, capable of building coherent arguments for her side. Sotomayer and Kagan's real problem is that they are mediocre pencil punchers who were advanced to their current position to fill a quota, and everyone there knows it. Neither of them has ever had an original insight in their lives. And Breyer is now just an old man who's long past his sell-by date.

Just like in the rest of government, the "great legal minds" of the left today are nothing but ineffective, inarticulate, mediocrities.

Yea, I get that and I agree that in some cases it provides a degree of stability. But to use it as a hard and fast rule in every circumstance means that every decision made my a previous court was perfectly decided. Clearly, this is not the case.

Ah, but the idea is that you could research your conundrum in advance so as to not break the law. There is also the vagueness doctrine and the presumption that criminal laws be strictly construed in favor of the defendant. For example, the honest services criminal law provision was limited by Scotus in the Black and Skilling cases.

In real terms, the proliferation of laws means that laws can be construed in such a way as to not know whether or not you are committing a crime even after research. So that is where you do the best you can to comply and rely on intent as a shield.

Once the Court became involved in social disputes rather than structural allocations of power, there is little common ground in society to permit constitutional amendments to pass through the amendment process. Either the elites hate what the commoners would propose (which would crimp the elites) and so it never gets on the agenda or the elites want something the commoners don't which means that it can never reach the stiff requirements of a constitutional amendment.

So, we get the court ruling on social issues by issuing de facto amendments which was never the original design in the first place.

The constitutional tests arose organically as the Court sought to reconcile historical patterns of free speech with that of a modern mass media society. Then having developed this via caselaw, they applied it to racial classifications and thence to other groups via equal protection of the laws clause.

Under rational basis, the government has carte blanche to restrict your speech. Under strict scrutiny, there has to be a compelling state interest and the state has the burden of proof to show that as well as the language has to be narrowly tailored to address the compelling interest.

The court basically has three audiences that are being simultaneously addressed: the lawyers and the judges in lower courts, the other branches of government, and the people. Difficult to write a coherent opinion that each of these groups grok.

455 If you are going to punish people, then the law has to be knowable.

Go to a law library, look at all the books sitting on the shelves, be aware that in a court of law you are held legally responsible for knowing every thing in all of those books, even when they contradict each other.

Of course when Jefferson said "Ignorance of the law is no excuse", the laws of the United States fit on two hand written pages of paper.

If I didn't know better, I'd say court rooms were just places where bullying is celebrated and enshrined, wait, how exactly, do I know better? If it quacks like a duck, walks like a duck, and smells like a duck, is it a duck?

461 The whole bear thing was highly instructive this morning. I was trying to find out if the photo was a hoax.

There are literally thousands of people on the internet passing this along as an anesthetized bear. I had to dive really deep, like research sub deep, to find that the bear had been shot, and the name of the person holding the paw.

This is scary. There used to be a saying that "a million Frenchmen can't be wrong." But they can. Dead ass wrong. The truth doesn't win on the internet. The answers people want to hear and then pass along win.

I see this a lot in discussions on COVID. The air is thick with statements supposedly hard facts, on ALL sides of the discussion, that aren't facts at all.

The research necessary to find this out is immensely time consuming, and requires filtering cosmic levels of bullshit out. And if you present it, it's ignored anyway.

Don't trust anything you read on the internet until you can track it down on your own, and do it properly. "I read it in fifty sources" is no longer a valid thing.

Remember the Gell-Mann Amnesia effect.

462 Hmm, just stumbled across the Women Marines' new dress blues, and could barely stop cheering. They are great! SO much better than what we had when I was in, which were wimpy to say the least.

I'm going to have to check further -- haven't had a reason to in decades -- and see if they ever got rid of that horrid green-and-white seersucker summer uniform. Dreadful, that was.

463 Very late reading my AoS threads due to work issues today, but one comment on the Lamb Stew recipe:
It's very similar to mine with a couple small exceptions,
1) Skip the tomato paste and red wine
2) Use 1 can of Guinness in the stew instead (and 1 or more cans in the chef while cooking!)
