OH, NO: DEFENSE ASKS FOR A MISTRIAL -- WITHOUT PREJUDICE
"Without prejudice" means a new trial. They base this on not having the best quality video. They say they would have prepared their defense differently.
This could just be setting up an "in case" situation if Rittenhouse is found guilty. But this also means the defense thinks that Rittenhouse will be convicted. If the prosecution agrees to this, then the judge is likely to grant a new trial. I suppose the judge COULD, MAYBE deny the motion, but it's hard if both defense and prosecution agree. Prosecution opposes -- because they think that the jury, by asking to see the "raises gun" video, is thinking about convicting. I disagree with that, actually. When a jury wants to see something, sometimes it's just to clear their last doubts. The OJ jury wanted to review the testimony of the chauffeur who said that he kept ringing OJ's doorbell and OJ didn't answer for a half hour (because he was showering after killing his wife), IIRC. People took that to mean they were going to convict. I, smartly, thought it meant they were reviewing it in order to dismiss it. But this does not look good, my friends. Re: Flufferboy2004 Rekieta said that someone did a social media search on T. Clair Binger (Littlefinger's full name) and it came up with a previous email of "Flufferboy2004" at some email host. This has not been confirmed fully, but he says it pops up on a search. For what it's worth. See last night's Midnight Post for more about T. Clair Binger. ***Not sure what he'll do about the latest bad-faith action.

Update: the judge seems to be taking it, as usual, by just biting the pillow for Littlefinger. I thought he was angry, but he just seems to be treating this as another "Oooopsie!" by Flufferboy2004. I think Fatlock is making the argument of innocence because maybe Flufferboy2004's credibility is still in question.

The typical flow of this kind of operation would be "compress-then-send" not "receive-then-compress" because the receiver wouldn't need to do so.
This is maddening. These people use high-tech evidence all the time, have no knowledge or mastery of it, and let people's lives hang in the fucking balance while they engage in cargo-cult button mashing in what is essentially deference to magic.

Uh, when I send full-res video cuts to someone's email, I use a fuckin' share link like a professional. There are even free services up to 2GB for it. But you can be damned sure the DA's office has some other means of filesharing. Something secure, with at least a couple terabytes of storage.
I buy precisely none of this. None. They know how to do this, because 2021. Elderly office workers with crappy IT support know how to handle file transfers.

This is different. This is what appears to be a normal, baseline, typical SOP for how they do this shit in normal circumstances. No argument, nothing like that, just the routine gross mishandling of evidence through abject incompetence and probably a fair amount of indifference if not bad intent. It's shocking. It's not raw and likely never was. This is drone footage. It was probably acquired in a compressed format (likely a common MPEG variant) and stored on an SD card in the drone itself. It was probably only raw at the censor.

I would think a law firm would be operating their own servers. In my case, I've been transferring video/photo files for decades. I can receive literally any file via email, I have no realistic limits unless you're sending a fucking IMAX motion picture. When a client needs a humongous file, I make that link available on my server which they can access. Again, a shitload more secure than using something like dropbox.
Now, if a friggin' trade show demonstration or TV animation or real estate virtual tour or whatever is that secure, shouldn't a trial where somebody's life is literally on the line be at least as secure? The stench from the bench...

Because the "enhanced" video seems to be central to the prosecutions provocation argument, I would suspect that the low-res video was given to the defense intentionally, which implies the defense knows the higher resolution version would have been relatively more helpful to KR.

The sizes of things have been abbreviated for so long ("megs" and "gigs"), and the introduction of bandwidth as a common measure (megabits, etc.) makes things even muddier. There is *less* precision now than there used to be. She should have just said "megs" or "MB" instead of trying to remember the actual word that she doesn't use.

The only possible thing that could happen is a change of compression by changing file types - say you send an Android MP4 to an Apple, which changes it to a Quicktime format.
What we're talking here is a change of resolution/screen size. You absolutely cannot change a 1920x1080 file by handing off the file. Even if it changes the file type - the resolution remains the same. Somebody had to actually tell it to save off at a lower format. Now, accidentally? Yeah, if somebody didn't know WTF they were doing, they could save an AVCHD archive file to a QT or MP4, and let the software default settings change it. But this is NOT even close to just handing off the file. Again, incompetence and most likely malicious.

I was just wondering this myself. In order to enter video, photos, documents etc. into evidence you have to authenticate them first. This usually involves testimony from the person who generated the piece of evidence about when, where, how, all that.

I think that's exactly what he's doing. The prosecution has been so shady in this case that they've created a situation where it's impossible to say Rittenhouse had a fair trial, and the judge is concerned about a conviction getting reversed on appeal. He's hoping the jury acquits, so he doesn't have to rule on the defense motion, because their arguments are valid, but he doesn't want to throw out the case because he knows there will be outrage from the left and the media (BIRM) if he does that.

The judge lost control of the trial and enabled this shit show by failing to punish the prosecutors for misconduct early on. He did not sequester the jury, did not issue gag orders, and allowed repeated misconduct from the prosecutors. No wonder that at the end of the trial, the prosecutors felt they could shove this through. The judge did not force the issue early on which only encouraged repeated misconduct by the prosecutors. Now, the jury is cowed by threats, the judge is still trying to split the difference apparently.
As a very minimum, the judge should disallow the video evidence and throw out the provocation instruction from jury consideration. If the jury still votes to convict, the verdict should be thrown out as contrary to justice by the judge due to prosecutorial misconduct prejudicing the jury.

It's not raw and likely never was. This is drone footage. It was probably acquired in a compressed format (likely a common MPEG variant) and stored on an SD card in the drone itself. It was probably only raw at the censor.

At some point, the people of Kenosha need to take care of their damn selves.
If the census is that people here (the blog) would stand up for what is right IF they were on the jury, then helping to protect the innocent bystanders in Kenosha is no different than doing the same in your own backyard - because it's coming soon to everyone's backyard.
I'm not as brave as 99% of the people here. but, why aren't there massive crowds in Kenosha supporting Kyle and at least trying to provide cover for the jurors?

You will on occasion see a judge give a lot more leeway to the side that he thinks is clearly losing. It reduces grounds for appeal.
But usually that means giving the defendant everything. Never saw it with the prosecution before.

Hence my first question. Does it materially help the defense? At some point it seems pretty clear to me he was acting in self - defense and no amount of enhanced evidence is going to change someone's mind. They either believe in self-defense or they don't.

I was originally under the impression that this was an FBI drone, and the footage submitted by them. Now it seems to be a big mystery. As far as I'm concerned that's at least 2 pieces the judge shouldn't have allowed - despite the fact the high res footage looks good for Kyle.
If it was the FBI, then am I supposed to believe they only had one quad copter airborne? These things are autonomous, I'm guessing there's lots more.

"Without prejudice" means a new trial. They base this on not having the best quality video. They say they would have prepared their defense differently.
This could just be setting up an "in case" situation if Rittenhouse is found guilty.
But this also means the defense thinks that Rittenhouse will be convicted.

I disagree with that, actually. When a jury wants to see something, sometimes it's just to clear their last doubts. The OJ jury wanted to review the testimony of the chauffeur who said that he kept ringing OJ's doorbell and OJ didn't answer for a half hour (because he was showering after killing his wife), IIRC. People took that to mean they were going to convict. I, smartly, thought it meant they were reviewing it in order to dismiss it.

The lawyers are talking about multiple past events quickly and the judge is relying on their description of events to remember what they're talking about. Not just once. SEVERAL TIMES. The 5th Amendment issue. The state bringing up prejudicial events the judge had affirmed THAT MORNING he hadn't changed his opinion on. TWO BRADY VIOLATIONS. The first is Jump Kick Man being known to the prosecution and them affirming in court they had no idea who he was (this is still to be proven). The second is the bullshit low resolution video fuckery.

To reach that bar, the prosecution has to be proven to be corrupt or criminal. That is a high bar.
Or the state has to be clearly incapable of providing a fair trial (due to lack of law and order, bias in community, etc.)
But dismissing charges without another trial goes against every fiber of our criminal justice industry. It means there will never be "justice", and that the industry loses revenue stream.

I know My Cousin Vinny is not real life, but I also know the screenwriter knew his stuff to the point it has been shown in law classes as examples of court procedure. And I learned from it that Vinny going shooting with the prosecuting attorney was pointless because the defense gets to see all the evidence anyway.
Why do I seem to know more than these supposed experts in the courtroom, that messed up evidence from the prosecution should make it a mistrial.
What Guzalot says should happen should carry the day in a just world. We will see what kind of world we are actually in today.

Maybe they should be. It was the prosecution's job to convince the jury beyond any reasonable doubt. The jury going out of it's way to build it's own case is dangerous.

I think he thinks the jury will come to the right decision. I think he thinks its better if they jury does come to the right decision.
Judges are not natural risk takers. They basically avoid any kind of controversy for at least 10 years as a lawyer to then start applying to be an actual judge. Its not the kind of thing a loudmouth like me can easily do. So, not naturally risk takers.
So, when they feel the weight of a decision, if there's any way to punt, they'll likely take it.
