I suppose the judge COULD, MAYBE deny the motion, but it's hard if both defense and prosecution agree. Prosecution opposes -- because they think that the jury, by asking to see the "raises gun" video, is thinking about convicting. I disagree with that, actually. When a jury wants to see something, sometimes it's just to clear their last doubts. The OJ jury wanted to review the testimony of the chauffeur who said that he kept ringing OJ's doorbell and OJ didn't answer for a half hour (because he was showering after killing his wife), IIRC. People took that to mean they were going to convict. I, smartly, thought it meant they were reviewing it in order to dismiss it. But this does not look good, my friends. These arguments at the trial about the video and video quality make me want to scream. There needs to be a technical director available. The video was sent to the state via a phone-to-phone Apple technology that only works between iPhones. They sent it to the defense via E-Mail per defense request. They are asserting that the receiving device compressed the file and that the difference is the defense's fault.
I am not 100% certain, but I seriously doubt this. The sender likely compressed the file to cram it into an E-Mail or to save bandwidth. This might have happened transparently, but am not sure. The typical flow of this kind of operation would be "compress-then-send" not "receive-then-compress" because the receiver wouldn't need to do so. This is maddening. These people use high-tech evidence all the time, have no knowledge or mastery of it, and let people's lives hang in the fucking balance while they engage in cargo-cult button mashing in what is essentially deference to magic. If there is a full-resolution video file added as an E-Mail attachment, it might well get compressed prior to transmission. There a bunch of possible reasons for this - attachment size limits on the sending E-Mail service, bandwidth management settings on the phone, etc. Lots of possibilities for the phone to very helpfully recompress the file to get it out the door.
And this is why you shouldn't be throwing digital evidence around willy-nilly without a forensic record or chain of custody that guarantees that you didn't degrade or otherwise fuck up the evidence. BUT he is holding that motion for a mistrial with prejudice in his back pocket, and he can pull that card out and play it any time he wants. Here's where the "I texted the video" argument falls apart. Yes it is true that you can get extreme degradation in a video when you send it via MMS (who TF that uses a smartphone doesn't know this?). I am not 100% certain, but I seriously doubt this. The sender likely compressed the file to cram it into an E-Mail or to save bandwidth. This might have happened transparently, but am not sure. The typical flow of this kind of operation would be "compress-then-send" not "receive-then-compress" because the receiver wouldn't need to do so.

Anybody should be able to just checksum the file to see if the version they possess is the original or not. Next, the video itself hasn't even been authenticated. They got a video from some questionable source, how do you know it wasn't manipulated by that person? The judge lost control of the trial and enabled this shit show by failing to punish the prosecutors for misconduct early on. He did not sequester the jury, did not issue gag orders, and allowed repeated misconduct from the prosecutors. No wonder that at the end of the trial, the prosecutors felt they could shove this through. The judge did not force the issue early on which only encouraged repeated misconduct by the prosecutors. Now, the jury is cowed by threats, the judge is still trying to split the difference apparently. As a very minimum, the judge should disallow the video evidence and throw out the provocation instruction from jury consideration. If the jury still votes to convict, the verdict should be thrown out as contrary to justice by the judge due to prosecutorial misconduct prejudicing the jury. Served on two juries, one as foreman. First vote on one was 6/6. On the other it was 4/4/4 (undecided). IOW, both split right down the middle (or in thirds). So we wrangled into the night. Took 8 hours in a HOT ROOM to get one verdict, another 9 in the other. The jury room was intense, people went after each other, it was real. But we all wanted a verdict, not a hung jury and eventually, we got there.

Judges (mostly) don't like throwing out criminal cases. This judge is just hoping the jury does the dirty work for him. But there's still plenty of time after the jury verdict comes in (if it's wrong) for the judge to clean it up. The jury verdict coming in is NOT the end of a trial.

When a jury wants to see something, sometimes it's just to clear their last doubts. The lawyers are talking about multiple past events quickly and the judge is relying on their description of events to remember what they're talking about. In my experience as a prosecutor, mistrials will often lead to a plea offer on a lesser offense - maybe even for time served. The thinking being that you failed to convince a jury beyond a reasonable doubt at the first trial. The defense is thinking along the lines that we barely dodged a big time conviction, so maybe not risk it twice.

To reach that bar, the prosecution has to be proven to be corrupt or criminal. That is a high bar. Or the state has to be clearly incapable of providing a fair trial (due to lack of law and order, bias in community, etc.) But dismissing charges without another trial goes against every fiber of our criminal justice industry. Hasn't the defense already made a motion for a mistrial with prejudice that hasn't been ruled on? Maybe they could have added this to the pending motion, but I'm speculating that the motion might have been filed this way to create another basis for reversal in the appellate court (I'm neither a criminal lawyer nor a WI lawyer, so apply salt to this speculation as needed.)

I think he thinks the jury will come to the right decision. I think he thinks its better if they jury does come to the right decision. Judges are not natural risk takers. They basically avoid any kind of controversy for at least 10 years as a lawyer to then start applying to be an actual judge. Its not the kind of thing a loudmouth like me can easily do. So, not naturally risk takers. So, when they feel the weight of a decision, if there's any way to punt, they'll likely take it.
