Closing Argument: Video Replay of Night

Sorry I haven't been live blogging much, I'm rapt.

Richards (the defense attorney) has finally woken up. Although he's still not the clearest-thinking or most articulate guy in the world, he is hitting most of the most important points.

He called the prosecution's dishonest photo manipulation "Hocus pocus that's out-of-focus." Rekeita's panel liked this. Pretty cornpone.

And he's consistently calling Littlefinger a liar who "cut corners" in his drive to "put Kyle Rittenhouse's head on his wall" at any cost -- due to the "pressure" to avoid further rioting and arsons.

He's doing a good but not perfect job. Some points I wish he'd hit harder. Like Littlefinger's claim that he shot Rosenbaum "in the back." What Rittenhouse actually did was skim a bullet across the top of his back as Rosenbaum was lunging at his gun -- the bullet hit near his shoulderblades and then exited by the rear hip.

Littlefinger just straight up lied about this. Richards did make this point, but not as, well, pointedly as I'd've liked.

But still, I am feeling slightly hopeful.


I wish he would make the point that Littlefinger is basically arguing that no one was allowed on Kenosha's streets that night except antifa, because antifa warned people to stay off the streets, and if you defy antifa's apparently-state-backed orders, you "provoke" them and give them the legal power to arrest you and use deadly force against you.

Now he has talked about this sort of thing but he has not addressed Littlefinger's contention that antifa is empowered to act as vigilantes and chase down the "active shooter" Rittenhouse but if Rittenhouse puts out a fire he's acting as a "provocative" anti-fire vigilante who is "provoking" the crowd and giving up his right to self-defense.


Remember, unfortunately, Binger will get the last word. He gets a rebuttal. And Binger goes on and on and on. I don't think I'll put up a post for that.

"After ten days, the prosecution has yet to explain why Joseph Rosenbaum had the right to chase my client. If I didn't know better, I'd think he was a whiny defense lawyer. He's claiming everyone's lying: 'The witnesses are lying, the citizen journalists are lying. Everyone's lying to make my client look bad.'"

Mimicking Littlefinger interrogating Rittenhouse: "'So you put out a fire? It was just a small fire.' Well last time I looked, small fires turn into big fires."

"Ladies and Gentlemen, THIS is a political case."


Now going through the video, showing child rapist Rosenbaum getting crazed when someone dares to put out the flaming battering ram he was pushing towards the police rhyme. Calls Ziminsky, who did have a gun and shot it, Rosenbaum's puppeteer. Richards is arguing they acted in concert. Or may have acted in concert. And that Rosenbaum was emboldened by Ziminsky showing off his gun all night.


Now showing all of Rosenbaum's acts of mayhem, making fun of Littlefinger for calling this a "night of calm" or claiming that Rosenbaum was just a "demonstrator."

Now showing the Ziminsky's -- and the man is armed with a pistol -- whipping up the crowd saying "GET HIM! GET HIM!" and staring the crowd chasing Rittenhouse.

42 I really hope this kid is found not guilty. Granted, from a purely self-preservation and sensibility standpoint, he *shouldn't* have been there. But, he was, and it's not hard to see the reason why.

The entire country is waiting for *it* to happen. Everybody feels it in the air. Some welcome it, some dread it, but everybody has that sense of foreboding. For all Kyle Rittenhouse knew, that night in Kenosha might have been the night *it* started, and instead of staying home and staying out of it, he got his rifle and headed out.

I admire the hell out of that.

Ha. We went to a restaurant in Asheville once with a party of eight and the waiter stood and took our order without writing anything down. Fancy pants dining and all. We asked to make sure that he didn't want to take notes since it was a big order even though it wasn't that complicated. Oh no, he was too fancy for that and was sort of offended that we'd even ask.

Every single order was wrong. I suspect he was a bit more offended when we sent all the plates back the first time, and two of them the second.

This aspect isn't really unusual. The person bringing the case (here, the prosecutor), gets the right of rebuttal. Because the prosecution has the burden of proof, it gets the final word.

But my $0.02 as a civil trial lawyer is the closings are to marshall your good jurors and given them weapons to convince the others, not to convince people outright at this point. This means that you should be painting pictures in mini closings throughout the trial, which IMO Richards hasn't done that well.

It seems like the whole trial is structured to give the defense the last word, which makes sense. (And logically the defense *has* to come after the accusation.) But then, at the very end, the state gets one more last chance to make their case. It's weird.

I honestly thought they were scripting it in an artificial way in Law and Order, so as to give McCoy a chance to end with a big bang. Had no idea that this was the actual procedure.

Philadelphia placed the Proterra buses in areas where it thought they could succeed but quickly learned it was mistaken. Two pilot routes selected in South Philadelphia that were relatively short and flat compared with others in the city were too much for the electric buses.
