They're back from lunch.
I'm calling this an Open Thread in addition to a trial thread because I'm up in the air whether or not commenters want to discuss this. I bet it's divided around 50/50. So please, treat this as an Open Thread if you cannot stand to listen to or think about Littlefinger and his Pedophile Starter Kit Mustache. All of my posts are always Open Thread but this one is more open thready than usual, given how many threads I'm putting up on this trial today. Rekieta feed. Crowder is covering at Rumble. CBS Live feed. Law of Self Defense's live tweeting. Littlefinger just claimed that Rittenhouse could have shown he was not a threat to the crowd by... firing warning shots into the air. He claims this would have indicated to the crowd he was not a threat to kill again. Anything Rittenhouse did, Littlefinger claims was the illegal wrong thing to do; anything he didn't do, Littlefinger claims would have been the legally-required right thing to do. Littlefinger is claiming the crowd has the "right to self defense" against Rittenhouse even though Rittenhouse wasn't attacking him. But Rittenhouse did not have the right to self defense, even though the crowd was attacking him.Sean DavisAntifa has a right to vigilante curb-stomp anyone they consider a threat, but Kyle Rittenhouse was acting provocatively in acting as a "vigilante fire-fighter" in putting out the fires that antifa worked so hard to set. Littlefinger is again claiming that full metal jacket is MaGiC bUlLeTz that are designed to pass through multiple targets killing people and in fact vehicles over 500 yards. He again claims that a carrying sling is for the purpose of retaining the weapon. He had all trial to call a witness who would claim this, but did not. So he's calling himself as an expert witness, I guess. The defense, again, does not object. This defense is awful. Awful. No wonder Robert Barnes quit. @seanmdav The prosecutor is just reciting the new left-wing dogma: left-wing violence is always allowed, while self-defense against left-wing violence is not. Under the current regime, you don't have rights so much as you have a duty to be a victim of left-wing mob violence.

Yeah the film adaptations of his stuff was pretty uneven. Like adaptations of Elmore Leonard. Some was great, even early stuff like Joe Kidd and Hombre, but most of it was pretty bad.
3:10 to Yuma was a Leonard short story and it got both a good and laughably bad film treatment, so maybe its the ultimate example.

I think his plan was to make the gun charge and curfew charges stick, because if you are in violation of any law at the time of a shooting you can't claim self defense no matter the circumstances. (in Wisconsin, at least) So he was going to get one or two petty convictions and say aha! no self defense allowed, that's murder!!!!

This opened the door to the claim the KR provoked the chain of events when he, according to the prosecutors, point his gun a Rosenbaum. The Defense royally screwed up by not challenging the witness he introduced the video's expert witnesses credentials. Not one person in the court room regarding this video was qualified to make conclusions on an expert level if zoomed in videos proper for forensic purposes. That failure leads directly to claiming KR had zero self defense protections.

they always say this but it isn't true. I found my own way to lose 60 pounds. if people love keto,then drive on. For sure too many carbs makes it very hard to lose weight. But then again, the scale never asks me how many carbs I have consumed. in my experience, it is calories.
I have run this so many times that I think i have a good handle on it. Sometimes I only eat/consume carbs and those are the weeks I lose the most. i still don't get some of this. I know eating all the time is the one thing you don't want to do. But still am not sure exactly if there are certain things you should not eat.

Nope. Too categorical a statement. If they overule they may not say anthing, but they can sustain and do sustain objections in closing. And you can get instructions on the spot from the judge curative instructions about mistatments, or they judge may just say that it isn't evidence and merely argument, jury you get to decide whether or not or what weight to give it.
if you don't object it is hard to argue on appeal, but there is a plain error rule. So bad, that your lawyers failure to object can't be held against you.

Literally the worst defense in the world. Literally. They have constantly allowed Litttlefinger to act as his own "expert witness" and testify as a prosecutor. An expert has to be voir dire'd, to establish his expert status. Littlefinger has none. The defense never objects. Never. Ever. Never ever ever.
They just let him testify and testify to things never entered into evidence, acting as an expert witness who was never established as such. They let him testify earlier that "you cannot fire a gun with your bicep blown off." So now he's a medical doctor.
Littlefinger is whatever sort of expert he needs to be at any particular moment, and the defense just sits there in silent stupidity.

Yeah they can be. Someone in a previous thread said that they tend to not be because it pisses off the judge and the jury. So the lawyers think it's better to just hit back with their own closing arguments rather than the objections.

My guess is they have a professionally prepared video playback of the key portions of the video, a walk through of the charges and the evidence negating each charge, and then about 20 minutes of how how monstrously contorted the prosecutions case had become under the sadistic tortures of the two lead prosecutors, and how the law itself depends on regular people to carry it out --- just like you jurors.
Not so-called professionals with extra degrees and political pull, like these prosecutors.

Yes but many lawyers resist making objections during closing but then bring out those points (lack of evidence, etc.) in their own arguments where they can use it as part of their theme. (Prosecution told you convict because of 1, 2, 3... no evidence to prove 1, none to prove 2, only very thin evidence potentially on 3= not enough)

There's no way the System can allow a not guilty verdict. Obviously that's not because of some archaic idea of "justice" in our post-rule-of-law former nation, but because this is clearly a show trial intended to humiliate the opposition and make an example for anyone else who might think about defying the regime's state-approved street thugs.
I hope I'm wrong. The witnesses did not go well for the prosecution and he was clearly acting in self defense, but the System will get what it wants, if for no other reason than the jury has been threatened/intimidated into submission.

Rather then object the defense will use their closing to attack those BS statements which serves two purposes:
1. the prosecutor becomes untruthful (or an outright liar) in the eyes of the jury and his theory of the case is suspect
2. builds strong support for defense theory of the case
Juries can be pretty dumb but a prosecutor making wild claims, despite what the evidence clearly shows (ie, "Jump Kick Man landing on Kyle's face is not a danger!"), with a strong rebuttal from defense can sink the prosecution. most prosecutors tend to be a little theatrical in closing but not cross a line the defense can clearly defend.

It does not take any time to say: "Objection" and the judge can respond "overulled" or "sustained" just as quickly. I have sat through closing and not objected on occasion, but more often than note I have had to object to make a record for appeal a couple times per closing. This prosecutor is making up the law, and he would be in plain error territory except this is a political trial.

Counsel can see the jury. We can't. I held my tongue more than once during closing when opposing counsel made objectionable statements because I could tell he'd already completely alienated the jury and objecting would just prolong things. At this stage of the trial, the jury's mind is almost always already made up.

According to FBI data more people are killed by hands and feet, blunt instruments, pistols, and even .380 pistols like Granbo had than AR-15s. Kyle had one of the least leathal weapons (I know, pulling a binger with the langauage) than anyone else there.

In 5.56 with some good ass behind it, it's not that bonded soft points, JHP, or expanding copper solids do "max damage" - it's that they do CONSISTENT damage. Because the FMJ at closer ranges tends to fragment explosively, but with a variability that is partly dependent on velocity and partly on weird voodoo shit that varies from barrel to barrel. (see: the One-armed Antifa).
A fragmentation at the right spot is much more lethal than expansion, but the "right spot" varies depending on angle and intervening things like limbs, *and* even if you were guaranteed a consistent shot to take it still would not be reliable.

That's why I tend to buy M193 and haven't been in a rush to get a 1/7 twist barrel upper. I picked that as my 5.56 platform because it's the most reliable tumble and fragment with enough velocity and it's still or was a cheapest option compared to heavier HP bullets. My favorite is actually the A1 clone with 1/12 twist and 20" barrel though it's not optics friendly.

It is, for several reasons. If the jury hangs, the prosecution gets another bite at the apple. They get to try the case again, and they'll correct the mistakes they made the first time around. Also, the prosecutor doesn't have to worry about running out of money, because the taxpayers are footing the bill for all the prosecution's expenses.
Meanwhile, Kyle has to come up with hundreds of thousands more dollars to fund another defense team, because his lawyers will have to do the same work, and it costs huge money to defend a case like this.
A hung jury would be better than a conviction, of course, but it would still suck big time for Kyle.
