I'm calling this an Open Thread in addition to a trial thread because I'm up in the air whether or not commenters want to discuss this. I bet it's divided around 50/50. All of my posts are always Open Thread but this one is more open thready than usual, given how many threads I'm putting up on this trial today. Rekieta feed. Crowder is covering at Rumble. CBS Live feed. Law of Self Defense's live tweeting. Littlefinger just claimed that Rittenhouse could have shown he was not a threat to the crowd by... firing warning shots into the air. He claims this would have indicated to the crowd he was not a threat to kill again. Anything Rittenhouse did, Littlefinger claims was the illegal wrong thing to do; anything he didn't do, Littlefinger claims would have been the legally-required right thing to do. Littlefinger is claiming the crowd has the "right to self defense" against Rittenhouse even though Rittenhouse wasn't attacking him. But Rittenhouse did not have the right to self defense, even though the crowd was attacking him.Sean DavisAntifa has a right to vigilante curb-stomp anyone they consider a threat, but Kyle Rittenhouse was acting provocatively in acting as a "vigilante fire-fighter" in putting out the fires that antifa worked so hard to set. Littlefinger is again claiming that full metal jacket is MaGiC bUlLeTz that are designed to pass through multiple targets killing people and in fact vehicles over 500 yards. He again claims that a carrying sling is for the purpose of retaining the weapon. He had all trial to call a witness who would claim this, but did not. So he's calling himself as an expert witness, I guess. The defense, again, does not object. This defense is awful. Awful. No wonder Robert Barnes quit. Littlefinger has none. The defense never objects. Never. Ever. Never ever ever. They just let him testify and testify to things never entered into evidence, acting as an expert witness who was never established as such. They let him testify earlier that "you cannot fire a gun with your bicep blown off." So now he's a medical doctor. Apparently, according to the prosecutor, the crowd of mostly peaceful fire setting and rioting people have no idea what Rittenhouse is going to do so they are justfied in attacking him, he however can read all their mostly peaceful minds and know that they are all just trying to help when they hit him with concrete blocks and skateboards. Crichton's first major book that for some idiotic reason did not see print is Dragon Teeth, it got released recently. That would make a fun, wild movie. He took a few liberties with some of the characters but its still a lot of fun.

Yeah the film adaptations of his stuff was pretty uneven. Like adaptations of Elmore Leonard. Some was great, even early stuff like Joe Kidd and Hombre, but most of it was pretty bad. 3:10 to Yuma was a Leonard short story and it got both a good and laughably bad film treatment, so maybe its the ultimate example. Where Littlefinger rally pisses me off is showing the aftermath of a defensive shot. The general public is NOT conditioned to see how a person dies. TV and Movies clean it up because it is so impactful. It removes impartiality from anyone when they experience it for the first several times.
This is exactly why the George Floyd death incited so much outrage. It didn't matter what he did before. It didn't matter what the options might have been. It didn't matter if the actions taken were actually the best of all those available. I think it's 50/50 at this point. At best. I never trusted the judge to do what was right, and he didn't. I'm going with the same thing for the jury: I don't trust them. I figure at least a few of them had Kyle R convicted and executed before the trial even started. That stupid, pro-BLM, anti-cop "joke" one of the jurors told only confirms my suspicions. Rather then object the defense will use their closing to attack those BS statements which serves two purposes: 1. the prosecutor becomes untruthful (or an outright liar) in the eyes of the jury and his theory of the case is suspect 2. builds strong support for defense theory of the case Juries can be pretty dumb but a prosecutor making wild claims, despite what the evidence clearly shows (ie, "Jump Kick Man landing on Kyle's face is not a danger!"), with a strong rebuttal from defense can sink the prosecution. most prosecutors tend to be a little theatrical in closing but not cross a line the defense can clearly defend. I held my tongue more than once during closing when opposing counsel made objectionable statements because I could tell he'd already completely alienated the jury and objecting would just prolong things. I picked that as my 5.56 platform because it's the most reliable tumble and fragment with enough velocity and it's still or was a cheapest option compared to heavier HP bullets. ________________ It is, for several reasons. If the jury hangs, the prosecution gets another bite at the apple. They get to try the case again, and they'll correct the mistakes they made the first time around. Also, the prosecutor doesn't have to worry about running out of money, because the taxpayers are footing the bill for all the prosecution's expenses. Meanwhile, Kyle has to come up with hundreds of thousands more dollars to fund another defense team, because his lawyers will have to do the same work, and it costs huge money to defend a case like this.
