SELF DEFENSE

Legal question: How can I protect my home from serious, determined looters?

I'm watching the Rittenhouse trial and the prosecution made the point that deadly force is allowed when you're defending your life, but not when you're protecting your property. You can't shoot somebody if all he's doing is stealing your stuff. When I heard that, I thought, oh boy, I'm screwed.

This was not a problem years ago, but now, with the social contract starting to tear apart, it's now and issue. I'm not a lawyer, so I'm hoping you morons with legal training will weigh in here. But after the 2020 summer of chaos and rioting, the situation I have in mind is this:

BLM decides to hold a protest/demonstration/march in my town, not downtown, but through residential streets, like mine. And the BLM leadership decides that they're just going to break into houses along the way and take whatever stuff they can walk off with. Because reparations. So, what do I do? I can lock my door, but they can bring police-style battering rams. I can stand there with a shotgun and try to look menacing, but what if they don't take me seriously? They can just push me aside and gain entry. Now, as I understand the law, I may be justified in shooting the first guy who pushed me, but if a whole stream of looters gain entry behind him and are not threatening me in any way (other than being in my house), they can just help themselves and there's nothing I can do about it. Yes, I can call the police, but ha ha ha, they'll come an hour or two later and take a report.

So, is there anything I can do, short of turning my house into a fortress? It's frustrating because, paradoxically, the looters are using the cover of law to do what they do. Because no matter what they do, the penalty for a private citizen to stop them in the act is greater than whatever they will be changed with for looting, assuming they're even caught. Look at this:

Isn't this just looting? I'm old enough to remember when the police used to shoot looters. And reducing such crimes to 'just property damage', as leftists love to do to justify thedir looting, is morally retrograde:

The open assault on property taking place in cities across the country is clearly a campaign of violence. After all, a standard dictionary definition of violence is “behavior involving physical force intended to hurt, damage, or kill someone or something.” That’s right, not just “someone,” but “something” too. That’s not just some technicality: it’s what people generally mean when they use the word “violence.” The term has long encompassed things like burning someone’s house down. Leftist commentators are basically trying to redefine “violence” as a synonym of “assault.”

Why the word games? It could very well be for political ends. After all, much of the hard left is heavily influenced by Marxism. And one of the tenets of Marxism is the rejection of private property rights in favor of communal (in practice, state-) ownership of the means of production. By excluding the seizure and destruction of private property from the meaning of “violence,” they are able to smuggle a key Marxist presumption into our very language.

This is an ominous path. The track record of Marxism is a litany of tyranny, famine, and murder, precisely because of its hostility toward private property.

Property rights are human rights, and we discard them at our own peril.

You know, what I could do is, like the left, change the definition of words to my advantage. In this case, I could redefine the 'self' part of 'self defense' to include my house, my car, and the rest of my property.

An earlier draft version of the Declaration of Independence contained the phrase, borrowed from John Locke, "life, liberty and property" which was eventually changed to "life, liberty, and the pursuit of happiness". That's how important the Founders considered property. It's also one of the Ten Commandments. "Thou shalt not steal" assumes the sanctity of property. This has been corrupted by the Marxists to "Thou shalt not steal, but we shalt". Only they call it liberation.

42 In Florida the castle doctrine applies. If they are coming into your house, you can shoot them. Doesn't matter if they are armed or not. It is a legal shooting.

If they are leaving your house with your stuff, then you can't shoot. You life is not in potential danger at that point.

So the key is always are they moving toward you or away from you. If toward you or your house, you are legally allowed to use deadly force to defend yourself, whether they are armed or not.

Nothing new. In San Francisco some time ago, the police started advising people to leave their cars unlocked so that burglars and thieves wouldn't smash the windows when they decided to loot your car. This would limit the inconvenience and damage when you targeted for property crime.

Under Texas law, you ARE allowed to use deadly force to protect your property. Most northern states though are no.

To shoot an antifa looter is as much a crime against the state as to shoot the cop that stands down to allow it, or the prosecutor who would charge you for defending your community or yourself.

As a purely academic exercise, this makes some sense. If you shoot someone leaving your house, you've acted as judge, jury, and executioner, and imposing a much steeper sentence than is allowed by law. It's a pretty safe bet, though, that the people making these rules don't live in high crime areas.

You're missing an important point: Taking *your* property is no big thing. Taking *their* property is a big crime.

As I said above, in Texas you CAN shoot someone who's trying to leave with your stuff. Most states are no, though.

For home defense, the first and cheapest help is to improve your door locks. Replace the short door screws in the door plate and deadbolt with longer 2" models, maybe add a security bar to brace against the floor.

Next, though there are pros and cons, get a rifle or shotgun. Maybe a 20 gauge might be better for you than a 12ga. If you need help or advice ping me offline, you should have my email.

The Roof Koreans wouldn't have been a "thing" back in the day if they had to operate under these restrictions. Check local/state codes. If it sucks, move. That's where we're at.

Or... Get an interior home security camera. On your phone, have a loop recording of "I'll kill you!". Hit play, shoot, hit pause. You now have security footage of somebody audibly threatening you with bodily harm.

94 I'm watching the Rittenhouse trial and the prosecution made the point that deadly force is allowed when you're defending your life, but not when you're protecting your property. You can't shoot somebody if all he's doing is stealing your stuff. When I heard that, I thought, oh boy, I'm screwed.

This is what I have been warning everyone about now for a few years. We have imported not only the amorality and traditions of the world, but also their worst practitioners.

If you use google street view at places that support it, most home are built behind thick walls, decorated with concertina wire or some other area denial contraption. First floor windows and doors are barred and the home are made of durable materials. They build understanding a Low Trust Social model

In the former United States most properties are constructed under the High Trust Social model with combustible materials, unprotected and fragile windows, open space parking and largely unfenced very low security property lines.

A multi phase plan is requried. Get the hell out of populated areas and replaced the burned down suburban homes with concrete/tilt-wall inner-portico architecture.

He bailed from a car and ran into a strangers unlocked home where Mr. and Mrs. were sitting in their living room. He threatened to harm them if he didn't get their car keys so they pointed where they were and he ran outside to steal their truck.

The Mrs. went to their room for the Mr.'s pistol who took it outside and stood in front of his truck in the driveway. When the perp put the struck in gear he was shot once through the windshield killing him.

The sheriff said it was a good shoot and the matter was closed.

The Farmers Insurance guy said he's seen a thing or two.

He is also charged with illegal possession of a dangerous weapon. Which is a misdemeanor with up to 9 months in prison.

When I purchased my first firearm in '93 (thanks Brady Bill), I was temporarily working in Arizona. At that time, a gun safety class was required. The instructor, a retired cop, said this was the case at the time.

If somebody walked up to you, said I'm stealing your car, It doesn't threaten you physically -- you were not allowed to stop them. I said "that's bullshit, my property represents the hard-earned fruits of my labor and the thousands of hours of my life time spent, and I'm allowed to defend that? So if some mob walks up to my home with torches, but doesn't personally threaten me, I have to let them burn it down?"
He said "Not unless you 'believe' somebody is inside. Wink wink, nudge nudge." Crazy.
Anyway, I know live in AZ and that's no longer the case with constitutional carry and very strong castle doctrine/stand your ground laws; not that laws matter anymore.

Every single day the local bay area media posts several crime videos and keeps asking "how do we stop this?" the irony seemingly lost on them. Look no further than DA's like Chesa Boudin. Every single DA in the greater bay area is a Soros funded activist. And it looks like many other cities are going the same route across the country.

At some point, we're going to see people trying to protect their homes and properties against these emboldened criminals. There's going to have to be a point people start protecting themselves, their property and their livelihoods. Kyle won't be an outlier.

I have been arguing with Mr. TheTemp that we need to sell the house and move to a red state, or at least a redder part of our state. We saw Antifa/BLM march through some suburb last year, and all the residents came out quietly standing in their front yards with rifles. Unexpectedly, the march was really, really peaceful. What Kenosha is doing is saying next time, they will arrest everybody with the riles and let Antifa burn your house down. I'm guessing this jury does what juries always do, and convict Rittenhouse on some lesser charge (I think manslaughter is one of them, or maybe the gun charge) - and then it's open season on us.

If you ever have a chance to attend a US Law Shield event in your area, it's worth it. Their seminars are usually either very low cost or free, and the information is top notch. 143 In Florida the castle doctrine applies. If they are coming into your house, you can shoot them. Doesn't matter if they are armed or not. It is a legal shooting.

If they are leaving your house with your stuff, then you can't shoot. You life is not in potential danger at that point.

So the key is always are they moving toward you or away from you. If toward you or your house, you are legally allowed to use deadly force to defend yourself, whether they are armed or not.

Yes, and here's why. Say that large screen TV that the thief is walking out with cost you $1,000 at purchase. To the left, what's a mere $1,000, right? Uh, not so fast.

Presume one is making $1,000 per week. Out of that income, 1/3 is lost to taxes. Now, you've got mortgage/rent, utilities, food, car payment and much etc., besides. Maybe you can set aside $40/mo. for that TV? You might've had to save for months, even more than a year to have set aside enough to have bought that TV, or conversely, make payments on it for that long, or longer. Half a year or more out of your life that can't be replaced.

Thieves steal time off of your life, and THAT is the crime. Anyone tries to steal time off of my life, is about the same as killing me that much sooner than the sand in my hourglass might otherwise say. Makes it a Capital Offense, in my book. Texas law pretty much sees it that way, too. (yes, exceptions, different discussion.)

Penalties for Burglary were "enhanced" as the saying goes, because people can't be expected to be able to defend themselves when asleep.

153 I know two men here in Texas who shot a killed bad guys that were trying to do harm to them. One was at his farmhouse and a bad guy who knew his grown son showed up threatening the man and his son. Police were called and they went to the wrong place, meanwhile the bad guy started pushing his way onto the property telling them he was going to harm them. The DA in that county was kin to the bad guy and charged the shooter with murder, about year and lots of money finally kept it from going to trial.

Second case was a man with a pick axe was trying to break into my friends garage during the dark hours. When bad guy was confronted he charged my friend with the axe in his hand and was shot and died. Friend was charge with murder by a lady detective who did not understand the law, with the help of a good attorney the Grand Jury did a 'no bill' on my friend and it was over.

Both bad guys were white and the men who had to defend themselves thought it was good thing the bad guys were not of other ethnic origins. Even here in Texas things can go wonky so my suggestion is to only shoot if you or your family are in danger of physical damage, then get a good lawyer.

155 I'm not a lawyer either but my understanding of what you're allowed to defend with deadly force is different in different states.

In some you're allowed to defend your "castle", in others you're required to retreat if at all possible. Looter comes in the back door, you go out the front. In some states you're required to retreat from a threat when you're out and about and in others you're allowed to "stand your ground". Some states seem to include defending your car or truck even if you're not in it. Defending your business from robbers seems like it usually counts as your "castle".

I think that generally, you're allowed to defend other people, pretty much anywhere, with the same "fear for your life" and reasonable man standard for self-defense.

On the same sort of subject - I saw a news special from Houston PD regarding dealer temp plates being forged and the black market around them. We have the same issue here in CA. Just when the fuck did they start these things anyway? Now, people roll around with these fake plates, commit crimes like mad and are untraceable. Police are afraid to pull them over for traffic stops - because you have no idea who is in the car. I see these things everywhere now. Almost always a bunch of Hispanics in a throw-away Honda or Nissan. And I'd bet 1:5 tops is legit.

Our entire society in America is based on a high trust model. We trust when we go to a restaurant that the food will be safe to eat. We trust when we go to a grocery store that the food will be safe. We trust when we go to the bank and deposit our money that the bank will keep it safe for us. We trust when we send our children to school that the teachers will take care of them.

And most relevant over the last 20 months, when we go to the doctor or dentist or listen to a medical industry person, we trust they are telling us the truth so we can make informed decisions about our health and life. This has all been destroyed over the past 20 months.

Where I grew up, there were no dealer plates. When you bought a car from a dealer, you got a hard physical plate. Dealers had them stacked and ready to go. And if you bought private, the plate when with the car.

Then when I moved for college, I was shocked when I started noticing cars without any plates at all or those flimsy paper things in the back window. And I was like huh? How stupid is this, I can make one of those at home.

Amazing nobody at the DMV or DOT in these states thought this was a possibility for decades, lol.

A lot of it depends on what state you're in, so it's worth doing the due diligence. There are a couple others out there with good reps as well. I had the NRA carry guard for a year and dropped it. Way too many limitations and when you boiled it down all you got was some upfront cash for a defense lawyer and a phone number to call if you needed it. I switched to USCCA after that.

In texas simply being on your property and being told to leave opens up legitimate weld defense claims. A lot depends on whether the state is a "castle doctrine" state. Familiarize yourself with your local laws!

Hard to believe, but Oregon used to be about as conservative as it got. I haven't been there in ages since my Uncle passed - but there were gas stations in Medford that sold ammo right next to the cigarettes. Some even had guns. It was easier to buy ammo than a bottle of hooch. But I bailed on U of O Eugene because it was so left wing in 1979. That was my first red pill moment.

There's a 1950s short story by a S. African author, "Being a Murderer Myself," which details the farm-owning narrator's disposal of his ex-girlfriend's body by chopping it up, pounding it into paste, including the bones, and feeding it (blood meal, bone meal) to his chickens and other farm animals. The hair he burned and used as charcoal. By the time the investigators came looking, there was not a trace of her to be found. This was pre-DNA, of course, but the story is fun to read for the sheer thoroughness of its narrator.

I have a mansion, 3 stories with a slide down to a swimming pool. It comes furnished with a cadre of beautiful girls, a sports car, and a private jet.

It's currently sitting in my living room and I'm trying to sell it. My girl left the barbie doll dreamhouse mansion stage a year or two ago so we've been changing things so it's not a "baby room for babies" anymore. At least she still has a stuffed animal pyramid. They always make it out to be greedy to not want your stuff stolen, the formulation that property is not as valuable as a life. Except for the summer of BLM and antifa rioting, it wasn't a choice between Floyd's life and whatever property in whatever city. No one's life was in jeopardy that required stores to be looted, properties to be set on fire, bystanders to be beaten in order to save a life.

When my wife's Akita died on the table getting fixed we brought her home to bury her. They had put her in the freezer and she was frozen solid. I had to drag her across the yard on a sheet, covered her up and started digging a hole. It got dark so I went and got the coleman lantern and kept digging. People kept driving by and slowing down staring at me. when I got the hole about 5 foot deep I got out stood there and finally figured out why people were stopping and staring. Surprised no one called the cops.

339 Not a lawyer, but if they are in the act of entering your home illegally, and you live where your state has a castle doctrine of one type or another, you can shoot them while they are in the act. If you have a shot gun, I would recommend having far more than the normal 5 to 6 rounds type, I bought one that uses magazines and can even use a drum of 50 if need be. If you are worried about a mob, you are going to need to be able to kill an entire mob and a 10 or less round loaded shot gun is not going to get that done, as the time to reload is going to get you into trouble.

If it's the same case off of Forensic Files, he used a chainsaw before the wood chipper, scratched out the serial numbers and threw the chain saw in the same river. The chainsaw was found, they recovered the serial number. And the guy had previously sent in the warranty card.

Back when I was a kid, a local ophthalmologist (world famous) belonged to our country club - really cool guy and avid tennis freak. He had a castle built in Los Altos overlooking one of the fairways. I started watching The Chosen. It's the new crowdfunded Jesus series online. I had heard a bit about it starting with Glenn Beck but because it's 1. Independent and ii. religious I concluded that C. it would suck.

But then I heard a few more things here and there and said, fuck it, it's free. Check it out.

So three episodes in and it's pretty good! It's at least on the same level production wise as a modern network show, if not better. The dialogue is modern, to be sure, but the sets look great. The acting and direction is solid. Like every non-network web series the episodes are of irregular length. Episode 1 is almost an hour. Two is forty minutes. Three is thirty. Maybe that and the only other criticism is the Roman Centurions costumes look obviously cheap. Everything else is a real winner.

So really enjoying this show so far. Can't comment on the history part but It's a decent effort and definitely worth a watch.

I grew up on a farm. We always dug a nice deep hole and planted something pretty on top. Daisies for our dog Daisy, etc. Where I am now we're on rocks. Just rocks. I feel horrible that we didn't bring any of our dogs "home" over the years but it's hard to find a place to bury a hamster or a cockateil. We manage cats and allowed a friend who lived in town to bring her cat out for a nice funeral but there's almost not a hole, and then rocks over the top.

I had to drag her across the yard on a sheet, covered her up and started digging a hole. It got dark so I went and got the coleman lantern and kept digging. People kept driving by and slowing down staring at me. when I got the hole about 5 foot deep I got out stood there and finally figured out why people were stopping and staring. Surprised no one called the cops.

I don't recall seeing any mines from the highway on the road up to Leadville, but that doesn't mean there aren't any.
You can see a lot of un-remediated mines from I-70 on the Western Slope as you drive west on the interstate.
Also, a lot of old narrow-gauge railroad grades where they pulled up the rails and roadbed, but the grade is still there.
That pure Colorado water from snow is a lot of hogwash. Runoff water in CO is full of Selenium and other heavy metals from all the un-remediated mines.
And they are actually working the old gold mine in Cripple Creek, where all the new casinos are.

1. This is STATE BY STATE
2. The most important usual factor is a "duty to retreat"

Most states that do not have a "duty to retreat" indicate that you may use lesser means to protect property, and then if the situation escalates to a threat on your life you may then use self defense to include lethal force.

So they way this looks is, you catch someone trying to steal your stuff, you confront them, instead of running they threaten you, you use self defense to protect yourself.

Now in States that have castle doctrine, depending on how it's written it could be as liberal as, "they were in my house, and I *thought* they were going to steal stuff" and that's good enough to use lethal force.

Check the laws in your state. Know what you can do and can't do.

If it comes down to a jury deliberation, then like most cases, it was won or lost in voir dire. The trial is pretty much pro forma, and matters little. If the prosecution did its job in voir dire, they'll win without regard to the merits of the case. But after their performance at trial, I'm not confident they did a good job at the early stage, either.

A while ago, my very aged mother was worried that a cat would die within a week or two, so while I was visiting, I took an old mailbox and buried it so that door was at the top. Attached a string to the door and covered the whole thing with a large overturned plant pot so that if it rained, it wouldn't fill up the mailbox with dirt.

Years from now when someone is digging around in the garden they will find a decomposing animal in a mailbox.

IIRC, and it's quite possible I don't, Grosskreutz already has a felony conviction for something, and so shouldn't have had a gun in the first place because it is illegal for him to do so. Not that he'll be charged with anything for that.

Yeah, I've been in Buena Vista a few times and driven up to Leadville from there. Leadville is the highest altitude continuously occupied city in the US. It's like 10,400 ft above sea level. It's cold there even in the summer.

You'll already know how to change the way the rifling marks a bullet. If not, learn.
