Rittenhouse Trial: Littlefinger Demands to Know Why Rittenhouse Didn't Let a Man Who Threatened to Kill Him Twice Take His Gun From Him

You gotta watch, go back a bit, to after he has Rittenhouse watch the drone video on the big tv. This is amazing.

Littlefinger is arguing with Rittenhouse is arguing that Kyle was the aggressor and somehow provoked Rosenbaum into chasing him by pointing the gun at him after Rosenbaum chased him and threw an unknown object at him. Then he insisted that Rittenhouse had no reason to shoot Rosenbaum even after Rosenbaum started pulling his gun away from him.

Remember, this is after Rosenbaum told him twice that he would murder him.

Littlefinger is now arguing that you can't shoot a man who is kicking you and stomping your head when you're on the ground, because "he doesn't have a weapon." He says he only used "one foot."

He is now arguing that Grosskreutz only had a handgun and Kyle had an AR-15 and therefore had nothing to fear so he should have let Grosskreutz point the handgun at him.

This series of questions:

Rosenbaum only chased you and tried to take your gun.

The guy who kicked you only stomped you in your face.

Huber only hit you in the head with a skateboard used as a club.

And now: Grosskreutz only pointed a handgun at you.

You had an AR-15 and should have just absorbed all these attacks because it is the only Real Weapon at the scene.

I'm not watching and can't, so I will take this at face value. Why on earth should you? Who the hell does this fucker think he is?

Generally, in terms of the overall philosophy, the threat itself is immaterial. If someone wants to take a weapon from you, that person wants the ability to hurt you without risking himself in the process. Period. No other explanation.

The three people who got shot didn't do that. If fact the keep coming at him while Kyle was trying to flee or was flat on his back. These people had plenty of opportunity to evaluate the risk to them if they continued charging. None of the did what a reasonable person in fear of their life would do: run like the wind away from the treat. Instead the first tried to tackle and take KR's weapon, with the second trying to crush in KR's skull with a skateboard, and the third drawing down a loaded pistol on KR from a distance easily measured in inches.

The jury gets a questionnaire they to fill out, stating what they believe the facts are. A good trial attorney focuses on what the jury instructions will say, and thus avoids any potential landmines.

And if the state's case is weak on one of the elements, the defense attorney hammers that again and again, so that the jury thinks--wow, this document that the judge gave us says the same thing that the defense attorney has been saying. . .

That's the argument the prosecutor *wants* him to make, "I was trying to be a hero" which goes into motivation and would let him say he provoked the attack. But saying he just wanted to protect himself keeps him firmly inside the boundaries of Justified Self Defense.

Q: Why did you shoot those guys?
A: They were trying to kill me.

Q: Why were you there carrying a rifle in the first place?

We don't really know. There's a Wisconsin law forbidding those under 18 from carrying weapons, BUT there are a host of exceptions plus case law that allows those younger to carry hunting rifles. It's a very confusing law and it has been suggested it may be unconstitutional because it contains so many exceptions.

I tend to agree. For better or worse, this entire gambit by the defense was to make the jurors listen to an insane person gnaw tendentiously at the defendant until 4:30 in the CT afternoon, then graciously allow them to go home and eat.

I agree. Kyle accomplished Goal #1, which is to show the jury that he remains calm and composed under a great deal of pressure, and can defend his actions rationally. The prosecution is the side beating this dead horse into the ground.

Odds on the jury was with horrified by the totally of what just occurred or in the equivalent of a diabetic coma. I can't imagine any of this advancing the prosecution case. The totality of the prosecution cross is KR had a duty to get killed and anything short of that was cold blooded murder. KR came across as telling the truth about living through moments of terror. I don't think I could have held up as well as KR did on the stand.

The defense was probably keeping an eye on Kyle and probably thought it would be wise to get him off the stand, as Kyle is probably worn out, and, nothing really to be gained.

The father who beat to death the perv who molested and killed his child is another situation... very different, but one that strikes close to home about what is/isn't "justice" as we've been led to believe.

Deciding whether to do redirect with your own client is not a simple question. There's strategy. If you try to rehabilitate your client on redirect, the prosecution gets to recross. Sometimes, its better to get your client off the stand even if he's taken a few hits rather than spending the next hour+ picking at the scab, and allowing your opponent to pick at the scab some more.

Up till now his character and actions have been presented thru the lens of the MSM and Social Media. The jurors got to see and hear from him as an actual person.

He clearly came across as having restraint and only used deadly force when absolutely necessary. He exercised that force only as long as the threat remained. He never shot anyone who was not a threat -- no bystanders or innocents.

Finally, they got the prosecution to show how malicious, vindictive, petty, and abusive they are. Kyle came across as more mature and adult in his responses then Littlefinger did during his petulant question in this farce. That will go a long way with a jury.

I will go back and review the testimony but my sense of Kyle's testimony is that Binger, the ADA, did not lay a finger on him and Kyle's responses and the prosecutor's overemo questioning style did a lot of damage to the prosecutor's case as well.

The chief worry that I have right now for Kyle is the nebulous gun charge. Sometimes juries when confronted with people dead try to reach a compromise verdict by convicting on a lesser charge. Personally, from a plain reading of the text, I think that the law is unconstitutionally vague and a strict reading (required in criminal cases) would exonerate Kyle. But, the judge has not dismissed that charge unlike the curfew one. We shall see.

There were 9 women and 3 men, including me on the jury. I live in a very very red state - Trump won 60%/40%. Not including any of the women here on this blog, but man. Women shouldn't be allowed to serve on a jury. All the problems we had were from the women who couldn't seem to make a fucking decision. After three 12 hour days of deliberations, we convicted him on all counts. It should have only taken 3 hours.

Kyle is above ground so there is that. Unfortunately, there are many self defense actions done every day, they just don't involve shooting much. Estimates are between 800,000 and 2.2 million or so defensive gun use incidents occur annually. Most of the time, presentation or even someone believing that someone was armed was enough to end the conflict.

In the relatively few self defense cases that involve shooting, most are clear--either justified or not. The gray area ones get the media coverage but are probably less than 20 percent that go to trial.

Unless the judge can explain exactly what the law means, and the jury can also reasonably read it that way, the most logical thing to do is to decide that you can't find someone guilty of violating a law nobody can understand. The panel of lawyers on Rekieta Law couldn't figure out what it meant.

They don't care what businesses they destroy or if anyone else gets killed by it, they just want more violence so their numbers go up. These are no longer journalist, they are completely distorting all information to provoke the idiots that watch them. Some enterprising law firm needs to start adding media companies for this, and attempting to show that any journalistic protections shouldn't cover not only what amounts to slander (of Kyle) but also the provocation of violence.

568 Littlefinger Binger... I'll never get that out of my head anymore! Binger is acting like some sort of tyrant so the name definitely fits!
So Littlefinger's attempts at mistrial yesterday didn't work out so well with the judge, so he's just going for Twitter exoneration of his attempts to prosecute KR. This guy seriously needs to be removed from his office. I'm sure he's backed by Soros money so it will take some serious efforts to oust him in Kenosha.

I would love to see the mayor, police chief, et al asked about that. Why was it allowed to continue? Why is Rittenhouse the only one being procicuted? How may from out if town? The multi day riots precipitated the deaths as well as the actions of the local and state governments.

If anyone should be on trial it is them!

572 I have a theory.

Assume, for the sake of argument, that the prosecution team is a group of decent lawyers who know what's going on, and aren't, as it seems, unfamiliar with things like courtroom rules and the Fifth Amendment.

My theory is that they've come to a "gentlemen's agreement" with the defense. They know their case sucks, they know that Kyle will be found Not Guilty, and they also know that the jurors will be in danger because of it. In order to mitigate that danger, they're throwing the trial. If the judge is forced to declare a mistrial with prejudice, then there's no reason for people to attack the jurors, and the jurors would even be free to give interviews and say that they were leaning toward "guilty" votes.

People will riot against the court and the city, of course, but that's going to happen anyway, regardless of the verdict. This way, they can at least protect the jury and their families.

Anyway, it's the only explanation that makes sense to me. The only other possibility is that Littlefinger has never been in a courtroom before, and probably hasn't even attended law school in the United States.
