Hey everybody! Hey ace!
Russian Tea Room? That takes me back. I remember a hot eatery to be seen in, in the early 80s in NYC, was the Russian Tea Room. There's a great scene in Tootsie (Dustin Hoffman reveals it's him in drag to his agent, Sydney Pollack) that takes place at the Russian Tea Room. Not sure if it was actually shot there or not. So ace is Ace, now? Just checking.
And the embargo on the arrest/its implications is absolutely SOP, ace, I mean Ace. For years now. Those old enough, and with experience in the now defunct authoritarian societies we used to fight on a global scale, often find it difficult to put into words how the US is now essentially a soft North Korea, of sorts. There is no "press", there really is no "news". And it was bad enough, decades ago, that those of us in the biz mocked it relentlessly - but that was merely on the level of bias, and cluelessness, and partisanship. We are now in a post-American, post-constitutional, post-open, post-scientific society. And a VA governor race has done bupkis to change the bizarre alienated feeling that this incredible situation has created. Posted by: rhomboid at November 04, 2021 06:51 PM (OTzUX) 40

Huh? "Charlottesville" (where the reality was actionable criminal civil rights violations by then-guv McAuliffe, and the C'ville mayor and police chief) *to this day*, to almost everyone in the country who even knows anything happened, is some example of Trump's "racism" (the crude, North Korean-level lies about the statement he made in NYC).
This crude, infamous slander was never "debunked" by an army of independent "journalists" - not in any way that mattered. Of course anyone not an airhead and with any curiosity knew it was nonsense from the start. And on, and on. There isn't a single meaningful issue or event where the MSM distortion or outright fabrication is not "reality" for most of the country - even "Trump supporters". Jeebus we see it here in the comments constantly. Posted by: rhomboid at November 04, 2021 07:07 PM (OTzUX) 110

Posted by: All Hail Eris, She-Wolf of the 'Ettes 'Ettes at November 04, 2021 07:09 PM (Dc2NZ) I am excited about a bit of trash I have finally tracked down, and which is coming in the mail on Saturday. A good while ago, I asked the Horde for help. I had watched some video, that I could not find again, with some really funny black dude showing clips of Obama losing control of his crowds, then playing a clip from some movie, with a pimp saying "You saying you can't control your bitches?" and then him coming on and saying "No, he can't." I asked if anyone could identify the movie, but no one could. Finally, I cracked the riddle. It's a Blaxploitation movie called Willie Dynamite. It gets a surprisingly high 6.5 rating on IMDB, so I really want to watch it. Amazon had a DVD with that and two other fun trash movies on it for 7 bucks, so of course I went for it. It turns out that I am not the only one captivated by that line. There's a YouTube that repeats it, over and over, for like 4 minutes. https://www.youtube.com/watch?v=hCEi2qtiFIk Posted by: Splunge at November 04, 2021 07:16 PM (R+A4V) 149

And more often, just friends repeating the same tired talking points. Nope, they're far more versed on whatever is the new hot show on Netflix. They know who won the world series, but have no clue there were elections in NJ or VA. Not unless a cultural icon gets out there and starts screaming will anybody notice. Hopefully, that might happen. If a hot rap artist started screaming about $450k, the black community would be up in arms. But I'm not holding my breath. There was some really bad prime time TV sci-fi thing back in the 80s (?) with Natalie Wood. She played a russki scientist. Oddly for such a low-budget piece of dreck, they had some Russian language in it.
As with "The Russians Are Coming!", when viewed later in life on TV, and Alan Arkin's perfect Russian, I was astonished to hear Natalie (Natalya) speak perfectly, no accent. Pex for plumbing, wiring harnesses for power and telecom can be either set in conduits, in tunnels printed in the walls, or like with current concrete casting, set into runs cast into the walls that can be covered by wainscotting or mop boards.
Easy-peasy. Or build the walls a few feet higher and use raised flooring for all of the electrical, plumbing and HVAC. Any room left is for storage. Interior curtain walls allow someone to quickly reconfigure the floor plan and move outlets and plumbing at will. Posted by: Reuben Hick at November 04, 2021 07:48 PM (+LCoQ) 246

So the case law on the clot shot mandate is Jacobson v. Massachusetts.
Basically Mass based a law requiring people to get a smallpox vaccine. Someone refused and the court ruled the legislature can force you to get a vaccine if they think its a good idea. The one good thing about Biden's EO - it isn't a law and it wasn't passed by congress. But one expects that the left will cobble together 5 votes in the SC for it, unless they come to believe pushing for it is untenable politically. Oh...and this is also the legal basis for the government being able to forceably sterilize people that believe shouldn't have kids - one of the most important SC decisions of the progressive era. These scrunts think the only way to date is up, both socially and economically. They also do everything in their power to use their victim status to get an edge on men. So the scarcity is of their own making and choosing. They could date a plumber or electrician or any other skilled tradesman, but he's socially icky. Wouldn't fit in with the brie and Pinot crowd she prefers. So she get a guy with an attitude. Good for them. Posted by: OneEyedJack at November 04, 2021 07:56 PM (MFphb) 274

Given the rate so many people have given their conscience and bodies to the State to do with it whatever the State wills, there aren't too many "individuals" left in this world. 271 Jacobson court did not rule that he had to get a shot. Instead, reminiscent of Dred Justice Roberts, Jacobson had to pay a fine for not being vaccinated. Rochin v. California is more on point where the police pumped the stomach of a man that swallowed illegal drugs in order to save evidence to indict the man. This was held to be an unconstitutional search regardless of probable cause in that it shocks the conscience of the court under the 4th.

Whether the worker is asking for an accommodation that would likely be requested for nonreligious purposes Whether the circumstances indicate that the worker is asking for the accommodation for nonreligious reasons So...presumably you do NOT want to talk about the side effects of the clot shot nor its ineffectiveness. Trump made Durham a special investigator, during his lame duck period--and I think Durham retired as a US attorney, too. Basically, that means there are statutes that protect him, and he can't be shut down easily

Because I'm a cock-eyed optimist, I'll point out that no one's been fired for failing to get the vax--at least not yet. The admin always backs down, because no one is complying. The supply chain situation is nowhere near as bad as the hype. And inflation is bad, but not Venezuela bad. (Not yet, anyway) Meanwhile, the worm has turned--you can feel it. Disneyland has a mask mandate, and I went yesterday--no one was wearing a mask. And that's in California Posted by: artemis at November 04, 2021 08:54 PM (AwPyG) 502
The ancient writ of habeas corpus is that the federal government arraigns the defendants with specific charges against them. There is a caveat that may be used where others are held as material witnesses to crimes like after 9/11 in detention. But generally, everyone upon arrest is given a chance to declare themselves guilty or not guilty before a judge in a reasonably short period of time (see 18 US Code 3161).
I cannot speak for all of the January 6th detainees, but I think that most if not all have been bound over for trial after arraignment and no bail set by DC judges. Where things get sticky is that they have the right to a fair and speedy trial under the 6th amendment (impartial as well) which is implemented into a statutory requirement but any defendant motion such as discovery of evidence etc. resets the speedy trial timeclock (see 18 US Code 3161). A judge's ruling that the DOJ cannot farm out discovery in these trials to a third party also increased the time to trial unless defendants unwisely waive discovery to get on with the trial. OSHA is a policy, not necessarily a law enforcement agency. They have been known to shut down "unsafe" businesses in the past. Now, "unsafe" businesses are those that do not enforce vax mandates or whatever this administration dictates.
This was always the plan. Let the businesses be the enforcement arm of the fed. It's not law. It's policy. Policy is now above the law. Businesses can, and will, enforce corporate "policy" that just happens to jive with what this administration wants. It also lets the businesses off the hook for any potential legal issues as they can claim they were only doing what the government wanted. And don't forget; most businesses have been all in on this shit for nearly a decade. Big Tech lead the way and everyone else just got in line.
