ANOTHER DAY, ANOTHER POWER GRAB

Here's Tucker Carlson on the latest outrage from the Biden Administration:

It's a pretty righteous rant about the CDC director's decision to extend the eviction moratorium, and who gave the CDC authority over landlords and the houing market? I agree with Tucker that this is an outrageous overreach, but I have a beef or two with how he's arguing his case.. The first is that Tucker is presnting it his audience as if it were a new thing, some new form of tyranny that the Biden Administration thought up just now. But this is misleading. What Tucker is describing actually has a name, administrative law, and it's been going on over a century, informally since the end of the 1900s, and formally with the passage of the Administrative Procedures Act (APA) in 1946.

I don't think this country's founders ever envisioned regulations with the force of law being written (enacted) by unelected bureaucrats, but that's the country we're living in. This applies to any federal agency, but my favorite whipping boy is the EPA who can come in and designate all or part of your property as a "protected wetland" and too bad about your development plans you were counting on to bring in income for your retirement, but they're now illegal. Or, worse, you need to spend many thousands of dollars to bring your "wetland" up to EPA specs, otherwise you'll be subject to heavy fines.

Often with no appeal.

So what about due process? Congress enacted the APA specifically to establish fair administrative law procedures to comply with the constitutional requirements of due process. But I've heard enough horror stories to wonder how effective these protections are.

Second, despite Tucker's protestations of the illegality of this, I'm not sure it will hold up in the long run. We've been living with administrative law for decades. Some Republicans have grumbled about it on and off, but, like any other federal program or agency, once it's in place, it will never go away. It's now a feature of the landscape. There is, for lack of a better word, "precedence" for this power grab. It's outrageous that SCOTUS has already ruled against this but they're going ahead with it anyway, but what the CDC director wants to do is only different in degree, not in kind, from what has gone before. The Biden administration is doing what it can get away with. As Tucker said, who is going to stop them? Mitch McConnell?

There's a scene in the underappreciated science fiction movie Outland where the beleaguered Federal Marshall O'Neil (Sean Connery) appeals to the people he is trying to protect for help. "What about your men?" one of them asks. "My men?" responds O'Neil. "My men are shit."

That's pretty much how I feel about the Republican Party right now.

Administrative law is a malformed chimera and an appalling mess. It needs to be eliminated. Congress enabling the Executive agencies to write their own laws, all haphazardly, and then enforce them on whatever terms they decree is a disaster. It - along with most of the agencies themselves - need to be destroyed. Each and every one of those enabling acts - and there have been many - passed by Congress needs to be repealed by Congress.

And while we're in fantasy land, the Dallas Cowboys cheer squad will blow me this evening.

13 If I remember correctly, Outland was one of those movies where the hero (Sean Connery) was brought in and specifically set up to fail because The Powers That Be (TPTB) running the mining operation on Io had a sweet gig. Naturally, the hero overcomes the challenges and prevails, more or less. TPTB don't actually want to solve problems--they want to find scapegoats to blame things on when everything fails.

This is the kind of motte-and-bailey shit we see all the time. They won't get their "Department of Anti-Racism" but they *will* back off and put "anti-racist" doctrine into agencies like HHS and HUD and EPA and DoE (both of them) to various degrees.

I knew that would come up, and, in fairness, I did say somewhat more innocent than the 1950s or 60s. In any event, Arbuckle was framed by a grifting pimp and an ambitious DA who thought he could ride the case straight into the governor's mansion.

As well, Virginia Rappe, the "starlet" Arbuckle supposedly "raped" was not the gonorrhea-ridden slut of popular fiction. She was more successful and less trampy than people want to believe. Greg Merritt's Room 1219 clears away the myths on that bit of Hollywood Babylon.

36 McQueen knew Jay Sebring, the hair stylist guy caught up in the Tate-Lo Bianco murders. He recommended Sebring to Robert Vaughn, and Vaughn went to him for hair cuts and styling for several years. Vaughn tells in his memoir that Sebring invited him out to parties with Sharon Tate and the rest of the group, and Vaughn kept turning him down (he does not say exactly why, just that he can't remember why).

If he'd accepted that last invitation . . . we'd be calling them the "Vaughn-Tate murders."

one of my favorite movies, one that now is being called "neo-noire" . The car chase is famous because it's not only good, but more importantly *no* *one* had ever filmed a car chase like that before. Look back at movies before then and almost any car chase scene is people inside cars looking back with a screen behind them making them look like they're moving. This one was real, it was mesmerizing - and now it doesn't seem so special when we see it because *every* director who filmed a chase scene after that copied the techniques first used in Bullitt. It was one of those movies that changed the way every other film director worked.

I didn't get that. I thought it was more: "Honest man gets injected into a totally corrupt environment, zany hijinks ensue" sort of plot. I thought it was suggested that O'Neill had a mouth on him and, to stop him from causing trouble, TPTB sent him to the most remote posting they could find.

Congress doesn't even write its OWN laws - they use activist groups to do the actual writing, and then they just put an authoritative face on it. These enabling laws are just saying the quiet part out loud.

Using human shields like politicians to hide the smarmy, extremely anti-human activist groups is as old as the Trojan Horse. We know a little bit about this process thanks to the internet and bloggers specifically, but in the end, little people like us get fucked.

The California model. They do a border checkpoint on roads to check for agricultural products they don't want to enter into the state. It's illegal and you *can* tell them to fuck off and enter anyway (which I did), but most people don't. They've been doing border intake control on their state lines for a long time now.

My guess is when this order comes down in a month or two, what the Biden Cabal will do is ask a bunch of states to "voluntarily" set up Wu-flu vaccine papier checkpoints to further acclimate people to the idea. Some will resist and while the legal process is grinding, watch for the usual suspects (Hawaiian judges, ACB) to give the standard "no standing" delay.

This might be a way to get a non-compliant governor like DeSantis under control by declaring his state "under rebellion" and send in the Feds to try to extinguish any small flicker of liberty left.

Just close all of the roads that cross a state a line that you don't want (or can't) control and route all traffic onto Interstate Highways and whatever US routes you wish to remain open. Sure, it may result in detours running hundreds of miles, but those line crossings are superfluous and unmanageable in the current emergency. It is just a temporary measure anyway, and everything revert after the crisis passes...

They may not be able to put checkpoints at every state border crossing but they will want to see your papers if you get stopped for a ticket. Also they scan plates of cars from out of state and some data base will have vax status.and notify cops if you need to be pulled over.

On this day 60 years ago, everyone thought that the Soviets were going to invade West Germany imminently because the the construction of the wall in Berlin. That's the GM methodology to this day. It's not the case. I know a kid that's taking 4 cyl Volkswagen's and pushing over 700 HP to the wheels. Granted, the longevity is largely non-existent, but, 700 HP in a car that weights 3500 lbs is significant.

CVS only has the J&J vaxx at the MinuteClinic stations inside a few CVS stores. Search for those. (Last week CVS pulled the J&J stuff out of their pharmacies and sent all they had in-stock to the MinuteClinic locations.)

I got the J&J shot at a Minute Clinic in Houston, late Tuesday afternoon. No arm pain, felt a little woozy with a slight headache for less than 48 hours. I am back to normal now.

It just demonstrates that the problem wasn't the Taliban. The progress they're making - if it's real - is only because people are willing to let them do so. They have to be fought off with heavy weapons for every inch of territory, but the moment you leave they come right back and do so quickly and without apparent effort.

So what does that tell you? It tells me that the *people* of Afghanistan are down with the Taliban, are happy to have them, and are welcoming them back. They certainly aren't interfering. So the problem is the people and population at large, not those nasty Taliban fighters who are oppressing them.

TL;DR: nation-building was a stupid idea without vanquishing the population first.

I'll take a stab at this. The flu vaccine is developed for the flu that they THINK will be predominant that season. They're almost always wrong. I did a quick search, and it seems that the flu vaccine is sterilizing, however they just guess what strain is going to dominate, which is why people get the flu.

The Safeway stuck out as I had shopped there in 1989 or so and it hadn't changed a lick in 20 years or so. The feeling where you see a scene in the limited POV of the camera and your mind just fills in *all* the peripheral information is weird.

Renting a piece of real estate is a purely local, i.e. intrastate, transaction. That transaction is not interstate commerce, and rightly considered does not even "affect" interstate commerce. Proof of that is the difference in rental prices in different states. So even if Congress had enacted the eviction moratorium by an enacted law, this Justice would rule that unconstitutional. Much less so when a bureaucrat out of her lane decrees it.
