The Morning Report - 6/18/21

Good morning kids. Friday and the weekend is here. There are a number of stories breaking including two huge rulings from SCOTUS that underscore that corrupted institution's schizophrenia. On the one hand, they delivered a 9-0 annihilation against Big Homo forcing Philly's Catholic Social Services to countenance homosexual marriage. That is a huge and important victory for religious freedom, especially given today's insane political and cultural environment. Yet, at the same time, the court handed down a 2-7 loss that seemingly leaves us with Obamacare forever. Feh. Well, after all, it is a tax/penalty/tax/penalty or whatever the penumbric emanation of the goat entrails told Cheap Justice Julia Roberts to call it.

A good friend of mine is a lapsed Catholic and atheist who has always blamed the Church and all religious dogma for his as well as the world's ills. G-d bless him, when I pointed out that its not the Church nor religion that's the problem; it's the failing of people who ignore religious doctrines of ethics and morality that's the problem. I think a lightbulb went off with him and considering he's a testa dura Pugliese, I consider that a small victory. But Psaki-psircling back to SCOTUS, we have their abject failure in the wake of at the very least a completely compromised 2020 election to do their duty in hearing the cases that was the absolute bitter end for me and confirmed for me that besides being irreconcilably divided, America's house was rotten from the inside out.

But, with revelations that confirm the obvious premeditated fraud as well as outright larceny on election night in Georgia, Arizona and now in Pennsylvania, the Court may once again be the focus of attention.

The Supreme Court avoided involvement in the election because they wanted to stay out of the controversy -- they didn't want to be bullied by the Democrats or the media. There are other possible motives, but they're even more disturbing. Cowing to bullies will not avoid conflict. Bullies prey on weakness. One has to either stand up to them eventually or accept servitude. Every kid on the playground has learned that lesson by the 8th grade. Apparently, John Roberts hasn't. Each time Chief Justice Roberts has acceded to the bullies, he's made the court's future challenge greater.

Ruling that last minute ad-hoc election changes were unconstitutional would have been relatively straightforward -- but the court didn't. Hearing the election fraud evidence and adjudicating the result would have created a political crap-storm -- but it would have been the right thing to do. What will become of the court's reputation if it becomes obvious that the election was stolen and rather than stand up, it sat down

An April poll by Rasmussen Reports found that 51% of the population believes that fraud affected the election outcome. Does Roberts grasp the significance of that number? It's the percentage of the population who believe the Supreme Court was derelict in defending the Constitution. If John Roberts wanted to defend the court, perhaps he should have considered pursuit of the truth rather than avoidance of controversy.

A recent Ipsos poll found that 63% of the public thinks it's time to impose term limits on Supreme Court Justices. The public isn't stupid. It recognizes that the Supreme Court needs to be taken to the woodshed. The next few months will say a lot about the Supreme Court. Will it correct course, or will it embrace servitude to the mob?

Paraphrasing Mark Levin, every June, the entire nation bites its nails in anticipation of be-all-end-all rulings from 9 very flawed human beings that will affect the lives of 320 million of us forever, with no recourse. The court was never meant to have this kind of power but then again, the Federal government was never supposed to be an ever more powerful and invasive Leviathan of unelected bureaucrats issuing edicts that carry with them the force of law. And yet, here we are, with every institution that is supposed to safeguard our G-d-given inalienable rights as well as ensure our physical safety totally corrupted beyond all recognition and anathema to the very reasons the nation was founded in the first place nearly 245 years ago.

Levin himself proposed term limits for all justices up to and including SCOTUS in his Liberty Amendments from a few years ago. Ironically, with Ruth Bader-Meinhoff's departure for the Choir Invisible and the installation of alleged originalist Amy Coney Barrett right before the election, the Left were not only hell bent on packing the court but failing that, they glommed onto Levin's term limits brainwave. Seems appealing insofar as getting rid of the hacks-in-black but the cold reality is, as someone much wiser than I once postulated, "any organization not explicitly conservative will turn liberal over time." In any case, our nation from top to bottom and inside-out has been so thoroughly corrupted that it's pissing in the wind trying to fix it piecemeal, even something as important as SCOTUS. For argument's sake, let's say the audits actually confirm what we already know, that select cities across 6 states essentially rigged and stole their 2020 elections. First, there's the gauntlet of not only the media/Democrat propaganda shit-storm claiming the audits are frauds but now we have this tinpot Torquemada in Merrick Garland threatening the auditors.

But even if the audits successfully run that gauntlet, what is the end-game? Surely, there's no way in hell that we'll get a do-over, let alone see Trump re-installed back into 1600! But it is crucially important that the audits go forward and the truth put out there. The nation as we knew it, or at least as we had perceived it to be up until about 2009 and for sure on January 6th, 2021 is gone. We are in uncharted and very dangerous territory. Trying to deal with things and anticipate outcomes based on institutions like elections and run of the mill party politics is a complete waste of time. Even worse is institutions that are supposed to be independent of political considerations, especially business, have now for the most part also been subsumed by the Leviathan.

As more and more people are waking up to the nightmare of a dementia patient being used as someone's puppet (and it looks like the way is being made for Biden's exit), the abject evil that is Crackpot Disg-Race Theory, the fraud of Anthony Fausti and the 18-month imprisonment over Wu-Flu and the acknowledgment that Red China caused it and is out to conquer the world, those who have inflicted these evils on us are quadrupling down on the censorship and persecution.

Something's building out there, and it's big.

25 J.J. I am glad that your remarks about people not following ethics and morality in the framework the church provides may have caused a lightbulb to go off with your friend. It seems odd to me though, it never happened before. There are plenty of atheists who while acknowledging the large moral and large failures of certain people in the church are willing to admit the value of Judeo-Christian ethics in maintaining a well regulated and generally upright society even if they themselves are not believers.

Its a moot point. The courts have been increasing corrupted since the ink on the Constitution began to dry. Now the courts are completely corrupted, unmoored and have forgotten that the US Constitution exists and is not a eight hundred thousand page document of fine print, exclusionary, ambiguous and sunset language.

Furthermore, the Supreme Court loses legitimacy with each 5/4 ruling because it shows that the Constitution had absolutely no effect and that these jokers are wing-ing it on ideological basis and what kind of shitty interns are composing the rulings.

But most important, the courts lost legitimacy when a growing segment of the BAMN population bullies, ignores or flat out rejects court rulings. And why not? It is just a game now. Do whatever you damn well please, wait for someone to complain and have the issues dragged before the Supreme Court a decade after it no longer matters, then have the Court rule on some arcane trivia that ends up having no effect.

Good point. I try to do that everyday. I along with others in our church group are leading a book study called "Holy in the Moment" by Ginger Harrington. It is a book for women but men can probably also benefit from some of the ideas it suggests. She says on page 39 1. Christians should invite Jesus into their day by saying, Good morning, Jesus and comments no matter how the day starts we can make a choice to connect with our source of life. 2. Ask Jesus to express his life in you and believe that he will do it 3. Stop and ask God for what you need at that moment.

And, of course, all these can be applied to people who are Jewish as well. They just substitute the word God for Jesus.

67 They could impose FAA mandatory retirement rules on the SCOTUS, I suppose. I don't know that it would help. Much of the Court's problem stems not from longevity but from the venal and banal pursuit of power. Knowing that your ride has a fixed end date won't make you ride less enthusiastically. If anything, it might make it worse since you have only so much time to ensure your "legacy" of casting the former Republic deeper into ruin and sanctioning greater and greater degrees of evil within its halls of power.

88 When I take off my optimist hat (I rarely wear it) and but on my "bitter, jaded cynic" hat, I think the audits are officially meaningless. There will be one of two outcomes:
1. They find little wrong, and declare that it wouldn't have affected the outcome. They promise to fix things next time. This is clearly not true, but they'll stick with the story.
2. They find massive problems, acknowledge that it affected the outcome, promise to fix things next time, and encourage the illegitimate president and his party to pump the breaks and ride status quo until the next election. The figurehead and his party do nothing of the sort.

Either way, no meaningful reform happens, because - just like last time - any new law or rule, however complete and powerful, will not be enforced. The only result the audits can have is to lay things bare for people to look at and know, deep in their bones, that the emperor is naked.

The mortgage bubble is back. It is slightly different this time around, but it's there. Last time the problem was essentially two-fold. First, housing prices shot up due to low interest, but the ascent affected the debt carrying capacity of the borrowers and the growth collapsed. Second, a lot of it was financed with ARMs and silent second mortgages (where you also borrow the down payment and double-encumber the property), resulting in 100% or higher debt ratios.

The ARMs are more or less gone, so there won't be reset-based defaults this time. But the low-interest fueled appreciation is still there, plus we now have PE in the mix. The prices are untenable, and even a tiny bump in interest rates is going to rip it down. Strategic default when the asset value falls is still going to be in play, regardless of ability to pay.

I doubt it, though I envy your optimism. The fact that he is with DIA is perhaps promising (since that is the only facet of the IC that is even potentially aligned with American interests), but ultimately I think that it won't matter.

Suppose he does tell us everything and it gets confirmed. The entire power class is in China's pocket, including the titular president and the men behind him. Assume our worst nightmare is not only true, but worse than we thought.

I think we largely agree. But there is a way to release information whereby the people who get it must act on it. If you do it the right way, there is almost no way to avoid situations where there is a direct material violation of the law backed up with evidence. The mistake people made in the past was to keep that evidence secret and then render judgment in the "dark".

This is true, and it was avoidable had our governments made different, better decisions. The only reason this is happening is the lack of regularity in tax and other codes, brought upon by inefficient and disharmonious dog-eat-dog competition.

What Florida has done is unfair. Their absence of an income tax, their lighter-touch regulatory complex and other factors create a perverse incentive for relocation. That needs to be dealt with. The rest of the country cannot stand by while place like Florida, Texas and Tennessee rob Peter to pay Paul. It is absolutely imperative that we pursue tax policy harmonization across the states, as directed by the federal government.

Without imposed harmony in tax (and eventually regulatory) codes, this kind of gross imbalance will continue to grow and the effects of zero-sum competition will continue to enrich the newly-dominant states at the expense of the old home states. The perverse incentive in the form of competitive tax and regulatory regimes needs to be forcibly eliminated through harmonization.

I would agree the justice system has been subverted. "Justice" is no longer dispensed. It is weaponized against one side and not applied to the other. But part of what allows that is the media and the overall lack of information. People are getting wise to that game. So are people in positions to make a difference. So I agree if past is prologue it's hard to see convictions. But I think what you will see are releases of information before that naming specific individuals that will either be beyond repute, or that will tar those individuals with very specific information. My daughter works for a contractor, and their government client told them yesterday at noon that it would not be working today, so the contractors can't work or charge the contract.

The upshot of that is that everyone on the contract is being forced to either take a day of their own paid time off, or take 8 hours less pay. Or just work as usual and not get paid.

Doesn't bother my daughter much but what a mess.

I'm in tech, and I can't tell you how many rescue missions I have been highly compensated to perform. Just the time-zone difference is enough to frustrate the front office suite, imagine the cultural and language barriers. You have to sit on the curb in a small American Town as a child on July 4th, not read about it as an adult from a book to understand certain things. That concept translates into many different domains.

What you see being outsourced to non-Americans is exactly the targets for replacement with AI. Foreign labor is merely a temporary interim step. You want work in the future economy, the first indicator you should use is how popular is that role for foreigners?

Your wish was already fulfilled! In the run-up to Y2K Crisis, I was pulling north of $350k/yr in 1990s fiat writing code.

Then the H1s flooded in and brought in the great crash in tech salary. So I repositioned myself in the industry and have recovered.

Some people bitch and moan that a customer found a less expensive product, others realize that a market has been saturated and another should be developed.

It does two terrible things; first, it absolves the individual of their responsibility, capacity for shame and remorse, secondly, it allows the redirection of blame to arbitrary and convenient targeted enemies of malevolent powers.

Corrupt individuals in a group love it when you blame the group and not them. A scientist lied = YOU HATE SCIENCE. A journalist is corrupt = YOU HATE THE FREE PRESS. A politician is corrupt = YOU HATE DEMOCRACY. A priest has committed horrible crimes against the vulnerable and innocent = YOU HATE RELIGION.

It's lazy and corrupts your own sense of morality. And gives tremendous power to people who should never have power over others.

Why are you commoditizing medical personnel? Granted, specialization, automation and regulation has worked its way through the nursing profession, but what is it exactly that you want when you need medical help?

A huge hidden benefit of Obamacare is the compilation of massive amount of medical data. As technology and standardization coalesce, the data becomes more meaningful and becomes a prime target for AI.

Death by Medicine is a big deal that can be diminished through AI. In this case, A = Augmented, where a physician can make a diagnosis, compare it to similar, or at least have guard rails to flag incorrect procedure.

Somebody is making that product. That has always been a weird thing about unions. The union believes that a job belongs to a union member, not that a customer needs to have some work performed.

A customer wants widgets made. The union rep shows up and declares that whatever labor is required to make that widget, that labor can only be fulfilled by a person who is a member of the union - not that other person over there who also needs to pay the mortgage. The union takes ownership of something that they have zero risk in providing.

Basically, unions say "fuck those other people".
