Take it back – The Rise of Neofederalism (Part 1) [Dave in Fla]

To my knowledge, the United States is unique in that each state operates almost as its own country. The federal model establishes a number of roles filled by the federal government, but outside of those roles all other responsibilities of governance are left to the states. Of course, we have seen the erosion of this model over the last decades, but in principle it is still unique. Every other country in the world operates using a national model, where policy implementations and police enforcement tend to be dictated from the top. It is fair to say that individual states have more autonomy for establishing laws and conditions than any peer state or province in other countries. This was particularly shown during the COVID plandemic, where the responses were wildly different between different states, resulting in significant differences in economic outcomes.

Leveraging the power of states to chart their own course is a tactic that the left has used for half a century to push their agenda. Now that they have succeeded in taking the reins of the federal behemoth, they are focusing on using the administrative state to impose their will on the rest of the country. A country that does not want their vision of America, as I discussed in my post on demographics.

But their shift toward a federal focus leaves an opportunity, a place where they have now abandoned the field. They only have so many troops for this fight, and they can’t fight on every front. Individual states are where the opportunities for victory lie, ironically due to the success of leftist initiatives in the past. Let’s take a look at some examples that show how state initiatives ended up driving national policy.

The Clean Air Act

In 1975 the Clean Air Act established a national standard for the levels of emissions that are permissible for automobiles. However, when the Act was established, an exemption was issued for California. The EPA legally must issue this exemption to the state for them to establish rules that are stricter than the rest of the country. The current exemption was issued in 2013.

The reason that California was granted this exemption is that they got to the issue first. They had already put emission laws into effect prior to 1975, therefor to keep from overruling the existing state laws, the exemption clause was added to the Act. The practical result of this exemption is that California dictates to the rest of the country what kinds of automobiles they can drive. The automakers aren’t going to bother building two types of cars for sale in the United States, so cars that are able to meet the more stringent California requirements are what are sold to everyone. This exemption to the Clean Air Act has become the only operable feature of the Act itself, and California has threatened to sue if the exemption is ever rescinded. This example shows that a single state does have the power to regulate itself, even if it imposes a burden on businesses that operate nationwide. The courts don’t care about inconvenience to businesses.

Marijuana Laws

In the last few years there has been a rush to legalize the use of recreational marijuana. First was the push for medical marijuana, but that soon morphed into open marijuana use within many states. These laws are in direct conflict with federal law, where marijuana use is still a crime.

The basis for this disconnect is two memos issued by the Obama Administration’s DOJ. These memos outline conditions where the DOJ would look the other way and not prosecute federal laws, if states passed laws in compliance. What is interesting is that these memos are specific for marijuana, yet Oregon just passed its new law that legalizes all drugs, going far beyond the context of the DOJ memos.

The practical effect of the situation is that state laws have usurped federal law, in the case of Oregon without any underlying precedent. While none of this has been tested in court, there is nothing that stops the DOJ from rescinding those memos and prosecuting recreational drug users for federal crimes. However, if they did the likelihood is that the state laws would be ruled as taking precedence.

There are many other examples where state laws have driven national policy. The Right to Repair law in Massachusetts forced automobile makers to enter into an MOU in 2014 to guarantee access to car telemetry by 3rd party repair shops. The automakers did this rather than fight another 49 lawsuits.

Neofederalist Strategy

So how do we use these precedents to push our agenda, rolling back the leftist cancer that is destroying our country? First, keep in mind my first two essays. Our political philosophy represents a majority position in the country as a whole, and in the majority of states. Also voting laws are being strengthened to allow our votes to count. I have read your comments, and I can’t argue with you. The 2020 election and many others in the past make us question whether voting matters. But for the survival of our philosophy and ideals, it must be made to matter. In the end, our victory depends on the voters in places like Pennsylvania forcing their political will to be acknowledged. It means putting the right people into the legislature, getting a governor that respects the will of the electorate, and removing judges who won’t uphold the law. And while fixing states like Pennsylvania is crucial, using the political power that we already have in states like Florida and Texas is the lynchpin for taking our country back.

The examples above show the strategy that allows states to establish their own laws to govern on a range of fiscal and social issues. If a state can establish laws before any law is set by Congress, then they have a dominant position to demand that their law not be affected by federal legislation. Even if the legislation does exist, if the law or administrative rule is not identified as an enumerated power within the Constitution, the state law has a very good chance of prevailing in the courts. The winning strategy is to use our demographic advantage in the Red states to establish laws enshrining our principles and demonstrate the success of our model of governance.

Ace talks often about a National Divorce. We wonder what that would look like. I contend that it is major states like Texas and Florida enacting laws and policies that act as a magnet. Other states will follow suit. Liberals that don’t like the conditions will leave for states that better suit their tastes, while those with conservative leanings migrate to the Red states. By taking control of the educational process, within a generation the leftist cancer will be rolled back in these states, and their economic success will ensure they continue to dominate the national discourse. Eventually, they also retake Congress from the Uniparty by controlling the majority of legislative districts and states.

Since this post is reaching movie review length, I’m going to provide numerous examples of how this strategy is already playing out throughout the country in Part 2. Stay tuned!

This was before the Bank of the United States, which was a Hamilton idea, and one that others (like Jackson) hated.

29 Texas buys school books for the entire state* in a mass purchase, which means that textbook publishers have to make a version at least of every textbook that is not unacceptable to the State Board of Education. The SBOE tends to run very conservative. So the Texas version, if it's not the only version, at least ensures that there is a reasonable version of every textbook out there.

*OT, but remember a certain Mr. Oswald worked at the Texas School Book Depository. Texas has been in this business for a long time.

Why wait? It is either the right thing to do or it is not. Usually the people who act first on an idea do better in the end. I think the key here is it pretty much doesn't matter who is elected president. At least that is what happens with Republicans. President Trump was ignored by liberal states throughout his presidency.

I think it is clear it is the Hard Left that focuses on the local, not us. Sure in Red States, conservatives do ok outside of pretty much every city. But the left long ago realized all politics is local. In fact, Virginia started turning not based on presidencies or even Senators. VA went Blue when the grass roots changed from conservative to leftist.

I actually think a reasonable version of a national divorce would be for the United States to kick out California and a few other states, then admit New California (northern, eastern, and San Diego County) when those counties secede from California (like West Virginia).

50 I don't know if it's possible, but it could sure make a difference. Could states like TX, AZ, FL etc. enact some sort of law where new residents from other states people from CA couldn't vote in any local election for "X" amount of time? I don't think a federal election could be off limits, but it would certainly make a difference locally, and during that amount of time some folks might even come around to realizing why the place they found more desirable than San Jose is that way?

I was a criminal attorney (both sides of the fence) for 30 years. In all that time I had two latent prints cases. It's so dry, fingerprints rarely take. On the other hand, swamp coolers work pretty well.

One example, however minor, of success in a blue state just happened here in Springfield, IL. An ordinance was just passed allowing for the impoundment of a vehicle from which the police witness fly dumping. (You can drive almost any street in this town and see garbage in or on the side of the road).

Warnock are both saying they never opposed voter id laws, when we all know they did. Why is that? They also have warmed to Manchin and this new proposal he's putting forward. This is all very sneaky and it's about getting their true agenda of vote by mail etc. and statehood for DC and PR. It's all very weird and troubling.

Right. It's not perfect but ok. I live in Greene County, just outside the city limits of Springfield and there is a bar around the corner I could go to when everything else was locked down/masked up. It was like a different world in there. No masks and you can still do indoor smoking if that's your thing.

A huge blow to the Feds ability to force states to knuckle under was struck in 2012 when the Supreme Court struck down 'pre-clearence' ability to the DOJ on grounds of mere assertions, yet unproven, that state election laws violated the 1965 Voters Rights Act.

Before then, the DOJ could 'toll' or halt any state election law action under pre-clearance if they deemed the law as a potential violation of the Voters Rights Act and then tie up the law in litigation in perpetuity, never presenting a real case, but effectively stopping these state laws from going into effect by stonewalling. With that tool gone, the DOJ has no intimidation power, which is what they used before the ruling to get what they wanted from state legislatures.

For some reason, I envisioned a border with a bunch of orange extension cords running from AZ to CA.

Maybe from personal experience - when I was in college a bunch of us rented a house in San Jose on 7th street. Since I was the only one with a car, I was the only one who used the large, empty detached garage.

One day when we were admiring a friend's motorcycle, one of us noticed an extension cord running from the outlet in the garage to the house next door, it was pretty well covered with leaves and dirt and who knows how long it had been there. We unhooked it, and apparently the neighbor went so far as to check the fuse box (old glass), the fucking balls! 3-4 Hispanic families lived there. Sadly, several died a few years later when the extension cords running under their carpet caught fire and burned the house down.

I observed something interesting this week - The condo I rented overlooked a downtown coffee shop in a good sized city. The shop was almost always full but, it appeared that all the patrons sat alone and did not engage with any other patron at any time in any manner. Warnock are both saying they never opposed voter id laws, when we all know they did. Why is that? They also have warmed to Manchin and this new proposal he's putting forward. This is all very sneaky and it's about getting their true agenda of vote by mail etc. and statehood for DC and PR. It's all very weird and troubling.

Historically, Switzerland for sure. I would guess Spain as well for reasons. Italy would be another that historically has been very decentralized. I am not sure how it works today so no debate here. But Historically Spain and Italy were a bunch of regions that were a country in name only. Even the modern UK has some of those aspects. For some reason Scotland has its own parliament and representation in London.

I always thought of France as an example of a truly nationalized nation. But I am talking history, though not very old history. The E.U. certainly has an iron boot. Crap, the E.U. has superseded nationalism in many ways.

190 Juneteenth was a celebration in Texas, mostly East Texas for decades. People of all backgrounds celebrated it and it was a time to enjoy family and freedom. I guess I get why some people are bewildered as it became this national thing almost overnight. But the celebration is very old and it was not controversial. It was a Texas celebration, based on events in Texas.

They say it was the end of slavery, but ok, that is one way to look at it. As I recall, it was the end of slavery in parts of the nation that had not yet ended it. It is not like all slaves were freed on Juneteenth. Hey I am all for learning the history. But I don't think many care about learning history unless they is a modern axe to grind.

Its wayyyy too much temptation to run up debt. Hell, I wrote a check for my last 3 new cars... and own my home outright.

Learned that lesson the hard way after going into a lot of personal debt trying to keep my IT Development shop running a few years ago (of course, it don't help when your business partner skips town owing you $20K either...).

I agree with everything you said, but one of the rubs is that states are not set up the same. For example, if Ron DeSantis were governor of Texas, he would not be viewed as so successful.

The Texas governorship is weak and is the 4th most powerful position in the state. Texas governors are good for negotiating with big corporations to move to Texas, but the position is largely symbolic.

Governor Abbott is not perfect, but he has less power than many believe. Bad Texas County Commissioners can and do wreak a lot of havoc.

Florida governors have real power. That works well with a Governor DeSantis but not so well with a Governor Crist. Oklahoma is strongly conservative but has built-in strength for unions. That is the biggest reason Oklahoma hasn't prospered as much as Texas.

Your way is the best way. It's still a hard slog.
