Supreme Court Takes Up First Second Amendment Case in Ten Years

A year or two ago, there were media reports that sources said that the conservative justices were intentionally dodging all second amendment cases.

The reason? Chief Justice Roberts. They were pretty sure that Bush's Present to Conservatives would vote against the second amendment, and they didn't want to let this sad cuck closet-masturbator invent new precedent.

Maybe the court now senses that they have five conservative votes.

Roberts is simply a liberal. Straight up. Not a swing vote. A liberal.

Thanks Bush! Thanks, Federalist Society!

The case being taken up is whether people have a fundamental right to carry weapons outside their home, and whether the state can "regulate" that right into non-existence.

The Court decided to take up the case New York State Rifle et. al. v. Corlett, focusing on the question of "Whether the State’s denial of petitioners' applications for concealed-carry licenses for self-defense violated the Second Amendment."

Robert Nash and Brandon Koch applied for licenses to carry firearms outside their homes in New York, SCOTUS blog reported. The licensing officer denied their requests after determining that, under New York law, they had "failed to show 'proper cause' to carry a firearm in public for the purpose of self-defense, because [they] did not demonstrate a special need for self-defense that distinguished them from the general public."

The state wants to have very stringent conditions for carrying a gun, such as being a Democrat celebrity, and deny them to all people who don't fit that category.

Hopefully the Court will rule that people have a right to carry a gun, and the state cannot set up "conditions" that essentially render this right a nullity.

23 My theory is that most of SCOTUS just didn't want to touch the election cases out of self-preservation. If they "overturned" the vote by allowing actual investigation into the rampant cheating, they'd be marked for retribution. They're largely cowards for that.

I never thought it would extend to them bending the knee to every leftist wishlist item in the future, though. We were still going to be getting conservative victories. The balance of victories for the right vs. the left was going to continue to tilt towards the right, though we were never going to get blowout cases (Chevron still deserves to die, though).

These are clerks, doing a mundane job of applying laws decided by others. Every bit of "doctrine" and schools of interpretation are transparent usurpation of legislative or executive authority. It is 100% the result of failure by those 2 other branches to do their job and exercise their authority, but this removes no bit of the stigma from courts acting unlawfully.

And by passing on the obviously unconstitutional election (it's a slam-dunk, simple, irrefutable case in PA and GA, where election process was determined unconstitutionally), SCOTUS completely discredited itself. It's a major factor in the hollowed-out state American institutions find themselves in today.

Roberts has been desperate to avoid any politically charged cases. He wants to avoid a Roe v Wade type decision during his tenure. The irony is that in trying to keep the court "non-political", he's only encouraged the worst sort of political gamesmanship from the left.

From what I understand about how SCOTUS works. The majority doesn't just agree on the winner, but the scope and breadth of the victory. Narrow or broad, to simplify things.

If, in conference, Roberts agrees with the 5 and then assigns himself the task of writing the opinion only to come out with a much more narrow version than what had been agreed upon, the other 5 will essentially write a concurrence that becomes the core opinion because of their numbers.

Roberts will only join with the right if he can actually narrow the decision with the other 5 agreeing. We'll see how that works.

169 What they've done in NYC is to create a scheme that denies carry at their discretion. Many of the surrounding counties have done the same, except they create another level of scheme that includes a Sportsman/Residence license. That way they can't completely keep you from owning a handgun, just deny you the ability to carry at will. The only people they grant a "full" carry license to are LEO's and retired LEO's who are apparently the only people NY feels the Second Amendment covers.
I am glad they took this case. History, tradition and the Framers own writings indicate The Second Amendment was meant to exist outside the home. Denying people the right to carry was always the Democrats unchallenged subversion. But what I fear from a Roberts Court are more subversion of process for the Blue States disguised as "balance". That's the hallmark of this court. They just can't say "it is your right to carry and protect yourself outside the home" which is the key issue left unresolved from Heller.

He doesn't want to make any really controversial decisions. He does not want the court to do that.

Its not impossible that this is driven by a desire to downplay the Supreme Court's status and importance, which has grown insanely out of control over the centuries. If so, that's a noble goal, but poorly executed. Dodging cases doesn't lower the power of the court, it just avoids dealing with real problems.

205 Whatever Scotus does, this case would not have been granted cert unless there were four votes--Thomas, Alito, certainly, and then probably Gorsuch and perhaps Kavanaugh (see his DC Circuit opinions for that prediction). If they thought ACB was shaky, they probably would not have voted to grant cert.

As far as Roberts goes, he can assign the initial opinion but what makes law is the final one that is actually issued. You still have to get five votes on who wins and who loses. After that, to make binding precedent, you need five justices on that final opinion issued.

Roberts will undoubtedly want to limit the scope of any ruling but not sure that he will be able to play that stunt this time. CJ Burger was known to be a political hack and played games with assigning opinions and granting cert. That earned him the dislike of pretty much all the other justices, liberal AND conservative. Burger left the court more or less because his influence on his colleagues was more or less nil by the end of his term as CJ. Roberts is probably heading down that same path.

235 To clarify, the CJ gets to assign the INITIAL opinion to a justice if the CJ is in the majority. There have been times, particularly during Burger's tenure, where the final majority opinion of a decision is written by someone other than who was given the initial assignment because that initial opinion did not attract five justices signing on to it.

You have to have five at least to become the majority opinion at the time when it is issued publicly by the court. If less than five but a majority agrees on who wins (merits) but not why (the opinion),then generally it is a plurality opinion with concurrences and possibly dissents.

I grow uncertain from there as to what else comes out of this ruling. Will they outright state that people have a right to carry outside the home? A clear ruling these schemes are subversion, and people can not be denied the right to freely carry, will cause people who already have a "limited" permit (sportsman, hunting, etc) to immediately gain a full carry permit as a result of the ruling, thus ending the usurpation of their rights. I doubt this court has the balls to let that happen

Y'know, my real potential military years were mostly Ford/Carter days, just post-draft, and it seemed like a bad idea. The mess at the end of Vietnam, the Mayaguez fuckup and Desert One kinda took any thought out of my mind.

In retrospect, this much later, I think it's a good idea. We had a much better citizenry after everyone was forced to mingle in WWII. My ne'er-do-well nephew came out of the Navy vastly better for his time.

Then 104degF fever and general weakness, and as I was out of town and 5000ft above my normal altitude at the time 'am I having a problem breathing or am I generally just weak?' That lasted four, five days then back to 98.6 and eventually normality.

The federal court system itself is overloaded and rife with poor case management. Realistically, the diversity jurisdiction of the federal courts needs to have the $ limit raised on civil cases heard. Large corporations often try to get cases sent to the diversity jurisdiction of federal courts as a way to delay any judgment and raise expenses for those challenging them.

In addition, judges need to adhere to strict time schedules for attorneys on filing motions and rule far more last minute delays by filing new motions as dilatory and punish the attorneys that do it. Justice delayed is justice denied.

So you're 'quarantined' in a hotel 1200 miles from home, you take the test, you walk half a mile to Wal-Mart and buy a thermometer but they've got no finger o2 clips. Order from Amazon. Test comes back positive, you're hiking a bit in the mountains you're feeling fine, four days later it hits...but five days later it's gone. I think it's opportunistic, it kills the weak, and apparently I wasn't weak enough.

The local folk wisdom went if you aren't politically connected, a retired cop, or the owner of a cash business, forget about it. Back then, long guns weren't subject to any restrictions. But in the late '60s, our rulers came up with their "registration" scam which was only to identify who had what supposedly. Over the next decade, it became much, much more.
