Sefton: sefton at cutjibnewsletter.com | Kristi Noem Exposes Herself as a Vapid, Sinecure-Seeking Corporate Whore on Tucker CarlsonWatch it. You tell me she sounds convincing. As Will Chamberlain points out, the bill she vetoed gave girls and women a private cause of action -- the right to sue -- against any institution that forced them to compete with boys. And how does Kristi Noem defend vetoing it? She calls it a "trial lawyer's dream," hoping that you're so fucking stupid that you say "Oh, trial lawyers will sue schools? I'm against that, because I'm a conserv-o-mat-ive, a-dooyyyy" without ever considering that wait, you want women forced to compete with males to have a cause of action. You want them to be able to compel these institutions to provide them an honest all-girls competition. This shows how absolutely bankrupt her position is. She wouldn't have to resort to these sorts of deceptive bumper-sticker "Lawyers R Bad Mmmkay" talking points if she had any real argument for her betrayal. She doesn't. I'll tell you what likely happened. Amazon told her it might move its headquarters out of her state if she didn't adopt the Amazon Federal Government position on transgenders everywhere. The US Chamber of Commerce pressured her, telling her that Woke Banks might move out of the state if she did not go along with the Corporate Congress' legislation on this. And her key adviser -- a corporate lobbyist -- probably told her she would have a bright future of collecting corporate checks for doing nothing if she played ball with the Corporate State, but would have to work for a living if she didn't. Here's that background on her shady corporate lobbyist pal:For someone who doesn't hold elected office, attorney Matt McCaulley of Sioux Falls, has amassed a significant amount of political clout, and he is among the most influential people in Pierre during South Dakota’s annual legislative sessions. Throughout his more than 14 years of lobbying, McCaulley, 47, has developed a reputation for quiet competence, effective problem-solving and honest negotiation -- and, recently, for serving as a top adviser to Gov. Kristi Noem. McCaulley's talent for navigating complex legal and political issues has made him a go-to lobbyist for clients ranging from Noem to Sanford Health, and from South Dakota agricultural interests to national cell service provider T-Mobile. In addition to maintaining one of the deepest client lists of any lobbyist in South Dakota, McCaulley is also the managing partner of Redstone Law Firm in Sioux Falls, which has been hired to provide outside legal counsel to the Noem administration. So far, Redstone's work for Noem has cost taxpayers more than $123,000 over the course of about 15 months, according to state records. McCaulley shuns publicity and operates mostly behind-the-scenes of the legislative process. But his work for Noem over the past 15 months, while continuing to lobby for 16 private clients, has raised some eyebrows in Pierre. The dual role -- well known by decision-makers in Pierre -- could give McCaulley unfair and undue influence to affect policy and legislation, according to one legislative leader. "I do think it's problematic," said Senate Minority Leader Troy Heinert, D-Mission. "If you’re going to lobby for the governor’s office, or any government department, you shouldn’t be able to lobby for the private sector."So much money for you when you officially start working for the Corporate Congress of America. As long as you enact our hard-left Silicon Valley agenda. Bye, bitch. If you want a corporate job, apply for a corporate job. These fuckers have to stop working for corporations while they're being paid by the taxpayers to do an entirely different job, one that requires, frequently, telling megacorporations to fuck right off. I'd like to see this bitch grilled by a committee of impeachment to find out what the real reasons were behind her sudden lurch to the left. Zero tolerance for RINOs and Cvcks and GOPe Corporate Stooges. Zero tolerance. One strike, you're gone. Otherwise they play the game of saying, "Well, we vote with you on all the easy stuff that doesn't matter, what's the difference if I take the leftist tyrants' side on the five or six tough votes a year?" It matters everything. It's the only thing that matters. You don't judge someone by how they handle the easy stuff. You judge them by how they handle the hard stuff.

Matt Walsh on his most recent podcast (also on youtube) gave an excellent argument why THIS is the hill to die on.
He articulated what we are all thinking that this is a lot more than just men playing on women's teams. Very much worth a listen or a watch. And Noem is a classic corporate whore. Good Riddance. Hmmm. Very unimpressed by Chamberlain's analysis, and surprised, as I expect more from him.
He might want to educate himself a bit on the enormous, enormous financial, political, and practical impact of ATLA and trial lawyers in general on our political situation, going back to the 90s at least. Very simplistic, verging on ignorant, comments from him, and frivolous. Don't see how Noem's added language re birth certificate actually changes anything, for good or ill. One can change one's birth certificate. OK. So how does the bill's original language get enforced, then? Seems like a dilemma for all approaches, and a weakness of the original bill. And his/y'all's dismissal of her assessment that SD would lose badly in court fights with the NCAA has no inherent strength. She claims to have sought the advice of experts on her circuit, and its likely response to the relevant court action. Maybe she's lying. But absent details, from both her and her critics here, I don't see how her claim is that breezily dismissed. And overshadowing all this is that this is not the end of the story, she said she'd even call a special session to get one. Posted by: rhomboid at March 23, 2021 05:29 PM (OTzUX) 119

She did not reject the bill because she believes transgenders should be allowed to play on whatever team . She did it because she believes and that has merit the bill is written badly. For obvious reasons the left wants her out of the way and some of this got fomented by them by the baiting of transgender language and the right has gone whole line on it.

The coming scarcity of a socialist economy will basically get rid of such bourgeois decadence. The viciousness that the new trans movement is sending toward the gays and lesbians is simply whetting the axe that will come back to haunt them. I'm on the fence about the whole fight. I can see a reasonable argument that the college fight should be separate from the high school discussion, and better to get the easy win (the high school ban) and take more time to figure out the college issue. That said, Noem's performance on Tucker was cringe-worthy. She needs to fire her advisors, since they obviously have not done her any favors.

The outrage by the right over Noem sending the bill back to the legislature for reworking is so over the top seizure like that I am pretty much discounting it. She did not reject the bill because she believes transgenders should be allowed to play on whatever team . She did it because she believes and that has merit the bill is written badly. For obvious reasons the left wants her out of the way and some of this got fomented by them by the baiting of transgender language and the right has gone whole line on it.

Btw, her "I don't wanna get sued" and "legal scholars have told me we can't do this cause the courts will side against us" is an even bigger line of bs when you consider she's planning to sign into law a pro life bill that (I) will absolutely get challenged day one and (II) may well run afoul of supreme court precedent on abortion.
In fact, she's probably happy to lose on the abortion stuff in coirt and say "I tried" and totally scared of her constituent citizens winning in court on the transgender stuff. Hence signing the likely to fail bill into law and running scared of the likely to succeed bill. Posted by: Stephen at March 23, 2021 05:38 PM (cbRv4) 177

Hand-waving with "I guess trial lawyers vote for Democrats" is idiotic, especially for Chamberlain, who otherwise seems smart and well informed. Yes of course you're right that the main substantive test is specific as to whether a new right of action is good/bad. But as I noted above I don't see how this isn't all moot anyway - birth certificates can be changed, so how does a court not in the end face the need to litigate some claim, however ridiculous, over gender of a student athlete? Noem would be a fool to think the woke corporations would leave. The state is too pro-business to make economic sense to leave. No personal income tax. No corporate income tax. Right-to-work laws.
Amazon has spent $206 million on building permits already (ok, that's a few minutes' profit for Bezos, but still...) for its new fulfillment center. The banks are not going to leave. Thirty years ago SD repealed its usury laws, so the banks moved credit card operations here to be able to charge higher interest. Ten years ago it repealed the Rule Against Perpetuities (every law student learns this in first year property, but the quick version is that SD now permits family trusts in perpetuity, rather than being limited to two generations - the "life in being plus 21 years" rule). So the filthy rich re-registered their family trust here. Banks, trust companies, and law firms opened offices here to service them. Posted by: Wethal at March 23, 2021 05:43 PM (ZzVCK) 211

One other point on the courts:
I have no idea what the state court situation is in South Dakota, but at the federal level it's part of the 8th circuit, which is probably the most conservative federal appeals court in the country 10 out of 11 active judges appointed by republicans, and every single senior judge appointed by republicans. Only appeals court in country where you cannot get a majority Dem appointed panel, either three judge or en banc. So either this is the dumbest job of drafting, ever, or she's scared of winning. Technically, the law is silent about what constitutes a readily completeable firearm versus a chunk of metal or polymer. But the 80 percent rule has been out there for a long while. If you really wanted a true ghost gun, there is a company that has molds for the AR lower and you put the polymer in the molds and cure it yourself. Pretty hard to apply an 80 percent rule to that. Posted by: creeper at March 23, 2021 06:07 PM (XxJt1) Because she's obviously not a very good politician. Half of leading is anticipating what people will support; only occasionally can you go counter to that, and you expend political capital whenever you do so, so you'd better have banked quite a bit, and the issue had better be worth it. Actually, the fathers of the girls should wander out onto the field and take a stand, like men.
first of all I hate the NCAA with the fire of a thousand suns. it is UTTERLY corrupt and soulless and it WILL destroy any female athlete that dares to say anything against this there are ALREADY collegiate "female" athletes. NCAA protects DI from this as of now, but DII and DIII has a few guys on girls teams. her club is having them play coed now, in preparation for the EXPECTATION that there will be males playing on their collegiate girls' teams. it's happening, insofar as DII and DIII are playing at all (that's really limited due to COVID crap) and yeah, Title IX is basically dead. the schools aren't even worrying about it as far as head count anymore. The NCAA should not be calling the shots in South Dakota. If the state's colleges are so deeply in hock to a semi-professional-entertainment organization that has ABSOLUTELY FUCKING NOTHING TO DO WITH EDUCATION that they have to ignore and deny biological reality as a matter of official administrative policy and visit injustices upon the people they exist to serve, then they are not colleges anymore but merely tax-supported grooming stables for professional players of children's games.
