The case was rejeected on a pissant legal technicality:
Judge Beth Bloom dismissed the case Monday. Bloom said that the court does not have subject matter jurisdiction to hear the case because Isaac "fail[ed] to allege complete diversity," which means that all the plaintiffs and all the defendants must be from different states. Because Twitter is headquartered in Delaware and Isaac is a Delaware resident, the complete diversity requirement is not met, Bloom said. Hi.
Sorry for being so scarce here lately. I am settled in Arizona now, and have been busy unpacking boxes. I am grateful every single day that I am out of California, and out of Hair Boy's oppressive jurisdiction. Arizona may have weird politics, considering McCain and all, but I will put my thumb on the scales as I can. I do not include the last election, because Arizonans clearly voted for Trump, and something bad happened to make that not the official result. I used all my vacation time on the move, but I'll see if I have accumulated one day to get my ass to the statehouse on Jan 6. We need to make a showing.

Corporations can have TWO states of residence. Their principal place of business (nerve center) and their state of incorporation if different. Delaware is a favorite place to incorporate because of its business friendly environment. YOU can't have two states to be sued in. We concur with the AoSHQ amicus that the plaintiff lacks standing.
Conversely, Twitter has been granted a countersuit that we will file on its behalf that Plaintiff has besmirched the poor, innocent Twitter victim and Plaintiff is responsible for treble damages to Twitter's brand. Plaintiff, if lacking sufficient compensatory assets, must provide Defendant one male offspring or two female offspring or two attached testicles and his house. Well as I understand diversity that then means he has 48 states to shop for a reasonable judge in. And like I said, this is a case that should attract a shark of a lawyer with the huge payout and publicity.
Posted by: Christopher R Taylor at December 29, 2020 07:52 PM (KZzsI) That isn't true. Where a case can be venued is very limited. It is usually where one of the defendants "resides" (for a corp., this is the corporate domicile or state of incorporation) or where the cause of action arose. Usually a plaintiff has just one or two options. This principle is unrelated to diversity in a federal lawsuit, which will stop you before you even get to an analysis of proper venue. This doesn't mean "any office." A corporation has one domicile and that's what counts. If the plaintiff is a citizen of the state of incorporation OR the state of corporate domicile, then there's no diversity. Otherwise, there is.
Posted by: Cicero (@cicero43) at December 29, 2020 07:50 PM (guGkK) Yeah, this usually applies in contract law...both parties agree and stipulate where they can be sued for breach, libel, etc. and diversity is the issue typically that gets sorted out in the contract. A global entity can declare one state as its US incorporation state and have many other places as its operations, but then, if it they have precedent (ie contracts with clients) that suggest they require to be sued in their incorporation state, they are nullifying their claim to diversity...period, end of story. This happens all the fucking ass time. If I were the IT guy, I'd try and find somewhere where Twitter suggested in a contract that all litigants use Delaware as the legal state when Twitter is being sued. Assuming Twitter is a DE corporation (which is what alleged), Twitter is a citizen of DE and wherever it has its principal place of business. So it's possible there could still be diversity jurisdiction in another a federal district court in another state, depending on where Twitter's principal place of business is.

The ones that irritate me are the men - and it's always men - who will do constant elaborate trilling because they believe they are a bluebird on the shoulder of the other customers in the bread aisle and that people around them are impressed by them doing something that most people use to call their dogs. Come on. No serious person can possibly think this is going anywhere.
You're telling me he was legally "harmed" by a casual, indirect reference to information related to him as "hacked" ? Utter bullshit. There is no real law against lying anywhere, unless you're talking to the FBI, in court, or the police. For Twitter to be somehow liable for something, they would first have to know that this material was NOT hacked, which they certainly did not, AND their having labelled this info as "hacked" would have to measurably harm the guy beyond just the fact that he was the center of a media and political firestorm. I put the chances of this going anywhere at less than absolute zero. Posted by: deadrody at December 29, 2020 08:20 PM (/jrmI) 232

Meanwhile, keep in mind that despite the fact that we all know the Hunter Biden story is true does not mean a damn thing. Twitter labelling it "hacked" doesn't even necessarily imply this guy DID the hacking. In leftist fevered imaginations, the entire contents of the laptop could have been "hacked" by Russians and then planted with this guy or Guiliani, or whatever. The fact that Twitter called it "hacked", in reality, is legally irrelevant information.
