Mark Levin Rips the Supreme Court for Its Election Interference Inconsistency -- It Constantly Interferes to Push Leftwing Demands, While Using "Standing" as an Excuse to Avoid Ruling on Rightwing Complaints

Good rip from @marklevinshow:

1. This election has exposed the complete collapse of the judiciary as a check on unconstitutional acts by state officials eviscerating legislative authority under our federal constitution (Art. II, Sec. 1, Cl. 2).

2. It has also exposed the Supreme Court as a highly political, result-oriented, LIBERAL body that grants standing when it wants to rule on a case (Mass v. EPA) and denies standing when it wants to duck a case (Texas v. PA, et al).

3. That Court intervenes relentlessly in state election processes, almost exclusively in support of leftwing activists and Democrat organizations that seek to weaken election security and fraud prevent.

4. The Court and inferior federal and state courts have earned the contempt of tens of millions of Americans. While the media, Democrats, NeverTrumpers, and others, have celebrated the denial of substantive court proceedings to scores of petitioners raising fundamental federal

5. and state constitutional issues, not to mention serious questions of fraud in states including, but not limited to Wisconsin and Georgia, these courts have disgraced themselves and severely damaged the electoral process.

6. In effect, they have served as the Praetorian Guard for the planned, elaborate, and unlawful acts of the Democrat Party, its lawyers, and their state public officeholders throughout battleground states. Despite the media claiming that 6 of the justices are conservative, and...

7. ..Chuck Schumer's propaganda about his desire to pack the Court because it is supposedly too conservative, the FACT is the opposite.

8. When the Court actually upholds the Constitution it is, more often than not, the EXCEPTION to the rule, which for the Court is activism with few limits.

Hear, hear.

Thanks to deplorable unperson.

42 The Supreme Court has abdicated its responsibility to adjudicate interstate disputes as laid out in the Constitution. The "lack of standing" argument is risible, since cheating in a national election affects everyone bound by the results of said election.

A refusal to enforce the law is the same as no law at all, in declining to attend its Constitutional duties, the Court has, effectively, unilaterally, canceled the Constitution - and thus itself - and thus the Federal Government and any shred of legitimacy it can claim.

The Constitution and the ratification thereof is the sole point of legal connection between the states. We should, at this point, be free and independent nations.

46 SCOTUS has been 'disappearing' parts of the constitution for some time now.

'Diversity', as it is imposed these days, violates the 14th Amendment.

'Civil asset forfeiture' is a violation of the 4th & 5th Amendments.

Kelo v. New London was a continuation of a campaign to eliminate 5th Amendment protections of property.

Most every gun law in the states is a violation of the 2nd Amendment.

The 6th Amendment has been in abeyance for over a half century or longer.

The 9th & 10th Amendments have been ignored for well over a century.

To put it more charitably, you knew exactly what the law was SUPPOSED to be. Not a doubt about it. The reality is that we are governed by a ruling class that sees all of that as nothing more than lip service to keep the peasants happy, mere words that can be overridden and tossed right out the door any time they become inconvenient for them.

We are ruled by a Government that is no different, morally, than Putin or the ChiComs. They all rule by decree, and worship only power. Once America was something special, but no more. It's just another piece of the same old, same old, from now on.

59 Good poast from Sarah Hoyt today. An excerpt:

"Their illusion, their gaslighting is so flimsy, both on the "we're all going to die from Winnie the Flu" and on the "there was absolutely no fraud, believe us" that normal contact between human beings would dispel it. Which btw, is the reason for Biden's "100 days mask mandate and probably lockdown, peasants!" I mean, it also makes us beggars and kills people, but the real reason is that people can't talk to each other in passing and say "I know the election was stolen."

100 days and they'll have cemented their hold on our minds, they think. For all I know, they're right. This year has shaken to the core my belief in people's ability to penetrate lies."

Same here. Awful lot of people willing to swallow a huge bolus of lies so that they can keep hangin' with the cool primate pack.

81 The Supreme Court fails to recognize that the fundamental nature of the Constitution was an agreement between independent nations. As such when the constitution places a requirement on a state (such as to have a Republican form of Government) and that requirement is unheeded (such as a State failing to follow its own laws) and their transgression affects federal power, then of course as the nature of the Constitution at it's essential being an international treaty to form a federal government, the other nations have standing to bring before the Supreme Court a complaint that a member state adhere to the requirements of the Constitution, which in the specific case would mean following their won constitutional in the manner of a Republican form of government.

The argument to lack of standing is bad jurisprudence. Of course other states may demand you follow your own written laws when it comes to federal elections. And further that you may not hide behind your state courts when failing to do so.

Yeah, the problem is that it isn't the Supreme Court's job to do the job of the state legislatures in states where election fraud is alleged. That's why they didn't hear the case.

The Republican Majority legislatures in AZ, GA, MI, NV, PA and WI are the only entities empowered by the US Constitution to investigate the fraud found in their states, with their remedy to vote alternative slates of electors to DC for the 1/6/2021 House/Senate to decide on.

That's it. It's not the S.Cts job, nor the job of any of the State or Federal Courts where all of these lawsuits have been filed to Stop the Steal.

Which is why my plan to destroy the GOPe is the only option going forward. Trump has to force the state legislatures to do the right thing on pain of utter destruction.

Really well argued. This is one of many reasons why the entirety of the Federal Government has forfeited any sanction of legitimacy. At this point I'm just hoping that the Republic of Texas reasserts itself so I can immigrate there.

88 The problem with the Constitution is there is only one. In reality, the Democrats will need 100 Constitutions. There are two Houses of Congress and each of those Houses can exist in one of 5 states, Super-majority Democratic, Majority Democratic, Tied, Majority Republican, Super-majority Republican. So, five different states in two Houses means 5 x 5 or 25 Constitutions. In addition the White House can be held by a Republican or Democratic and the Supreme Court can be Conservative or Liberal. Therefore 5 x 5 x 2 x 2 = 100 Constitutions.

I cite as an example, with a Democratic Majority House of Representatives, a liberal Supreme Court and a Republican President, the 25th amendment of that Constitution would allow the House to vote the president out of office.
The Constitution governing a Republican Majority House, a Democratic President and a Conservative Supreme Court would have no 25th amendment at all.

I've given up even trying to guess at what the various legal options are since it doesn't appear to matter.

Okay, back on the standing thing, I know I'm more than a bit of a procedure whore when it comes to legal matters, but it is significant that the Court said nope, no standing on a case where there is explicit Constitutional standing, as opposed to filing an near instant sua sponte 12(b)(6) dismissal. Rule 12(b)(6) is failure to state a claim upon which relief can be granted, which is what that standing ruling really was.

The difference between the two *matters*. It's not a short cut to say eh we'll dismiss anyway so pfft no standing.

Look, take this case along with all the birther cases (I ONLY CARE ABOUT STANDING DON'T START WITH THE REST) and it sure as hell seems to be the case that the Court is saying there is no one who has standing to protest possible electoral fraud.

That's not good.

130 Sharkman has it mostly correct, on the key issue: the state legislatures here are the proper focus of attention and action. And they appear to be failing (though I find it near impossible to find out where almost anything actually stands in these states).

It's those legislatures - all "GOP" - that should have seized control of this process. They've done hearings. What else have they done? The evidence presented at the hearings has been dramatic, far more than sufficient to question the reliability of the election process.

And then there's the SoS in GA - no signature verification? No signature verification?? What am I missing here? This is absurd, brazen, Third World corruption.

However, there is a role for federal courts. FL 2000. The PA case about 14th Amendment issues is a 5-minute slam dunk analysis for SCOTUS, based on Bush v. Gore. There are legitimate SCOTUS issues in all these states, even if the legislatures have primary responsibility for preventing a fraudulent election from being recognized and rewarded.

In one of these cases, the state court (may have been the PA Supreme Court) rejected a claim that the Republican watchers had been prevented from watching the vote counting by saying something like "the statute does not specify the distance that must exist between the observers and the vote counters, so we find no violation here."

AYFKM? We all know that if it had been Republican vote counters keeping Dim watchers away from the vote counting, making them stand across the room and putting shit in front of them so that they couldn't see, the court would have said that the statute was clearly violated, as the legislators' intent in passing the statute was to prevent potential fraud during the vote counting, and that obviously would require watchers to be in a position to clearly see the vote counting.

But since these are not legal decisions, but nakedly partisan political decisions, we got the decision we got.

I suggest staying away from google Nest if you live in a warm humid place. It is designed for the comfort of west coast people. Either cold NW or dry SW. In humid SE they just don't work. The auto temp min range for cooling is something like 76deg. I don't even like to keep things cool in the summer but 76deg would screw up my home. So you just have to hardwire a schedule just like any dumb digital thermostat. And you get requests from the local power company to take over your setting to save (them) money.

160 AYFKM? We all know that if it had been Republican vote counters keeping Dim watchers away from the vote counting, making them stand across the room and putting shit in front of them so that they couldn't see, the court would have said that the statute was clearly violated, as the legislators' intent in passing the statute was to prevent potential fraud during the vote counting, and that obviously would require watchers to be in a position to clearly see the vote counting.

But since these are not legal decisions, but nakedly partisan political decisions, we got the decision we got.

It's all bullshit. Levin is right, of course.

Not so much. If you study Christian theology and ethics you would find "jus bellum justum" has a long standing tradition and philosophical basis. Whereas any sort of "just lie theory" is highly questionable.

In short the current state of Christian ethics would say, absolutely yes, there are some situations were you just need to shoot some folks and you are justified.

However lying, even under the most extreme circumstances and duress (such as hiding Jews from the Nazis) remains a morally questionable act.

No goog theology of "when it's ok to lie" exists. Which is why Christians have no equivalent to Taqiya.

Yes, they have interfered, and it wasn't their job to do so and their actions violated the Constitution they are supposed to interpret.

Just because courts do something doesn't mean what they do is correct or constitutional.

The point remains: The state legislatures have plenary power over election laws in their states, in interpreting those laws, in investigating fraud, and in voting slates of electors. Not the Courts, at any level.

I understand.

S Ct. wasn't asked to order new elections, change ballot counting methods, change deadlines back to what they were before they were fucked with by state courts, certify different slates of electors, or anything else.

The remedy asked for in the Texas v. Asshoe States case was:

1. Stop certification of the votes in GA, PA, MI, WI;

2. Tell the legislatures of those states to fix the problem.

And the Supremes said (without saying in an order):

"Why do we have to stop the certification of fraudulent elections and order the legislatures in those states to do their job that is clearly stated in the Constitution? What gives us the power to order those states to do their jobs?"

232 Texas filed a novel suit that would expose the court whatever it did. I did not know whether or not the Sup. Ct. would take the case and how it would rule. I personally felt that the equal protection claim was at least as strong as that in Bush v. Gore regarding differences in how a vote counted.

The original jurisdiction docket has more or less withered over the years to relatively trivial border disputes and it is clear that the Court likes discretionary jurisdiction.

That being said, the court diminished itself and has more or less destroyed any real reason not to pack the court.

If they want to act as a super legislature such as Gorsuch's rewriting of the Civil Rights Act, then convert them to one--one suggestion is to have every state send two representatives to the Court with staggered terms by means of state legislative appointment just like senators used to be.

So, Lady YD left me with the kids yesterday, and no hot sauce, so I tried making my own out of butter, water, lime juice, garlic, cayenne, and paprika.

It came out pretty nasty. Really powdery, not much flavor. Just kinda gross.

I left it on the counter overnight, and planned to throw it away. But then I saw the pork rinds and thought "whatever, it's better than nothing," shook it up, and tried it out again.

This time, it tasted awesome.

I think I'm going to make a bunch of it and just let it sit in the fridge for a week.

291 210 Sharkman,

The problem that people have noted above is simply that the Supreme Court has done all of these things--rewriting election districts, intervening in state election districts such as in Gray v. Saunders, etc. Baker v. Carr for example was about Tennessee not reapportioning its legislature but the Warren court was not stopping at that--instead they ordered districts to have equal number of voters, contiguity, tradition, etc. be damned. They continued to allow the "emergency" provisions to only be applied to states and local jurisdictions in the original bill despite that they also expressed that these emergency provisions were technically unconstitutional in treating states differently over pre-clearance.

They have no credibility in regards to messing around with state electoral systems.

Bit of a straw man argument, that. Equating with cultishness the people's support for Trump as a bulwark (heh) against the Dem neo-maoist kleptocrats.

Also, kvetching about spending when the the republic itself was the stakes. Seems like nit picking.

America today, call it what you want, just don't call it "legal".

We're in an Insurrection right now at the state level, if a Blue Guvnor is running the show. And the Courts refuse to protect citizens from this government that now refuses to answer to it's citizens. Instead, they hold a press conference, in front of their highly paid jesters who call themselves journalists. In fact, they are simply whores, doing what they are told to do and get paid good money to do it.
We currently aren't killing each other because we were raised to be civilized and think about making the future better than we have it now. That entire line of thinking has been obliterated and is now only believed in pockets of the population.
But our civilization is becoming a false civilization. It is not based on honesty or sharing the burden or helping others. Nope, only in pockets now.
There are the "haves" and "have nots". But instead of being dictated by hard work, saving for a rainy day, or being logical and frugal, now it is defined by which political side you choose. And only one side is supposed to win, according to the government, the incredibly dominant media, and the Government Deep State. Otherwise, you are a serf, not a citizen.
This has been reinforced and even redefined in the last year and with this election. Democrats stole it without caring about the law, Republicans (except Trump and a few others) let them take it (but still get paid and be invited to cocktail hour) and the Courts ignored the massive theft and cheating, thus dooming their future role in the country. With one side running everything, why would anyone need courts?
No, there are most certainly good communities, but as a nation, America is history. The only thing that will help is Trump executing his EO. Throw it into chaos. It is the only way to save America.
Because in case you haven't been paying attention, the Second Revolution has already started.

It went SUPER WELL for the fraud investigator who was all super Javert about it when the judge interjected himself into examination to say wait did you just testify that the pictures of the car taken by the repair shop that the insurance company said to do the repairs showed blood and bits of fur? And you still say he didn't hit a deer?

356 302 iandeal, no--the court eviscerated its authority when it bravely ran away. Lincoln once said when criticized about violating the Constitution and more or less replied, why condemn me for violating some provisions when the Confederates were violating the entire reason for the document--e.g. the Union.

In this case, the court essentially used standing to avoid even making a decision. If the court wanted to be direct, it could have used Luther v. Borden and tell the American people up front that it was a political question as to who won in their states and should be resolved by the state legislatures. But Brave Chief Justice Roberts ran away with his other profiles in non-courage. He did it because he has personal spite for the president and because he is hiding what he did as supervisor of the FISA courts. He is shady as hell on his adoption of his Irish "children" from a country that does not allow foreigners to adopt.

Thus, when the courts are no longer about the rule of law, then there is no reason for them. Might as well pack the court and make it a third house of the legislature.

373 Random question for the Horde - I've inherited an 80's Dodge Ram that has not been driven in years.

When it was parked last it ran. But the battery died a while ago so it hasn't been started since probably 2017.

If I put in a good battery and some fresh gas / starter spray into the carburetor, should I expect it to start? Or has it frozen up because it's sat unmoved (and the oil uncirculated) for too long?

I'm looking to get it up and running again this winter / spring but I don't want to ruin it because I don't know everything.

There will be a time for cutting off those efforts but that time is not now. When that time comes, we will have to turn to other action but RIGHT NOW, please do not let their utter fecklessness drive us to despair and inaction.

I completely agree.

The remedy is for state legislatures to do their jobs all year round, every year, like FL and OH did, to prevent what led to the fraud.

And, for Congress and the States to take back the power that Marshall took from them with Marbury vs. Madison in 1803.

380 Katie Worthman, Austrian who survived Hitler's rule describes how the Nazis disarmed the Austrian people:

"We also had gun registration. All the Austrian people had guns. But the government said, 'the guns are very dangerous. Children are playing with guns. Hunting accidents happen and we really have to have total controlled safety. And we had criminals again. And the only way that we can trace the criminal was by the serial number of the gun.'

So we dutifully went to the police station and we registered our guns. Not long after they said, 'No, it didn't help. The only way that we won't have accidents and crimes [is] you bring the guns to the police station and then we don't have any crimes anymore and any accidents. And if you don't do that: capital punishment.'

So that's what we did. So dictatorship didn't happen overnight. It took five years. Gradually, little by little to escalate up to a dictatorship."

394 354 "Why do we have to stop the certification of fraudulent elections and order the legislatures in those states to do their job that is clearly stated in the Constitution? What gives us the power to order those states to do their jobs?"

Yes, because the federal courts never order anyone to abide by or perform the duties specifically enumerated in the federal constitution.

Posted by: bear with asymmetrical balls

And again, just because a court does something, that doesn't mean they are within their constitutional right or duty to do so, and doesn't mean what they order is constitutional.
Posted by: Sharkman at December 16, 2020 04:22 PM (BM2fS)

This is just a goofball-level response. It's like when someone justifies not implementing some conservative policy on the basis of federalism. Constitutionality, stare decisis, standing, federalism - they are all one-way ratchets being used against conservatives. The other side respects none of these; they are never an obstacle to liberal rulings. We have a de facto Court of Platonic Guardians who do whatever they want whenever they want. So I want them to rule for me. If they can henpeck state legislation based on various constitutional provisions, they can ride herd on state legislatures based on another.

TL;DR version: we are way, way past the point of serious constitutional discussion. For authority, I will rely on the Sodomy Clause of the Constitution.

404 SCOTUS will rule for Trump but it has to be bulletproof and not all encompassing. The standing issue in Texas vs PA et al was arguable. Plus they want the fraud to be bulletproof as well, so the ruling will be inarguably right on the law and on the justice.

Or they will cowardly cop out.

Lots left to go before the answer is known. Plus there's the EO and insurrection act which will kick in with a full seizure, recount and audit by the military. This is how Trump not only gets the Presidency but the house and Senate also, because all races would get recounted too.

That's how Trump wins--totally.

I'd pull the plugs, and put a bit of Marvels Mystery oil in each cylinder. Then remove the cap (so it can't start) and crank it over about half a minute, just to lube everything before trying to start. Ideally, if it has an oil pressure gauge, you're looking for pressure.

++++++++++

The Insurrection Act was designed as the means for the Commander in Chief to fight "enemies domestic."

After the Civil War, the Insurrection Act was expanded to give the President the authority to enforce the 14th Amendment and the rest of the Reconstruction agenda.

That authority is now found in Title 10, Section 253, which gives the president the right to take military action within a state when "any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection."

We're not asking for Trump to go full-Napoleon here. We're asking him to follow the law and the powers vested to him as President. Foreign agents have infiltrated our country and, through the machinery used in our election, have fraudulent deprived the American electorate of their constitutional right to a republican form of government. Legal challenge after challenge has been dismissed without any consideration of the merits, state legislatures have refused to intervene in accordance with Article 2, Sec 1.2. The Senate Majority leader has ordered the upper chamber of congress not to exercise its constitutional right to challenge potentially fraudulently-decided electors. The Supreme Court has denied the injured states the request for the highest court simply to order their sister states to uphold the Constitution.

When the Legislative and Judicial Branches have failed to stop the enemies domestic, it falls on the Executive Branch to fulfil its oath of office.
