Sefton: sefton at cutjibnewsletter.com | Christopher Nolan Rips Former Partner Warner Bros. for Putting All Movies on HBOWarner Bros. -- now owned by an incredibly-indebted AT&T -- announced that it would put all of its 2021 movies on HBO Max, with an obligatory, barely-even-counts simultaneous release in movie theaters. Movie theaters might not even be willing to show a movie that's also on TV at the same time. Hollywood is reacting angrily. Christopher Nolan, who has a long history with Warner Bros., ripped the company: "Some of our industry's biggest filmmakers and most important movie stars went to bed the night before thinking they were working for the greatest movie studio and woke up to find out they were working for the worst streaming service."On [December 3rd], Ann Sarnoff -- whose ungainly title is chair and CEO of WarnerMedia Studios and Networks Group -- and Warner Bros. film studio chairman Toby Emmerich called the heads of the major agencies to drop a bombshell: Warners was about to smash the theatrical window, sweeping its entire 17-picture 2021 film slate onto its faltering HBO Max streaming service, debuting them on the same day they would open in whatever theaters could admit customers. Surprisingly to some in the industry, sources say the idea was the brainchild of Warner Bros. COO Carolyn Blackwood who, looking at a relatively weak 2021 slate, saw an opportunity to avoid the humiliation of potentially bad grosses while currying favor with streamer-obsessed higher-ups.AT&T doesn't care about the movie business. They only care about the streaming business, and HBOMax has had a poor roll-out. It's an also-ran in the streaming wars. (To be honest, like most people, I don't even understand what HBOMax is. Is it just the premium side of the already-a-premium-channel HBO? Is it Powered-Up HBO? I don't know! No one does!) AT&T's move to put all of 2021's movies on HBO, with only a crippled, contractually-obligatory theatrical release, will almost certainly result in lawsuits. Remember, a lot of the big names in movie production, from producers to directors to stars, get a big cut of a movie's theatrical box office. And Warner/AT&T has just effectively cancelled, or at least crippled, the theatrical box office-- to benefit HBOMax. Which the movie's talent has no financial interest in. The instant response in Hollywood was outrage and a massive girding for battle. "Warners has made a grave mistake," says one top talent agent. "Never have this many people been this upset with one entity." Like others, he had spent much of the day dealing with calls from stunned and angry clients. And that swooshing sound you hear? It's the lawyers, stropping their blades as they prepare for battle: that Warners was self-dealing in shifting these movies to its own streamer, perhaps, or that the company acted in bad faith. Some talent reps say the decision affects not only profit participants but others who have worked on films as the move might affect residual payments. They expect and hope that the guilds will get involved. (The Writers Guild of America declined to comment.)This is a huge sacrifice play to get HBOMax off the ground. Theatrical exhibition of five of the biggest movies could have brought AT&T maybe one and a half billion dollars. (I'm guessing they take about half of box office receipts, and that the five biggest movies might have grossed three billion all together.) Instead, they'll get some sign-ups for $10 a month. They're losing a lot of money here. This only makes sense if they can get a lot of sign-ups, and those signing up stay signing up for a year. Instead of just dumping it after the movie they were interested in is shown. Midnight's Edge, whose sources tipped them that this was coming weeks ago, have another tip from their sources: AT&T might have done this even without covid. The reason is that AT&T's entry into the streaming wars, HBOMax, is failing to generate many sign-ups, and buying a library of content for a streaming service was the whole reason for AT&T's acquisition of Warner Bros. AT&T needs some kind of big attractive content to get people to sign up. Disney has that in The Mandalorian, but what does AT&T have? Their sources tell them that AT&T had expected that they would launch HBOMax on the promise of four or five Game of Thrones spinoff shows. But, of course, everyone decided they hated Game of Thrones at the finale, and all interest in Game of Thrones immediately fell off to near zero. Further, most of the spinoff shows have been cancelled -- one of them for being "too woke," reportedly. So HBOMax is debuting its service with the promise of delivering... nothing much, really. AT&T greenlit the Snyder Cut of Justice League in an attempt to give HBOMax some kind of catchy unique sales proposition. But that's just one movie. Midnight's Edge's sources tell them that AT&T, therefore, essentially cancelled all the planned 2021 theatrical releases in order to fill the gap created by the implosion of the Game of Thrones franchise. So if Hollywood begins collapsing -- if this is, as many expect, the first domino that will almost completely end theatrical exhibition in movie houses and cut Hollywood's revenues by, who knows, maybe 75% -- can we say maybe that this was all due to Benioff and Weinberg's total fumble on Game of Thrones? Has Winter finally come for the media? (And does this mean obese loudmouth leftist George R.R. Martin singlehandedly destroyed Hollywood due to his laziness?) >>>9 Huh. So they're putting it out there for anyone with capturing software to watch at their leisure?yup. I just don't think you can make enough money to support a big version of Hollywood with streaming. I think the biggest boxing match charged like $75 for the evening's matches, and pulled in like $400 million. Hollywood can't make big ticket blockbusters if the most it can make off them is $400 million. True, they'd keep a big share of that $400 million, rather than splitting it 50/50 with theaters, but this still isn't enough money to support Hollywood As We Know It. Plus: How many times per year will they have a big enough draw to make $400 million? Add in piracy and forget it. I think Hollywood is going to shrink, and salaries are going to shrink even more. This is why I insisted that DB and David would be meeting with the headsman. I personally enjoyed Shazam (aka the real Captain Marvel), but WB has done a generally piss poor job with its cinematic universe. So you can't blame Game of Thrones solely, though they are a major cause of the failure.
What we are seeing now is Hollywood accounting in action. The stars and directors might never see a true blockbuster again, while the execs certainly don't want to hand out more money. The problem they have is- what if the celebrities decide that diminishing returns might be a great reason to expose the pedophilia of the Singers and Epstein types? Everyone has gone streaming for any kind of content. I used to like watching MASH reruns, but I think Hulu bought up the property. Now the only way I can watch it is pay Hulu or pay three bucks an episode. NBC now has Peacock, but to get the good programing you have to subscribe to their streaming service. It really sucks on so many levels.

We have HBO. Once we figured out that our HBO account + amazon firestick got us onto HBO Max "free" on our TV (roku and HBO Max are having an economic dispute), we installed it. I've been watching more on HBO Max than I ever did on any other station... it is basically Netflix without an additional cost for me.

I will hazard - just internet spitballing cause there is non-zero probablility that they know their business better than I do - that this is a very short sided move for Warner bros.
Movies such as we know them, the kind that can take 100s of millions to make and can from time to time generate billions in franchise merchandise and cinematic offshoots depends on the big screen explosive types of experiences and pricing. They will not get 30 per movie on HBO max, because once everyone is online then pirating is just all too convenient. And you don't lose out on the social outing that you would have in the past because there wont be one. Streaming requires a never ending pipeline of interesting stories and frugal production costs. The new model will never produce another MCU. This will also be bad for us, because as Hollywood goes online we can expect more and more draconian monitoring and control over the internet and many Governing administrations will be more than happy to put the clamps on humanity to any extent possible. The people will be given porridge and only porridge and they will like it! Posted by: havelhavolim at December 08, 2020 06:15 PM (fLpTX) 69

People are willing to pay for three streaming services year around and that's it. They'll pay for another service for 2-3 months if it has some shows they want to watch.
Right now, Netflix and Amazon have a massive lead. Netflix because it was first and the breadth of their content, and Amazon because Prime is more than just a streaming service. Disney, whether we like it or not, hit a homerun with The Mandalorian at a time they absolutely needed it and it also coincided with the MCU wrapping up and Covid. I tried HBOMax, it sucked. The Peacock is actually a decent platform with a lot of free content and in my mind is far-better positioned. Hulu has FX material which, quite honestly, is better than whatever HBO has right now. Hulu is something I'll subscribe to for a 2-3 months every year. Posted by: Trich at December 08, 2020 06:17 PM (7wCmd) 92
Levin saying he thinks they are fearful of court packing so denied the case. ------ This is more or less what I've been saying. The Court reacts to fear of consequences, nothing else. I'm wondering how much money has been lost pushing the opening of Top Gun's reboot back, and back, and back again. I mean the interest on the production costs of a movie would add up just like any other investment, until they finally break that thing out for public consumption. At this point if I'm Tom Cruise I'd be worried that the producers would be considering having him off-ed just for the publicity it would generate.

They're losing a lot of money here. This only makes sense if they can get a lot of sign-ups, and those signing up stay signing up for a year. Instead of just dumping it after the movie they were interested in is shown.
HBOMAX is thrown in as part of my cable package (don't even bother with the cut the cord stuff with me, for what I need and want it doesn't work). So, sure, I'm paying for it somehow but since my bill didn't go up when it rolled out, I don't know what the backend deal is. What killed HBOMAX at initial rollout was not being on Roku and Fire TV, mainly Roku. Roku has the largest hunk of market share and not having that deal in place was a killer on momentum. Pick a genre, almost any genre, and then see how much SJW signalling, foul language, nudity, and/or violence you can cram into it. It is boring and repetitive. The other thing, if you really want to repeat watch something, you get it on disc. Why suffer the whims of a streamer?

One of the very few areas of original jurisdiction for SCOTUS is cases between the states. Since Texas is suing other states, the case starts at SCOTUS. All that order does is set the deadline for the response by the other states to what Texas filed. That's it. What it does show is that this is the most rocketed of dockets. Rocket docket is the term for when matters are put on an expedited hearing schedule. It won't work. Even if WB has a killer slate of movies (I am guessing they don't), it won't work.
Streaming is a continuous cost. You pay every month (or maybe you pay annually like I opt to do where possible, but it amounts to the same thing). Why pay every month? Catalogue and to keep abreast of the new stuff. HBOMax clearly doesn't have a good enough catalogue (I dunno, I never looked), because no one is signing up. So that leaves the new stuff that is exclusive to the service. And now we have a problem. To justify that continuous cost, there needs to be continuous content and content that your customers want to watch. Disney+ and its exclusives - most notably, as Ace mentioned, "The Mandalorian" - does this because they're serials. Netflix has serials and movies and documentaries and standup comedy - they flood the zone (catastrophically expensive, but Netflix's investors remain credulous and they can get away with it). CBS All Access also does this, notably with their dreadful Star Trek products. Continuous cost requires continuous content and/or (usually "and") a banging catalogue. Rhe most cost-effective way (which matters unless you're Netflix) to deliver continuous content is through serials. Movies don't work for this, because they're one-offs and they're fairly short. Add in that this was the *original* plan for HBOMax but they had to scuttle it because they ruined their most valuable serial IP (Game of Thrones), and this is a sticksave measure that isn't going to work. I can actually provide some insight in regards to some of ATT's idiocy, here: at the time they glommed on Warner, they were chasing some half-baked white whale of data collection.
You see, movie tickets don't do them much good in that regard. But app installs - both mobile and TV streaming hardware - does. They would rather have streamers than media in theaters. I don't know if they had a specific plan, or if they just had some pointy-haired executives chasing the cool new thing. You can basically bet that whatever they had in mind was sleazy; they told DOJ in the antitrust suit that they weren't going to take certain actions on acquiring Warner, and then did exactly those things almost immediately. After a viscous fight to avoid anything Disney +, I lost and ended up watching the Mandalorian Season 1.
There are some decent episodes, but some terrible ones. Like the 8th episode season finale. Fucking Titty Watitty directed it (Thor Ragnarok director) and that fucking guy can't avoid fucking up a script. It's like he doesn't care. The fucking episode ignored its on continuity and rules set IN that fucking episode. Oh, I was pissed by the time credits rolled. But there were some good episodes. The one with Clancy Brown was good. And Nick Nolte did a fine job, surprisingly short though. I thought he'd be taller. Did people see the presser for the Staten Island Bar? Loved it, the accents and everything.
They point out that SNL (which is using a loophole to stay open during COVID) mocked them in a skit for trying to stay open. One of the guys on the show, Pete Davidson, is a Staten Island kid. They point out his firefighter dad died on 9/11, they raised money and supported him and his mom through that. For Pete to mock people who supported his fam, when they are now struggling to get by, on national TV is just appalling. https://www.youtube.com/watch?v=94itzKrh-U4 Posted by: LizLem at December 08, 2020 06:30 PM (Rbfr/) 174

The golden age of streaming is over. Too many players with too much content divided into too small of slices. You know people are hopping in and out just to see what they want. That's why the big name series, like The Mandalorian, are getting weekly episode releases. We're going to be back to a commercial break model in streaming soon.
Posted by: WOPR - Tactically Dramatic is Failue at December 08, 2020 06:28 PM (WVeiZ) It amuses me that people are now agitating for bundles of streaming services. Oh. You mean like tiers of channels with cable? It was inevitable once broadband was widely available and people saw that streaming was viable that people would yank back their own IP to try to get some precious dollars. Hell, Discovery is now going to have Discovery Plus. Everything is going to go premium streaming tier and we're right back to things being in channels. It's just coming over the cable to your modem, not your tv. Oh and don't forget even the premium tier of Hulu has commercials. That's bundled in with my cell phone service. And I agree on physical media. Look what happened with the Charlie Brown specials. Those got bought by Apple to force people to Apple Plus. Yeah, people are getting weary of okay what thing is on what service again and aren't we supposed to be saving money, not having it cost more? This is not unusual in a situation where there are competing cases on the same subject. The court chooses the one it wants to rule on, and deflects the others without really denying. Ok now I understand why on the one hand it's only injunctive relief that's been denied (not cert) but also that many legal experts like Levin are taking this as the death of case.
From the Redstate article: "The other thing to take note of here is that the Plaintiffs have not yet filed a Petition for a Writ of Certiorari with the Court. That is the document that actually requests that the Court review the decision of the Court which is being appealed. Emergency Applications like the one filed are used in an effort to preserve the status quo, and to prevent the lower court's decision from taking effect while a Petition for review is being prepared, or after one is filed and pending." Basically, everything that they'd asked for up until point was in fact denied. Posted by: havelhavolim at December 08, 2020 06:37 PM (fLpTX) 231

That's kinda what the rule is. The states get to make up their own laws, and no one is supposed to override them. The defendants in the Texas suit ae in trouble because they allowed the governor to override the state laws, which violates the US Const which gives plenary power only to the state legislature The USSC doesn't get involved unless the state law violates the federal constitution--here, it's an equal protection problem. The state that is not following the constitution is allowing too many false votes, to the detriment of the states who are following the constitution Posted by: artemis at December 08, 2020 06:49 PM (AwPyG) 313

the remedy Texas is seeking is the most uncontroversial, pro-constitutional remedy possible.
It's the one remedy that doesn't require SCOTUS to divine out of thin air a solution to the problem. they don't have to throw out votes, decide which votes are good and which aren't deny states the right to seat electors, etc. All it's doing is asking SCOTUS to recognize there has been a problem and to solve it looking at the rule book for the solution: The Constitution offers the remedy: Article 2, Section 1.2 - states seat their own electors The court can do that and effectively wash their hands of it. They won't be in any way directly changing the outcome of the election. They can look the other way and say "the state houses can choose to accept the results of the November vote if the want. We're not going to make them one way or another." Meanwhile the state houses, cowards all, can use the SCOTUS order to seat the electors they want, irrespective of the vote, arguing that SCOTUS' ruling admitted the election was tainted and they will thus send (Trump) electors. Both sides meet in the middle. Everyone wins except the Democrats. Sounds like a Merry Christmas to all who say Merry Christmas. Posted by: pmurT at December 08, 2020 06:51 PM (ojwvu) 325

It is a full blooded streaming service and it has the entirety of the Warner Bros catalog behind it. The UI is confusing, though, and it makes it hard to find those 40k titles that are the WB ctalog. Yeah, you never know. The Constitution is supposed to be interpreted first from its language and then from evidence of the founder's understanding of issues at the time. Amazing that all of Hollywood may be looking at porn-level budgets.
Posted by: Mr. Peebles at December 08, 2020 06:58 PM (oVJmc) Holy shit. Without enormous budgets they might have to start to rely on writing and creativity. I doubt that compelling stories and old fashioned artistic cinematography have a place in movies. Posted by: clutch cargo Now 100% Lubricant Free at December 08, 2020 07:05 PM (L8ADy) 414

real problem is this:
1) They borrow money to make movies. 2) These are short term loans. High interest, but short terms. Say a 1 year loan at 15%. 3) the terms of the loans are odd - the interest sometimes doesn't kick in till after a certain date (the release date). The interest may accelerate over time, the first few months being cheap, but later being very expensive. The idea is to force the studio to recognize the win or loss on an investment quickly. 4) All the money is spent, the movies are in the can. 5) They are looking at a highly uncertain return on investment. 6) They are paying interest on those loans, having recouped nothing, and having already paid all the talent. 7) They can't take out new loans for new content until the old loans are paid back. the drain is plugged. meaning they can't even fund new content for HBO Max until this movie situation is fixed. they are not in a revenue neutral potion. they are losing money like crazy until those movies are released. Each month they are bleeding money. And the bleeding is getting worse. 9) Accountants look at a movie that cost say $150 million to make. They are paying several million a month to hold that film. In two years, that film will have cost them an extra $35 million. Maybe even $50 million. They are paying interest on the interest. 10) Release it now, you can write off the loss. And move forward. 11) Assume the $150 million invested only gets you, say $70 million in revenue. That is enough to pay back half the loan. The rest can be negotiated into long term debt. 12) Various guilds and stars have clauses in their contract for acts of god. That is what they are going to lean on. Posted by: President-elect Emmie at December 08, 2020 07:01 PM (ofYez) Reasonable concern. They want to be re-elected would be my answer. Yes there's a fear that Atlanta may burn, but you know what the GOP reps in GA care about more than Atlanta? Their jobs. A little political cover from SCOTUS will be all they need to fall in line with the Trump voters, who will be screaming for them to act in the right way. Posted by: dantesed at December 08, 2020 07:05 PM (88xKn) I don't bother with nearly any new media. Rather than gamble on things being worth the price, I prefer to just wait until the hype and marketing have died off and then pick and choose the things I know I'll enjoy or trusted sources recommend. As long as marketing campaigns are still spending tens or even hundreds of millions though, I'm pretty sure I'm in the minority. Posted by: Sjg at December 08, 2020 07:14 PM (gDSJf) 424

I just noticed Pa appended the certification of the election to their response, so stopping that from happening is moot. The naming of electors is entirely within the province of the legislature.
SCOTUS may have determined no action from the court is needed right this minute, since the legislature can stop the fraud if it chooses, and hearing the merits of the case can be done at any time (for the sake of future elections integrity). HBOmax is actually the best streaming service - they have the entire HBO movie and tv show catalog plus I think some other content, on demand. You no longer have to pay a cable company to get that content.

Yep. I mean, why not? Fuck Pennsylvania. Fuck the Penn State court. THEY don't get to decide the next president all by their lonesome, and if they can't run a clean election, fuck them. In fact, continue fucking them till they guarantee the problem is fixed once and for all. Let me make a prediction: Movies will become totally digital/virtual - no actors needed. And you'll be able to select who plays which part in any movie. Humphrey Bogart and Lauren Bacall will be making a comeback, in color, visual form, and audio. Deep fakes aren't just for politics, you know. And Hollywood and the Oscars will be gone forever.
