Texas Files Lawsuit in the Supreme Court Asking The Federal Courts to Throw Out the Election Results of Pennsylvania, Wisconsin, Michigan, and Georgia

A copy of the complaint is here.

It's filed in the Supreme Court because rhe Supreme Court has original jurisdiction -- that is, the Supreme Court is not merely an appellate court but the original, first trial court -- in disputes between the states.

The lawsuit seeks to set aside the fake election results in these states due to rampant irregularities which make the results unreliable and therefore prejudice the citizens of Texas and any other state which held a clean election.

Julie Kelly discusses the suit here.

In a lawsuit filed Monday before the U.S. Supreme Court, the state of Texas accuses four states currently "won" by Joe Biden of using the COVID-19 pandemic as an excuse to violate the Electors Clause and the 14th Amendment. Texas Attorney General Ken Paxton is suing Pennsylvania, Georgia, Michigan, and Wisconsin for usurping the sole authority of state legislatures to create election law and charges that millions of absentee ballots were unlawfully processed by local election officials.

"They accomplished these statutory revisions through executive fiat or friendly lawsuits, thereby weakening ballot integrity," the plaintiffs wrote. "Finally, these same government officials flooded the Defendants States with millions of ballots to be sent through the mails, or placed in drop boxes, with little or no chain of custody and, at the same time, weakened the strongest security measures protecting the integrity of the vote--signature verification and witness requirements."

The filing asks the court to extend the December 14, 2020 deadline to certify each state's electoral slate noting that the only date "mandated by the Constitution" is January 20, 2021.

Yes, that's correct. The "safe harbor" date -- today -- is specified in a Congressional Act, not in the Constitution.

The bill of particulars against the four rogue states is damning. Unelected bureaucrats such as Pennsylvania Secretary of State Kathy Boockvar and members of the Wisconsin Election Commission changed rules at the last minute and without authority. Local election workers flagrantly violated numerous state election laws; rejection rates for mail-in ballots were far lower than in the primary elections despite the unprecedented volume of absentee voting; and the statistical probability of Joe Biden's victory in those four states as of 3 a.m. on November 4, 2020, given Trump's substantial lead, is "less than one in a quadrillion."

Trump has also filed a lawsuit in Georgia, which wobble-kneed Establishment drull and former Russia Collusion Hoax Enthusiast Andrew McCarthy finds to be strong on its face.**

In the Peach State, the campaign is represented by different counsel than it has been elsewhere. The 64-page complaint is a linear, cogently presented description of numerous election-law violations, apparently based on hard data. If true, the allegations would potentially disqualify nearly 150,000 illegal votes in a state that Biden won by only 12,000.

If something is going to happen, I would assume it must happen soon or the election will be thrown to the House and I'm not confident of such an outcome as there are so many RINOs and "Never Trumpers" and Chinese stooges in Congress.

What amazes me is how many people have been bought at such a paltry sum. But Congress has demonstrated they are cheap whores at every turn so we ought not be surprised here.

This is what pisses me off. The fraud was so damn blatant. But how many courts now have said shit like "we can't invalidate the ballots of thousands of Biden voters" as they dismiss the fraud lawsuits?

108 This Texas Lawsuit is actually a Texas request to the Supreme Court that Texas be allowed to file the attached "Bill of Complaint" against PA, GA, MI and WI in the Supreme Court for direct adjudication by Our Black Robed Masters.

The Supreme Court can deny this request, but if it grants the request and allows the filing of the Bill of Complaint, and grants the remedies requested, then things'll get hot.

Request for relief: Block PA, GA, MI and WI's currently unlawful election certifications, allow the legislatures of PA, GA, MI and WI to appoint each state's electors.

130 The other suits - PA, WI, MI - are not as unimpressive as many seem to think. Not sure what "clean and linear" has to do with anything.

Look at the specific, concrete examples of irregularities, violations of election law, etc. in those suits. They are voluminous, and cover just about every aspect of the process.

They easily - easily - meet the standard for calling an election process into question, which is the point. One doesn't have to prove that you won by 17 votes, vs. lost by 78 votes.

McCarthy is OK on certain things. Generally, one must first immediately screen his views for legal cult assumptions and distortions. Oddly, he coined one of the best phrases about the lawless SCOTUS, saying the 4 authoritarians "vote, they don't judge". Odd because that very thing, the substitution of lawless, baseless, partisan voting for actual judging, is the root of legal cult damage to the society. I think he coined this term in response to the O-care debacle.

Said so, WAAAAYYYY, back in March.
Once the donks were able to change the very nature of how we conduct a national vote, with a major assist from the GOP, this nightmare we are living through was fore ordained.

Fun Fact:
11 pct of ballots in Maricopa county were digitally "adjudicated." per a spiffy bill rushed through in February.

Ditto. Or, alternatively, it causes the other state legislators to do what might actually be the right thing: abstain and not send electors. The election was hopelessly and irredeemably corrupted. It is probable that Trump won, but we don't actually know. The best (most honest, in my opinion) move is to not send electors at all. Kick it to the house.

The problem is that all of the changes to voting procedure that came this year came from the judiciary and the executive branches of the individual states, even though the legislatures have sole constitutional authority over how electors are awarded.

The legislature didn't say, "Anyone can ask for an absentee ballot." Governors and courts did.

That might be the play here, and it would explain why the roll out has been so slow. You can't really trust the state legislatures, either.

the USSC says the vote tallies can't stand and its too late to come up with electors so you don't get electors. sorry. (added bonus: voters in those states are furious with their leadership)
Nobody has 270, so it goes to states per constitution--one vote one state.

Trump wins easy.

Posted by: Xipe Totec-MAGAfauna at December 08, 2020 01:36 PM (o2MD2)

The sword cuts two ways here. We keep saying that in the end the legislature picks the electors via whatever method they choose. Let's say the MI legislature votes to approve the electors. What recourse does TX have? It doesn't matter if every person in the state voted for Trump, if the legislature makes the electors Biden electors. The state legislature is the final arbiter in the matter. SCOTUS is going to tell TX, everything you say may be true. Legally, it doesn't matter.
Posted by: WOPR - Tactically Dramatic is Failue at December 08, 2020 01:46 PM (J70i0)

Yeah, I think this is more right.

Under election law, Texas doesn't have a whole lot to say about how Pennsylvania votes and what their procedures are.

However, under 14th amendment case law (equal protection), courts have been more then willing to say "okay, technically this is Georgia's election to run, but they're running it in a way that discriminates against black people, so we need to rewrite Georgia's laws."

But Texas wouldn't have standing to sue under 14A.

So... I don't know. I think it's a clever way to get a case to SCOTUS, but I think SCOTUS would be following existing procedures and case law to dismiss the suit for lack of standing.

I read an interesting story recently (not related to anything here), about the Australian Cardinal Pell.

Seems this guy has been a vocal critic of financial shenanigans in the Vatican, had a brush with a pedo priest in his early days, but has otherwise been fairly vocal too about rooting out the pedos.

And this guy meets criteria for "conservative" when it comes to the Catholic Church.

So.... they manufactured some pedo claims against him. It appears they were bullshit cases, and yet the courts in Victoria (or whatever, this is Aussie locals), the movement against pedo priests, AND the media all ganged up on him. And he was convicted.

Appeals court upheld the conviction.

Aussie's highest court in the last tossed out the conviction, basically saying there's no evidence to back up this claim from this one dude (and another guy who's dead now), other than him saying it happened in a Cathedral, in public, in broad daylight, with no one else seeing a damn thing.

Bullshit.

Why, it's almost as if the #metoo can falsely accuse Catholic clergy, and everyone rushes to judgment, including zealots in courts.

Law be damned.

Good thing for THIS guy the Aussie Supreme Court seems to have some integrity.

286 As a back up and this is an appeal to Ace, maybe the most important avenue and the only one we ever had would be to pressure the legislatures in the stolen states. The only thing they care about is getting elected. It's a suicide moment for the US and should be for them too. A bunch of state legislators are rhinos, never Trumpers, corrupt, etc. so we all know that the best we could do is coerce them. The only leverage we have is to target them and tell them they either all vote and get the electors successfully for Trump or we vote for their opponent in their next election their careers are done.

Ace there is no organization on the right. We need a major new site like yours to take up the cause. This is their constitutional duty. It's relatively easy to supply the information to organize. They have original jurisdiction over a handful of things. Off the top of my head I want to say it's Admiralty law, diplomats, and disputes between the states.

Congress is also allowed to expand that list.

Interestingly, the Constitution doesn't say a whole lot about how the courts should operate -- just that they're establishing a Supreme Court and whatever "inferior" courts need to exist.

So, if Congress wanted to, they could grant SCOTUS original jurisdiction on everything and get rid of all of the lower courts.

I don't know why they'd want to, but it would be constitutional.

Posted by: artemis
.....

Each state has many different methods they could use to appoint electors..

By county or federal House District, for example.. Whichever candidate got the most votes in a District, that get assigned an elector for that candidate.

I think Trump wins in this case.. For sure he wins all of the contested states by county.. not sure by District.

SCOTUS is absolutely the obvious and correct forum for this.
Posted by: rhomboid at December 08, 2020 01:57 PM (OTzUX)

It's not about the issue involved, it's about the parties involved.

From a logical perspective: if NY wants to sue CT over an issue, which court should hear that? The state trial courts in CT or NY? The federal district courts in CT or NY?

Obviously, one state would have a home court advantage.

At least that's how the thinking went in the 1700's.

So in those rare instances, SCOTUS has original jurisdiction.

But if that same dispute was simply between 1 guy from CT and 1 guy from NY, (and the amount in dispute was enough $$), then it would be filed in federal court under diversity jurisdiction, usually in whichever district court is more convenient for everyone, but both sides will likely battle to have the federal court in their state hear the case.

389 They have original jurisdiction over a handful of things.

Posted by: Harry Paratestes at December 08, 2020 01:57 PM (UPoLF)

Congress can determine the scope of SCOTUS' appellate jurisdiction, IINM. Both expanding and restricting. So it's entirely possible for Congress to tell SCOTUS, "Hey, this law we passed is not any of your business." I believe they did just that with regards to some of the Guantanamo Bay stuff.

By county or federal House District, for example. Whichever
candidate got the most votes in a District, that get assigned an elector
for that candidate.

I think Trump wins in this case.. For sure he wins all of the contested states by county.. not sure by District.

Posted by: Chi-Town Jerry

And that's precisely why it can't go to the state legislatures. How long is it going to take for each legislature to agree on the method they're going to use? It's utterly impractical. It's not a right to force the states to obey; if they fail to obey, they forfeit. It's a right for them to exercise in a deliberative, public manner, long, long before a month AFTER the dogdamn election. If you're cynical about government *now*, just imagine what kind of sleazy, backroom deals and chaos can go on behind the scenes?

By contrast, the federal Constitution has a perfect solution: disqualify them all and let the People, via their representatives in their Republic, decide per the mechanism laid out in ART II, as amended.

There was a case between Wal-Mart (Arkansas) and some outfit from Texas and both were lobbying for home-court advantage and the case had stalled in constant back-and-forth over venue. Well, I think he's right that SCOTUS most likely will dismiss the case for lack of standing.

SCOTUS can, of course, do whatever they want. But either TX is suing in its capacity as state (and has standing in that capacity, but only as an aggrieved state under election law, which is ... well, I don't think there's any caselaw on that) or, it's suing in behalf of people in those states who weren't afforded equal protection, in which case they don't have standing, and the court won't hear the merits of the case.

This is the problem with our side only appointing judges that are "not activists" and believe in "judicial constraint" etc. Because established precedence says that the 14A cases should make their way through the courts like any other case. I don't think our current SCOTUS will create a whole new avenue for states to sue each other over election outcomes.

I was not a Cruz guy during the campaign, but I have to give him loads of credit for being one of the few to hold up his end of the bargain with the RNC. If the RNC provides you resources during the primary, you are obliged to go stump for the eventual winner. All of the candidates who accepted RNC assistance - including Trump - agreed to those terms.

Most did nothing to help Trump win or actively worked against him in 2016. Cruz didn't. He wore out shoe leather and telephones campaigning for Trump after the nomination. He did what he said he would do, even though he found it (quite clearly at the time) personally distasteful.

He went up several notches for me after that.

No doubt because of my personal regard for him and respect for his high-end ability, I am inclined to cut the former director slack. He was thrust into a no-win situation: It is not his fault that Democrats nominated a criminal suspect, or that Republicans nominated an irregular politician heedless of the norms of discretion and distance that a president should maintain when dealing with his law-enforcement subordinates. Comey aside, I had no better friends in nearly 20 years as a federal prosecutor in New York than Dan Richman, the Columbia Law School prof through whom Comey transmitted information to the New York Times, and Pat Fitzgerald and Dave Kelley, Comey's lawyers. These aren't just former colleagues of mine; they are old friends.

A *very* superficial observation, by myself, would be that the GOP is ripe for takeover. That method works for 'Progressives'. Rather than build their own institutions, they simply attach themselves leech-like to an existing structure, and slowly begin to take control. It has happened innumerable times.

If the will exists, there is no reason to not assume control of the existing Party. There are considerable established resources there.

If the will does not exist, then an effective new Party seems unlikely.

For some reason, dems can plan decades in advance, then other shit is incredibly myopic. See: Filibuster.

As I've mentioned before, while Roberts is definitely a loose cannon, something like this has got to be weighing on his mind. He loves the court and what it stands for, almost as much as his position in it.

I'm betting that the threat of losing his standing and diluting the power of SCOTUS is going to be every bit as important as any arguments made to them regarding the election.

"..the so-called "church" of Bergoglio does not hesitate to close churches, arrogating to itself the wicked right to deny God public worship and to deprive the faithful of the grace of the Sacraments through a wretched connivance with civil power.

This "church" humiliates the Most Holy Trinity, lowering it to the level of idols and demons with sacrilegious rituals of a neo-pagan religion. It snatches the crown and scepter away from Christ the King in the name of Masonic Globalism; it offends the Co-Redemptrix and Mediatrix in order not to annoy the heretics, Her enemies.

It betrays the duty of preaching the Gospel in the name of dialogue and tolerance. It silences and adulterates Sacred Scripture and the Commandments of God in order to please the spirit of the world.

It tampers with the sublime and inviolable words of the Prayer which the Lord Himself taught us. It profanes the holiness of the Priesthood, cancelling the spirit of penance and mortification in clergy and religious and abandoning them to the seductions of the devil.

It denies two thousand years of history, despising the glories of Christianity and the wise intervention of Divine Providence in earthly affairs. It zealously follows fashions and idelogies rather then molding souls to follow Christ. It makes itself a slave of the Prince of this world in order to preserve its prestige and power.

It preaches the blasphemous cult of man and refuses the sovereign rights of God. And when Bergoglio speaks, the faithful are almost always scandalized and disoriented, because his words are the exact opposite of what they expect to hear from the Vicar of Christ.

He asks for obedience to his own authority even as he uses it to destroy the Papacy and the Church, contradicting all of his Predecessors, none excluded.

First hand knowledge of this. Recall that most National Guard forces were activated under Title 32 or State Active Duty. T32 is paid for by Federal funds but still operating under the command and control of the State Adjutant General- the 2 star in charge of NG forces for a state- AND the Governor. State Active Duty is entirely under the auspices of the Governor.
The riots et al were under T32 or State Active Duty- and in democrat states. For example, you think Gov Inslee of WA is gonna allow NG troops to pummel his hard core supporters in BLM/ANTIFA. No.

So this has nothing to do with the Federal brass and everything to do with politics being local.

661 Flynn should have won, but the deep state and the judiciary would have none of it. Trump ended up smashing his fist onto the scale to overcome the chicanery and refusal by his enemies. This wasn't a win for Flynn in the sense that it should have been. But I am pleased that Flynn is at least a free man (until Biden gets in and the re-prosecute him, anyway).

People often talk about very weird things when they're dying, much of it reminiscing about where they were when something big happened-and things that don't seem meaningful to other folks.

Something to keep reminding people of...Biden's "majority" is an absolute fiction only propped up by the MSM / DS.

And, the number of people in Blue States who would cheerfully hang their 'elites' from bridge overpasses, if anger passes critical mass, is growing.

The Blue State Bosses are desperately hoping for that monster bailout from DC...it's the only thing that keeps them from boarding their private jets and fleeing for their lives.

Not to scare anyone, but there is talk that they might try to add Obama to SCOTUS if they do the court packing. So in that comparison Cruz is on par with the SCOTUS greats in comparison.

the meaty part-" importantly, the Texas lawsuit presents a pure question of law. it is not dependent upon disputed facts. 679 >>Well, let's not act like Ted Cruz is doing Trump a favor here. It's every trial lawyers dream to argue in front of SCOTUS. There are very few people alive who can claim to have litigated a case in front of SCOTUS.

Posted by: Harry Paratestes at December 08, 2020 02:25 PM (UPoLF)

Cruz has already argued 9 cases before SCOTUS...only a handful of active attorneys have argued more.

Not saying his offer here isn't self-serving in some way, but it isn't about fulfilling that dream.

It's a magical spell that accurately summarizes every SCOTUS opinion on the 2020 election before it's written. Not that there will be many opinions. Most of the cases will be thrown out with unexplained orders with only 1-2 dissents to the orders.

685 Funny thing; if the Popular Vote Compact was legal (its not) and we had honest elections (we don't), all those Blue States would have been forced to give their Electoral Votes to Donald Trump by their own end run around the Constitution.

Which is why they support it: with Dominion Cheatware and Mail-In Fraud they know they'll always win.
