Even As the GOP Flips Another House Seat, Fox's News' "We're Just That Damned Good" Decision Desk Arrogantly Refuses to Retract or Even Comment on Its "Call" that the Democrats Would Pick Up +5 to +15 Seats

That's Fox's brand, huh?

Republican Michelle Steel has taken the Huntington Beach area seat away from the Democrats.


Earlier, Christopher Gage wrote a barnburner of an article chastising Fox for standing by its "call" just because they will not admit error to the conservatives they plainly despise.

As the GOP continues gaining seats, Fox News has refused all calls to rescind its absurd "call" that the Democrats would win +5 to +15 seats.

In fact, they're so arrogant, they are refusing to even answer legitimate media inquiries about it.

Deb Heine asked if they were standing by the call, and if so, why.

She got the same answer the leftwing media usually gives conservative critics: No answer at all. Nothing but static.

Trusting that they have the media power to smother the story in silence.


It's a good question so American Greatness emailed Fox News Corporation Monday morning to ask it. We didn't receive a reply.

The Fox News Decision Desk made its wildly inaccurate projection early on Election Night, saying that Democrats would win at least five seats in the House. The bad call was devastating to Republican morale and set the false narrative that President Trump had no coattails.

As Gage noted, "this happened while Californians were still voting."

Why does that matter? Because there are four districts in California that Democrats won from Republicans in 2018 and which Republicans were trying to retake. They are likely to win at least three of them.

Fox News anchor Martha McCallum reported on Election night that according to some projections, Democrats could pick up as many as 15 seats.


We now know the GOP are projected to gain up to 13 seats, and are 21,000 votes shy of retaking the House, according to House Minority Leader Kevin McCarthy (R-Calif.).

American Greatness emailed Fox News' corporate communications vice president Irena Briganti Monday Morning to ask if the Fox News Decision Desk had rescinded its inaccurate projection, but did not receive a reply.

Giving the finger to conservatives' questions about mistakes?

Fox News has nothing more to learn from CNN. Their transformation is complete.

Meanwhile, the Fox house is burning down -- and the "News" division has forbidden daytime to even cover election fraud.

But I'd say calling VA immediately, and saying D's were on track to pick up house seats definitely suppressed votes out west.

AZ and NV may have went R if the R's out there didn't think there was no point in going out and voting.

I mean, maybe not. But we'll never know.

But I do think that Fox thought it would suppress votes. Which is why they did it.

It's very possible (I'd say likely) that he waivered a bit on the details of the story, the cops threatened him with charges for signing a false affidavit, and he said "well, I don't know. I don't remember" or something, and so they turn around and say "he recanted his story."

That kind of stuff happens all the time. I've watched cops write in reports "the suspect then admitted to this Officer that his original story was untrue" when I have the damned body cam footage and that's not at all what happened.

Yeah, I remember making fun of them for their media circle jerk "election simulations" which seemed very odd to me, since they had people playing military generals and the supreme court, and I kept thinking "what? They say Biden is going to win by 10. Do they really think that if Biden clearly wins the election, courts and generals are going to be involved, because Trump wont leave office? How ridiculous!"

No calls, delayed calls, wrong calls all in the favor of the Dems.

The 3 key fraud states (PA MI WI) have big cities which have enjoyed some spirited peaceful protests (i.e. idiotic destructive and deadly riots) in the last 6 months. Except for MI, interesting.

Anyway, I have close to zero confidence in the PA legislature acting like adults and doing their duty. No idea about MI and WI.

But if in fact these legislatures end up voiding the election, there will be festivities (Phila, Madison, Milwaukee), maybe Detroit but not even sure about that. But how much? Common sense and the unvarying local anecdotal evidence and reactions from the locations themselves tell us Biden of course had zero enthusiasm there (one of the mysteries, or tells, of the election, depending on how it goes).

Those most likely to engage in festive peaceful protesting in these places are simply not people who care about Biden, per se. Nor are they as full of anti-Trump hatred as they might once have been.

Might be a dud. However, I can see outsiders coming in, bigly. And if you thought the NC bathroom policy boycott was something, wait until you see what happens to one of these states (especially if it comes down to one of them, as it might) if they are seen as flipping the presidential election.

This issue is that NC has a fairly strong executive so there was a colorable argument that the NC SoS could make that change which is why SCOTUS didn't issue the injunction.

But it's a very uphill battle. Not only is this a political question, which courts hate to touch, but the Constitution specifically grants Congress the right to decide when elections are and when people are sworn in, and they've passed legislation spelling that out.

Not to mention the practical consequences -- who is president if this isn't resolved by what is supposed to be inauguration day? Trump?

Well, Art I. Section 4 Clause 1 says "The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators."

So like... not exactly laid out in the Constitution.

But yeah, as I said above -- the Constitution specifically says that the date is to be set by congress.

Clearly those numbers were wrong.

And like, honestly, every election seasons polls are wrong. They spend all summer saying the D is +10 or +12, then it "tightens" at the end, then they say "well, yes we had D+3, but, you know, with the margin of error and all, we weren't really THAT wrong when we said Trump wouldn't win. Just a little wrong."

So we can discount the polls.

And election day is full of fraud, possibly in the millions of ballots in swing states.

Understanding that -- how do we know the country doesn't routinely vote 55 or 60% republican, and the D's cheat so much that they win a decent amount of the time?

Not this much fraud, but it is measurable to a degree.

Prior to 2018, Broward County was fraud central. After Brenda Snipes almost cost DeSantis the Governor's race, he fired her and forced Broward to clean up their act.

You can go look at the partisan split in Broward in 2016, 2018, and 2020 and see a massive improvement for the GOP. It is still a blue district, but voting at something like 55-45, not 65-35. The shift didn't come because Trump suddenly got more popular in that county.

Here is another crazy stat.

You know how people say the country is split 50/50? Not the case at all.

Over the past 100 years, voter turnout (total votes cast / total eligible voters) typically falls between 50-60%. Over the past 40 years, it has bottomed out at 49% in 1996 and peaked at 58.2% in 2008.

Turnout this year looks to be about 58% or so. With Biden with 51% and Trump at 49%, that means that it's actually...

Biden -- 30%
Trump -- 28%
Apathy -- 42%

Who knows what is the partisan breakdown of the 42%.

Whether NC has a strong executive or not, the Constitution tasks the legislatures with time place and manner of elections. That is not colorable and would not survive challenge.


Also, part of the PA suit is that Dem localities broke the law to contact Dem voters so they could cure ballots before election day but Rep areas followed the law and did not. That is an equal protection violation that applies equally as well in NC.

Similar thing happened in my community, where voters overturned a permit for a pot dispensary that was voted in by the city council and never put up to the citizens for a vote. I think they were just pissed that they were never asked.

When you present these issues a la carte on the ballot, people reveal what they want. The trouble is, they don't seem to connect voting for a particular candidate/party to how their lives are running.

(As soon as someone realizes this, California's constitution will change and no referendums or propositions will be allowed.)

Issue an order that none of the disputed elections are valid until the disputes are resolved. So January rolls around and there is no EC vote. What does Congress do? They can pass legislation to delay all the dates and Trump continues in office.

Similar thing happened in my community, where voters overturned a permit for a pot dispensary that was voted in by the city council and never put up to the citizens for a vote. I think they were just pissed that they were never asked.

When you present these issues a la carte on the ballot, people reveal what they want. The trouble is, they don't seem to connect voting for a particular candidate/party to how their lives are running.

(As soon as someone realizes this, California's constitution will change and no referendums or propositions will be allowed.)

Not 100% true JJ. Statistical analysis is admissible and was used in the 1976 case challenging NY presidential results. But it has to be coupled with proof that fraud occurred.

First you prove there are enough incidents of fraud to show it was not localized, but widespread. Then statistical analysis can show the impact of the fraud.

Right now the stats are solid showing how much fraud there was and the real impact of it.

I think the SCOTUS opinion is going to take some time and I don't think it will be a question of a recount.

The problem in PA first and foremost is a Constitutional one. The governor and the PA Supreme Court clearly violated the law by usurping power that belongs to the PA legislature. Changing the rules for late voting as was done by the Gov and the Court without the legislature was clearly unconstitutional and if that is true every vote counted under the unconstitutional act is illegal.

It's such a fun movie. It doesn't have a pompous bone in its body. It's got one of the best hero archetypes for that kind of movie you can imagine (hero archetypes, especially of the kind that can grin properly, are sadly lacking these days). I think that this is the best legal argument, personally. But I haven't really studied the case law.

In 2020, neither Trump nor Gore have won PA (or any of these other swing states). Some are still counting, some will auto-recount, and some will be sued for a recount by Trump.

The difference is Trump is asking for a full state hand recount, not just a recount in Trump-favorable districts. In fact, if anything he'd want a hand recount in Biden favorable districts! Trump is fighting to maintain the integrity of the enfranchised, not support disenfranchisement by allowing spoiled ballots into the pile.

But Jake is trying to pre-argue that SCOTUS will "overturn" the vote in PA. No, at most SCOTUS will say "these ballots in PA, these ones over here, the ones that are illegal? Those are illegal and shouldn't be part of the final tally." That's not overturning anything. That's getting the numbers right before the election in the state is certified.

notice that he tries to imply that Florida was Bush's and so SCOTUS didn't "overturn" the call. No. That's very clever of him but it's a lie. He's saying that because he wants to later say PA is Biden's and so SCOTuS shouldn't overturn the call. But Florida wasn't Bush's until it was certified and that didn't happen until the SCOTUS told Florida's supreme court to stay out of it.

PA is not Biden's nor is it Trump's, not until it is certified, and if it can't be certified, then the state house will handle what to do with their electors.

but again, this is NOT, like Bush v Gore, no matter how badly the media wants it to be

So the story is "Trump is Gore except he won't concede."

Otherwise, why bother with Presidential elections.

The Legislature sets up the procedure, prior to election day, that determines how electors are selected and seated.

The Electoral Count act of 1887 came about, because during one prior election, some southern States had a situation where the Governor sent in one slate, and the Legislature sent in another.

That Act says the Governors Slate wins in that case.

It also says that a Legislature CAN change election law prior to Election day, and there is a 'safe harbor' time limit when, if said law is disputed in court, they have until 6 days before the Electors vote to get it resolved (and the new change can then still take effect).

Now, 1887 has never been tested in court. So who knows how the Supremes would view it.

But it sure reads like it was never intended that a Legislature could just over ride the existing law, and put in electors THEY voted on.

717 Mark Steyn was a co defendent with National Review against Michael Mann, with the idiots from Jones Day representing them both. So Steyn has a lot of experience with them. I read his opinion of them years ago and it wasnt good

Steyn eventually went independent and now appears to be winning his part of the case against Mann, while Jones Day just wracks up costs that get paid off by NR cruise participants. So Steyn obviously had better strategy than Jones Day. He also holds a grudge.

Now, Mark Levine flipped out and went after Steyn (not by name) and accused him of dragging volunteer lawyer for the Trump effort through the mud (apparently Levines wife is one of them). I did not hear all of Mark Steyn today so I do not know how true this was, but Levine does holds a grudge against him since Steyn sued Levine and the original funder of Levine TV for breach of contact and has won. And he may not like it that Steyn is a front runner to inherit the EIB network slot of Rush passes away (a guess, nothing more!). Its one of the things I view Levine in low esteem for, and I usually like him a lot. (Although he was a frothing never Trumper before the election, I and many like me have forgiven him for it - his transformation seems real).

Inside baseball, but I find it disappointing that Mark Levine can be so vindictive. He is that way against many others (although the grudge match against Glenn Beck evaporated after Beck reached out to him, and now Levines tv show is on Blaze TV ). Steyn is no where as rich as Levine, and seems like a nicer guy overall. That he is not a lawyer is a plus

Yes, he and Rush are not authoritative. But given Steyns experience withJones Day, I bet he has them pegged to rights on this one.

Had to go looking for a total outstanding (I think its 77000). Given that Trump needs 58% to win. When Biden was ahead by 30000 it was 67% So this is excellent news. Trump is gaining.

But in bad news Alaska says they are just STARTING absentee votes now. What the helm have they been doing? Any Alaskan horde members? Sounds like the have been manufacturing the votes they need
