The Morning Rant: Minimalist Edition

Pack the court? Sure. How about if by some miracle the Republicans regain the House and President Trump nominates five more extremely young and extremely conservative judges and Cocaine Mitch McConnell rams them through in the next few months. How does that sound?

Article III of the U.S. Constitution does not specify the number of judges on the Supreme Court. The current number was set by the Judiciary Act of 1869, which is an act of Congress and can be changed by any subsequent Congress.

Or maybe we should go in the other direction. How about a Supreme Court of three judges? Thomas as Chief Justice, with Barrett and Alito as associate justices.

And while we are at it, how about if Congress limits the scope of the court's authority? The Constitution seems to give them that power in Article III Section 2:

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be a Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the Supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.
That would open up some interesting possibilities. How about a specific prohibition against limiting any of the 10 amendments in the Bill of Rights?

It is these insanities that makes conservatism immensely satisfying as a political philosophy. Chesterton's Fence is a lesson that needs endless repetition. I'll bet Harry Reid would like to revisit his destruction of the filibuster and the consequent boon for the Republican party. He claims to be happy with it, but legislation can always be changed, but the court is for a generation and can set the tone of legislation and even the direction of the political process of the country. As much as the Left would like to radically remake the structure of our government, there is the possibility that their enemies on the other side of the aisle will be emboldened to use those same tools, and the end result might be unpleasant for them.

If President Trump wins reelection next week, he will have a tremendous opportunity to do just that. Gut the regulatory state and empty the departments of the thousands of apparatchiks who have nurtured the Deep State. And a rational Supreme Court will be much more supportive of a return to basic principles!

I prefer the idea that 2/3 of state legislatures need to approve of a SCOTUS ruling to give it the power of precedence.

Start by wiping out everything as precedent, give SCOTUS them mission of submitting everything they want to be precedent to the states over a 5-10 year period. After that, it's just new stuff.

45 Too late, it is ingrained in American politics that SCOTUS has the final say on any legislation, EO, or decision made by any Civil Servant even though the power to make those decisions are clearly laid out in the Constitution and settled case law.


Both parties rely on SCOTUS to settle things that are clearly not in their lane.


For example, the EO that cancelled the dreamer stuff that obama did. SCOTUS ruled that even though the President has the power to cancel the program they ruled that no he couldn't do that because they didn't like the reason he gave them for cancelling the EO.

Which is complete and utter horse$hit, but the decision stands to this day.

57 The only real fix for SCOTUS is to not allow the federal judiciary to rule on any darn thing they want via the 14th amendment. So long as they can do that, term limits and state overturning decisions is just musical chairs. Limiting jurisdiction and clarifying the 14th is the only way to go.

The founders never, ever envisioned a single district judge overruling an elected state supreme court.

I don't think it was as close in PA, MI, WI, as the polls have been saying, but the debate eliminate the oil industry put a nail in Joe's coffin in the Midwest.

Western Wisconsin (where Trump will be today) is the center of the fracking sand industry so the talk of shutting down oil will not go over well.

Maybe he's gotta go somewhere and they threw a dartboard at a map where "lots of blacks live" and they hit GA.

Too complicated; postulates a complicated plan when a much more simple slip up, easily explainable, is more likely.

Remember that AOC's Green New Deal calls for the elimination of all. All of the activist left wing base has been calling for it; all of the corporate grifters who see huge profits to be made from the takeover of the energy industry have been calling for it; Tom Steyer spent millions of dollars of his own money calling for this. Joe has been hearing it from everyone around him since the campaign started.

What has been hard is that he has had to walk a tightrope and pretend that he WON'T kill the oil business, that he WON'T let AOC have her way and kill the oil industry. It has been getting harder and harder. It's safe and clean and it can pay well. I work in the software industry. I'm a medium-shot. I have some authority and a lot of skill.

I am not hurting, but the fact remains that I don't earn more than a lot of the oilfield guys. Never mind that the skills are wildly different. Even if we assume that job transitions are easy (they aren't, at all), a lot of those now unemployed oilfield guys earning six figures are going to be in for shock when they start as junior programmers.

Decisions based on such matters are to be deemed as void.

That stopped in 84. Congress gets the same FERS retirement that all civil service people do. Granted it's a generous plan but it's no longer "fully funded" like CSRS was. They have to contribute and they have to pay social security tax also.

My local rag is also all about full hospitals. A neighbor is an ER doc. He works at a more rural hospital about 30 miles away so it's not quite apples to apples. But he said since day 1 of the WuFlu his hospital has seen no significant increase in patients or any shortages of anything. You'd think if the hospitals in town were at full capacity there would be some overflow to his hospital. But there isn't. Which tells me all the stories about it are total bullshit.

The report didn't explain why the patients weren't being transferred to Spokane (which is the regional medical center), but in any case it isn't true - the hospitals in Northern Idaho aren't full, and there are no plans to transfer people.

NY is always blue so my presidential vote won't count in the general too much, other than I hope to help give Trump a referendum and to keep trending red so we can someday God willing break away from downstate. But of course I voted Red all the way down so that helps.
It was an older crowd, it being morning on a work day so more likely pro trump but it's hard to tell where I live. Nobody was talking about who they were voting for and nobody had any political gear on. But they wouldn't, because that's just the kind of neighborhood I live in. Mrs. Cooper reasoned that the unusually high turnout is a sign that people are coming out for Trump. The church we voted at is right on a very busy street and we had several cars honking and shouting "GO TRUMP" as they drove by.
I'm in a suburb of Albany. So it's kind of a mix. Albany County went something like 60/40 for Clinton in '16. But that's because of the city and the colleges. The suburbs are reddish/purple for sure. I live in a village that's kind of a reddish enclave in the county.
Last year I saw tons of Trump signs and some Hillary sings in the neighborhood. This year, I see a lot less political signs at all. Way fewer than 2016, not many for either candidate. Although I took a bike ride Saturday and of the few signs out, the Trump ones outnumbered Biden 3 to 1.I've been thinking about what the lack of signs means, and I had kind of an epiphany. I think people don't really care about any of the election news or all the drama. They don't live on Twitter or care about what the news says. They, like me, knew who they were voting for 3 years ago and nothing is going to change that. No need to talk about it or put up a sign or anything. They're just going to go vote and that's that.

Different poll, this Trafalgar poll is a new one.

But it is confirmation. Rich Baris will finish a new PA poll tomorrow that I am curious to see. I think it will match Trafalgar.

The Trump +3 poll is a bit of an outlier, but not necessarily wrong. There is something going on in Chester County that is causing the honest pollsters to look at it. And there was a reason Biden was there yesterday.

On the news last night they reported that Harris County, which includes Houston, has had 1.14ish million early votes. Obliviously those are not all D's, so think that they are doing a little wish casting. For an FYI, there are about 2.4 million registered voters in Harris County.

I'm not sure if the Uber/Lyft issue will affect this election much. I am sure it's going to help drive the State's economy further into the ground, and drive ever more productive people to leave the state for good.

And it's important to note why California is doing this - Uber and Lyft are not unionized because they use Independent Contractors; they compete with the heavily unionized Taxi and Transportation industries.

A very large portion of the money earned by those unionized companies (and their employees) is kicked back to the Democrat Party of California. That's why the California Dems could not care in the slightest about who it hurts, or what it does to the economy. They are protecting a huge source of their own grift, and they will do anything to keep it going.

As a young lad of 29, I never understood the appeal of Cher? Even in my youth, when she was straddling the gun on the USS Iowa for a music video, she looked like a worn out horse.

You're welcome! Tell him to check out the Old State House; in the basement is the Edes and Gill print shop, which is a replica of an 18th century printer's shop (my kind of thing) and right outside is a marker designating the site of the Boston Massacre.

The Old City Hall nearby is a Ruth's Chris now, but a lovely example of Second Empire architecture.

And I haven't been there in years, but if he can visit the Warren Tavern in Charlestown, it's worth a look. It was the first building re-erected after the Brits burned the town during the battle of Bunker Hill.

And tell him to avoid "Cheers" on Beacon Street and at Faneuil Hall like the plague.

Atlanta also had a taste of BLM including the sacking of Buckhead-wealthy people do not like having their shopping district trashed nor did the folks appreciate the sacking of the area around the Mercedes Benz stadium.

Note that the DA involved lost his reelection bid regardless of wrapping himself in the movement.

Newt's district was significantly more rural--the new 6th is basically trending hipster until it is probably significantly redistricted in 2022 by moving some of these voters to Hank Johnson's and Lewis's old districts.

If Stacey could not come close in GA, then I doubt Biden will do it.

The way around that is you have very generous term limits. The problem isn't necessarily the guys who are there for 20 to 30 years, it's the guys who've been there for 30 to 40 years and refuse to leave. So 24 years in the House or the Senate (if you last so long).

It wouldn't hurt to repeal the 17th Amendment either.

They knew. Jefferson estimated the lifespan of this type of government to be around 300 years.

I don't think we need a radical change though, just a solid service life extension plan and some well-implemented adjustments. Whatever changes we make will also be corrupted in time, it's the nature of man's relationship to power... but if we do a good enough job, and leave good documentation, our posterity may be able to do their own fixes and renew this old republic yet again.

I worked in Newark, NJ, after getting out of the Marines. One of my older friends was an Army National Guardsman during the riots. The stories he told me were unbelievable. They were in APC's and would take sniper fire and respond with .50 cals on Housing Projects. It seemed to work.

Show entries put in for the Dallas cluster in early December.

Pre-COVID, making show entries was easy. All you had to do was be sure you made them before they closed at noon on Wednesday two weeks before the show weekend. Now shows have limited entries, so to avoid getting shut out we have to know when entries open, which can be 8:00 AM, 11:00 AM, 5:00 PM, 8:00 PM or whenever.

There's another consideration for us. The earlier the entry is made, the lower the armband number. Judges almost always have the dogs in the ring lined up in catalogue order, lowest armband number first. By getting our entry in the second entries open, Delilah gets a number that puts her ahead of her #BigKennel rival. Lila moves beautifully while the rival slobs around the ring like the rest of her line. The contrast, Her Majesty says, is striking.

It takes a Machiavellian mind like Her Majesty's to think of stuff like that. No wonder I call her The Field Marshal.
