US Files Anti-Trust Lawsuit Against Google, Alleging It's a Monopoly In At Least One Field, Search

They're merely a monopoly in the no-potatoes field of... searching the internet for information.

The companies that obeyed the pressure of Social Justice Warriors may have to pay a heavy price for so doing.

he Justice Department on Tuesday sued Google for antitrust violations, alleging that it abused its dominance in online search and advertising to stifle competition and harm consumers.

The lawsuit marks the government’s most significant act to protect competition since its groundbreaking case against Microsoft more than 20 years ago. It could be an opening salvo ahead of other major government antitrust actions, given ongoing investigations of major tech companies including Apple, Amazon and Facebook at both the Justice Department and the Federal Trade Commission.


'Google is the gateway to the internet and a search advertising behemoth," U.S. Deputy Attorney General Jeff Rosen told reporters. "It has maintained its monopoly power through exclusionary practices that are harmful to competition."

Antitrust cases in the technology industry have to move quickly, he said. Otherwise "we could lose the next wave of innovation."

Google responded immediately via tweet: "Today's lawsuit by the Department of Justice is deeply flawed. People use Google because they choose to -- not because they’re forced to or because they can't find alternatives."

The case was filed in federal court in Washington, D.C. It alleges that Google uses billions of dollars collected from advertisers to pay phone manufacturers to ensure Google is the default search engine on browsers. Eleven states, all with Republican attorneys general, joined the federal government in the lawsuit.

Actually it was the opposite. IE had been a separate application from Windows. The lawsuit was about bundling IE with Windows. Microsoft's solution was to embed IE in the operating system. It was a horrible decision because if IE broke, Windows broke, and it wasn't severable.

Google really earned their top position because they really can deliver better search results to their users, and users aren't locked in at all... it's trivial to try a search on Bing or any other competitor. So if they didn't use dirty tricks to get their top spot, and they aren't using dirty tricks to lock customers in, it's not really fair to use the power of government to hit them over their monopoly position.

On the other hand, I know that Google is abusing their top position to push a lefty prog agenda, and my desire for fairness and small government is not a suicide pact. I heard the quotes of people working for Google saying that they want to make sure that "this" would "never happen again" (where "this" was "the election of Donald Trump"). So I want Google smacked down hard by the government, and if "antitrust" is the best club for smacking Google, then so be it.

Unfortunately, my go-to Duck Duck Go seems to have decided to become involved. They've definitely changed for the worse in recent months.

Bing still seems to be untainted, they're just letting the real and simple algorithms control it.

Back in the 90's, there were a lot of search engines vying for power, and some had a lot of potential. The only reason google won out was speed, not results. And back in the days of no broadband that was big. When the big mergers post dot com bust happened, we lost all of the competition. Companies like Yahoo! shot themselves in the foot. Over and over.

Now, we've got one phone company again that owns the infrastructure by one means or another.

AT&T and the Baby Bells, aka the Regional Bell Operating Companies (RBOCs) were always sharing because they were the same company. The suit forced AT&T to divest the RBOCs into separate companies and allowed companies like MCI and Sprint to even exist because they could not access the network.

AT&T prior to divesture was a goliath but it worked like something in the Soviet Union. They literally had no competition of any note so they could be as bloated and backward as they wanted cause where the hell are you gonna go?

Virtually all of the technology we use today, from the internet to cell phones and everything in between and surrounding it only happened because of divestiture.

Google stole pretty much everything. Altavista was great. I also like Webcrawler, Lycos, Hotbot, GoTo and even recently, Fetch. Google lifted a lot of things including (great but now defunct) cache function, as well as images, dates etc.

I worked with and around AT&T for years just post divesture as the intertubes were starting to be laid. The bureaucracy within AT&T makes the federal government look like a well oiled machine.

I met some brilliant people there, particularly down at the Labs, but the bureaucracy made it next to impossible to get anything done. It was soul crushing.

Respectfully, this is completely wrong. Google's results were magic compared with other search engines. AltaVista, AskJeeves, Yahoo and others were all trying to use webcrawler, metadata, hand-curated sites, webmaster-submitted sites, keyword proximity, etc.

If you used these engines to search for ANYTHING, you got two relevant results in the top ten, some random person's website where they talked about something related, a few pr0n results, and the rest were somewhat related, but not what you were looking for.

Google was f*cking magic in comparison. The top one or two results were EXACTLY what you were looking for, and the remaining results were highly relevant. Zero pr0n results for non-pr0n searches.

Here's a story (one of a dozen) I conveyed here over a year ago. I was at a convention in Las Vegas. I was trying to find my way from one venue to a restaurant people were meeting up at. I tried firing up Apple Maps, but it was having problems finding my location in the casino.

So, I fired up google maps, and it took me by walking directions to the restaurant. Awesome! Ok, so I'm standing, talking to this guy, and buy him a beer at the bar. I paid cash BTW, so no tracing of what I was buying possible. This was a brand of beer from my neck of the woods (CA) and I hadn't had it for years, totally forgot about it. So, for about 2 minutes, the conversation is about the beer, and the location it's brewed at. After that, we go our merry ways.

About 2 hours later, I'm walking back to my room, and the map software starts talking to me. I'd forgotten to turn it off. So, I turn it off. Later back in the room, I fire up my Instagram account to share a couple of photos, and the first thing I see is an ad. For that beer. That very fucking beer. Lagunitas IPA. In fact, that damn beer ad was served up everywhere.

Now tell me, since I'd never seen an ad for that beer (or any beer TBH) until just then, what are the chances it was entirely a coincidence? I've never seen another ad for that or any other beer after that. A year and a half later.

Fucking google was listening into the conversation because I forgot to turn it off, and the app allows access to photos, camera, mic and probably contacts (I've since removed it). The AI heard the keywords "Beer, Lagunitas, IPA, searched the ad database, found it and served it up.

What you look at, where you are, etc. They do this with every other electronic device you use and put all that data, on you, in a giant database. They know who is in your household, what you view on the internet, what social media you use, what bills you pay, what comments you make, what you order online. Everything. All of it.

Think about that next time you use the internet. Also, realize they sell that data to others including foreign actors and our government.

I make my own exit route maps like flash card pictures,
Each flash pic a detail of the immediate area so that I can drive and view at the same time.

I understand your point, but it just is not true. The way we use the Internet has nothing at all to do with the AT&T divestiture. The fact that it took decades to get from voice grade lines to ISDN and then DSL is a related to the AT&T monopoly, but there's nothing about the infrastructure or the access modes that has anything to do with the divestiture.

I suppose you could claim that DSL came about as a result of the divestiture, but that still leaves wireless and cable modem access which doesn't. So, at best you could claim that the forced divestiture was the best thing that could have happened to AT&T to make their Internet work, but that's about it.

558 Unless the consumer benefit model of antitrust enforcement is destroyed, Google wins this case. Ever since Bill Baxter and Robert Bork captured the intellectual high ground on antitrust law, precedents have been entered in the pages of Federal Reporter and Federal Supplements which reinforce this model. The Justice Department must get out of the trap of showing consumer harm and defending against consumer benefit, because the tech tyrants win that one hands down: they give away the product, the collection of data is incidental to providing the product, it does not exist without the use of the product.

These companies were structured, in part, on the consumer benefit model. They and their lawyers knew that network effects (Reed's Law, Beckstrom's Law, Metcalfe's Law) should produce natural monopolies. Charging for the service would expose them to antitrust liability and would slow the increase in market share and the building of the network. So "giving away the product" was born.

The Antitrust Division must attach this in two ways. The product is not the search engine, it's the users' data. And network effects lead inexorably to natural monopolies.
