FCC Chairman Ajit Pai: I Intend to Provide a "Clarification" To the Scope of Protections Offered by s.230

Promises, promises.

ajitpai.jpg

The mention of a consumer protection law is interesting -- suggesting that the monopolies might be amenable to suit for violating terms of service, like promising to be the "free speech wing of the free speech party" and then turning into the most egregious mass-censor the world has ever known.

Also: People and corporations who's spent years building up a twitter followership (whatever that's worth) but who are then banned or suspended can have a lawsuit against the company for violating terms of service and publicly-stated claims about being politically impartial.

Remember, Twitter's claims to Congress that their censorship is not politically motivated are made under oath and therefore can be fairly be read into the terms of service. People can rely on the claims they make to Congress, and sue Twitter for violating those contractual terms.

Even if Twitter disclaims any obligation to treat customers fairly in its actual terms of service, people can justifiably incorporate the very public lies they tell in congressional hearings into those terms of service.

60 You can drive a stock price in the gutter by just making the "process the punishment". That is one big failure in my opinion the Trump Administration made, never really taking these companies on and at least giving them major headaches.

I honestly think Trump believed as long as he got to Tweet, it was all fine. You'll notice in the last few months of this term, he started making noises when they messed with his Twitter account.

Big red states like Texas should also pass some laws regulating what these companies can censor and discriminate. They would have to bend the knee with compliance.

Twitter censored the @nypost's Hunter Biden story because it contained "hacked" and "private" information.

So, @Jim_Jordan sent @jack a letter containing Hunter Biden's private emails.

Will @TwitterSafety censor us?

finally fighting?

They link the emails on the tweet. Good. Keep pushing this in their face.

107 If a socialist media company has a right to free speech, then how can that same right to free speech be denied to those who use their platform, like Kayleigh MacEnanny for instance?

Unless I'm missing something, this sounds like NewSpeak aka double-talk. By censoring anyone who wants to link to the NYP's Biden email story, they are engaging in a denial of free speech, which is a federal felony.

It's a simple fix to take away their 230 protection and make them publishers. That opens them to FTC and campaign laws. But it won't stop them from being in the bag. They will just have to be very careful.

Question is, okay. Now they are publishers. Will the FTC do anything when they ratio conservatives into oblivion? How do you prove that without access to their code and algorithms?

Twitter and Facebook are interesting problems, because network effects are what make social media work, and size matters. No one wants to be a social network with no users. It may be impossible. The approach I have thought of - and it's bad (though possibly there is no good one) - is to split up round-robin into five or six parallel firms (Twitter 1 through Twitter 5, or whatever they call themselves) and blindly allocate users (that's the round robin).

Either all of them, or all but one or maybe two of them, will die in this scenario as users migrate between them and set up shop at the most popular to exploit the network effects. When this happens, it will have to be broken up again when the winner becomes abusive.

It isn't a good answer, but cyclical breakup might be necessary.

It might be as simple as the FCC offering guidance as to what a publisher is. Then open the flood gates and let the trial lawyers feast on their entrails.

223 It's a simple fix to take away their 230 protection and make them publishers. That opens them to FTC and campaign laws. But it won't stop them from being in the bag. They will just have to be very careful.

Question is, okay. Now they are publishers. Will the FTC do anything when they ratio conservatives into oblivion? How do you prove that without access to their code and algorithms?
Posted by: AlaBAMA at October 15, 2020 02:44 PM (GV8+D)

Not quite. Basically, Section 230 of the communications decency act gives protections to internet "platforms" from certain civil lawsuits. You can read the text of section 230, it's pretty obvious what Congress was trying to do. They wanted to say "a website cannot be held liable for the content users post on the website." That, in conjunction with the dmca, set out our current regime of how the internet works.

For example, if I post something that is copyrighted on YouTube, the copyright holder can, under the dmca, send a takedown notice to YouTube, who then takes down the offending video.

That's in contrast, to say, a publisher. If the New York Times publishes something that they don't have the copyright to, a license for, or fit one of the exceptions (like fair use), the copyright owner can sue the NYT for that.

Section 230 protects "platforms" from defamation suits, copyright suits, etc. and courts have continuously expanded the meaning of 230 to basically give a lot more civil immunity to tech companies than any other industry in the country.

Removing that protection is a punitive move. It wouldn't make the services less biased, in fact, it would probably expand their biases. But it would also destroy their business models, as youtube, for example, would have to police every video that is uploaded, or potentially be civilly liable for publishing a video that is defamatory or whatever.

224 I've come to view the unholy triad of online content (Google, Facebook, Twitter) as something similar to the Rome-Berlin-Tokyo Axis, at least regarding it's war on America and conservative thought.

I see Twitter as Italy in this analogy. It has the weakest clout and reach. And it appears to be the first one that would capitulate, based on Jack's muddled explanations and apologies.

I know of no one in my family/friends/coworkers who do any tweeting. Perhaps some use it in read-only mode, but they never reference anything from it. And, unlike the other two, there is a decent alternative to it (Parler) in place. Twitter can and should be the first warring power knocked out first of this cyber war.

Some on the Right say not to walkaway from it. That just gives the Left a win by default. And yes, I know that's easy for me since I'm only exposed to its contents here. However, Twitter has moved beyond using its thumb and now just sits on the scale.

We essentially have two Americas now anyway. Might was well have two birdfeeders.

He was given a $1.5 billion dollar fund to manage by the ChiComs. The yearly he ears from managing that fund is probably around $15,000,000. He gave half to Joe, and has banked $7,500,000 for the last 5 years.

He's sitting on huge pile of money.

It's all hookers and blow for the rest of his life. He'll OD, but he won't kill himself intentionally.

So I like the threat of repealing 230, but in practice, it would kind of fuck up the internet.

Its actually a bit more complicated.

The US is the ONLY country that actually believes in Free Speech. All other countries limit speech, even England.

So, worldwide corporation is putting information online, for the world to see, that often breaks the Speech Codes and Laws of foreign governments.

They decided to side with the rest of the world, which means they MUST have US government help.

Trump can't be bought off, but its a proven fact that Biden can be bought, threw his family.

Ergo, they are going all in to get Biden elected, because the ONLY entity that can combat their power, is the US Government itself.

Agreed. But this is the logical progression of what happens when you open the doors to censorship.

I guess my point was that I don't think the initial thoughts on this by the tech CEO's was "let's become D party mouth pieces."

It just ... got here. And it's hard to say to them "it has to be all or nothing when it comes to free speech" because most people recoil at the idea of some of the, ahem, more controversial parts of the internet.

Like remember reddit in its heyday? "Hitler did nothing wrong" memes everywhere, n bombs dropped on every thread, etc.

It was pretty fucking annoying. You'd most in a sub about something innocuous and the whole thread would get taken over by 4chan autists trying to out shock value each other.

So we start getting into it, because she views my reasons as invalid or whatever.
I told her I want the fucking government to leave me alone is the bottom line. Libs can't do that. they gotta fix everything and make everyone miserable when their plans inevitably fuck up. It costs me time and money.

423 I think the way to change the behavior of Twitter and Facebook is to take the responsibility for content monitoring away from them. If they legally are not allowed to be the content reviewers, then they lose the power to do things like this.

The question is who does it then, because clearly there is some content that needs monitoring. But I think there are some analogs out there, such as banks must have 3rd party auditors, and IT system redteaming can't be performed by the company.

It would have the benefit of making the SJWs complain to a faceless bureaucracy, rather than Twitter.

Maybe that stupid trust and safety council they have can be part of the FCC, and Twitter has no say over who is on it.

There is certainly plenty of precedent for regulatory oversight boards. Utilities are regulated this way.

Just spitballing.

Try doing bidness in their name without their permission and see what happens to you. And the absence of your specific name doesn't mean much, they wouldn't have that info without you generating it, would they?

You allow other companies to use that source - for a fee.
You allow experts to review that source and discuss all the things Twitter is doing which you'd prefer that they don't.
You fine them $1 billion every time they are using source other than that which has been published.

That and the Biden/Dems would have to acknowledge responsibility for their manipulating of Twitter/Facebook to squelch stories and not be able to plausibly lay it off on assorted xhe/xirs in Silicon Valley.

456 There is certainly plenty of precedent for regulatory oversight boards. Utilities are regulated this way.

Just spitballing.

...and look at how thoroughly corrupted those are.

Hard pass. Just forbid it and live with the nasty. It's not worth it.

BREAKING: I have a sworn Affidavit from a Poll Watcher just submitted to the District Attorney who says he caught Precinct Staff in Houston using Stack of Driver's Licenses To Help Drive-Through Voters Vote Illegally. And He Has PHOTOS PRESENTED HERE.

Voter fraud, comrades? What voter fraud?
Posted by: TheQuietMan at October 15, 2020 03:16 PM (7yxja)

SHIT! I know exactly what scam they're working. They've got a stack of valid driver's licenses that they've collected (dead people? who knows) and everytime an Illegal with no license comes through the drivethru line, they run in and get him a fake ID that they can use so he can cast a ballot.

and since the actual ballots are anonymous, they've probably worked out a way to use each license they have dozens of times. So that's how Houston officials intend to manufacture 100,000 surplus Dem votes.

458 These are some good stats coming out of Iowa:

The Trump campaign gathered data on the attendees at Trump's Iowa rally yesterday:

https://twitter.com/GOPChairwoman/ status/1316566214471286784?s=20

"Great data from @realDonaldTrump's rally in Des Moines shows support the pollsters are missing:

10,139 voters identified

48.5% (!) NOT Republican

29.4% (!) Democrat

25.0% did not vote in 2016

13.7% did not vote in the last 4 elections

Thank you, Iowa!"

If this is true, Iowa is absolutely in the bag for Trump.

And if that's true in Iowa, I'm suspecting a preference cascade in other Midwest states.

459 "Our federal law enforcement agency is so fucking corrupt."

ALL of our institutions are corrupt now. Science, schools, media, government, churches, businesses, even parts of the military. I figure all politicians are as grafty as the Bidens are, if not as stupidly awkward and careless about it as the Bidens are.

Nobody has a conscience anymore. Everybody is just looking for ways to get over. Name me some prominent people that you trust 100%. I'm voting for Trump, but I don't _trust_ him, and I'm glad I never did business with him as a customer or a vendor. He's just the lesser of evils on offer.

Posted by: Citizen Cake at October 15, 2020 03:25 PM (HmZuC)

461 All of this could have been done the first two years except for the fact that the "Republican" Party are crypto-Dems.

They couldn't wait to throw the midterm elections with a record number of retiring incumbents, so they could blame the very things they were working for on the Dems.

462 374 the twitter rumors are that Biden's brother (you know, who owns the
island next to Epstein Island? Nothing strange about that) is going to
feature in the next big drop. About underage prostitutes.

Posted by: artemis at October 15, 2020 03:13 PM (AwPyG)

Biden's doesn't own an island next to Epstein, just less than one acre of property somewhere in the Virgin Islands. Best not spread nonsense as this is precisely what the media grasps onto to discredit the whole Biden money laundering scheme. There is so much crooked going on with the Biden's right now to focus on that it shouldn't be undermined here, of all places, with easily debunk'able gossip.

How about a giant BLOCK button on every feed to put the power in the hands of the user? Don't want to see any progressive feeds like MoveOn.org? Block them, with stiff fines should they persist in forcing their twats on you. Click on that once and you'll never see them again.

The NY Post is a more reliable source than the NY Times and, sadly, at this point the WSJ news sections.

Joe has been using him to get kickbacks since he was 21?
Just an indication of what a cold-blooded (ab)-user Joe is.

No.he's a grown adult. He is capable of making choices. He's not some wayward 20 year old, he's 50 years old. He has five kids of his own, has been married twice , lived with a gal for several years and has one of his kids with another. He graduated from Yale Law School and has a law license. He simply is one of those people who continuously squanders opportunities, and looks for the easiest way to make a buck and escape responsibility. Like his old man.

474 Make no mistake. If Biden/Harris/Democrats win in 2020, we will all be dead by 2030, with Jade Helm as the last great battle in American history. Yes, some of us will live a bit longer than others in our bugout locations, but in the end, the military has far more destructive firepower than 2A patriots, and worse, the personnel who will be indoctrinated enough to use it against us. This election LITERALLY IS LIFE OR DEATH.

476 " People can rely on the claims they make to Congress, and sue Twitter for violating those contractual terms." I've been hesitant to trust-bust. I haven't been as hesitant to make Dorsey, Zuckerberger, et. al. point out what part of their T.O.S. and E.U.L.A. the New York Post violated. Do that first, then see where that goes. I like the *idea* of FB and Twitter, just find a way to keep leftist retards away from the DELETE button.
