The dismissal neither involves nor tarnishes the courts. The whole point is that its a PURELY executive branch function. That's DOJ's argument. The court doesn't have a role so it doesn't tarnish it.
Gleeson says he "embraces" Fokker. That is laughable. He reverts back to Ammidown. Gleeson and folks who follow this line of argument just want to reject that the Separation of Powers law post-Ammidown undermines it entirely.

And the Obama prosecutors lied to the court about that in the plea deal documents. There is a shit-ton of evidence having zero to do with Trump or Trump tweets that prove this prosecution is and always has been a purely political prosecution of an innocent man. The DOJ didn't yield to pressure from Trump. The DOJ yielded to the ugly reality of what this case is and always has been: total bullshit.

A non-material lie is *still* a lie, it's just not chargeable. If the investigators know all the facts, then there is no additional penalty for a "guilty" person "lying" to the FIB.

When I first head Sullivan mention he may charge Flynn with perjury for changing his plea, I thought, "By Sullivan's view of things, if I take a misdemeanor traffic ticket to court and plead not guilty, and the judge finds me guilty, the judge can immediately order me arrested for committing felony perjury." 2. Just notified a Biden Staff member tested positive for COVID 19
3. Trump will not agree to my rules (30 minute cheating breaks) so it is off
4. Trump is a tax cheater and I will not debate a tax cheater.
5. The debate will start and after 10 minutes Biden will depart saying Trump is mean and hates children of color and small animals.
6. Biden takes a drug and overdoses and is medically removed from the stage and the news will blame it on Trump for being mean to a senior citizen.

Yeah, I've been thinking #5 might happen tonight. If the sneer and hurl insults schtick he used at the Paul Ryan debate don't work against Trump--and they won't, Trump is not a beta male like Ryan and will happily brawl back--Joe will get a keyword in his earpiece, to pivot and go to plan B. Then he will pull a Pesci-style "everything this guy just said is bullsh**" line, and will storm off the stage, claiming he cant debate a liar.
Perfect primetime theater.
