Judge Rules That There Is Enough Evidence to Sustain Sarah Palin's Defamation Lawsuit Against the New York Times;
Orders Case to Proceed to Trial

Would the New York Times say that Sarah Palin is targeting them?

The case had been at the deposition and discovery phase. The New York Times moved that the evidence supported them, and the court should just rule and say "The New York Times wins."

The judge said, "Nah."

A federal judge has ordered a jury trial in former Alaska Gov. Sarah Palin’s libel suit against The New York Times over an editorial linking her to the 2011 Arizona shooting rampage that seriously wounded then-Rep. Gabby Giffords and killed six others.

In the latest round of litigation in the case, U.S. District Court Judge Jed Rakoff rejected separate motions in which the Times and Palin claimed they should prevail based on the existing evidence and depositions in the case.

In a ruling issued Friday evening, Rakoff said the issues were not as clear-cut as either party suggested, so the matter will have to be decided by a jury. He set Feb. 1, 2021, as a target for a trial to open in the case, but noted that the date could be delayed as courts continue to struggle with in-person proceedings amid the ongoing coronavirus pandemic.


The initial version of the 2017 Times editorial said it was "clear" that the 2011 shooting was linked to a map Palin's political action committee released that included crosshairs over Giffords' Tucson district. However, no such link has ever been established. The shooter, Jared Lee Loughner, was found to be mentally ill and was sentenced to life in prison in 2012.

Palin says that this defamation was made with malice, because the fact that this was all a lie had been well-proven by 2017.

The New York Times' defense is, I guess, "We live in a hard-leftist bubble and literally do not know anything beyond the lies we tell each other, so we are innocent of malice."

IIRC, that is exactly what the defense is.

I would not be surprised if this settles and that right quick. The NYT cannot take the risk that courts will take another look at the Sullivan standard. This is especially true as Clarence Thomas has said it's past time for Sullivan to be revisited.

I am paid up through late September. Keep that money and stop delivering the paper to my home. I will be instructing my credit card to not pay any future charges."

There was never any evidence that Loughner had even seen, let alone been influenced by, the "target" map that Palin had put out, showing which congressional districts were up for grabs in the coming election.

So, all Flynn and DoJ have to do is agree in their joint status report/briefing schedule that:

1. They waive application of the 21 day finality rule;

2. They waive their right to appeal yesterday's denial of mandamus;

3. They report that they are in agreement that there are no further proceedings needed other than dismissing the case as the law requires, and that they are able to file any responses to any non-court-appointed amicus briefs tomorrow.

File it today.

The court-appointed amicus that imbecile Sullivan created is NOT a party to this case. So Flynn and DoJ should be able to expedite this first step to getting to a decision.

The written statement the lawyer put out 3 days ago was that Kyle was given the gun in Wisconsin when he answered the call to protect the business owner's property (he was in Kenosha in the first place to help clean up grafitti).

I also saw Tucker -- the lawyer talked about how it was legal in WI to open carry and 17 was the age. He didn't say anything about carrying the gun in from out of state other than Kyle did not do that.

Interesting.

Well, I don't think it really matters one way or another for the criminal case, but that does kind of raise some questions -- like who is lending out his ar-15 to a 17-year old kid? That doesn't sound very wise, and could potentially open up whoever owns the gun to legal liability.

And to be frank, while I don't think Kyle did anything wrong in the shooting scenario, I'm a little uncomfortable with the fact that a 17 year old was put in that situation.

The statement from the attorney was an interesting read. Apparently the kid left home to go to his normal (summer?) job of being a life guard. After he got off duty one thing lead to another and he ended up responding to a plea for help from an auto dealer to guard one of the two buildings he had left standing. How he got the gun or who gave it to him was kind of glossed over in the statement, but the attorney as adamant that it was already in Wisconsin. According to the statement he had earlier in the night even provided first aid to some of the injured rioters. They appear to be making the case that the kid just wanted to help people regardless of which side they were on, and found himself the target of a mob.

Yep, statements of fact, easily provable.. no, the rifle didn't cross state lines. Yes, Kyle was LEGALLY allowed to possess it, and since Wisconsin is an open carry state, there's nothing about the presence of the weapon that would render the events to somehow have been tainted by committing some OTHER crime.

I always use an absentee ballot. I am surprised I haven't gotten mine yet. But over the years, I never get the actual ballot card in time (I receive it after elections, or not at all). I get a photo copied 8.5 x 11 stapled packet of candidates in which to choose. SO easy to just toss, because you can easily see who I vote for.

This year I'm going to mark the outside envelope in a way that lines should match along the seal. I am not sure if that is disqualifying but I'll try it in a subtle way.

I know my vote never counts. I used to get the actual ballots in time, a long time ago. But no more. They are made easier to cheat now.

I think a best case scenario would be that Trump wins enough states where mail in voting is simply going to be impossible to overturn it, but some place like Minnesota goes from a +3 Trump win to a -.1 Trump loss over a few days as mail in votes keep pouring in and Trump fights it.

His team fights it so hard and so well that it becomes obvious that it's impossible to run a vote by mail campaign without corruption that even SCOTUS (who's not faced with the prospect of overturning a Trump victory because this is a fight for the size of the win and nothing else) agrees.

It becomes illegal to vote by mail in federal elections across the country.

And a pony.

I don't think they can win the electoral college vote with mail in ballot fraud, but what they CAN do is cling to their pathetic, wretched "he lost the popular vote" lie, and that's the goal. It does not matter if 80 billion votes in California were for Biden, its still only 55 electoral college votes. But they can keep the dream alive that Americans don't REALLY want him as president if they fake the popular vote.

It was Kyle putting out the dumpster fire (20 feet from a gas pump) that really put the animals over the edge. There was video of the pedo harassing him earlier, so he was waiting for an opportunity to go after Kyle. It really looks to me as if the cops put Kyle in harm's way. They ejected him, and kept him from returning. They knew exactly what they were doing, throwing the hyenas some raw meat.
