I think legally he's guilty, but I don't think the law is in effect any longer. The government is refusing to enforce it against insurrectionists, effectively making the State Sanctioned Terrorists, and citizens are forced to defend themselves and their own property.
I've been saying it for years: If the government will not protect the citizenry, then the citizenry will turn to vigilantism. And citizens do not have the long hours of training that cops do. You have to give them some leeway. If the state is effectively making terrorism and arson legal, then I say, shooting rioters without normal legal justification is now legal too. He has been arrested. I say: Jury nullification. We'll start giving the state convictions they moment they start enforcing the laws, and not a moment before. There was an earlier video (watched this in realtime so dont have a link) of a group of the armed kids in a confrontation at a gas station with the antifa types. They seemed to be saying the supported the movement but not the property destruction. There was just some shouting and pushing. There was a green shirt guy there, but its hard to tell if its the same guy, looked older than 17.

I have no advice on availability of rounds. I would guess 9mm is more available than .45ACP these days but I still prefer a slow moving short sword over a fast moving short sword. Both rounds are basically the same size - its the speed that travel that makes the killing difference.

it's a fascinating case already from a legal point of view, because there's a lot of conflicting issues. (for anyone who wonders if I "want" to see him convicted or go free, I'm just fascinated by the issues, I don't have any stake in how it turns out)
The case in his favor: he was clearly attacked before he fired the gun, that sure looks like self defense.
The case against: Wisconsin's open carry law only applies to those 18 and older; he's 17. This would mean he was open carrying in violation of Wisconsin State Law, and any violation of the law usually negates all self defense claims in a shooting. So he may not be legally allowed to claim self defense, even though it was self defense.
This case could be with us for a while.

Exactly. One of the early "justifications" (excuses) for the Minneapolis riots was the lack of indictment and arrest of Chauvin and company. Kenosha's just trying to stay ahead of the violence curve. It won't work, but you can't blame them for trying.

In my opinion, these were two shooting in self defense and are not murder. Justifiable homicides unless something happened before the first video justified him being chased down & attacked.

Kenosha Police Department took possession of his rifle.
The complaint (940.01 - 1st Degree Intentional Homicide) and application for a warrant to arrest Kyle was filed by Kenosha DA Michael D. Graveley. Kyle was arrested in Antioch, IL by the Antioch Police Department who are also charging him with 'fleeing from justice' (basically being a fugitive present in Illinois).
Kenosha DA is considering additional charges but the 940.01 is just to get him extradited back to Wisconsin quickly.

- Someone shot a rioter in the head. Maybe the same shooter, I don't know.
- If the (pursued-future) shooter was that shooter, it's a separate incident. However, since he demonstrated not retaliating earlier, prosecution will have some difficulty establishing mens rea.
- He is/isn't that shooter.
- He's seen running and others pursuing. One of the pursuers throws a molotov cocktail at him, which breaks, but doesn't do the Hollywood fiery explosion - because they don't really do that.
- He is pursued and swarmed on the ground.
- One of the pursuers (the one wearing the "Paramedic" hat has a pistol drawn. This is visible in the video and confirmed in still picture after.
- Shooter is attacked and starts firing.
- Shooter sees someone with hands raised and holds fire.
- Shooter continues to move toward police presence with hands raised and surrenders to police.

Apparently due to this guys public questions, the report has been redone, with the result that there is no more hazard to people who've had covid than to those who haven't.
There's like 10 different conclusions that (this guy says) didn't make any sense in the original report--impossible under the factors given.
Not a surprise, of course, and unfortunately probably won't change any minds. But a good example of fake science.

The funny part is, in prior years, if you didn't want the shot, you had to mask if seeing patients. (I don't see patients).
But now that we are forced into masks, suddenly we can't do that.
I know what they are doing - they have lamented for years that they want 100% compliance with seasonal flu shots, but could never get it. They never wanted to go the route of mandatory for fear of pissing staff off, but now they have the perfect "excuse," never mind the two are not related.
Oh, and the best part, even if you get a note from your doctor that you can't get the vaccine, the employer will make the final determination.

Was talking to someone overseas who is pretty neutral and we could not believe how fast the Governor bailed on his police force.
We thought he had knowledge of police cam footage, that is how fast and inflaming his Twitter reaction was.
And it was obvious USA Today specifically cut off the first three seconds where you could tell they were coming off the ground on the other side of the vehicle and all three cops drew their pistols immediately.

That's very good, thanks to that I have a good feel for how the shooting went down. Watching it, I have to agree with the "not a molotov" group; that's just a bag of something with some weight, no ignition source, and it's too flimsy. But I don't think that matters for self defense; the guy is chasing him aggressively, that's assault, that would put him in enough fear to defend himself.
WHY the age of 17 could be a Big Deal: Because under age 18 does not have the right to open carry in Wisconsin, which would mean he was violating the law at the time, which would mean he would be legally barred from claiming self defense, even though it was self defense.

I guess I don't care why he was there unless there is evidence he was there to destroy things and riot, and as far as I know, there isn't any.
He had a legal right to be where he was (even if there was a curfew, I think he is ok on that- i.e. not breaking and entering or something similar), and he attempted to retreat, he should either not be charged or have the charges dropped after the DA reviews the evidence. At worst, he should get off at trial either through a directed verdict or jury verdict.

There is video from the fist shooting. It shows a couple people chasing Kyle. The bald manlet chasing Kyle through a parking lot and throw something at him. Kyle keeps running but the guy catches up with him and Kyle turned and shot at what appears to be point blank range.
Everything from that video shows Kyle trying to get AWAY from the people chasing him before resorting to deadly force once they caught up with him.

Note that EVERY person shot? The shooter shows clear restraint. The first guy charges him throwing things; the shooter WITHDRAWS. It isn't until the red shirt wearing guy charges AGAIN that shots are fired.
The skateboard guy GETS IN A FREE HIT on a guy on the ground before the guy shoots him.
The guy shot in the elbow? He is rushing the kid on the ground who has just downed his first attacker and *freezes.* The shooter? Covers him and doesn't shoot. The third guy? Decides to charge the guy who is covering him. Gets shot for it. Peels off -- no more shots fired. The shooter withdraws, because it is clear he can't remain. He tried that after the first shooting, and MORE people attacked him.
A lot of things were screwed up here; I wouldn't go out with a rifle because I don't want to shoot people. But, I also wouldn't charge a person with a rifle; hit a person who was down; charge someone who JUST showed me the mercy of not shooting me when I stopped being a threat.

I carry a gun almost everywhere I go, and I seem to recall at some point concluding that it's better to stay away from a conflict or danger zone rather than get embroiled in it.
Regardless of whether he was being attacked, one questions the wisdom of his actions preceding the shooting.
The last thing we need is people going out of their way to get into situations where they need to shoot in self defense. It is not a good look at all for the 2A crowd.

I think you've got it backwards; it only concerns the accused's actions, not those of anyone else. I think all states have a version of this; it means "if you are engaged in any criminal activity, then you are not allowed to use a claim of self defense for anything that happens."
For example, this would mean that if someone is burglarizing a business, and the owner shows up and takes a shot at him, then he may NOT claim self defense for pulling out a gun and shooting back. He is barred from using that.
In this case, the shooter was in violation in only a technical way; he was only 17, and Wisconsin's Open Carry laws only authorize that for people who are 18 and older. But this technical violation may be enough to bar him from using any self defense claim, which is very bad for him.

Even if true, which may be debateable, it was incredible overcharging to go with Murder One. Clearly they want to pressure this kid to plead to anything because they do NOT want to take this to trial.

I have no advice on availability of rounds. I would guess 9mm is more available than .45ACP these days but I still prefer a slow moving short sword over a fast moving short sword. Both rounds are basically the same size - its the speed that travel that makes the killing difference.

Regardless, the victim (shooter) was being chased by a mob including some with melee weapons. He was clearly in flight and retreat when he was caught. The victim (shooter) is probably on the hook for various, lesser weapons crimes due to his age, but this is far clearer a case of self defense than the Travon case (which was also self defense).

Per a good friend, a succinct summary of the events from Kenosha:
1. The Kenosha shooter suspect is a 17 year old IL resident.
2. To obtain a firearm in IL you must have a FOID card.
3. To obtain a FOID card in IL you have to be 18 years of age with parental consent, 21 without.
4. The suspect was therefore illegally possesing a fireaem and he moved it across state lines. Meaning all of his subsequent actions from here on out during the protest/riot last night are illegal.
5. What we know for certain: The shooter ran up to a protestor/potential rioter and shot them in the head.
6. There are claims that someone threw a molotov at the shooter -- these claims are unsubstantiated and video evidence is vague at best.
7. After shooting the first victim the shooter called someone (presumably the police but I don't have any official corroboration of this claim) and clealy states on video: "I just killed someone".
8. While making the phone call the shooter runs away, while running away the shooter is chased by people responding to him having just killed someone.
9. While fleeing the people chasing him, the shooter trips and falls, he then assumes a defensive stance and shoots the second victim in the stomach.
10. After shooting the second victim the shooter then fires and hits another person that was trying to disarm him in the forearm.
11. The suspect fled Wisconsin for Illinois to avoid charges. This is also illegal.
12. What I don't know at this point is how that first shooting happened, but since the kid was legally in the wrong possessing and transporting a firearm across state lines I cannot see how anybody can possibly defend him.
Philando Castille legally owned a firearm and the Right justified him being gunned down by the police because he had weed on him.

To begin with, as the incident occurs in Wisconsin, Wisconsin laws regarding firearm ownership apply. The feds can perhaps come after him for illegal interstate transfer of a firearm depending on how he obtained the firearm but this is not a civil law issue with admonitions that he who comes to court must have clean hands. Thus, the shooter can face charges in Wisconsin, and perhaps after the fact in Illinois or the feds regarding an alleged illegal transfer (if that is what occurred). Hunting laws often allow possession of longarms by minors when supervised by adults and some allow yutes to have them as gifts etc.
5-11 are facts where multiple sources are saying different things so that will get hashed out at the trial, not in the media or discussion groups.
In some states, self defense is allowed as a justification defense even when the initial acquisition or even retention of that firearm is illegal. The phrase is the lesser harms doctrine. Quite a bit of law exists regarding where a felon forbidden by federal or state law uses a firearm for self defense. Generally speaking, unless the actual use of the firearm was tied to illegal actions directly such as using a firearm to rob someone and then shooting them in "self defense". Drug deals self defense cases can go either way depending on the state.
Generally speaking, as in the Arberry case, a mob seeking someone is not legally empowered to render street justice nor is dispassioned legal analysis of the arrest powers of a lawless mob, Citizen's arrest laws are a murky area at best and absent actual case research on Westlaw, best left to professionals in the field.
So, the person can face charges aside from the murder rap from other state and federal authorities. But, the justification for self defense generally does not require "clean hands" in order to claim self defense. If the guy was part of a riot versus simply watching with a firearm are two different things in most jurisdictions.
Self defense is an odd area of the law and very dependent on state variations in caselaw, jury instructions, and prosecutions. It is not an area where the forums online, the media, nor even most legal professionals are qualified to render any kind of opinions.
Basically one is admitting that they did an unlawful thing but either affirmatively arguing or justifying what they did rested on a real fear of death and/ or serious injury. The existence of a mob rioting and its preceding behavior along with all other facts known at the time to the shooter and whether the shooter's perceptions were "reasonable" will be left to a judge and jury.
