Trump fires TVA Board members for outsourcing labor & allowing CEO to loot its bank account [Buck Throckmorton]

Donald Trump puts America first, and more importantly he puts American workers first.

A quick primer, the Tennessee Valley Authority (or “TVA” for short) was created in 1933 to provide flood control on the Tennessee River, generate electricity, and propel economic development in Appalachia.

President Donald Trump said Monday that he had fired the chair of the Tennessee Valley Authority, criticizing the federally owned corporation for hiring foreign workers. Trump told reporters at the White House that he was formally removing chair Skip Thompson and another member of the board, and he threatened to remove other board members if they continued to hire foreign labor.

The order followed the TVA’s announcement that it would outsource 20% of its technology jobs to companies based in foreign countries. TVA’s action could cause more than 200 highly skilled American tech workers in Tennessee to lose their jobs to foreign workers hired on temporary work visas, according to the White House.

The president of a TVA engineering union has been telling local media that TVA workers are now having to train their replacements, and that many of the new contract workers are foreign citizens working in America under H-1B visas

It’s not just the outsourcing that has President Trump upset. He is also highly critical of TVA’s CEO receiving an $8 million compensation package.

Trump also urged the TVA board to immediately hire a new Chief Executive Officer who “puts the interests of Americans first.” According to the president, the current CEO, Jeff Lyash, earned $8 million a year. “The new CEO must be paid no more than $500,000 a year,” said Trump, who lacks the authority to remove the CEO. “We want the TVA to take action on this immediately. Let this serve as a warning to any federally appointed board: If you betray American workers, you will hear two words: ‘You’re fired.’”

CEO Lyash followed the True Conservative™ playbook of terminating employees, making them train their inexpensive foreign replacements, then rewarding himself with a 7 or 8-figure salary for all the labor expense he eliminated. But what if his actions could have saved consumers 1 cent per kilowatt hour after the executive bonuses? David Harsanyi would tell us that as consumers we should celebrate all those employees being fired. To the open-borders / outsource-all-the-jobs / Principled Free Traders™ at National Review, Lyash earned that money by firing his workers and finding cheap foreign replacements. And those displaced tech workers? They can just, uh, learn to code. Oh wait. Our thought leaders now want to outsource coding too.

So what does Senator Lamar Alexander (R – Chamber of Commerce) have to say about this?

Sen. Lamar Alexander, R-Tenn., said the TVA doesn’t get any taxpayer money and defended the CEO’s salary, saying it is in the bottom fourth of what his counterparts earn at other big utilities. “TVA may have shown poor judgment hiring foreign companies during a pandemic, but, on most counts, it does a very good job of producing large amounts of low-cost, reliable electricity. Residential electric rates are among the 25 percent lowest in the country, and industrial rates are among the lowest 10 percent,” Alexander said in a statement. “TVA’s debt is the lowest in 30 years, its pension fund is stronger and TVA leads the country in new nuclear power plants.”

Wait…what? TVA’s outsourcing of labor is only a problem “during a pandemic”? Otherwise it’s an idea we should rally around because TVA has a well-funded pension plan? This lifetime politician’s tenure as a Tennessee senator has only a few months left. He won’t be missed.

Oh, and look here. After Trump made his announcement, CEO Lyash suddenly found out that his pet Senator doesn’t have any influence on President Trump.

TVA President Jeff Lyash said Tuesday the IT employees at TVA who have received termination notices -- both in a round of 62 individuals whose jobs were to end this summer and another 38 workers whose jobs are ending in October -- will remain on the payroll while TVA goes through a review of the new executive order and completes all of the appeal processes for laying off workers at TVA.

25 When this came up last week, I mentioned that the CEO's salary, all other things being equal, is not out of line given the tremendous revenues of the TVA and the fact that the TVA, generally, does a good job at maintaining a vast electric generation and transmission infrastructure. I still think that, though it's neither here nor there.

The government - or a state-owned enterprise or a state-connected enterprise that operates as a chartered monopoly (the TVA resembles both) - has no business outsourcing abroad and displacing American workers with H-1Bs. If they need a specialized skillset we don't have then by all means, go sponsor an H-1B and get him. But that isn't how firms use the program. They use the program to price out American workers and compress wages. When that fails, they just outsource it. It is endemic. I am glad Trump at least threw down in one small area where he has the authority. Beyond that requires cooperation with Congress, and he'll never get it.

I'd like to see the H-1B program reduced by 90%, if not a general moratorium on immigration for a decade. The H-1B program exists for a reason, but that hasn't applied in a very long time if ever.

Every single place I've worked here has 95% Indian labor, with a few Asian upper management types. It really is slave labor.

These guys come over here, 5 live in one 2 bedroom apartment, they send the money back to the family, and, if they get promoted enough will fly the wife & kids out to join them. They might even all go in on a house together.

I can't blame them for wanting to come here instead of remaining in Hyderabad, but Silicon Valley in cahoots with the chamber of commerce have found their sweet spot. CA is all about importing brown people to do their bidding.

It's especially bad over time. At the beginning of a company's experiments with the program, an H-1B earns about the same as his American counterpart. When there is time for a layoff, though, the Americans go. The H-1B won't complain, because when he loses his job, he has a short time to get a new one or the visa invalidates and he has to go home. He doesn't want to go home, so he'll take a pay cut or forgo raises and bonuses. When the next cycle comes, he might get laid off, and then the heat is on to get another job. He'll accept a lower wage if he has to, to stay in the country.

Repeat that a few dozen times across an industry, and you get wage compression and majority non-native staff.

When I go to my HQ, the only indications that you're not in South or East Asia is that the place is scrupulously clean and most people are speaking something that approaches English.

We at the government feel the health benefits will save us more than enough money over the lifetime of covering an employee to justify this one time expense of $4,000. That is 2,000 per desk, $1,000 to remove the old desk, and another $1,000 of graft just thrown around.

If there is a screaming labor shortage, yeah, I can see having it around. If not, well, it's only right that we take care of our own. And I like legal immigration, one half of me comes from a legal immigrant. I like inflicting brain drain on other countries and bringing them in here. But if the immigration is not going to benefit both parties, what's the point?

76 The H-1B problem would be easy to solve. While not a perfect solution, it can be controlled through pay scale. H-1Bs are supposed to be premium people with remarkable skills. People who are good are paid for it. It is unusual for an H-1B to have a job that no one else has (e.g., something new). If you have an H-1B who is "Software Engineer IV," for example, they should be paid 150% of your average "Software Engineer IV" wage. If they're that good, they should be paid. If it is a new position at your firm, then they should have to earn 150% of the prevailing wage for the job in your geographic area.

you wanna hear something really infuriating? The Post Office used to be policed by Postal Inspectors- and they still are to some degree. PIs usually handle the big external felonies that affect the Post Office- bomb threats, anthrax in the mail etc.
The juice that the Postal Employees Union emits could dim a star. So many postal employees were going out on disability they created the USPS OIG to combat the fraudulent disability and mental health costs. The Postal OIG alone recoups serious cash based upon their investigations where they prove false medical claims- very similar to the VA-OIG.
USPS OIG also investigate more traditional stuff like postmasters stealing mail, drugs in the mail etc.

American kids often avoid STEM subjects because they're difficult, require a lot of work, and employment in them is seen as short-term, as many employers will replace older, experienced engineers and scientists with young, inexperienced (and therefore cheaper) ones. Their reasoning is a scientist is a scientist, an engineer is an engineer. Yikes indeed. And Id bet 95% of people have never heard of it. It is by far way more serious than h1b. For all the attention h1b gets it is capped at 65k visas a year. For L1 there is no cap. And h1b is not just tech and not just Indian. A lot of professions use h1b like finance. And there is a process to go through that takes time and effort.

L1 on the other hand allows an Indian company to set up a US subsidiary and transfer 1000 of their people over with virtually no effort. Then they get a contract from USA Company X to manage their IT and those 1000 are essentially full time workers for that USA company with the Indian company as a middle man. And just like that 1000 American jobs replaced with Indian jobs. All legal too.

It looks like the CEO was paid about .1% of the company's gross revenue. Is he worth that much? How much more value is he adding then a CEO you could get for say $4M instead?


In most cases this could be handled by various corporate governing rules (you can only sit on one board, CEO salary needs a specific majority vote from stock holders, etc), but I think Trump did the right thing here , both in regards to optics and policy.

The local business hit is very bad, but I'm not sure they'd be getting it much if the sports are on this year. Just look at what a hassle travel has become, especially with recent state quarantine requirements. Labor follows the law of supply and demand. If there's no supply of labor available at what they're willing to pay, their choices in a free market should be to find alternatives (IE, automation) or stop doing it - not compel the state to provide them with a supply at below-market prices!

It has now metastasized into a behemoth that in some places overshadows the academic function of the university.

That is directly related to the stock price of their company. There's a substantial luck component as a consequence but pay is generally structured so that both shareholders and the CEO win or lose at the same time.

There is a difference between a private company, and a regulated utility, or a government job. I have no problem with a Ford or Goolag paying their CEO whatever they want out of their revenue. Those decisions have to be justified to their shareholders. A school board member, a government department head, or the CEO of a regulated monopoly - yes, those salaries should be public, and debated.

That was CEO compensation for a mid-sized nursing home company I worked for in the mid-90's. That leaves out the golden parachute, healthcare coverage after employment, stock options, etc.

Add in that every Business application or program has a 3-5 year life cycle? Where major updates make mean you either need to retrain your techs, or REPLACE them?

Then add in the Tribal Nature of those coming from other nations, where once an Indian or Pakistani got into a management position, they would no longer hire Americans?

And you can then understand why I just finally said F it, and retired early.

Along the trail to Gregory's Cave, in a wooded area, there's an old, early-modern foundation nobody bothered to remove. My grandmother was born there. Everything with the name Gregory on it belonged to some part of that branch.

The Russell Gregory in the cemetery described as being ambushed and murdered by North Carolina rebels was my ancestor. He was a Union militia Captain that raised the force to protect the town. (The assasination didn't have the desired effect, the militia was enraged and drove the rebels back across the border).

I had a VERY awkward conversation with a colleague who totally into the whole organic/vegan/non-GMO thing when it comes to food. It went like this:

Me: "Try those new Cosmic Crisp apples! They're delicious."

Him: "Oh no, I would never do that! I refuse to eat genetically modified food."

Me: "You do realize that it was made simply by cross-breeding existing varietals, right?"

Him: "Yes, and that's human interference. It still counts as genetic modified even if not done in a lab."

Me: "Ummmmm...isn't nearly every single fruit and vegetable we eat these days the product of this exact same kind of manipulation?"

Him: "What??"

Me: "When tomatoes were first discovered, they were tiny, bitter and poisonous, took hundreds of years to breed big juicy healthy ones. ALL modern-day tomatoes are the result of 'genetic modification." Same is true for potatoes, oranges, wheat, etc. etc. etc. -- including apples."

Him: "Wha--????"

Me: "If you really wanted to avoid ALL GMO food, you could only eat wild herbs foraged in the forest and wild boar you hunt yourself. If it's in a supermarket, it's the result of genetic modification by humans. Pretty much withoiut exception."

Him: (Silently stomps off in a huff.)

I don't think the TVA is still considered a public-private corporation as FDR originally conceived it. The whole argument about the TVA was why Wendell Wilkie ran for President in 1940; Wilkie actually was an executive of a major private utility, who saw the TVA as a subsidized competitor.

Still, even though I think the TVA has largely been privatized, this is a leverage issue for Trump, regarding bringing in H1B visa holders to replace Americans. The purpose of the H1B was to allow foreign nationals to be hired for a job that had no American expertise. I know that many years ago, the company I worked for had as the Technical Director a foreign national (who later became a US citizen) who was hired away from a competitor.

They still had to advertise for the job, to get applications from Americans (nobody wanted the job).

The whole H1B visa thing has gotten out of hand. The TVA was literally hiring cheaper help from overseas to get rid of their native American employees. There was competent American employees. Disney and other companies have done the same screwy two-faced dealio.

One type of protected class under the Civil Rights Act is "national origin".

When you fire a cheap American worker in favor of a cheaper foreigner on an H1B, that could be considered two counts of national origin discrimination per position, don't you think? After all, it does fit the definition of discriminating against both the American and the foreign worker; you're firing the American because he's American and therefore has a higher cost of living (thus can't take a big pay cut), and you're discriminating against the foreign replacement by bringing him in just because you can pay him less.

383 THIS is the very reason Lamar is out of a job come Nov. He wanted to r'un again but we Tennesseans sent a VERY clear message to him that we are TIRED of the RINOS this State sends pretending to be "conservatives". We got rid of Corker and now it is his turn. He also turned on PDT and didnt support him several times and that sealed the deal.
Lamar decided not to run again and "retire". Truth is, WE, in Tennessee, "retired" him so why would PDT listen to him? He is a nothing.
In TN we love the TVA but not this version of the TVA. The TVA we knew and grew up with provided Energy AND great jobs for our Neighbors. It was a wonder and a thing to be proud of--a LOT of us knew someone who worked at TVA and those were great, coveted Jobs. That changed about 15 yrs ago and now we have THIS incarnation that still provides (sort of) the service but ALSO allowed the disgrace of the "Accident" that happened a couple of years ago (COAL ASH) that actually has killed those working to clean it up!
TVA needs a Housecleaning, NOT a Senator making excuses for it.
We in TN were GLAD to see Rep Tim Burchette who just was elected and has LONG been a Critic of TVA as the lone Rep in the meeting with PDT at the White House along with the Tech Workers who were going to be displaced (along with other Techs being replaced).
Burchette introduced the TVA Transparency Act so the Bd Mtgs (long shrouded in secrecy) will be made PUBLIC as they should.
Lamar is history--he had his time, he stayed PAST it, WE replaced him.
