Federal Court Judges and Jihadist Simps Overturn Death Penalty for Boston Marathon Bomber and Leftist Heartthrob Djokhar Tsarnaev

A federal appeals court Friday threw out Dzhokhar Tsarnaev's death sentence in the 2013 Boston Marathon bombing, saying the judge who oversaw the case did not adequately screen jurors for potential biases.

A three-judge panel of the 1st U.S. Circuit Court of Appeals ordered a new penalty-phase trial on whether the 27-year-old Tsarnaev should be executed for the attack that killed three people and wounded more than 260 others.

"But make no mistake: Dzhokhar will spend his remaining days locked up in prison, with the only matter remaining being whether he will die by execution," the judges said, more than six month after arguments were heard in the case.

Tsarnaev's lawyers acknowledged at the beginning of his trial that he and his older brother, Tamerlan Tsarnaev, set off the two bombs at the marathon finish line. But they argued that Dzhokar Tsarnaev is less culpable than his brother, who they said was the mastermind behind the attack.

Meanwhile, federal judges are charging hard to keep Michael Flynn -- a man the DOJ has determined was framed by the previous corrupt administration -- in legal limbo and legal jeopardy forever.

He, too, will probably die while still entangled in federal criminal process.

Another of the victims is a woman from Newport. One of her legs was so badly damaged it had to be amputated.

When I lived in Boston I used to go to the Marathon every year and stand pretty much right where the first bomb went off. My sister used to work in the building and her company used to encourage employees to bring their families to the Marathon and used the company facilities since it's right near the finish line.

They set out to maim and kill random people for no reason at all. I have no problem at all with the death penalty in this case.

This is exactly me position. There are crimes for which death is a just punishment. My opposition to the death penalty is not a moral one. It's practical. Death is irreversible. And our judicial system is so badly corrupt that they shouldn't have the power of cold-blooded life and death. When they screw up and lock someone up for life, that person can be released. He can't be made whole, but he can be released and compensated. You can't release a dead man, and the operators of our criminal justice system have not shown themselves to be advocates or pursuers of truth, or even competent operators at all.

That is hopelessly naive.

Having said that, ADX Florence is no joke. 23 hours/day in an 8' x 8' (IIRC) cell, by yourself, where you can not see or hear or speak with anyone, or see outside. You have no idea where you are in the prison at all (to make prison breaks that much more difficult).

You get one hour a day of exercise - by yourself - in what looks like a drained swimming pool.

That is the rest of Tsarnaev's life.

They're not even allowed to SEE each other. They're also on different schedules, e.g., one prisoner's day may start at 6 am, another's at noon, yet another's at 6 pm, since they're all inside and under artificial lights.

I agree with the contention, but the guillotine is messy, as is the electric chair. Hanging is a better choice. Yeah, I know people lose control over bodily functions, but the witnesses don't see that.

In the EU and the UK, it's nearly impossible to get life without parole.

Even Anders Brevik, who murdered something like 70+ people, got a limited sentence of something like 40 years. Serial rapist-killers who rape, torture and kill a dozens little killers in the UK get non-life sentences.

getting rid of the death penalty is a very slippery slope; almost immediately, they go after life without parole, then they go after life LIFE parole, then they cap the max sentence at 30 or 40 years, then they allow people to serve 1/3 of their sentences before being released, etc. The average murderer - -first-degree murderer -- in England serves 12 years at most, even after receiving the maximum possible sentence.

(I think they technically still do have life sentences int he UK, but they are handed out with extreme rarity.)

Even though the left :loses the argument" on any number of issues, they just "keep persisting" Black Knight-style ("Just a nick"), until they ultimately get what they want.

In this case, what they want is a complete end to all incarceration. "Smash the prison-industrial complex."
