Soros' Pet Prosecutor Kim Gardener Charges McCloskey's With Felony Brandishing;
Missouri's AG Moves to Dismiss the Charges

We're at the tipping point of civil war.

We now have government actors attempting to jail anyone who defends himself against the left wing's Street Reparations squads, antifa and BLM.

A country cannot continue when half the population has not only declared vigilante war on the other half, but then seeks to use government power to imprison anyone who resists the vigilantes.

St. Louis Circuit Attorney Kim Gardner, the city's top prosecutor, said Mark and Patricia McCloskey – both personal injury attorneys in their 60s – will be charged with felony unlawful use of a weapon following the June 28 incident.

"It is illegal to wave weapons in a threatening manner -- that is unlawful in the city of St. Louis," Gardner said in a statement. She added that she was recommending a diversion program as an alternative to jail if the McCloskeys are convicted.

Gardner declined to discuss to why Missouri’s “castle doctrine,” a law that justifies deadly force for those who are defending their homes from intruders, didn’t apply.

Within hours of the ruling, Missouri Attorney General Eric Schmitt filed a brief seeking to dismiss Gardner’s charges against the McCloskeys on the grounds that their Second Amendment rights are being violated.

"The right to keep and bear arms is given the highest level of protection in our constitution and our laws, including the Castle Doctrine, which provides broad rights to Missourians who are protecting their property and lives from those who wish to do them harm," Schmitt said in a prepared statement provided to Fox News.

There are three signs in my neighborhood of about 24 people. One of the houses is owned by octogenarians - the husband is a patient of my wife's and cannot remember her when we cross paths in the neighborhood walking the dogs.

Another neighbor is an opinion columnist for the Boston Globe. His work is insufferable but he's a generally nice guy in person. He was trying to trim some branches of a dying pine tree the other day with hedge clippers (he's not handy) and I asked him - with no shortage of sarcasm - if he'd filed an environmental impact assessment to do it. I think he can barely drive - let alone figure out how to do me harm.

The last one is neighbor who keeps to themselves and we've never met. They keep to themselves. I have no idea if they'd come after me or not.

This is a fundamental problem: the AAs tend to vote and make other decisions by heinie color over anything else. See, e.g., the OJ Simpson trial. They're apparently not bright enough to figure out that: a) heinie color does not guarantee that they themselves will benefit (the Peggy Joseph fallacy), and b) that by supporting people of the same heinie color regardless of their ability or culpability, they guarantee that people of other heinie colors will flee, and leave them living in a broke crime-ridden shithole.

I don't think it was cowardice at all. John had integrity, and he stuck by his moral and ethical code throughout. As with all stats, the crime numbers are not as simple as that. St. Louis city is unique, in that it occupies a tiny geographical space in a much larger metro areas.

Comparable metro areas across the country have vastly more space, and so the areas that circle St. Louis city, in another metro area, would be part of the city.

So... if you add in crime stats from large chunks of surrounding St. Louis county, the numbers look very different. Not great of course, because the city is a dumpster fire, but the numbers would look a lot more similar to similar cities like Indianapolis, which is probably the closest comp.

Of course there are other cities in the US that have vastly more violent crime, so it's only possible to say St. Louis is "more dangerous" when you compare it to per capita data.

It's 61 square miles. I bet if you took 61 square miles of most cities, including their downtown areas and the surrounding residential neighborhoods, most would look about as bad.

This. AB60 is an abomination, I have no idea how something like this could be foisted on us. Then again, CA doesn't care, they'll pass laws on whatever they feel is appropriate. If we get to vote on it and they don't like the results, they'll overturn it. What a joke.

Back when the DMV was touting how great this all was on their website, the last I believe published in 2017 (it passed in 2015) they had handed out 1M DL's to illegals. That's with a 50% failure rate. So, right off we know that 2M were sent voter registration materials.


They called this a "glitch" in the software at first - they weren't supposed to get the registration materials, but apparently the DMV couldn't discern the difference between legal and illegal (even though the license itself could). So, everybody got it. Now, they have the DMV verify you're not illegal - it's an "honor system". Yeah, that'll work. Oh, except you can't ask that question directly, you need to suggest to them if they're not legal they shouldn't fill out the materials you've just been given.

I think part of the problem is laziness, but don't be so quick to dismiss the danger argument.

Most of us work in an environment with reasonably responsible people. Teachers work in an environment where a good 10% are assholes with no impulse control on a good day.

You would have to do it in phases.

Most states have public education provisions embedded in their states constitutions that prevents them from making changes to it's structure.

Phase one: Change state constitution to change the nature/wording of "public education."


Next, you would have to decouple the funding of education from teachers, districts and institutions and instead tie the money to a child so the money goes with the child wherever that child goes.


Etc, etc, etc....


There is so much work that has to be done to correct the situation we find ourselves in that's it's positively Sisyphean.

As a parent, I'm full prepared for my kids to eventually bring this home and we get it.

Individuals in the mob threatened to kill them, to burn down their house, and to kill their dog. The McCloskeys were well within their rights under MO's statutes to wave those guns around. In fact, the MO statute specifically says that "the crime of exhibiting a weapon in an angry or threatening manner" SHALL NOT APPLY to people who are lawfully defending themselves or their property, which the McCloskeys clearly were.

Gardner has charged the McCloskeys with a crime that they are clearly not guilty of under MO law, in an attempt to intimidate them and other Missouri citizens from using firearms to defend themselves. Gardner herself should be charged, as she is clearly abusing the power of her office here.

Under MO law, the AG can intervene and ask for the charges to be dismissed, which is what the AG's brief does.

Under the MO constitution, the governor only has the power to issue pardons to people who have been convicted. So if the case goes forward, he will have to let it play out, because he does not have the power to pardon them before conviction.

539 The DA can only hang a charge like this on the McCloskeys because they are within their rights to protect themselves. They are on their own property; the entire area is a gated, private property, including streets and sidewalks.

So in this case the demonstrators are trespassers and can be prosecuted. But of course they are not, by city directives.
In the end the DA pulls this out with the carrot that the McCloskeys may get some kind of penance done. I would not bet my life on that assurance.

The fact of the matter is that you may support the police and the department, but they have been neutered of power, so collectively they are not your friends. That is what the city wants. The mayor, the city council are achieving their goals, which the destruction of government as we know it.

The funder of the DA's campaign must feel that campaign money was well spent. Until the DA, city council, mayor, political funders are made personally responsible for this lawlessness, then the descent into anarchy and dictatorship is inevitable.

The McCloskys are extremely successful attorneys who have beaten some of the top attorneys in the world, meanwhile the STL DA and her underlings are semi competent (on a good day) political hacks who often can't get a win despite having unlimited resources. A court case would expose them to be unqualified for their jobs (though a huge risk pof getting an equally corrupt judge)
