Do The Limits Of Free Speech Extend To Molotov Cocktails?

As distasteful as flag burning is, if a protester wants to burn an American flag, then have at it. And if a protester wants to burn a cross, well, that's offensive, but the whole point of free speech laws is to protect offensive speech, not pathetic bromides spouted by smarmy fools.

But...there is a line, and a burning Molotov cocktail is clearly across that line. There is no purpose for a gasoline bomb other than destruction, and that is not protected by our natural and God-given right to speak freely.

Protester claims lighting Molotov cocktail protected by First Amendment

The federal government says it was arson. The protester charged with igniting a Molotov cocktail outside the District of Columbia police station during the recent race riots says it is protected First Amendment speech.

Jarrett Jeremy Pace, on the night he set the fire, had said on Facebook he wanted to “burn a 12 station to the ground!” The number “12” is street slang for police.

But now, Mr. Pace argues in federal district court he was speaking metaphorically, that he actually tossed the firebomb on the street near the Fourth District police station rather than at it, and that his action was not meant to burn the station but rather to express solidarity with George Floyd and protesters in Minneapolis.

Let's give his lawyer some credit for an interesting defense!

But it also illuminates the Left's profound misunderstanding of speech. The saying that "Our violence is speech....your speech is violence" is unfortunately an accurate portrayal of their belief. Even Brandenburg v. Ohio isn't going to protect him, because that burning Molotov cocktail isn't advocacy, it is a clear and unambiguous threat. Well...hopefully, because if our youthful miscreant gets the right judge, he might just get off.

It's an interesting question though. Personally, I am a fan of uninhibited speech, because the quotation from Justice Brandeis is more true than ever..."Sunlight is said to be the best of disinfectants." But that's not what the Left wants. Their speech is intended to shroud their true purpose in layers of obfuscation, and that is protected by a compliant media.

Imagine if the true origins and intentions of BLM and ANTIFA were the topics of discussion on the evening news and the Sunday talk shows and were the subject of journalists' investigations, rather than what we have today...a concerted effort to limit speech about the reality of those organizations.

Just have one such truck make one single pass, the length of that gutter "art" in NYC.

Those trucks are set up to spray a solid coat of liquified tar out to a maximum width of 14 feet. That's the standard width of a U.S. Interstate Highway Lane, IIRC.

One pass, pressure and volume set to max, and let 'er 'rip.

There wouldn't be a spec of yellow paint remaining to be seen.

And all the truck has to do is just keep on drivin' away, after the deed is done, leaving horrified howls of anger and outrage in his wake.

Trick is, have a couple hundred GOOD GUYS to fall in behind the truck at the end of the pass, and keep the mob offa his ass, till he makes good his escape.

The truck can be returned to the jobsite from where it was so generously loaned to the cause, of course.

lot of that land is owned by BLM (Bureau of Land Management). I live in eastern WA and BLM has a huge footprint due to dams, canals and chunks of hills/mountains. its the same with eastern OR as well. A lot of this land has a tendency to burn during wildfire season, so i am guessing most people don't want the burden of owning that land and then being forced to pay for firefighters to put out the blazes that are inevitable.

A) a Molotov cocktail is designed specifically to commit a crime--arson which is a forcible felony for which in most jurisdictions, one can be shot in self defense.

B) burning gasoline in open air risks a) environmental damage, b) injury to individuals breathing gas fumes even if it does not light, and c) explosive combustion under the right circumstances. Thus, legitimate neutral laws designed to protect people's health, safety,and welfare trump any sort of constitutional claim of viewpoint discrimination here. If I recall right, Oregon even prevents someone from pumping their own gas under such laws so that even putting it into a non-approved container is a crime.

A neutral law designed to protect health, safety,and welfare along with time, place, and manner of speech that have been constitutionally vetted have effectively neutered making claims that one has a free speech right to have a Molotov cocktail on city streets or on other people's private property. Tinker, which instituted symbolic speech protections dealt with only an armband. The Texas v. Johnson case only dealt with a specific charge of burning the flag but the court's majority opinion clearly states that Johnson could have been prosecuted based on requiring any open burning have a permit, and so on.
Under the time, place, and manner restrictions, the plaintiff is required to show how a neutral law is enforced in such a way that viewpoint discrimination occurs. In this case, it would be that other people were not prosecuted for having Molotov cocktails in public based on their political views so the prosecution was specifically designed to quell a particular viewpoint. I somehow doubt that some counter protester with a Molotov cocktail would not be charged as well.

Arson is one of those forcible felonies that can end up with a very nasty prison sentence.

And, if the firebombing is part of a concerted activity including training, etc. then terrorism charges and conspiracy to commit terrorism charges begin.

Text of the proposed 28th Amendment:

"WHEREAS the Failed State of California is in de facto and de jure nullification of federalism, and thereby insurrectionist, and is a generally pernicious influence on the rest of the nation, it is hereby ejected from the United States, and reduced to the status of a special Territory.

This Territory will be administered by the United States Army.

Its Governor-General will be an Army officer named by the President. The appointment of a Governor-General will not be subject to Congressional approval, but will be subject to recall by a Congressional Bill of Recall. This Bill must originate in the House of Representatives with a simple majority, and must be confirmed by the Senate with a two-thirds supermajority.

The Governor-General will be provided with troops and funds sufficient to provision his troops, and secure the Territory and its border, from the discretionary budget of the executive branch of the United States.

Within the Territory, the Territory's executive, legislative, and judicial powers will rest under the sole authority of the Governor-General.

Peaceful Residents of the Territory will be treated according to the Geneva Convention as constituted in the first quarter of 2020. Violations of that Convention will be subject to the judgment of Congress, and no other country. Suggested violations will be referred to Congress by the United States Supreme Court, as a matter of original jurisdiction.

Insurrectionists who have commited or conspired to violence may be handled as seen fit by the Governor-General.

Residents of the Territory as of ratification of this Amendment, or in the future, may seek repatriation to the United States from a Tribunal composed of twelve enlisted soldiers and non-commissioned officers from the bottom half of all the States in population, at time of their enlistment in the Army. These Tribunals will consist of six enlisted men and six non-commissioned officers, each serving a two year term, and selected by lottery. These Tribunals will determine the status of applicants as Americans or Californians. Those Residents deemed fit will be granted Citizenship in the United States.

At least eight members of a given Tribunal must affirm the Resident in question as a Citizen for repatriation to occur.

No other Resident will be permitted travel to the United States, or abroad.

The Territory of California will be eligible for readmittance to the Union after seventy-five years from the date of this Amendment's ratification.

The Territory of California will be subject to taxation and receive disbursement of funds by Congress, separate from their discretionary budget.

The Governor-General will determine internal usage of Territorial production as needed. Any excess will be exported to the United States, whose Congress will make determination as to its re-export, or domestic sale.

The Territory of California will not be permitted to receive loans from any foreign individual or government.

With regard to imported goods, tariff and trade agreements with foreign governments will remain uniform with United States foreign policy as set forth by the Congress and President.

The Territory of California will have no representation whatsoever in Congress, and will have no franchise whatsoever in midterm or general elections.

The Territory of California may not be sold.

American Citizens may be permitted travel to the Territory of California with a United States passport, pending approval of the Governor-General."

Waaaay back in the 80's I owned a design firm in Palo Alto, and worked for many of the Silicon Valley startups. One time, we were asked by Cisco to bid on some design work (I think it was an annual report but it doesn't matter).

This of course before they were the behemoth they became. Of course, the company was basically pilfered tech from Stanford. We met with the CEO or COO or whatever she was calling herself at the time, but one of the founders. I went there with one of my partners (me being the quiet creative type).

It was one of the weirdest meetings of my life. You remember in Dodge Ball where Peter walks into Kate's house the first time and it's wall-to-wall unicorns? Yeah, imagine the "corner office" only it's kittens. On plates, posters, lamps, throw pillows, statues... The look on Al's (his real name) face was priceless, probably same as mine.

Basically, the conversation when we left sums it up. "What the fuck was that about?" We didn't know. "Why were we even asked in?" Then 20 minutes of silence on the drive back.

Not one time did our presentation/interview turn to design work, their needs, or anything to do with Cisco. We never cracked the portfolio. Nope, this fucking dyke cat woman basically tore us up one side and down the other. It was the weirdest thing, but apparently she knew our deepest thoughts, history, motives and it was a good 15 minutes of personal attacks.

Today it would be white privilege, and cis het norm devils. We were 2 white guys, that's all it was. She had a chip on her shoulder the size of Montana, and I imagine that same scenerio played out with every other firm until a pink haired woman showed up with a bunch of finger paintings.

We refused to consider any work for Cisco after that, regardless of the office. I remember an article in a business mag on her after she left (a billionaire) IIRC had funded a cat rescue in Oregon, and was politically active (no fucking shit) in local and national politics. The article was positively glowing.

I can guarantee she's involved in whatever is happening in Portland, and is probably helping to fund it. I'm sure a quick google search would turn her up. You'll see a 70 something hippy that looks like a bad apple doll.

The district he's in is Northville, and in the Detroit area, the BLM is protesting the schools being open for summer school.

Corporations are not the friends of the right and there is no reason not to punish them in court for wrongdoing. The more the pain is, the less that corporations will be forced to be neutral in order to exist or they will go under.

I've mingled with and interacted with Antifa and Black Bloc 17 years now (dating back to my first reports). 90% of these guys and gals are from what the rest of the country would deem upper-middle-class homes. Parents who have lots of $$ and make an easy living as professors, lawyers, writers, techies, administrators, high-level civil servants, etc. etc. All liberal and lax in parenting and discipline. They let the kids run wild, yet still support them completely.

Most of the rest are all on SSI and get lavish government benefits.

Some are drug-dealers.

None are hurting financially.

They currently align with the Democrats on most of the issues however should Trump win they'll have to decide if they want to switch their allegiance over to him. Some will posture, some will openly defy the President others will continue to stay silent. The politicians know this war isn't over.
