Report: John Durham Feels "Pressure" to Either Wrap Up His Investigation Unfinished, Or Put It Off Until After the Election

U.S. Attorney John Durham is under pressure to wrap up his investigation into the origins of the Russia probe by the end of the summer, but if he doesn’t, he could wait to reveal his findings or initiate prosecutions until after the 2020 presidential election, Fox News has learned.

Two sources familiar with Durham's investigation told Fox News this week that Durham is working expeditiously to try to finish the probe by the end of summer, but that several lines of investigation are not yet complete.

"He believes it's critical to do them," one source said. "He is feeling more pressure to get this done and wrapped up."

The source also told Fox News that Durham "does not want this to be viewed political," and the closer it gets to November, Durham could "punt it to after the election."
A spokesman for Durham declined to comment on the status of the investigation.
The president himself on Thursday appeared to express anger over the Russia probe, tweeting "PROSECUTORIAL MISCONDUCT!" and lamenting how "it is a disgrace that nothing happens."

Some Republicans are pushing for the probe to come to a conclusion soon. Earlier this week, Senate Finance Committee Chairman Chuck Grassley said it was "SAD" that Attorney General Bill Barr and Durham could wait until after Election Day to initiate prosecutions.

25 Well, it's "sources say" and therefore a nice big heaping pile of salt is warranted.

That said, it wouldn't surprise me. The last thing anyone wants is the possibility of indictments before November. That would make for uncomfortable talking points. I don't think Trump wants to slow-walk it, but the establishment certainly would. If Trump loses, this all just silently peters out. If Trump wins, he can pursue it but gain no electoral benefit.

No indictments and no public disclosures before the election seems like the safest and most desirable outcome for the state, which is why I have no trouble believing that this could be true. But unless these "sources" come out from behind the curtain, I remain skeptical on principle.

The law is just an arbitrary cudgel. If they want you, they'll get you on one of the scores of laws the average person breaks every day. If they don't want you, no amount of lawlessness will change their minds.

Reverse constructions will increasingly become the norm. The only reason that "I don't like this guy, find something he did so I can take him out" isn't the norm is that it is still expensive and difficult to do that. This is less true every day. They are willing to commit the resources to this for big fish, but rarely for a local matter. That's going to change. I give it a decade, tops, before it is the norm.

My dad worked on a Hopi reservation (oh right I told that story on TV already). They're mostly good people - a little problem with the Firewater, but they aren't usually the instigators of most of this garbage. That being said, reservations are usually *not* good places to live.

I'm no expert on the reservations, but at least in the couple near me, you can't own your land on the Rez. It's the tribe's property. So why bother improving it or building a house or anything?

Plenty of people on the Rez are perfectly happy buying a trailer and just doing barely enough to get by.

Sure, you can leave the Rez, but there have been some nasty precedents where tribal members have been cut out of casino profits because they left the Rez.

Just buy a few extra of things you normally buy. Figure out a system so that you use them. Every so often, think of what you need if there's nothing in the stores and pick up that for long term storage. And store water too.

The Brit parliamentary system is very unlike the American system on purpose. So a Thatcher or a Churchill for that matter simply could not make it to the Presidency. Plus, you have the issue where the House of Commons since the early 20th century is effectively sovereign and then sovereignty resides with the majority party in Commons.

In our case, separation of powers you know. First, Congress is controlled by enemies of DJT via the uniparty and the judicial branch has demonstrated equal disdain. The bureaucracy is in outright rebellion including the military and the law enforcement community. Then the media including "conservative" media has simply ignored the truth in their quest to get Trump.

That DJT has accomplished as much as he has under constraints that perhaps no president other than Lincoln has endured is a testament to the man. As Teddy Roosevelt once said, he is the man in the arena.

I am an admirer of Thatcher and Churchill btw and have read most of their authored books but the British system is different and brings forth a different style of leadership. As long as a majority holds, and the cabinet does not do you in, you can pretty much get what you want in terms of policy even in the face of public dislike for the policy.

Our system, for better or worse, you cannot.

No land ownership or use changed because of today's ruling. The court just ruled that, for the purposes of bringing charges for certain crimes, the original boundaries of the Creek treaty lands must be respected even if Indians retain no other actual use of that land. Basically, OK will either have to come to some agreement with the Creek nation that allows them to charge, and try in state court, Indians who commit crimes within those boundaries OR federal courts will have to try such cases under the federal Major Crimes Act.

There are two reasons I doubt this scenario:
1) Corruption
2) Identity politics

Poorer people bank less and use cash more, and cash dominates in a lot of black areas. These are desirable groups to the state, and they don't want to piss off major groups the value for electoral reasons.

More than that, though, is corruption. The US does a lot of hinkey shit abroad, and it depends on pallets of benjamins to make it all work. If that cash can't repatriate and spend at home, it's worthless. And international gangsters and tin horn dictators don't want wire transfers.

The state would love to do away with cash for the many benefits (final end to privacy, workable "negative interest rates" (e.g., outright theft), etc.), but for once I think their greed and corruption outweighs their general-purpose perfidy.

Not per my understanding, which is based on what people said here. If a member of the Creek tribe were to violate *Oklahoma* law, then the tribe would have to agree to the prosecution if it is not also a crime under tribal law (in which case, they would have to prosecute), or it becomes a federal case. In essence, if my vague understanding is remotely correct, members of Creek tribe in eastern OK are no longer subject to Oklahoma law, and are subject only to tribal law.

But I don't know how the opposite works - for example, could the tribe launch a prosecution of, say, an oil company in Muskogee for some violation of tribal law that is *not* a violation of Oklahoma law.

496 407, redbanzai, knowing a bit about tribal law, it is not insignificant if Congress does not act to rectify it immediately.

Right now, effectively, the state of Oklahoma's court system has serious questions of legality in operating in about half the state--if the land is in effect a reservation then native American tribes have sovereignty including business, commercial, and criminal law. Effectively, reservations are equivalent in standing to states with their own law enforcement, laws, status of non members of the tribe to members, and so on.

Thus, all crimes now will be tried in either federal or tribal court including non-reservation members, etc. Ditto for business suits, etc. And thousands of current convictions for past offences can be voided or be forced to conduct retrials as the opinion did not reach that.

What Gorsuch did was to instigate legal chaos in Oklahoma and perhaps other states using this precedent in order to get Congress to fix it. That is not justice--in this case, the doctrine of laches is superior--he who sleeps on their rights--loses them. The petitioner in this case lost decades ago and now brings up this new claim under habeas in order to get out of jail. Effectively Gorsuch revived a moot case in order to make his sweeping statement. Oklahoma became a state in 1907, the treaty in consideration dated from 1857.

Thus, Gorsuch is ignored settled law dating from 1907 about reservations. If he is willing to go back that far, why not the whole ball of wax as there is no limiting principle to his rule in this case that limits the consideration of every alleged cession and treaty in the U.S.

This is similar in practice to his stupid rewriting of the Civil Rights Act which also induced legal chaos. Whatever one may say, this is not judicial restraint but activism with a vengeance in service of individual beliefs--not the practice of law as such.

In effect, the same result happened regarding the Yazoo land fraud--innocent people bought title to the land and did improvements etc. and it was unfair to rescind those contracts signed in good faith in Fletcher v. Peck.

It is never in the interest of justice to take the path of legal chaos if two different interpretations exist where one spurs legal chaos and the other assumes that later acts of Congress override earlier ones which has been settled law for over one century.

Gorsuch did two major decision this term and bombed on both of them regarding reasoning, restraint, and interpretation of the laws. Unfortunately, it looks like he imbibed the Justice Kennedy ideals of being the philosopher in residence on the Supreme Court and apparently does not understand textualism at all. Dred Justice Roberts has the poisonous idea that he is the political "fixer" on the Court like former Justice Brennan and should be impeached as his role for supervising the FISA court shenanigans at the very least.

Neither justice demonstrates much in judicial restraint, respect for precedent, nor faithfulness to the rule of law. Kavanaugh strikes me this term as behaving like a child asking mom and dad to not fight in trying to alleviate split between Alito and Thomas and Roberts/Gorsuch. Maybe he will straighten out or maybe he will become a court mediocrity slowly drifting leftwards like Powell, O'Connor, and Blackmun.

You have two principled justices on the court, Alito and Thomas. The rest are politicians and wannabe philosophers in robes.

Gorsuch, like he did in his Civil Rights Law rewrite, says that he is simply addressing the case at hand and not the broader implications. That is similar to one saying, I merely pulled the pin on the grenade, the explosive effects when I release the handle is not at issue here.

In effect, he is declaring the area under consideration as a reservation because Congress did not allegedly clearly abrogate the 1857 treaty assignment. Indian law from treaties with the U.S. government which the U.S. quit doing in 1871 has long been done as a matter of ordinary statute since then. Using his hi-tech textualism glasses, he fails to find any intent behind Congress making Oklahoma a state in 1907 and the override of the older treaty with the Creek Indian tribe. What happened is that some tribes allotted land to individual members and those members promptly sold the land to non Indian tribe members. This is what happened in the Oklahoma Territory and other places. Now, the question is if the Creek Reservation still exists for criminal laws, then there is no limit on its sovereignty (other than federal law) on that reservation for other matters. Thus, legal chaos regarding law enforcement, business contracts, prior convictions, and so on. In extreme circumstances if not rectified by congressional legislation, Justice Gorsuch and his majority disenfranchised non-tribal members in that area because non-tribe members cannot vote in tribal elections which include all government legislative, judicial, and executive functions and Oklahoma cannot do a damn thing to stop it as it is a reservation.

Congress should rectify this disgraceful decision immediately but given that Oklahoma is a red state, I am sure that Nanzi will get right on it.
