Appellate Court Lawyer: Of All The Options the DC Court of Appeals Could Have Chosen in the Emmet Sullivan Matter, It Chose "The Most Extreme, Rare, and Drastic" of Them

Yesterday I wondered if it was a big deal that the DC Court of Appeals -- Emmet Sullivan's overseeing judges -- had issued the order to Sullivan to personally explain himself to them.

As a Twitter thread from an appellate court laywer found by John Sexton explains: Yes, it's a huge deal.

Most of the thread is below, but here are the main points:

1. The appellate court could have just dismissed this motion out of hand, which they do most of the time. (As I noted, when you're dealing with a jailhouse lawyer's frivolous filings, it's only a matter of time before he cries prejudice and demands a new judge.)

They did not do this, obviously. They're taking this seriously. That fact means that this motion has already cleared a "huge hurdle" -- the appellate court accepts that this is serious matter requring their attention and not just a desperate last-chance gamble.

2. They could have politely "invited" Sullivan to file a reply with the court. Which is friendly and collegial.

They did not. They "ordered" him to. Which is unfreindly and reminds Sullivan who the ranking officers are here.

3. They could have asked an amicus -- a friend of the court; a respected lawyer or judge or legal commentator -- to file a reply on Sullivan's behalf and thereby spare him the indignity of having to, effectively, defend himself and act as his own lawyer.

They did not do that. They insisted that Sullivan himself reply.

This all seems like good news.

The three judges on this panel were appointed by Reagan, Obama, and Trump.

I assume the Obama appointee is a loss -- this case, after all, is about the misbehavior of Obama's ministers and minions.

The Reagan appointee, I don't know. People always think that Reagan appointees must be conservative, but that's not true at all. Emmet Sullivan was a Reagan appointee, originally. This was back when there was no Federalist Society, and when, frankly, liberal Bushites were running most of the government anyway. So this one could go either way.

The Trump appointee, Rao, I assume is good draw for us.

Considering theacts of treason and the FISC and other judges complicit (e.g. Amy Berman) ... some hangings are probably in order, French Revolution style or American Revolution ... wither way, a coup that involves judges is intolerable.

Rao is supposed to be rock solid. As far as the other two judges, my COMPLETE AND TOTAL WAG based on nothing at all is that the panel will be pissed that Sullivan is point blank ignoring direct precedent on this from the DC circuit and from just a couple of years ago. That's a slap by Sullivan to the authoritah of the Circuit court and those judges take their authoritah very very seriously indeed.

And, though, that's an utter WAG.

I now think there's at least a chance that Sullivan folds and just dismisses the case, rather then filing an answer. In fact, that's what the Appeals Court is clearly inviting him do to.

38 This is too high profile a matter for the appellate court to mess around with. They and their clerks are going to triple check everything, out of a healthy sense of paranoia. I've worked on things that were high profile. You did not trust to your memory on anything, you went and looked it up again. Darn near every sentence would have a citation or two in support.

74 Flynn was helped by the fact that there is a case directly on point, from this very appeals court, that says that Sullivan can't refuse to dismiss a case when the government wants to dismiss it. The appellate panel cited that case (Fokker Services) in their order to Sullivan.

Judges don't typically ignore precedent, directly on point, from their own circuit.

If I understand correctly, Sullivan went off on some sort of rant against Flynn, which effectively put Sullivan way out on a legal limb and Sullivan doesn't want to climb back down.

It appears the Appellate court has appeared just behind Judge Sullivan and offered to saw the limb off that Sullivan is on, unless he climbs back down.

Sometimes in the past when the opposite party controls the Senate there have been "one of yours, one of ours" deals, and there has been a long tradition of "blue slips," where the two Senators from a particular state, regardless of party, are allowed to table indefinitely a nomination they don't agree with, giving them effective input into who a President of the other party nominates. And even when two Senators from a state are of the President's own party, sometimes they're McCain and Flake, for example, so a good conservative isn't necessarily going to get nominated.

And then there's the substance of what's actually briefed and argued. I can see this panel finding for Judge Sullivan 3-0 on the following argument: 1. I haven't rendered a verdict yet, so this is not ripe for consideration until I find the defendant guilty, because if I dismiss the case this will all be moot, and I have not decided anything yet; 2. This is an attack on the independence of the judiciary and the inherent power of a judge to run his own courtroom. Not saying that would work, but I could see it.

This case is over. The only reason conservative appellate attorneys aren't barking that out is reputation management. It is never smart to tell a client (or the public if you profit from pontificating) that you're a shoo in because of course nobody's got a crystal ball and shit happens. But take it from me---an anonymous lawyer---the fat lady's singing.

I would pay good money to be inside Sullivan's chambers right now. I can't even imagine the shit he took when he received the DC Circuit's order. My federal district court judge once got hit with an invitation to respond to a mandamus petition, and he ran like his ass was on fire to reconsider and reverse his own decision. Just to moot the mandamus petition.

I have litigated or worked in federal courts for 16 years. Never, not once, have I seen a judge ordered to personally respond to a mandamus petition. Not once, and I have both filed petitions and ruled on them for my appellate court judge.

This is staggering stuff.

You can't appreciate what has happened if you aren't a federal court litigator.

Poor Judge Sullivan would be reversing his own order immediately if this weren't such a high profile case. The dumb bastard is stuck because everyone knows what he did. This isn't an obscure case he can hide by reversing himself. To do that would be to admit he did the indefensible. So instead, he has to advocate something on his own behalf, which he likely hasn't done in 40 years, and his law clerks have never done because they are new attorneys.

No, they can't fire him. Federal judges are appointed for life. The only way they can be removed from the bench is if they are impeached by congress and convicted by the senate.

They can, however, remove him from the Flynn case.

At least there's hotel rooms there. In CA (LA and SF) the hotels are filled with homeless people. If the hotels didn't comply, they were threatened with being outed (in LA at least). So, they have a choice of the homeless destroying the interiors, furnishings and probably plumbing, or the loonies burning the hotel to the ground.

The DC Circuit Court of Appeals currently has 17 active judges on it. SOP is that the names of 3 out of that 17 be drawn to constitute a 3 judge panel for each case that is appealed to them.

It is possible for all 17 to hear a case (en banc) but that is quite rare.

The only way he can ignore this is to grant the dismissal and thus moot the writ.

143 It's true that writ petitions are summarily rejected more than 90 percent of the time without even requiring the opposing side (called the "real party in interest") to file any kind of response at all.

But the weird part is this: When a writ petition is granted, the writ simply commands the judge to alter his ruling. I've never seen a writ petition in which the judge has been ordered to personally explain why he did what he did.

Even in that small percentage of cases where the writ petition is allowed to be briefed and heard on the merits, it is the opposing side (the real party in interest) and not the judge who defends the challenged ruling. The judge is ordinarily completely aloof from the process, except for receiving and complying with any writ that is issued.

So yeah, strange.

I researched that earlier after someone posted about it on an earlier thread. I found a post by Gateway Pundit that referred to Whitmer's "Up North summer home" somewhere around Birch Lake, MI.

Only problem with that? Birch Lake is not "up north". It's on the southwest side of the state, south of Lansing.

Gateway Pundit linked to some Facebook post by some guy with some YouTube podcast I think --- Randy Bishop --- and he states in his post that Whitmer's 2nd cottage is in Antrim County. Antrim County is definitely north of Michigan. It's near Traverse City. But Birch Lake is nowhere near that.

Funny thing is that some defender of Whitmer came on Bishop's Facebook post and claimed that people were being hysterical for no reason. Because Whitmer was in Midland area to help with the flooding issue and supposedly her summer home is in the area.

Yeah, Midland is 2 1/2 hours away from Traverse City and Antrim County.

So yeah, lesson from all this? Don't believe anything you read anywhere until you research and confirm it yourself.

That goes for the Twitter post about Whitmer saying 'no' to opening hotels in the Midland area. I looked that up on Twitter and it was posted with the exact text by two different people. Neither of whom referenced any news source for their information.

It wouldn't take 15 minutes. It's pretty simple: Sullivan is ignoring a controlling precedent (the Fokker Services case) from his own circuit. That case says, pretty clearly, that a trial court CAN'T refuse to dismiss a criminal case that the government has decided to dismiss. The Executive Branch has the power to prosecute cases, not the judiciary. A trial court can't second-guess the Executive's judgment and substitute itself in as prosecutor. When the government moves to dismiss a case, the trial judge needs to dismiss it.

Sullivan is simply ignoring the holding in the Fokker case, because he wants to play prosecutor in the Flynn case. But appeals courts don't write those opinions for fun, they expect them to be followed by trial courts. That's why they are ordering Sullivan to explain to them why he is ignoring their precedent.

When people start making shit up, the Left uses that to disregard everything else that person then states, even if everything else they state is 100% correct.

They did that with the Plademic video. There were a lot of facts in that video, including the use of HCQ and the fact that healthy people wearing masks all the time is not useful. Carry on." Don't believe the hype, this one ain't a slam dunk.

So, it makes sense, in a way, for there to be a response from Sullivan, because a response from the DOJ would not be adversarial.
The thing is, they didn't allow Sullivan to be represented by an amicus. They wanted him to respond personally, and fast enough that it would be before Gleeson filed his own amicus briefs.
Don't be surprised if the amicus essentially writes an argument for Sullivan, that Sullivan passes off as his own. If Sullivan wants to go down flying his flag high, that's what will happen.

353 @occams, re 323, I forgot to add that Sullivan also needs to say this is not about me, this is about all the trial court judges out there and their ability to manage their own courtrooms without constantly being subject to the litigants asking the appellate courts to intervene prematurely. If I'm Sullivan, I point out that I have a schedule already for briefs and arguments on the DOJ motion to dismiss, and the defendant can always appeal if found guilty or even enter an interlocutory appeal if I deny the DOJ's motion and make him go to trial. I don't know if that overcomes the separation of powers argument that Sullivan shouldn't be presiding over this case in the first place if both sides want it dismissed, but it's not crazy.

Meanwhile Sweet Gretchen an hour ago extended the stay at home order until June 12th. She then declared a state of emergency while giving the finger to the legislature until June 19.

She's been extending her orders since April 7th. She originally wanted 70-day extension from April 13th expiration of her first order. That would have taken the order through June 22nd.

But the legislature "pushed back" and agreed to "only" 23-day extension through April 30th.

She then extended that to May 15th.

Then extended that to May 29th.

And now apparently has extended to June 12th?

And I bet she comes back Jun 5th and gets another extension to June 22nd.

Which would end up giving her what she wanted all along.

So she's getting her 70-days, only by piecemeal.

And the GOP sits helpless to stop her. And voters are helpless to vote her out until 2022.

Not that I even think they'll vote her out anyway, since this state is full of Karens.

The obvious person in my opinion is Michelle Obama. She would bring the "gravitas" and "energy" to the campaign in the same way that Sarah Palin brought it to the McCain campaign.

The goal for the Democrats is simply to keep everything from 2016 the same, except flip WI, MI and PA. And they win.

So they have to pick someone whom they think can help flip back to blue WI, MI and PA.

With the media protecting her, Hollywood fully engaged and supporting her, I think it's possible. They would also have Barack out there campaigning for both of them as well. Barack and Michelle would get rid of all the talk about racism and bring the Black vote back to the Democrat plantation.

Problem is that she's likely to become President soon after the inauguration, since Biden is long gone. The Left can also send the wink-wink message to their base that this would basically be 4-8 more years of an Barack Obama Administration.

None of the Bush family had liberal voting records. George Bush the Elder had so many assets as a human being, manifest in family life, in his military service, at Yale, and in the oil business. The one odd thing about him is that he could be very other-directed and malleable in select circumstances. A couple of his aides are touting Dan Quayle, so he selects Dan Quayle, a man who functioned passably as a back-bench legislator but wasn't suitable for much else.

In his order Sullivan cited Fokker ( which the appellate court mentioned too) and his "inherent authority". The DC Circuit could find all sorts of ways of avoiding the right answer. No one is golding a gun to the judges' heads saying enforce the rule of law or else. So what? The only fact that remains is the actual order the DC Circuit issued and that order is glorious.

Most litigants get anywhere from 2 weeks to 30 days to respond to motions. Judge Sullivan is a freakin federal judge. He just got ordered to file an expedited response in 10 days to a petition for writ of mandamus.

If the DC Circuit thought there potentially is a good defense of Sullivan's actions, it invites amici to defend him. Or it gives him AT LEAST a sufficient amount of time to draft his own papers.

But nope. He got bent instead.
