I looked up Fokker case the other night. If the D.C Circuit follows its own precedent, it will grant mandamus agin' Sullivan.

In Fokker, the feds charged some outfit called Fokker Services with export control violations. They then entered into some agreement with Fokker where they would do better, and moved to drop criminal charges.

The district judge didn't like it and refused to agree to drop the charges, saying he did think that agreement was enough punishment for Fokker.

the DOJ applied for Mandamus, bitches, with the DC Circuit and they granted it, ordering the judge to drop the case, and producing the Fokker opinion, which you can read about the near plenary power of the Executive to charge and not charge, and drop charges.

The only exception is when the executive is using that power to drop charges in a way to fuck around with the defendant. IOW, the only circumstances in which a judge can refuse to drop charges is *to protect the rights of the defendant* against government abuse.

303 We just got back from the BBQ place. It's our anniversary, so we decided to celebrate.

Very slow when we got there. They had signs on the tables they didn't want you to use and tape 'X's' in the hall for a line, but otherwise it was just like always. By the time we left, the parking lot was full- mostly take-out I imagine because it was close to closing.

Amazed at how much just sitting in a restaurant having a meal raised our spirits.

Luckily for my parents, who live upstream from another old dam, the drain commissioner had the bright idea of giving a warning and letting more water out. In the past, the people downriver have dictated flooding upstream because they stupidly built businesses too close to the river.

My parents still have water coming in the basement from ground water, but at least they hadn't put their dock in. Lots of them are underwater and not a few boats are either on the docks or gone.

LOVES water. Love it so much, and he is joyful splashing around. Unlike our purebred Newf showdog who HATED water and pulled our daughter out of the pool and dragged her to dry ground and sat on her to keep her from going back in.

Abner is indeed a lovable monster, who has won over all the neighbors, including the postman's wife, who can't have a dog because her husband can't stand them. Even he thinks Abner is okay. Our vet thinks he looks like a giant, black Cane Corso, but he has a slight underbite that can make him look a bit...challenged.

Yeah, it is bad. The water has been high for a number of years, and it hasn't gone down over the winter. Downriver is going to be lucky to still be there, and the Trenton Channel and River Rouge and Monroe powerplants (let alone Fermi) are going to have some interesting times.

In WA state we found out the new normal for taking pets to the vet. We stayed in the car and got in a line. Masked veterinary technicians came to the car and gave immunizations out to the 3 pets. Luckily the cat didn't escape from her crate- a real possibility.

One dog needed a checkup. She was conducted inside the building by the technician. When she returned, we paid our bill and left.

Sigh...all so idiotic but I am becoming resigned. We gotta live as best we can. At least we didn't have to wear masks. That is what I hate the most.

Some time later, I was going to see a show, and I thought to bowl before it, and I asked how much. It was a couple of thousand dollars for a group of 8, the smallest group they would accept.

We had a bamboo fishing pole. It had dark thread fishing line, some split-shot sinkers and a hook tied at the end. To reel it in you spun it in your hand, wrapping the line around the pole. We had it for when we were little because, as dad said "It floats."

I am under that assumption that working as intended, the communication is available more broadly, with AMERICAN CITIZEN 1, in place of identifiers. Then, based on the content generating sufficient cause to justify the unmasking, because of 4th Amendment protections against spying on Americans, only then, an unmasking request is made, presumably without foreknowledge of who AMERICAN CITIZEN 1 is.

As applied, I am under no illusions that Flynn was ever properly masked, that there was sufficient cause to make an unmasking request, or that it was done for any other purpose that to cross the i's and dot the t's.

Fry crispy (with chicken batter) , throw in Dutch oven and cook slow, with onions, grease and a bit of water for 2-3 hours, slow.

Well actually Wilson didn't need to tap their communication to Mexico. They were using our line to do it. He was an idiot for not listening in to begin with.
