There is no provision in the Constitution for the suspension of basic rights in an epidemic. The police power (passing laws to secure health safety and welfare) is nigh unlimited in states and local jurisdictions. That is why we still have blue laws in some places. Under the police power, individuals can be quarantined if they pose a threat to the safety of others as evidenced through the traditional English powers exercised in events like the plague of 1665 and earlier outbreaks. They can quarantine a family who is sick. They can shut down marketplaces. They can do lots of things PROVIDED they bear a reasonable relationship to the stated goal. There is no rational basis for half of these absurd rules going on right now. Even quarantining sick individuals power theoretically should be accompanied by notice and an opportunity for hearing under our constitutional concept of due process, but a statute can certainly convey the basic authority to quarantine. Obesity does not mean that you have diabetes. My late husband weighed 350 and was not diabetic. We would have to explain that to the doctors every damn time we went in. He had afib but did not need meds for it. He had limited mobility due to the second hip replacement, so yeah, his weight affected his hips. And they were so busy focusing on the stuff he didn't have that they missed the liver disease.
We would do a lot better if we stopped believing some of this nonsense that doctors tell us. Every time we change insurance, we have to do this fitness assessment. They always tell you to do a low salt, low fat, high carb diet. We know that's wrong and have known it for over ten years now. Yet that is still their advice. There are some areas that the medical profession does good work in and other areas where they are terrible. And this blind spot about obesity is one of the areas they are bad at. Facially neutral laws of general applicability can impede or infringe upon religious free exercise if meeting a rational basis and provided the law does not interfere with another fundamental right under the hybrid rights test of Smith v. Employment Div of Oregon. If there is a hybrid rights situation, then the law must meet the "compelling interest" test, a sort of heightened scrutiny that requires the law to be narrowly tailored to avoid infringing on free exercise wherever possible. In a pandemic, they could close all public places where more than 10 people gather. They can leave them open but limit the number of people or require distancing. some of this nonsense that doctors tell us. Every time we change insurance, we have to do this fitness assessment. They always tell you to do a low salt, low fat, high carb diet. We know that's wrong and have known it for over ten years now. Yet that is still their advice. There are some areas that the medical profession does good work in and other areas where they are terrible. And this blind spot about obesity is one of the areas they are bad at. I'm 5'6" and should weigh 130 according to their charts. Lowest I've gotten was 185 when I picked apples. I don't know when NJ will stop electing rich Goldman Sachs alumni. Murphy was essentially a back-slapping sales guy who became significantly rich and then carpet-bombed the state with ads for over a year before the Dem primary. He's not very bright. A lot of the bigger decisions and deals seem to be made by Senate President Sweeney and I don't really know what Murphy does all day besides really cling to lefty goals like $15 an hour. (My teenage daughter's friends with jobs ALL work under the table - nice lesson to learn.) So of course he will probably be re-elected if he doesn't stand down due to his kidney cancer. The sad thing is NJ has a lot of blue believers. My neighbors on both sides are huuuuge leftists. We left our church after the umpteenth sermon espousing gun control. Many of the small businesses will not reopen. So, there will have to be some supplement to keep things moving. A method of facilitating back to work would be to increase business hours or go to 12h days with fewer people each day.
I spent my life at hospitals and there are way more people around 9-5 than the rest of the day. Attendings go home, and the floors are crawling with administrators, social workers and misc clerical people (billing, supply, laundy) There is no law that says attendings must blow outta there by 5 ish and social workers and billing people could enter data at any time of day. One of the best surgeons I know used to book ORs exclusively after 6p. There was no pressure on space and the evening and night staffs were less stressed by the numbers of people arriving post-op to the units. And who would not rather have an attending or two around at 10p rather than a resident? A lot of the nursing and assistants work 12h days and only three days a week. While you always need an adequate number of these, you could "distance" better if the other shifts (even if this was in ad administrative building) were utilized by non healthcare regulars. No CA state-wide requirement - very weak "guidance", leaving it up to counties. And there are more "howevers" (don't take masks needed by medical types, don't treat mask as substitute for anything else, and wearing a mask might make things worse if you touch your face, etc) than anything else. Good. No wearing one, don't plan to, only will if required by a building, to get in, and then not for 10 seconds longer than required.

It strikes me that the different responses between the "stay shut for your own good" states versus the "we're opening up and accepting the risks of corona" states may well be the "divorce" opportunity that Ace has looked for. From the get-go, the governors have made the actual calls. As they pretty much corresponded to the task force recommendations, there wasn't any squabbling. Squabbling was about resources, not "lockdowns". At least 4 or 5 different categories of states based on conditions.
